RESOLUTION NO. 1644
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE
PERMIT NO. CUP 01-014 FOR A BUSINESS ADMINISTRATION
AND LANGUAGE COLLEGE WHOSE OCCUPANCY SHALL NOT
EXCEED 10 STUDENTS AT ANY GIVEN TIME ON WEEKDAYS IN
2,950 SQUARE FEET OF OFFICE SPACE AT 630 W. DUARTE RD. tlllib 301, 3ot~303
WHEREAS, on April 30, 2001, an application was filed by Theresa Woo to
use 2,950 square feet of general office space for a business and language
college (Development Services Department Case No. CUP 01-014) at
630 W. Duarte Road, more particularly described in the attached Exhibit 'A'; and
WHEREAS, a public hearing was held on June 12, 2001 at which time all
interested persons were given full opportunity to be heard and to present
evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
. SECTION 1. That the factual data submitted by the Development
Services Department in the attached report dated June 12, 2001 is true and
correct.
SECTION 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one for
which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping, and other features required to adjust said use with the land and uses
in the neighborhood.
4. That the site abuts streets and highways adequate in width and
. pavement type to carry the kind of traffic generated by the proposed use.

5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive general plan.
6. That the evaluation of the environmental impacts as set forth in the
Initial Study are appropriate and that the project will have no significant effect
upon the environment within the meaning of the California Environmental Quality
Act of 1970, and when considering the project as a whole, there was no evidence
before the City that the proposed project would have any potentially adverse
effect on wildlife resources or the habitat upon which wildlife depends, and
therefore, a Negative Declaration was approved.
SECTION 3. That for the foregoing reasons this Commission grants
Conditional Use Permit No. CUP 01-014 for a business and language college at
630 W. Duarte Road, subject to the following conditions:
1. That the use approved by CUP 01-014 is limited to the educational
activities as proposed for the 2,950 square feet of office space and that student
occupancy shall not exceed 10 at anyone time on weekdays.
2. That this approval of CUP 01-014 shall not take effect until the
property owner and applicant have executed and filed the Acceptance Form
available from the Development Services Department to indicate awareness and
acceptance of the conditions of approval.
3. That noncompliance with the plans, provisions and conditions of
CUP 01-014 shall be grounds for immediate suspension or revocation of any
approvals, and any expansion of the activities and/or space approved by
CUP 01-014 must be approved through a new application.
SECTION 4. The decision, findings, and conditions of approval
contained in this Resolution reflect the Planning Commission's action of June 12,
2001, by the following vote:
AYES: Commissioners Huang, Kalemkiarian, Olson and Murphy
NOES: None
ABSENT: Commissioner Bruckner
SECTION 5. The Secretary shall certify to the adoption of this Resolution
and shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUMMARY

This Conditional Use Permit application was submitted by Theresa Woo to operate a
business administration and language pollege in 2,950 square feet of office space at
630 W. Duarte Road. The Development Services Department is recommending
approval of the application, subject to the conditions listed in this report.
GENERAL INFORMATIOIll

LOCATION: 630 W. Duarte Road, Units 301,302 & 303
REQUEST: A Conditional Use Permit to allow a business administration and
language college to occupy 3 units totaling 2,950 square feet in a
3-story office building. Occupancy will not exceed 10 students at
any given time on weekdays.
SITE AREA: 3.81 acres
FRONTAGES: Approximately 347 feet along W. Duarte Road
Approximately 343 feet along the alley at the rear of the site

EXISTING LAND USE & ZONING:
The site (Arcadia Metro Center) is developed with 4 office buildings
with a total of 72,780 gross square feet. There are 235 surface
parking spaces. The property is zoned C-21General Commercial.

GENERAL PLAN DESIGNATION: Commercial
BACKGROUND
The Arcadia Metro Center was originally developed as 4 separate buildings in the
late 1950s and early 1960s. In 1989 it was renovated and consolidated into a single
complex with shared parking. There is a total of 68,855 square feet for lease and
235 surface parking spaces. The 4 buildings and their current uses are as follows:

These buildings pre-date the current parking requirements, and there is an overall
parking deficiency of 119 spaces. However, the configuration of the property
prevents the deficiency from causing parking problems on adjacent properties. The
parking spaces towards the front of the site are the most frequently occupied, and
there are time limits on some of those spaces; however, there is abundant parking
available at the rear of the site. If there is a parking problem at the Arcadia Metro
Center, it appears that it is being addressed.
PROPOSAL AND ANALYSIS

The applicant is proposing to use 3 office units totaling 2,950 square feet on the
third floor of 630 W. Duarte Road for a business administration and language
college. English as Second Language (ESL) classes will be held from 9:00 a.m. to
4:00 p.m. on weekdays, and advanced business administration classes will be held
from 9:00 a.m. to 5:30 p.m. on Saturdays.
The space will be used for both administrative offices and classrooms. The
applicant states that their occupancy of the space will not exceed 10 students at any
given time on weekdays, and that they will not exceed the Building and Fire Code
occupancy limits on weekends.

Parkino
The applicant has not yet determined precisely how the existing 2,950 square feet of
office space will be utilized. Therefore, because the parking requirement for
educational uses is based on classroom space (1 space per 35 sq. ft. of classroom
area) the actual parking requirement for this proposal cannot be calculated.
However, the applicant's proposed occupancy limit of 10 students at any given time
on weekdays should prevent this use from increasing the parking deficiency because
the general office parking requirement for 2,950 square feet is 12 spaces. On
weekends, parking is not a problem at this complex.
Code ReQuirements
All City requirements regarding accessibility, fire protection, occupancy, safety, and
site design shall be complied with to the satisfaction of the Building Official, Fire
Marshall and Community Development Administrator.
CEQA
Pursuant to the prOVIsions of the California Environmental Quality Act, the
Development Services Department has' prepared an Initial Study for the proposed
project. Said Initial Study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance that could not be made less than significant with
mitigation incorporation. When considering the record as a whole, there is no
evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
RECOMMENDA TIQN
The Development Services Department recommends approval of Conditional Use
Permit No. CUP 01-014 subject to the following conditions:
1. That the use approved by CUP 01-014 is limited to the educational activities as
proposed for the 2,950 square feet of office space and that student occupancy
shall not exceed 10 at anyone time on weekdays.
2. That this approval of CUP 01-014 shall not take effect until the property owner
and applicant have executed and filed the Acceptance Form available from the

Approval
The Planning Commission should move to approve the Negative Declaration
and adopt Resolution No. 1644: A Resotution of the Planning Commission of
the City of Arcadia, California, granting Condltionat Use Permit No. CUP 01-014
for a business administration and tanguage college whose occupancy shall not
exceed 10 students at any given time on weekdays In 2,950 square feet of
office space at 630 W. Duarte Road.
Denial
If the Planning Commission intends to deny this Conditional Use Permit application,
the Commission should move for denial and direct staff to prepare a resolution
incorporating the Commission's decision and specific findings.

South is a senior citizen apartment complex. To the East is a medical office
complex. And, to the West is a two-story office building.

The City Building Official and Fire Marshall will review any construction plans for
tenant improvements for compliance with all applicable construction and safety
codes and will oversee construction.

EVALUATION OF ENVIRONMENTAL IMPACTS:
1. A brief explanation is required for all answers except 'No Impact' answers that are adequately
supported by the Infonnation sources a lead agency cites in the responses followlng each question. A
'No Impact' answer Is adequately supported If the referenced infonnation sources show that the
impact simply does not apply to projects like the one Involved (e.g., the project falls outside a fault
rupture zone). A 'No Impact' answer should be explained where It Is based on project-specific factors
as well as general standards (e.g., the project will not expose sensitive receptors to pollutants, based
on a project-specific screening analysis).
2. All answers must take account of the whole action Involved, Including off-site as well as on-sile,
cumulative as well as project-level, Indirect as well as direct, and construction as well as operetional
impacts.
3. Once the lead agency has detennined that a particular physical Impact may occur, then the checklist
answers must Indicate whether the impact Is potentially significant, less than significant with
mitigation, or less than significant. 'Potentially Significant Impact. Is appropriate if there Is substantial
evidence that an effect Is significant. If there are one or more, 'Potentially Significant Impact. entries
when the detennlnation Is made, an EIR Is required.
4. 'Nagative Declaration: Less Than Significant With Mitigation Incorporated' applies where the
Incorporation of mitigation measures has reduced an effect from "Potentially Significant Impact" to a
"Less Than Significant Impact." The lead agency must describa the mitigation measures, and briefly
explain how they reduce the effect to a less than significant level (mitigation measures from Section
XVIII. 'Earller Analyses," must be cross-referenced).
5. Earlier analyses may be used where, pursuant to the tiering, program EIR, or other CEQA prOcess, an
effect has been adequately analyzed In an eariler EIR or Negative Declaration. Section
15063(c)(3)(D). In this case, a brief discussion should Identify the followlng:
a) Earlier Analyses Used. Identify and state where they are available for review.
b) Impacts Adequately Addressed. Identify which effects from the above checklist were within the
scope of and adequately analyzed In an eartler document pursuant to applicable legal standards,
and state whether such effects were addressed by mitigation measures based on the earlier
analysis
c) Mitigation Measures. For effects that are "Less Than Significant With Mitigation Measures
Incorporated," describe the mitigation measures which were Incorporated or refined from the
eartler document and the extent to which they address site-specific conditions for the project.
6. Lead agencies are encouraged to incorporate into the checklist, references to infonnation sources for
potential Impacts (e.g., general plans, zoning Ordinances). Reference to a previously prepared or
outside document should, where approprtate, Include a reference to the page or pagas where the
statement is substantiated.
7. Supporting Infonnation Sources: A source Ust should be attached, and other sources, uses or
individuals contacted should be cited In the discussion.
