RESOLUTION NO. 1656
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO.
CUP 01-021 FOR AN AFTER SCHOOL EDUCATION CENTER FOR UP TO
30 STUDENTS, AGES 12 TO 16 TO OCCUpy 2,173 SQUARE FEET ON
THE SECOND FLOOR OF A TWO-STORY OFFICE BUILDING AT
660 W. DUARTE ROAD.
WHEREAS, on July 16, 2001, an application was filed by Mr. Spencer Way for an
after school education center for.up to 30 students, ages 12 to 16 to occupy 2,173 square
feet on the second floor of a two-story office building; Development Services Department
Case No. CUP 01-021, at 660 W. Duarte Road, more particularly described as follows:
The north 209.88 feet of the west one-half of Lot 6, Tract No. 4090, as shown
on map recorded in Book 43, Page 47, of Maps, in the Office of the Recorder
of Los Angeles County.
WHEREAS, a public hearing was held on October 9, 2001 at which time all
interested persons were given full opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report dated October 9, 2001 is true and correct.
SECTION 2. This Commission finds:
1. That the granting of the Conditional Use Pennit will not be detrimental to the
public health or welfare, nor injurious to the property or improvements in the zone or vicinity.
2. That the use applied for at the location indicated is properly one for which a
Conditional Use Pennlt is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping
. and other features required to adjust said use with the land and uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by.the proposed use.
5. That the subject property is designated for commercial use in the General Plan,
that the proposed use is consistent with that designation, and that the granting of the
Conditional Use Pennit will not adversely affect the comprehensive general plan.

6. That the evaluation of the environmental impacts as set forth in the initial study
are appropriate and that the project will have no significant effect upon the environment
within the meaning of the Califomia Environmental Quality Act of 1970, and, when
considering the project as a whole, there was no evidence before the City that the proposed
project would have any potentially adverse effect on wildlife resources or the habitat upon
which wildlife depends, and therefore, a Negative Declaration was approved.
SECTION 3. That for the foregoing reasons this Commission grants Conditional
Use Permit No. CUP 01-021 for an after school education center for up to 30 students,
ages 12-16 to occupy 2,173 square feet on the second floor of a two-story office building at
660 W. Duarte Road, subject to the following conditions:
1. The occupancy and tenant improvements for the education center approved by
CUP 01-021 shall be in compliance with the Building and Fire Codes, and said education
center shall be operated and maintained in a manner that is consistent with the application
materials and plans submitted and approved for CUP 01-021. Compliance with the Building
and Fire Codes shall be detennlned by having detailed construction plans of the education
center submitted for plan check review and approval within 30 days, and any alterations to
the building that are found to be necessary shall be provided within 30 days of such
detenninations.
2. A par1(ing modification is included in this approval of CUP 01-021 for any
adjustments to the par1(ing layout as required by the Building Official to comply with the
handicap parking and disabled access requirements. This modification does not constitute
an approval for a general reduction of the paoong requirements for the subject office
building, but rather is limited to the three uses occupying the subject office building at this
time, which are the 2,173 square foot education center approved by CUP 01-021, a 2,000
square foot medical practice and retail sales, and a 4,395 square foot bank.
3. This approval of CUP 01-021 shall not take effect until the property owner and
applicant have executed and filed an Acceptance Fonn available from the Development .
Services Department to indicate awareness and acceptance of the conditions of approval.
4. Noncompliance with the plans, proviSions and conditions of approval for
CUP 01-021 shall be grounds for Immediate suspension and/or revocation of any approvals
and occupancies granted by CUP 01-021, which could result in the cessation of classes.

SECTION 4. The decision, findings, and conditions of approval contained in this
Resolution reflect the Planning Commission's action of October 9, 2001, by the following
vote:

SECTION 5. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUBJECT: Conditional Use Permit Application No. CUP 01-021
SUMMARY
.
This Conditional Use Permit application was submitted by Mr. Spencer Way to.
operate an after school education center for up to 30 students, ages 12-16 at
660 W. Duarte Road. The Development Services Department is recommending
denial of application no. CUP 01-021 because of inadequate parking facilities.
GENERAL INFORMATION
APPLICANT: Mr. Spencer Way (dba: Time Ed~cation Center)
LOCATION: 660 W. Duarte Road (behind Cal-Fed Bank)
REQUEST: A Conditional Use Permit to allow an after school education center
for up to 30 students, ages 12-16 to occupy 2,173 square feet in a
two-story office building. Classes will be held from 3:30 p.m. to
8:00 p.m., Monday through Saturday.
SITE AREA: 18,323 sq. ft. (0.42 acre)
FRONTAGE: Approximately 92 feet along W. Duarte Road

EXISTING LAND USE & ZONING:
The site is developed with a two-story office building with a total of
8,952 square feet. There are 21 substandard on-site parking
spaces. The property is zoned C-21General Commercial. The
current occupants are a bank, a physical therapist, and the subject
education center.

GENERAL PLAN DESIGNATION: Commercial
BACKGROUND
According to the applicant's architect, the applicant has been operating a tutorial
center at the subject location illegally for at least several months, possibly for as long
as two years. This situation was discovered during an investigation of a complaint
on July 3, 2001.
The operators were informed that a Conditional Use Permit is required, 'but that
approval could not be assured due to traffic and parking cqncerns, as well as other
possible problems. Because there were students already enrolled, the applicant has
been allowed to continue operating pending the outcome of this application.
The complaint was in regard to children congregating along the walkway. The
applicant has added a waiting room inside their facilities for use during inclement
weather, and is providing adult supervision of the children that now wait on the
balcony to be picked-up. .
PROPOSAL AND ANALYSIS
The applicant's proposal is to operate an after school education center in 2,173
square feet of office space at the rear of 660 W. Duarte Road. This is behind the
Cal-Fed Bank. The education center is on the second floor and is comprised of two
classrooms, an office, a reception area, a waiting room, and an employee lounge. A
third classroom is available on the ground floor in case there are any disabled
students or employees.
The students are ages 12 through 16 (middle school and high school) and each
classroom will accommodate up to 15 students for a maximum attendance of 30
students at a time (the third classroom on-lhe ground floor will only be used if there
are disabled students or employees). There are four employees: two instructors and
two administrative staff. Classes are held from 3:30 p.m. to 8:00 p.m., Monday
through Saturday.

There are 21 on-site parking spaces for this office building, but they are not striped
per Code. There are 19 parking spaces at the reat of the building, and two handicap
parking spaces on the east side of the building in the driveway. These two handicap
parking spaces are in a required fire lane and cannot be designed to meet Code.
The substandard striping of the parking spaces behind the building does not make
them difficult or inconvenient to use, but striping them to meet Code could result in
the loss of several spaces. Any handicap parking spaces that are to remain will
have to be striped and signed per Code. Their design standards cannot be
modified. Only one, van-accessible handicap parking 'space is required for this
property.
Additionally, the applicant has stated that the four employees of the education center
park at a 657 W. Duarte Road (across the street). The same landlord owns this
property. A conditional use permit (CUP 01-026) has been filed on this property
(657 W. Duarte) for a daycare center. Off-site parking is al,lowed by code, however,
the parking must be excess parking and, a covenant per Section 9269.6, in a form
approved by the City Attorney, needs to be executed by the property owner,
recorded in the Office of the County Recorder, and kept in effect for as long as the
subject use is maintained.

Based on the current tenancies at 660 W. Duarte Road, there sho'uld be 67 on-site
parking spaces for the three existing uses: The education center should have 29
spaces (1 space per 35 sq. ft. of classroom area) the physical therapist should have
12 spaces (6 spaces per 1,000 sq. ft.) and the bank should have 26 spaces
(6 spaces per 1,000 sq. ft.). There is a parking deficiency of at least 48 spaces.
Seven of the on-site parking spaces are striped and labeled for the handicapped;
however, the striping and signs are not per Code. There are five handicap parking
spaces at the north end of the three parking aisles at the rear of the building, and
two handicap spaces are located along the east side of the building in the driveway.
Based on the total number of on-site parking spaces, the Code requires only one
van-accessible handicap space for this property. It appears that the additional
handicap parking spaces are to accommodate the landlord's physical therapy
clients. However, during staff's several site visits, only the two handicap spaces in
the driveway were occupied. The five handicap spaces to the rear of building were
usually all available.

Access to the subject property is via an 18-foot wide driveway off of Duarte Road,
and through the adjacent property to the south from an alley. The driveway off of
Duarte Road is very narrow and is substandard for two-way traffic. The two
handicap parking spaces that have been striped along the east side of the building
preclude two-way traffic through this driveway.

The adjacent property to the rear is owned by the Bank of America and is used for
parking for their bank at 1234 S. Baldwin Avenue. The Bank of America posts signs
restricting these spaces for their use only, but the spaces are striped in conjunction
with the on-site parking for 660 W. Duarte Road. The parking spaces are striped at
an angle of 60-degrees and provide for one-way traffic in a clockwise direction.
There is a turning area at the north end of the parking aisles. Arrows painted on the
pavement indicate that egress to Duarte Road is not allowed.
The parking layout disregards the property line separating the subject property from
the Bank of America parking area. There is no documentation about this reciprocal
access and parking arrangement. The Bank of America building was built in 1948
and the subject building was built in 1961. It is assumed that this reciprocal access
and parking arrangement has existed since the subject building was developed.
The applicant has explained that their students are mostly dropped-off and picked-
up, and that the employees park across the street, therefore, their use does not
generate a significant demand for parking. They have instructed their clientele that
the drop-offs and pick-ups are to be at the south end of the building at the apex of
the parking lot turnaround area, and that they are to adhere to the clockwise traffic
pattern. An education center employee oversees the drop-off and pick-up process
during busy periods to avoid any dangerous situations and any unnecessary delays.
The applicant provided the attached traffic counts, which were conducted during the
week of September 101h. The survey counted the number of occupied and available
parking spaces at each hour from 9:00 a.m. through 6:00 p.m., and the number of
vehicles passing through the property during each hour. The survey indicates that
there are ample on-site parking spaces available, and that there is not a significant
amount of through traffic.
Staffs observations during the week of September 24th do not coincide with the
applicant's survey. Staff found that between 3:00 to 5:00 p.m. there were usually
only 8 or 9 parking spaces available with half of them being handicap parking
spaces. However, at least one of the two handicap parking spaces in the driveway
was always occupied. Through traffic, either for the education center, or for other
purposes was very limited. Staff did not observe any backup or congestion due to
students being picked-up or dropped-off.
It does not appear that the existing on-site parking is adequate for the education
center and the other tenants because it is not likely that the current number of
parking spaces can be maintained, and- the applicant's employees may not be
allowed to continue parking off-site. The following issues need to be addressed:
· The two handicap parking spaces in the driveway must be eliminated because
they are in a required fire lane. This will reduce the number of on-site parking
spaces to 19.

· The other five handicap parking spaces do not meet Code, and their current
arrangement cannot be designed to meet the Code. Providing the required
loading areas and paths-of-travel, and striping to meet Code will result in the
loss of at least two of the .handicap parking spaces, and would probably result
in the loss of at least one other parking space. The requirements for the
handicap parking spaces cannot be modified because these are regulated by
the State. Therefore, the number of handicap parking spaces will have to be
reduced. For this property, only one, van-accessible handicap parking space
is required, and compliance with this minimum requirement would result in the
loss of at least one parking space. This will reduce the number of on-site
parking spaces to 18.
. A covenant is required for the off-site parking at 657 W. Duarte Road,
however, it may be disallowed by application no. CUP 01-026. If the
applicant's employees are not allowed to park off-site, then 18 on-site parking
spaces would not be adequate for the three existing tenants.
Code Reauirements
The parking situation will have to be addressed regardless of the outcome of this
application. In particular, the fire lane will have to be restored and the handicap
parking spaces must be made to comply with Code. It is assumed that the other
parking spaces were developed some time ago and their arrangementis legal-
nonconforming.
Fire and Safety Issues
Also, during the review of this application; it was found that an education center
involving minors on a second floor requires that the entire building be equipped with
an automatic fire sprinkler system and that the education center have a one-hour
separation from all other uses. The applicant has been informed of these
preliminary findings and is in the process of having fire sprinkler plans prepared.
The education center occupied its current space without the proper authorizations,
and detailed construction plans of the education center's tenant improvements need
to be submitted for plan check review and approval to be sure that all Code
requirements regarding accessibility, fire protection, occupancy limits, and safety are
complied with to the satisfaction of the Building Official and Fire Marshal. Any
required al!erations would have to be provi~.ed in a timely manner.
CEQA
Pursuant to the prOVIsions of the California Environmental Quality Act, the
Development Services Department has prepared an Initial Study for the proposed

project. Said Initial Study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance that could not be made less than significant with
mitigation incorporation. When considering the record as a whole, there is no
evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
FINDINGS
Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use
Permit to be granted, it must be found that all of the following prerequisite conditions
can be satisfied:
1. That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare or injurious to the property or improvements in
such zone or vicinity.
2. That the use applied for at the location indicated is properly one for which a
Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking,
loading, landscaping, and other features required to adjust said use with the
land and uses in the neighborhood.
4. That the site abuts streets and highways adequate in width aod pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan.
RECOMMENDATION
The Development Services Department recommends denial of Conditional Use
Permit Application No. CUP 01-021, because the site for the proposed use is
. not adequate in size and shape to accommodate the necessary parking and the
pick-up and drop off of students.
If the Planning Commission determines that based on the evidence presented this is
an appropriate use at this site and moves to approve the Conditional Use Permit
Application No. CUP 01-021 staff recommends the following conditions of approval:

1. The occupancy and tenant improvements for the education center approved
by CUP 01-021 shall be in compliance with the Building and Fire Codes, and
said education center shall be operated and maintained in a manner that is
consistent with the application materials and plans submitted and approved
for CUP 01-021. Compliance with the Building and Fire Codes shall be
determined by having detailed construction plans of the education center
submitted for plan check review and approval within 30 days, and any
alterations to the building that are found to be necessary shall be provided
within 30 days of such determinations.
2. If off.site parking is included in the approval of CUP 01-021, a covenant per

by the property owner, recorded in the Office of the County Recorder, and
shall be kept in effect for as long as the subject use is maintained.
3. A parking modification is included in this approval of CUP 01-021 for any
adjustments to the parking layout as required by the Building Official to
comply with the handicap parking and disabled access requirements. This
modification does not constitute an approval for a general reduction of the
parking requirements for the subject office building, but rather is limited to the
three uses occupying the subject office building at this time, which are the
2,173 square foot education center approved by CUP 01-021, a 2,000
square foot physical therapist's office, and a 4,395 square foot bank.
4. This approval of CUP 01-021 shall not take effect until the property owner
and applicant have executed and filed an Acceptance Form available from

PLANNING COMMISSION ACTION
Denial
The Planning Commission should move to deny Conditional Use Permit
Application No. CUP 01-021 because the proposal cannot satisfy all of the
required prerequisite conditions for a Conditional Use Permit, and direct staff
to prepare a resolution incorporating the Commission's decision and specific
findings.

Approval
If the Planning Commission intends to approve Conditional Use Permit Application
No. CUP 01-021, the Commission should move to adopt the Negative Declaration,
state the supporting findings, and direct staff to prepare a resolution incorporating
the Commission's decision, specific findings, and any conditions of approval.

Planning Commission's findings Is as follows:

The area is developed with commercial uses. Next door to the west is a parking lot
for the commercial businesses that face Baldwin Avenue. To the east is an office
complex that is separated from the subject property by a block wall. To the south is
parking lot that is used in conjunction with the applicant's parking lot, but ownership
is separate. Across the street (Duarte Rd:) to the north is a neighborhood shopping
center.

EVALUATION OF ENVIRONMENTAL IMPACTS:
1. A brief explanation is required for all answers except "No Impact" answers that are adequately
supported by the Information sources a lead agency cites in the responses following each question. A
"No Impact" answer is. adequately supported if the referenced information sources show that the
Impact simply does not apply to projects like the one involved (e.g., the project falls outside a fault
rupture zone). A "No Impact" answer should be explained where Ills based on project-specific factors
as well as general standards (e.g., the project will not expose sensitive receptors to pollutants, based
on a project-specific screening analysis).
2. All answers must take account of the whole action involved, including off-site as well as on-site,
cumulative as well as project-level, Indirect as well as direct, and construction as well as operational
impacts.
3. Once the lead agency has determined that a particular physical Impact may occur, then the checklist

occupied by a bank institution with an office of physical therapist at the
rear. The second floor is the proposed educational center of2l73 sq.ft.
