RESOLUTION NO. 1649
A RESOLUTION OF THE PLANNING COMMISSION OF THEClTY OF
ARCADIA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO.
01-019 TO INSTALL A WIRELESS COMMUNICATIONS FACILITY
DESIGNED ASA 55' MONOPALM AT 60 W. LIVE OAK AVENUE.
WHEREAS, on June 27, 2001,. a conditional use permit application was filed
by TCG, Inc~ to install an unnianned wireless communications facility designed as a 55'
monopalm and a Modification for a height of 55 feet fora monopole antennae support
(Development Services Department Case No. C.U.P, 01-019) at 60 W. Live Oak Avenue,
more particularly described as:
Lots -I, of Tract 10260 in the City of Arcadia, County of Los Angeles, State of
Califc,rnia, as recorded in the Office of the County Recorder of said County.
WHEREAS, A public hearing was held on August 14, 2001, at which time all
. interested persons were given full opportunity to be heard and to present evidence.
NOW' THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA RESOLVES AS FOLLOWS:
SECtION 1. That the factual data submitted by the Development Services
Department iJ) the attached report is true and correct.
SECTlON 2. This Commission fmds:
I. TIlat the granting of such Conditional Use Permit will not be detrimental to
the public he,llth or welfare, or injurious to the property or improvements in such zone or
vicinity beca'Lise the initial study did not disclose any substantial adverse effects to the
area affected ,by the proposed project.
2. T11at the use applied for at the location indicated is a proper one for which a
Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate: said use. All yards, spaces, walls, fences, loading, landscaping and other
features inclllding the shared parking with the neighboring business, are adequate to

adjust said Ilse with the land and uses in the neighborhood. The proposed project
complies wid] all related zoning requirements as set forth in the Arcadia Municipal Code.
4. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use.
S. That the granting of such Conditional Use Permit will not adversely affect the
comprehensi;/e General Plan because the land use and current zoning are consistent with
the General. Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment. and that based upon the record as a whole there is no evidence that the
proposed prqject will have any potentiai for an adverse effect on wildlife resources or the
habitat upon which the wildlife depends.
SECTION 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit, to install an unmanned wireless communications facility
designed as II 55' monopalm and a Modification for a height of 5S feet for a monopole
antennae support at 60 W. Live Oak A venue subject to the following conditions:
1. That building code compliance and conditions of approval must be met to the
complete sati.sfaction of the Inspection Services Officer. All ADA requirements shall be
meet for disabled access; parking, restrooms, door hardware, and entrances.
2. The, cellular installation and the site shall be maintained in a manner that is
consistent ~ith the plans and materials submitted and approved for CUP 01-019 and
ADR 01-010,
3. That two Washingtonian Robosta Palms, a minimWTI of30'"0" in height shall be
planted at this location.
4. That a decorative block wall shall screen the BTS equipment cabinets.
5. Tha1: CUP 01-019 shall not take effect until the owner and applicant have
executed a fcirm available at the Planning Office indicating awareness and acceptance of
the conditions of approval.
6. Noncompliance with the provisions and conditions of this conditional use
permit shall i:onstitute grounds for its immediate suspension or revocation.

7. A m~dification of the overall height of 55' in lieu of 45' is hereby granted. This
modification applies only for the use approved by CUP 01-019.
SECTION 4. The decision, findings and conditions contained in this Resolution
reflect the Co:rnmission's action of August 14, 2001, and the following vote:
A YES.: Commissioners, Huang, Murphy, Olson, Kalemkiarian
NOES: None
ABSENT: None
giCTION 5. The Secretary shall certify to the adoption of this
Resolution arid shall cause a copy to be forwarded to the City Council of the City of
Arcadia.

SUMMARY
This Conditionill Use Permit (C.U.P.) application was submitted by TCG, Inc. to
install a wireless communications facility designed as a 55' monopalm at 60 W. Live
Oak Avenue. Development Services Department is recommending approval of this
application subject to the conditions in this report.
GENERAL INFORMATION
e APPLICANT: TCG, Inc. (on behalf of CingularWireless)
LOCATION: 60 W. Live Oak Ave.
REQUEST: A Conditional Use Permit to install an unmanned wireless
, communications facility designed as a 55' monopalm and a
Modification for a height of 55 feet for a monopole antennae support
in lieu of the maximum height of 45 feet allowed by the zoning
regulations.
SITE AREA: "98254.31 sq.ft. (2.26 acres)
FRONTAGE: Approximately 262 feet on Live Oak Avenue and 362 feet on
Weiland Ave.
EXISTING LAND USE & ZONING:
The site is currently being developed with a new 17,841 sq.ft.
industrial building and there is an existing warehouse with one
vacant pad, along Live Oak Avenue. The property is zoned C-M and
M-1 (Commercial Manufacturing and Planned Industrial).

GENERAL PLAN DESIGNATION,
The site tis designated as Commercial
BACKGROUNQ
Communications equipment facilities are permitted in any zone with a Conditional
Use Permit (Sei:. 9275.1.11). The proposed location is a 400 sq.ft. area located north
of the parking It)t for a new 17,841 sq.ft. industrial building that is under construction
located on the southerly portion of the lot. There is an existing vacant 2,140 sq.ft.
warehouse lasl; occupied by Chh Quality Products Inc. located on the northwest
portion of the lot. One vacant pad is undeveloped on the northeast corner of the lot.
On April 17, 2001 the Development Services Department conditionally approved the
applicant's design concept plan for the monopalm (Case No. ADR 01-010).
The area is z;oned CoM and M-1 for Commercial Manufacturing and Planned
Industrial uses. Communication facilities are considered appropriate in industrial
areas.
PROPOSAL
The proposal is to place cellular telephone equipment on a concrete pad and a
monopole desi!~ned as a 55' palm tree on a 400 sq.ft. area located at the northerly
portion of the lot being developed with the 17,841 sq.ft. industrial building. A
decorative block wall will screen the BTS equipment cabinets.

A modification .of the overall height of 55' in lieu of 45' permitted (35'-0" maximum
building height and 10'-0" for accessory structural items including mechanical
equipment) is ollso requested for the proposal.
Site Selection
The need for a cellular installation is determined by the amount of cellular activity in
an area and the distances between other network installations. To establish a
network, distarice between installations are determined on the basis of signal range
and quality. The proposed installation has been determined to be necessary in order
for an adequat'9 signal to be provided in this area.

Currently, the applicant is experiencing coverage/capacity difficulties in the subject
area and surrounding sites have reached their channel limits. The proposed
installation will alleviate the strain on the systems with the increase in customer
demand. This location is centrally located within this portion of the network. Based on
the applicant's proposal, "locating the proposed facility further to the north or south
would create si!~nal interference with other nearby CW wireless facilities and create
holes in the nehf'lork resulting in the need for two or more major facilities in the area".
The CoM zone provides for an overall maximum height of 45 feet. The maximum
structural height is 35 feet (Sec. 9265.2.1.) and an additional 10 feet is allowed for
mechanical equipment and facilities (Sec. 9265.6.2.).
The applicant il. requesting a height modification due to the obstructions in the area
with the current topography and development. Additionally, the applicant noted,
"Heights lower lhan 55 feet would severely impair signal propagation".
Site Improvemelnts & Architectural Desion Review
The location fer the proposed installation is a 400 sq.ft. area located north of the
parking lot. Thi~ 400 sq.ft. area is adjacent to a 20 foot wide alley that service the
industrial uses along Live Oak Avenue and the neighboring residential units to the
south. No portiim of the proposed location directly abuts residentially zoned property.
Dense landscaping exists along the alley, separating the residential uses from this
property.
The cellular equipment will consist of six (6) panel antennas atop a 55 foot high
monopalm and three (3) Base Transceiver Station electronic (BTS) equipment
cabinets. Architectural considerations for the proposed installation are limited. The.
applicant is proposing to disguise the pole as a palm tree using two thirty (30) foot
high Mexican 'fan palms adjacent to the monopalm to assist in camouflaging the
cellular pole. 1:1. 6'-0" high split face block wall will be added to conceal the BTS
cabinets from public view and to further enhance the equipment area.
No other improvements are proposed to the area outside of the equipment and
monopole areal. All other improvements to the site including parkway landscaping, is
being completed by other contractors for the construction of the new industrial
building.
ANALYSIS
Uses such as communications equipment facilities are permitted in any zone with a
Conditional Ui,e Permit (Sec. 9275.1.11). Based upon the applicant's proposal,
location next to the alley, and background information about the site, it is staffs
opinion that th'9 proposed monopalm will be an appropriate use for the industrial site.
In addition, there is dense landscaping to the west of the site which provides
additional screening of the monopalm.

The applicant shall be required to comply with all code requirements as determined
necessary by the Building Official, Fire Marshall, Public Works Services Director and
Community Development Administrator.
CEQA
Pursuant to the prOVIsions of the California Environmental Quality Act, the
Development Services Department has prepared an initial study for the proposed
project. Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole, there is
no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit No. CUP 0~-019 subject to the following conditions:
1. The cellular installation and the site shall be maintained in a manner that is
consistent with the plans and materials submitted and approved for CUP 01-019
and ADR 01-010.
2. That two Washingtonian Robosta Palms, a minimum of 30'-0" in height shall be
planted at this location.
3. That a decorative block wall shall screen the BTS equipment cabinets.
4. Approval of CUP 01-019 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the
DeVelopment Services Department to indicate acceptance of the conditions of
approval.
5. All conditions of approval shall be complied with prior to completion of the tenant
improvements, and opening of the learning center and computer arcade.
Noncompliance with the plans, provisions and conditions of CUP 01-019 shall be
grounds for immediate suspension or revocation of any approvals.
FINDINGS AND MOTIONS
Ailproval
The Planning Commission should move to approve the Negative Declaration
and direct staff to prepare the appropriate resolution for adoption at the
Planning Commission's next meeting.

If the Planning Commission intends to deny this Conditional Use Permit application,
the Commission should move for denial and direct staff to prepare a resolution that
incorporates the Commission's decision and specific findings.

EVALUATION OF ENVIRONMENTAL IMPACTS:
1. A brief explanation is required for all answers except "No Impact" answers that are adequately
supported by the information sources a lead agency cites in the responses following each question, A
"No Impact" answer is adequately supported if the referenced information sources show that the impact
simply does not apply to projects like the one involved (e.g" the project falls outside a fault rupture
zone). A "No Impact" answer should be explained where tt is based on project-specific factors as well
as general standards (e.g., the project will not expose sensitive receptors to pollutants, based on a
project-specific screening analysis).
2. All answers must take account of the whole action involved, including off-site as well as on-site,
cumulative as well as project-level, indirect as well as direct, and construction as well as operational
impacts.
3. Once the lead agency has determined that a particular physical impact may occur, then the checklist
answers must indicate whether the impact is potentially significant, less than significant with mitigation,
or less than significant "Potentially Significant Impact" is appropriate if there is substantial evidence
that an effect is significant. If there are one or more, "Potentially Significant Impacf' entries when the

ADR 01.01.0 for a proposed mono-palm antennae in the
parking lot of a proposed industrial site.
Dear Mr. Gonzales:
The Development Services Department on April 17, 2001, conditionally
approved your design concept plan for a proposed mono.palm antenna to be
installed in the parking lot of a proposed industrial site at 60 W. Live Oak
Avenue. This approval is subject to the conditions that:
1.A Conditional Use Permit (C,U.P.) application shall be submitted for a
public hearing and approved by the Planning Commission prior to any
installation.
2. Upon submittal of the C.U.P. application a site plan shall be submitted
showing two (2) 30' Live Mexican Fan Palm .to be located within the
vicinity of the proposed mono.palm.
3. A decorative block wall shall screen the BTS equipment cabinets.
This approval shall expire in one year (April 17, 2002) unless a C.U.P.
application is submitted to the Planning Services Department. The proposal
shall be consistent with the conditionally approved design concept plan. Any
inconsistency from the conditionally approved design concept plan may
require in additional design review and may delay the C.U.P. application
process.
