RESOLUTION NO. 1654
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL
USE PERMIT NO. 2002-004 TO RETAIN THE INTERIOR SEATING
THAT CURRENTLY EXISTS WITHIN THE EATING ESTABLISHMENT
AT 733-G NAOMI AVENUE.
WHEREAS, on February 13, 2002, a conditional use permit application
was filed by Denira Izadi, d.b.a. Subway Sandwiches & Salads, to retain the
interior seating i.e., a total of five tables with fixed seating for nine patrons at her
existing eating establishment (Development Services Department Case No.
C.U.P. 2002-004) at property commonly known as 733-G Naomi Avenue; and
WHEREAS, a public hearing was held on March 26, 2002, at which time
all interested persons were given full opportunity to be heard and to present
evidence.

NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development
Services Department in the attached report, dated March 26, 2002, is true and
correct.
SECTION 2. This Commission finds for reasons set forth in the above

report:
1. That the granting of such conditional use permit will not be detrimental
to the public health or welfare, or injurious to the property or improvements in
such zone or vicinity.
2. That the use applied for at the location indicated is a proper use for
which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping and other features are adequate to adjust said use with the land and
uses in the neighborhood.

4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such conditional use permit will not adversely
affect the comprehensive General Plan because the subject use will continue to
operate as an eating establishment within a developed commercial shopping
center,
6. That the evaluation of the environmental impacts as set forth in the
initial study is appropriate and that the project will have no significant effect upon
the environment within the meaning of the California Environmental
Quality Act of 1970, and, when considering the project as a whole, there was no
evidence before the City that the proposed project would have any potentially
adverse effect on wildlife resources or the habitat upon which wildlife depends,
and, therefore, a Negative Declarati'on was approved.
SECTION 3. That for the foregoing reasons this Commission grants
Condition Use Permit 2002-004, to retain the interior seating that currently exists
within the eating establishment at 733-G Naomi Avenue, subject to the following
conditions:
1. That the interior seating arrangement for dining purposes shall be
limited to a maximum of 9 persons.
2. A modification be granted for 760 on-site parking spaces in lieu of
1,401, and that this approval shall not constitute an approval for the general
reduction in parking for the total site - this parking modification shall only be for
the use approved by C.U.P. 2002-004 (an eating establishment).
3. Approval of C.U.P. 2002-004 shall not take effect until the property
owner and applicant have executed and filed the Acceptance Form that is
available from the Development Services Department to indicate awareness and
acceptance of the conditions of approval.
4, Noncompliance with the provisions and conditions of this conditional
use permit shall constitute grounds for its immediate suspension or revocation of
said permit.

SECTION 4. The Secretary shall certify to the adoption of this Resolution
and shall cause a copy to be forwarded to the City Council of the City of Arcadia.
I HEREBY CERTIFY that the forgoing Resolution No. 1654 was adopted
at a regular meeting of the Planning Commission held on March 26, 2002 by the

SUMMARY
The subject of this staff report is a request for a conditional use permit (C.U.P.)
to retain the interior seating Le., a total of five tables with fixed seating for nine
patrons at an existing eating establishment (d.b.a. Subway Sandwiches &
Salads) at 733-G Naomi Avenue.

The Development Services Department is recommending approval of C.U.P.
2002-004 subject to the conditions set forth in the staff report, and adoption of
Resolution No. 1654 that grants Conditional Use Permit No. 2002-004 to retain
the existing seating arrangement for dining purposes at 733-G Naomi Avenue.
GENERAL INFORMATION
APPLICANT: Denira Izadi (owner of the subject business)
LOCATION: 733-G Naomi Avenue
REQUEST: A conditional use permit to retain the interior seating for dining
purposes at an existing eating establishment (d.b.a. Subway
Sandwiches & Salads).
LOT AREA: 391,720 sq.ft. (8.99 acres)
FRONTAGE: 660.00 feet along Baldwin Avenue
680.00 feet along Duarte Road
535.00 feet on Naomi Avenue

The site is developed with the Burlington Coat Factory, a Ross
department store, and various retail shops; zoned C-2 and C-2 & H (along
Baldwin Avenue).

GENERAL PLAN DESIGNATION:
The site is designated as Commercial.
BACKGROUND
The majority of the buildings that exist on the site were originally constructed in
1964. Hinshaws was the site's major department store at that time.
In 1984 the on-site parking areas were redesigned to provide 760 spaces. Such
spaces currently exist on the site, and do not comply with the current Code
requirement of 1,401 spaces for the center (including the subject business).

The subject business has been at the same location since 1987. At that time a
conditional use permit was not required since the food service was for take-out
purposes only. .
Approximately 10 months ago the applicant purchased' the business, which
included the current seating arrangement Le., a total of five tables with fixed
seating for nine patrons. Until recently, the applicant was not aware that having
such seating required a conditional use permit. Staff informed the applicant of
the requirement when she made an inquiry about having an outdoor dining area.
The applicant wishes to retain the existing seating for dining purposes.
PROPOSAL
The applicant is requestin9 a conditional use permit to retain the interior seating
that currently exists within the eating establishment at 733-G Naomi Avenue
(d.b.a. Subway Sandwiches & Salads). Currently, the business occupies a retail
space of approximately 900 sq. ft., which is within a 276,905 sq.ft. shopping
center, as shown on the attached aerial photo. Business hours are from 10:00
a.m. to 10:00 p.m., seven days a week.
PARKING
Eating establishments require 20 parking spaces per 1,000 sq.ft. of gross floor
area. Based upon this requirement the subject business requires 18 spaces;
. however, the existing on-site parking ratio of 2.745 spaces per 1,000 sq.ft. of

gross retail floor area results in a net parking space requirement of 16 spaces for
the use.
Staff has made random vehicle counts on the site, and noted a peak parking
demand of 277 spaces (count occurred at 1 :30 p.m. on March 1, 2002), which in
staffs opinion indicates that there has been ample on-site parking for the
applicant's business, since the site currently provides 760 parking spaces. Also,
there is a reciprocal easement agreement with the neighboring Vons Pavilions
center to utilize the parking areas in common. The Vons' site provides 428
parking spaces.
ANALYSIS
Generally staff does not encourage uses that are deficient in parking; however,
the subject business has apparently been active for a substantial period of time,
and staff has not been advised of any parkin9problems in reference to this use.
Staff feels that the requested seating is minimal, and that the eating
establishment is an appropriate use for the center, provided that the operation of
such use remains consistent With this application.
The applicant shall be reqUired to comply with all code requirements as
determined necessary by the Building Official, Fire Marshall, Public Works
Services Director, and'the Development Services Director.
CEQA
Pursuant to the provisions of the California Environmental Quality Act, the
Development Services Department has prepared an initial study for the proposed
project. Said initial study did not disclose any substantial or potentially
substantial adverse change in any of the physical conditions within the area
affected by the project including land, air, water, minerals, flora, fauna, ambient
noise and objects of historical or aesthetic significance. When considering the
record as a whole, there is no evidence that the proposed project will have any
potential for an adverse effect on wildlife resources or the habitat upon which the
wildlife depends. Therefore, a Negative Declaration has been prepared for this
project.
RECOMMENDATION
The Development Services Department recommends approval of Conditional
Use Permit No. 2002-004 subject to the fOllowing conditions:
1. That the interior seating arrangement for dining purposes shall be limited to a
maximum of 9 persons.
2. A modification be granted for 760 on-site parking spaces in lieu of 1,401, and
that this approval shall not constitute an approval for the general reduction in

parking for the total site - this parking modification shall only be for the use
approved by C.U.P. 2002-004 (an eating establishment).

FINDINGS AND MOTIONS
Approval
The Planning Commission should move to adopt the Negative Declaration,
and approve C.U.P. 2002-004 by adopting Resolution No. 1654 that grants
Conditional Use Permit 2002-004 to retain the interior seating that currently
exists within the eating establishment at 733-G Naomi Avenue (d.b.a.
Subway Sandwiches & Salads).
Denial
If the Planning Commission intends to deny this conditional use permit
application, the Commission should move for denial and direct staff to prepare a
resolution which incorporates the Commission's decision and specific findings.

EVALUATION OF ENVIRONMENTAL IMPACTS:
1) A brief explanation is required for all answers except "No Impact" answers that are
adequately supported by the information sources a lead agency cites in the parentheses following
each question. A "No Impact" answer is adequately supported if the referenced information
sources show that the impact simply does not apply to projects like the one involved (e.g. the
project falls outside a fault rupture zone). A "No Impact" answer should be explained where it is
based on project-specific factors as well as general standards (e.g. the project will not expose
sensitive receptors'to pollutants, based on a project-specific screening analysis).
2) All answers must take account of the whole action involved, including off-site as well as on-
site, cumulative as well as project-level, indirect as well as direct, and construction as well as
operational impacts.
3) Once the lead agency has determined that a particular physical impact may occur, then the
checklist answers must indicate whether the impact is potentially significant, less than significant
with mitigation, or less than significant. "Potentially Significant Impact" is appropriate if there is
substantial evidence that an effect is significant. If there are one or more "Potentially Significant
Impact" entries when the determination is made, an EIR is required.

Issues:

The operation of the eating establishment is subject to
local air quality regulations as administered by the
South Coast Air Quality Management District, which
should prevent any impacts relative to items (a) andlor
(b) above. There are no exterior improvements
proposed that would result in alterations to air
movement, moisture or temperature, or cause a
change in climate. No objectionable odors have been
associated with the proposed use.
IV. BIOLOGICAL RESOURCES. Would the project:
a) Have a substantial adverse effect, either directly or
through habitat modifications, on any species identified as
a candidate, sensitive, or special status species.in local or
regional plans, policies, or regulations, or by the

the business is subject to all other environmental plans
