RESOLUTION NO. 1645
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, GRANTING A FIVE (5) YEAR EXTENSION OF
CONDITIONAL USE PERMIT NO. CUP 96-003 (RESOLUTION NO. 1536)
TO USE MODULAR CLASSROOMS AT 1900 S. SANTA ANITA AVENUE.
WHEREAS, on May 8, 2001, an application was filed by Steve Blankenship on
behalf of the Arcadia Christian School for a five (5) year extension of Conditional Use
Pennit No. CUP 96-003 (Resolution No. 1536) to use modular classrooms at 1900 S. Santa
Anita Avenue, more particularly described as follows:
Part of Lot 38 of the Arcadia Acreage Tract in the City of Arcadia, County of
Los Angeles, State of Califomia, as per map recorded in Book 10, Page 18
of Maps, in the Office of the County Recorder of Said County.
WHEREAS, a public hearing was held on June 26, 2001 at which time all interested
persons were given full opportunity to be heard and to present evidence,
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
HEREBY RESOLVES AS FOLLOWS:
SECTION 1, That the factual data submitted by the Development Services
Department in the attached report dated June 26, 2001 is true and correct.
SECTION 2. This Commission finds:
1. That the granting of an extension of such Conditional Use Pennit will not be
detrimental to the public health or welfare or injurious to the property or improvements in
such zone or vicinity.
2. That the use applied for at the location indicated is properly one for which a
Conditional Use Penn it is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping,
and other features required to adjust said use with the land and uses in the neighborhood.
4. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by an extension of the proposed use.
5. That the granting of an extension of such Conditional Use Pennit will not
adversely affect the comprehensive general plan.
6. That the evaluation of the environmental impacts as set forth in the Initial Study
are appropriate and that the project will have no significant effect upon the environment
within the meaning of the Califomia Environmental Quality Act of 1970, and when

considering the project as a whole, there was no evidence before the City that the proposed
project would have any potentially adverse effect on wildlife resources or the habitat upon
which wildlife depends, and therefore, a Negative Declaration was approved.
SECTION 3. That for the foregoing reasons this Commission grants a five (5)
year extension of Conditional Use Permit No. CUP 96-003 (Resolution No. 1536) to use
modular classrooms at 1900 S. Santa Anita Avenue.
SECTION 4. The decision and findings contained in this Resolution reflect the
Planning Commission's action of June 26, 2001, by the following vote:
AYES: Commissioners Huang, Olson and Kalemkiarian
NOES: None
ABSENT: Commissioners Bruckner and Murphy
SECTION 5. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUBJECT: A five (5) year extension of Conditional Use Permit No. CUP 96-003
SUMMARY
This application is for a five (5) year extension of Conditional Use Permit No. CUP
96-003 for the use of modular classrooms at 1900 S. Santa Anita Avenue (Arcadia
Christian School). The Development Services Department is recommending
approval of a five (5) year extension.

GENERAL INFORMATION
APPLICANT: Arcadia Christian School
LOCATION: 1900 S. Santa Anita Avenue
REQUEST: A five (5) year extension of CUP 96-003 to use modular classrooms
SITE AREA 8.35 acres
FRONTAGES: S31.50 feet along S, Santa Anita Avenue
462.50 feet along S. First Avenue
EXISTING LAND USE & ZONING:
The site is developed as an elementary school and is owned by the
Arcadia Unified School District. The property is leased to the
Arcadia Christian School. The zoning is R-1.

North: Single family residential & a church - zoned R-1

GENERAL PLAN DESIGNATION: Single-family residential at a maximum density
of 6 dwelling units per acre.
BACKGROUND
The subject property was developed as a public school by the Arcadia City School
District in 1947. The property has been leased to the Arcadia Christian School for
the past 20 years.
In 1991, the City Council conditionally approved a Building Code Variance (Reso.
5598) for the Arcadia Christian School to import up to nine portable prefabricated
buildings to be installed on fixed foundations.
In 1995, the Planning Commission approved Conditional Use Pennit No. 95-009
(Reso. 1529) for the Arcadia Christian School to expand into an existing youth hut.
This was the first CUP applied to the private school use at this property.
In 1996, the Planning Commission approved Conditional Use Permit No. 96-003
(Reso. 1536) for the installation of three modular classrooms. So far, only two units
have been installed at location 'E' on the site plan. The other unit was to go in the
area occupied by two old prefabricated buildings owned by the Arcadia Unified
School District at location 'H' on the site plan. The approval of CUP 96-003 was
limited to a period of five years. The two modular classrooms that the Arcadia
Christian School installed are in compliance with all City requirements regarding
accessibility, fire protection, occupancy, safety, and site design.
PROPOSAL AND ANALYSIS
This application is for a five (5) year extension of the approval of CUP 96-003 for the
two modular units that have been installed at location 'E' on the site plan. Each
modular unit has 1,440 square feet and is divided into two classrooms for a
combined total of up to 120 students.
In the past, the use of temporary/modular classrooms has been approved in two
other cases: The Anoakia School and the Rio Hondo Preparatory School. In both
cases, there were extensions granted to provide additional time for the planning and
development of pennanent structures. The Anoakia School eventually closed. The
Rio Hondo Preparatory School completed construction of pennanent classrooms in
January 1997, 20 years after their initial approval for the use of modular classrooms
(C-76-20 /Reso. 956).

Because the Arcadia Christian School leases the property frpm the Arcadia Unified
School District, the development of permanent structures is difficult to accomplish
and may not be practical due to provisions of the lease and the inability to finance
permanent construction. Their lease has a term of five years, and is subject to
termination with 180-days notice. Nevertheless, modular classrooms should not be
allowed on a permanent basis, and a five (5) year time limit is appropriate.
CEQA
Pursuant to the provIsions of the California Environmental Quality Act, the
Development Services Department has prepared an Initial Study for the proposed
project. Said Initial Study did not disclose any substantial or potentially substantial
adverse change in any of the phYSical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance that could not be made less than significant with
mitigation incorporation. When considering the record as a whole, there is no
evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
. RECOMMENDATION
The Development Services Department recommends approval of a five (5) year
extension of Conditional Use Permit No. CUP 96-003.
PLANNING COMMISSION ACTION
Approval
The Planning Commission should move to approve the Negative Declaration
and adopt Resolution No. 1645: A Resolution of the Planning Commission of
the City of Arcadia, California, granting a five (5) year extension of Conditional
Use Permit No. CUP 96-003 (Resolution No. 1536) to use modular classrooms
at 1900 S. Santa Anita Avenue.
Denial

If the Planning Commission intends to deny this application for an extension of the
Conditional Use Permit, the Commission should move for denial and direct staff to
prepare a resolution incorporating the Commission's decision and specific findings.

that the proposed project will not have a significant effect on the environment. A brief
statement of the reasons supporting the City Planning Commission's findings is as follows:

EVALUATION OF ENVIRONMENTAL IMPACTS:
1. A brief explanation is required for all answers except "No Impact" answers that are adequately
supported by the information sources a lead agency cites In the responses following each question. A
"No Impact" answer is adequately supportad if the referenced information sources show that the
Impact simply does not apply to projects like the one Involved (e.g., the project falls outside a fault
rupture zone). A "No Impact" answer should be explained where it Is based on project-speclfic factors
as well as general standards (e.g., the project-will not expose sensitive receptors to pollutants, based
on a project-speclfic screening analysis).
2. All answers must take account of the whole action Involved, Including off.slte as well as on-site,
cumulative as well as project-level, indirect as well as direct, and construction as well as operational
impacts.
3. Once the lead agency has determined that a particular physicel Impact may occur, then the checklist
answers must Indicate whether the Impact is potentially significant, less than significant with
mitigation, or less than significant. "Potentially Significant Impact" is appropriate if there is substantial
evidence that an effect is significant. If there are one or more, "Potentially Significant Impact" entries
when the determination is made, an EIR is required.
4. "Negative Declaration: Less Than Significant With Mitigation Incorporated" applies where the
incorporetlon of mitigation measures has reduced an effect from "Potentially Significant Impact" to a
"Less Than Significant Impact." The lead agency must describe the mitigation measuras, and briefly
explain how they reduce the effect to a less than significant level (millgation measures from Section
XVIII, "Earlier Analyses: must be cross-referenced).
5. Earlier analyses may be used where, pursuant to the tiering, program EIR, or other CEQA process, an
effect has been adequately analyzed in an earlier EIR or Negative Declaration. Section
15063(c)(3)(D). In this case, a brief discussion should Identify the following:
a) Earlier Analyses Used. Identify and state where they are available for review.
b) Impacts Adequately Addressed. Identify which effects from the above checklist were within the
scope of and adequately analyzed in an earlier document pursuant to applicable legal standards,
and state whether such effects were addressed by mlligation measures based on the earlier
analysis
c) Mltigallon Measures. For effects that are "Less Than Significant With Mitigation Measures
Incorporated: describe the mitlgallon measures that were incorporated or refined from the earlier
document and the extent to which they address site.specific conditions for the project.
6. Lead agencles are encoureged to incorporate into the checklist, references to information sources for
potential Impacts (e.g., general plans, zoning ordinances). Reference to a previously prepared or
outside document should, where appropriate, include a reference to the page or pages where the
statement is substantiated.
7. Supporting Information Sources: A source list should be attached, and other sources, uses or
individuals contacted should be ciled in the discussion.
6. This is only a suggested form, and lead agencies are free to use different formats; however, lead

addition will support.a total of between 100-120 students and will employ at least
4 additional instructors.
This project will require a Conditional Use Permit due to the use of modular
buildings. This is an existing school and is a leased site from the Arcadia Unified
School District. It is not feasible for us to build pennanentstructures that we
might have to forfeit. Arcadia Unified has no plans to build additional classrooms
on this site.
The requested life of this C.U.P. is presently 5 years. At this time the site meets
all current zoning requirements for an educational facility.
The project site is that of an elementary school with associated classrooms, off
street parking, support buildings, playgrounds and ball fields. With the addition

We, the nearby residents of the Arcadia 8hristian'School, oppose the request by Mr.
Sleven Blankenship-for a five (5) year exlension or Conditional Use Permit No. CUP 96.
003 to allow the continued use of two (2) temporary/portable modular classroom
buildings. We believe that continued use oflhe lwo(2) temporary/porlable modular
classrooms has and will continue to cause intolerable disruPtions in the nearby
neighborhood surrounding the Arcadia Christian School.
Therefore, we strongly oppose Mr. Steven Blankenship's request and would like our
voices to be heard and acknowledged by the.City of Arcadia
