RESOLUTION NO. 1646
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO.
01-015 TO OPERATE A 5,500 SQ.FT. EDUCATIONALIINSTRUCTIONAL
COMPUTER INTERNET LAB AND COMPUTER ARCADE AT 56 E. LIVE
OAK AVENUE
WHEREAS, on May 14,2001, a conditional use permit application was filed
by Max Yang to operate a 5,500 sq.ft. educational/instructional computer internet lab
and computer arcade (Development Services Department Case No. C.U.P. 01-015) at 56
E. Live Oak Avenue, more particularly described as:
Lot 5 of Tract 15628, in the City of Arcadia, County of Los Angeles, State of
California, as recorded in Parcel Map Book 354, Page(s) 24-25, in the Office of
the County Recorder of said County.
WHEREAS, A public hearing was held on June 26, 2001, at which time all
interested persons were given full opportunity to be heard and to present evidence.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION I. That the factual data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2. This Commission finds:
I. That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare, or injurious to the property or improvements in such zone or
vicinity because the initial study did not disclose any substantial adverse effects to the
area affected by the proposed project.
2. That the use applied for at the location indicated is a proper one for which a
Conditional Use Permit is authorized.

3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, loading, landscaping and other
features including the shared parking with the neighboring business, are adequate to
adjust said use with the land and uses in the neighborhood. The proposed project
complies with all related zoning requirements as set forth in the Arcadia Municipal Code.
4. That the site abut.s streets and highways adequate'in width and pavement type
to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan because the land use and current zoning are consistent with
the General Plan.
6. That any new exterior design elements for the subject building will be subject
to Architectural Design Review and in compliance with the design criteria set forth in the
City's Architectural Design Review Regulations.
. 7. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there is no evidence that the
proposed project will have any potential for an adverse effect on wildlife resources or the
habitat upon which the wildlife depends.
SECTION 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit, to operate a 5,500 sq.ft. educational/instruction!!l computer
internet lab and computer arcade at 56 E. Live Oak Avenue subject to the following
conditions:
J. That building code compliance and conditions of approval must be met to the
complete satisfaction of the Inspection Services Officer. All ADA requirements shall be
meet for disabled access; parking, restrooms, door hardware, and entrances.

2. All City code requirements regarding accessibility, fire protection, occupancy,
and safety shall be complied with to the satisfaction of Building Services and the Fire
Department which shall include, but are not limited to the following items:
a. A Knox-box With keys shall be installed in conformance with Uniform Fire
Code, per UFC 904.
b. An NFPA-72 Fire Alarm System shall be installed in accordance with the
Uniform Building Code and all other applicable provisions of the Arcadia
Municipal Code (3114.1).
c. Provide occupant load signs at all locations within the occupancy. Provide
seating plan and have in posted in the manager's office for inspection.
d. Exit illumination shall comply with Sec. 1211 UFC.
e. That all exit doors shall be equipped with panic hardware as defined in the
building code. All interior doors shall open in the direction of travel.
3. There shall be no more than 40 computer stations on the premises
4. A modification is granted for 8 on-site parking spaces in lieu of 92 spaces
required. This approval shall not constitute an approval for a general reduction in parking
for the to.tal site. That this parking modification shall only be for the use approved by
CUP 01-015 (computer arcade and lab).
5. The hours of operation of shall be limited to between 10:00 a.m. to 11 :30 p.m.
seven (7) days a week.
6. There shall be no computer stations located within the "snack area".
7. There shall be guard on site during the hours of operation.
8. Bicycle racks shall be provided and installed to the satisfaction of the
Community Development Administrator.
9. The applicant shall comply with the Business Licensing and Game Machine
Regulations stipulated in Article VI of the Municipal Code which include, but are not
limited to the following:

a. Any locations where a game machine is operated shall provide personnel over
twenty-one (21) years of age to maintain supervision of each game machine and
patrons thereof.
b. Any locations where any game machine is operated shall prohibit persons under
the age of eighteen (18) years from using or playing any game machine between
the hours of 8:00 a.m. to 3:00 p.m., Monday through Friday and after 10:00 p.m.
daily, unless accompanied by a parent or guardian. The 8:00 a.m. through 3:00
p.m. restriction shall not apply during school holidays and school vacation periods
recognized by schools within the City of Arcadia.
10. That CUP 01-015 shall not take effect until the owner and applicant have
executed a form available at the Planning Office indicating awareness and acceptance of
the conditions of approval.
II. All conditions of approval shall be complied with prior to completion of the
tenant improvements, and opening of the learning center and computer arcade.
Noncompliance with the plans,. provisions and conditions of CUP 01-015 shall be
grounds for immediate suspension or revocation of any approvals that could result in the
closing of the computer arcade.
12. Noncompliance with the provisions and conditions of this conditional use
permit shall constitute grounds for its immediate suspension or revocation.
SECTION 4. The decision, findings and conditions contained in this Resolution
reflect the Commission's action of June 26, 200], and the following vote:
A YES: Commissioners, Huang, Olson, Kalemkiarian
NOES: None
ABSENT: Bruckner, Murphy
SECTION 5. The Secretary shall certifY to the adoption of this
Resolution and shall cause a copy to be forwarded to the City Council of the City of
Arcadia.

SUMMARY
This Conditional Use Permit (C.U.P.) application was submitted by Max Yang to
operate a 5,500 sq.ft. educational/instructional computer internet lab and arcade with
68 computer stations from 1.0:00 a.m. to 11:30 p.m., Sunday thru Thursday, and
from 10:00 a.m. to 2:00 a.m. Friday and Saturday, at 56 E. Live Oak Avenue. Such a
permit is required because the applicant's proposal constitutes an arcade, as defined
by Municipal Code Section 6115.2.
The Development Services Department is recommending approval of C.U.P. 01-015.
with am~nded hours of operation from 1'0:00 a.m. to 12:00 p.m. Friday and Saturday,
i'lnd a maximum of thirty (30) computer stations, subject to the conditions in this staff
report.

. GENERAL INFORMATION

FRONTAGE: Approximately 50 feet on Live Oak Avenue.
EXISTING LAND USE & ZONING:
The site is developed with a 5,500 ~ sq.f.t. building that is part of a
commercial shopping strip along Live Oak Avenue. There are
approximately 100 parking spaces that are located off the alley
serving all businesses between 30-62 E. Live Oak Avenue. Eight (8)
on-site parking spaces are located directly behind the subject

building (see attached land use and zoning map). The property is
zoned C-2 (General Commercial).
SURROUNDING LAND USES & ZONING:
North: Mixed Commercial and residential: zoned CoO, R-1, & R-2
South: Los Angeles County, single-family residential
East: General Commercial: zoned C-2
West: General Commercial: zoned C-2
GENERAL PLAN DESIGNATION:
The site is designated as Commercial
PROPOSAL
The applicant's proposal is for a "dual use education and entertainment" facility with
68 computer stations. According to the applicant's request, they will:
"provide instruction and training in use of computer programs such as word
processing, also computer programming skills, internet use and web site
design. Rent computer time for personal use 'and for'use/access to age
appropriate Internet sites for communications, educational resource retrieval,
networking and network related competitive computer activities, matches and
recreation. "
Based upon the applicant's description of the operation, the use is considered a
computer arcade similar to the two recently approved businesses on Baldwin Avenue
and' Duarte Road.
The proposed hours of operation are from 10:00 a.m. to 11 :30 p.m., Sunday thru
Thursday, and 10:00 a.m. to 2:00 a.m. Friday and Saturday. They are proposing 68
computer stations along with a "snack area" with seating for 22 people that may be
utilized by patrons on the facility.
PARKING
The subject building was constructed in 1960 as part of the strip retail commercial
buildings at 30 to 62 East Live Oak Avenue. There are approximately 93 parking
spaces behind the buildings with access from the alley located south of the parking
area. Properties solith of the alley are developed with single-family dwellings located
in the County of Los Angeles. Eight (8) parking spaces are located directly behind
the subject building.
The on-site parking does not comply with the current Code requirements, as
summarized in the following table:

The proposed computer learning center and arcade will occupy a building that was
previously occupied by a blood and organ bank, which closed in 2000. The required
on-site parking for the blood bank was twenty-eight (28) spaces. The proposed
. computer learning center and arcade would require 92 on-site parking spaces based
on a parking requirement of 1 space per 35 sq.ft. of computer gaming area. This
proposal would create a parking deficiency of 84 on-site parking spaces.
As noted in the table, based upon the current uses in the strip center, 266 parking
spaces are required; 93 spaces are provided which results in an overall parking
deficiency of 173 spaces.
The applicant did not conduct a parking survey, however, staff has conducted several,
site inspections at different times of the day and noted that only about 50% of the
parking in this area is utilized at anyone time.
ANALYSIS
The Arcadia Municipal Code does not specifically address an "educational and
entertainment" type of use. By definition, it is considered an arcade because of the
video gaming aspect. 'Recently two similar type uses have been approved in the
City, one at 1023 South Baldwin Avenue and another at 651 Duarte Road.

"Educational and entertainment" type of facilities such as the one proposed are a
new business concept and Arcadia as well as other communities have had limited
experience in assessing the impact of these types of uses.
The Development Services Department is concerned with the limited number of on-
site parking spaces. Although staff has observed that the existing parking is
underutilized, there is a potential for 90 persons (not including the operators) to be on
the premises at anyone time, this includes the 68 proposed computer stations along
with the seating in the "snack area.
Because this property abuts a residential neighborhood to the south of the alley and
because of the limited onsite parking and the limited share parking, staff is
recommending limiting the hours of operation from 10:00 a.m. to 12:00 p.m. on
Friday and Saturday, and limiting the number of stations to thirty (30) maximum.

Based on other similar uses in the city, it is staff's opinion that such uses have a
tendency to become intense, creating parking and loitering problems. Therefore, the
recommended amendments to the applicant's proposal are justified to reduce the
amount of traffic and possible noise issues to both neighboring business and
residences.
The applicant's proposal is considered an arcade because Section 6115.2. of the
Arcadia Municipal Code defines an arcade as any place of business containing four
(4) or more "game machines." Such machines are defined in Section 6115.1.1.. of
said code as any device for amusement, including but not limited to a pinball machine
or video game, which may be activated by a coin or any consideration paid for its
usage.
Game machines are subject to business licensing and other related regulations under
Article VI of the Municipal Code. A copy of these regulations is attached.
The Police Department has concerns with the number of computer stations and the
operating hours. They concur with the staff's recommendation to limit the number of
computers to a maximum of thirty (30) because the 68 stations requested by the
applicant provides a greater potential for attracting more customers from outside the
community, which could pose a potential problem because similar type businesses
in other cities have become a gathering place for gangs.

If any problems arise from the business operation the Commission may revoke the
Conditional Use Permit or amend the conditions of approval to mitigate any negative
impacts to the commercial center.
Bicycle Parkin!::):
. Section 9275.6.3. of the Special Regulations for Game Machine Arcades requires
that adequate off-street parking be provided for bicycles as well as automobiles.
Because the proposed game machines primarily appeal to young children (under 16
years old) there will probably be a need for bicycle parking. The applicant will need
to designate an area at the rear of the building to accommodate such parking. The
designated bicycle parking area will be subject to staff's review and approval to
ensure that it shall not obstruct the pedestrian path of travel or any existing parking
space.
The applicant shall be required to comply with all code requirements as determined
necessary by the Building Official, Fire Marshall, Maintenance Service Director and
Development Services Director. C
CEQA
Pursuant to the provIsions of the California Environmental Quality Act, the
Development Services Department has prepared an initial study for the proposed
project. Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole, there is
no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit No. CUP 01-015 subject to the following conditions:
1. A modification is granted for 8 on-site parking spaces in lieu of 92 spaces
required. This approval shall not constitute an approval for a general reduction in
parking for the total site. That this parking modification shall only be for the use
approved by CUP 01-015 (computer arcade and lab).
2. All City code requirements regarding accessibility, fire protection, occupancy, and
safety shall be complied with to the satisfaction of Building Services and the Fire
Department which shall include, but not limited to the following items:

a. If only one of the proposed restrooms is to be disabledlhandicapped
accessible, then both of the restrooms must be unisex.
b. Installation of a Knox-box with keys in conformance with the Uniform Fire

FINDINGS AND MOTIONS
. Approval
The Planning Commission should move to approve the Negative Declaration
and direct staff to prepare the appropriate resolution for adoption at the
Planning Commission's next meeting.
Denial
If the Planning Commission intends to deny this Conditional Use Permit application,
the Commission should move for denial and direct staff to prepare a resolution that
incorporates the Commission's decision and specific findings. .

EVALUATION OF ENVIRONMENTAL IMPACTS:
1. A brief explanation is required for all answers except "No Impact" answers that are adequately
supported by the information sources a lead agency cites In the responses following each question. A
"No Impact" answer is adequately supported if the referenced information sources show that the impact
simply does not apply to projects like the one involved (e.g., the proiect falls outside a fault rupture
zone). A "No Impact" answer should be explained where it is based on project-specific factors as well

35. The project cite is a commerc~al space of 40 feet wide by 110
feet wide that is contiguous to similar commercial space all
owned by the Meeker Family Partnership. The building is a frame
and stucco with flat roof constructed on a concrete pad with
common area park-ing behind the premises and adjoining commercial
premises.
The premises are located on the south side of Live Oak Avenue in
the City of Arcadia, adjacent to and across from other
city/neighborhood commer~ial retail enterprises that serve the
community. Live Oak Avenue isa wide, well traveled, multi-lane
with median-strip and well maintained and lighteq public street
tha.t has retail commercial businesses on both sides thereof with
curbside parking.
There is no topography, soil stability, plants and animals that
are impacted by the premises or the type of busine.ss proposed to
be conducted thereon. .
There are no cultural, historical or scenic aspects that will be
impacted by the subject premises or the business proposed to be
conducted thereon.

of Live Oak Avenue are typically single st.ory commercial retail
businesses with store fronts, signs, display windows, wide
pedestrian friendly sidewalks with curbs.ide parking for patron's
automobiles. There are single family residences north of Live
Oak Avenue behind the commercial properties.
To the south of the subject premises there is a 20 foot wide
alley that serves the parking lot(s) behind the subject premises.
South of the alley are the back 'yards of single family residences
that abut the alley and front on Lynrose Street.
There are no known plants and animals, that are ~~own to exist on
the surrounding properties, other than types normally associated
with developed city residence and business areas; nor animals,
other than domesticated animals known to frequent the vicinity of
the subject premises.

Each machine shall also ~ar the name of the
licensee in plain view in leners of not less than
one.fourth inch in height.
6411.5. GAME MACHINE
REGULATIONS.
Each entertainment permit issued for a game
machine shalL be subj~ to the followio% condi-
tions:
I. The location where each game machine is
operated shalt provide suffIcient security mea-
sures to effectively regulate interior and exterior
lOitering, parking congestion, disturbing noise
and light, IGud conversations and criminal
aCT.i vlties.
2. Any locations where a game machine is
operated shall provide personnel over tWenty.
one (21) yean of age to maintain supervision of
each game machine and patrons thereof.
3. Any locations where any game machine is
. operated-shall prohibit pers<lns under the age of
eighteen (18) years from using or playing any
game machine between the hours of 8:00 A.M.
and 3:00 P.M., Monday through Friday and Ther
10:00 P.M, daily, unless accompanied by a parent
or guardian. The 8:00 A.M. through 3:00 P.M.
restriction shall not apply during school holidays
and school vacation periods recognized by
schools within the City of Arcadia.

date of Ordinance No. 1764 until such time such
