KOREAN BBQ RESTAURANT AT 1431 SOUTH BALDWIN AVENUE. WHEREAS, on July 23,2001, a Conditional Use Permit application was filed by Young Ji Jeon to operate a 1,750 sq.ft. restaurant, Development Services Department Case No. C.U.P, 01-022, at property commonly known as 1431 South Baldwin Avenue; and WHEREAS, Apublic hearing was held on September 11,2001, at which time all interested persons were given full opportunity to be heard and to present evidence, NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION I. That the factual data submitted by the Development Services Department in the attached report is true and correct. SECTION 2. This Commission finds: I. That the granting of such Conditional Use Permit wiJI not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied fot at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 4. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 5. That the use applied for will not have a substantial adverse impact on the environment, and that based upon the record as a whole there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which th~ wildlife depends, SECTION 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to operate a 1,750 sq.ft. restaurant, upon the following conditions: e 1. Seating shall be limited to a maximum of 49 persons. 2. All City code requirements regarding accessibility, fire protection, occupancy, and safety shall be complied with to the satisfaction of Building Services, Public Works Services, Development Services, and the Fire Department. 3. Outlet(s) from all kitchen sinks must be connected to approved grease interceptor(s). Detailed plumbing plans shall be provided to the Public Works Services Department for review and approval. 4. Approval of CUP 01-022 shall not take effect until the property owner and applicant have executed and filed the Acceptance Form available from the Development Services Department to indicate acceptance of the conditions of approval. 5, All conditions of approval shall be complied with prior to completion of the tenant improvements, and opening of the restaurant. Noncompliance with the plans, provisions and conditions of CUP 01-022 shall be grounds for immediate suspension or revocation of any approvals .that could result in the closing of the restaurant. . SECTION 4. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. Korean BBQ Restaurant with seating for 49 patrons located at 1431 S. Baldwin Avenue. The restaurant will be open 6 days a week from 11 :00 a.m. to 11 :00 p.m. The Development Services Department is recommending approval of C.U.P. 01-022 and adoption of Resolution No. 1652 that grants such permit subject to the conditions in this staff report. e GENERAL INFORMATION APPLICANT: Young Jj Jeon (tenant) LOCATION: 1431 S, Baldwin Avenue, REQUEST: A Conditional Use Permit to operate a 1,750 sq.ft. Korean BBQ Restaurant including the sale and consumption of beer and wine with seating for 49 patrons. SITE AREA: 203,430 sq.ft. (4.67 acres) FRONTAGES: 372 Feet on Baldwin Avenue 552 Feet on Naomi Avenue e EXISTING LAND USE & ZONING: The site is developed with an existing commercial retail shopping center; zoned C-2. SURROUNDING LAND USES & ZONING: North: Multiple family residential; zoned R-3. South: drive-in convenience store; zoned C-2. e East: Commercial retail center; zoned C-2. West: Multiple-family residential; zoned R-3. GENERAL PLAN DESIGNATION: The subject site is designated as Commercial. PROPOSAL The applicant is requesting a Conditional Use Permit to operate a 1,750 sqJt. Korean B.B.a. Restaurant, including the sale and consumption of beer and wine, at 1431 Baldwin Avenue, as shown on the submitted site plan. The restaurant will have seating for 49 patrons, and will be open 6 days a week from 11 :00 a.m. to 11 :00 p.m" closing on Tuesday or Wednesday. The restaurant will replace a vacant computer store. A restaurant is a permitted use in the C-2 zone with an approved conditional use permit. The proposed 1,750 sq. ft, restaurant requires ten (10) spaces per 1,000 sq. ft. of gross floor area, Based on this requirernent, 18 spaces are required for the restaurant. . ANALYSIS The proposed Korean B.B.a. Restaurant will occupy a vacant space previously used as computer retail. The adjoining businesses in reference to the proposed use are a Radio Shack and a Vietnamese R~staurant. The applicant shall be required to comply with all code requirements as determined necessary by the Building Official, Fire Marshall, Maintenance Service Director and Development Services Director. CEQA Pursuant to the prOVISions of the Califomia Environmental Quality Act, the Development Services Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been preparecj for this project. RECOMMENDATION The Development Services Department recommends approval of Conditional Use Permit No. CUP 01-022 subject to the following conditions: 1. Seating shall be limited to a maximum of 49 persons. 2. All City code requirements regarding accessibility, fire protection, occupancy, and safety shall be complied with to the satisfaction of Building Services, Public Works Services, Development Services, and the Fire Department. FINDINGS AND MOTIONS Aooroval The Planning Commission should move to approve the Negative Declaration and adopt Resolution No. 1652: A Resolution of the Planning Commission of the City of Arcadia, California, granting Conditional Use Permit No. 01-022 for a 1,750 sq. ft. restaurant at 1431 S. Baldwin Avenue. Denial If the Planning Commission intends to deny this Conditional Use Permit application, the Commission should move for denial and direct staff to prepare a resolution which incorporates the Commission's decision and specific findings. A "No Impact" answer is adequately supported if the referenced information sources show that the impact simply does not apply to projects like the one involved (e,g. the project falls outside a fault rupture zone). The proposed restaurant and its operation will be subject to local air quality regulations as administered by the South Coast Air Quality Management District which should prevent any impacts relative to items (iI) andlor (b) above. No objectionable odors have been associated with the proposed use. lV. BIOLOGICAL RESOURCES. The proposed restaurant will be located in an existing commercial building in a commercial area. None of the above circumstances exist. v. CULTURAL' RESOURCES. The proposed use will be in an existing commercial building. NODe of the above resources have been identified at the subject area, and none of the impacts have been associated with,the proposed use.
