RESOLUTION NO. 1643
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO.
01-013 TO PROVIDE ADDITIONAL FLOOR SPACE, ANEW SWIMMING
POOL, AND ADD THE SALE AND CONSUMPTION OF BEER AND WINE
FOR A 30,090 SQ.FT. ATHLETIC CLUB FACILITY AT 56 E. DUARTE
ROAD

WHEREAS, on April 23, 2001, a conditional us.e permit application was filed
by Larry Lachner to provide 180 sq.ft. of additional floor space, a new swimming pool,
and add the sale and consumption of beer and wine for a 30,090 sq.ft. athletic club
facility (Development Services Department Case No. C.U.P. 01-013) at 56 E. Duarte
Road, more particularly described as:
Lots 13 &14 of Tract 13252 ex of st lots 9,10,11,12 in the City of Arcadia,
COWlty of Los Angeles, State of California, as recorded in the Office of the
COWlty Recorder of said COWlty.
WHEREAS, A public hearing was held on JWle 26, 2001, at which time all
interested persons were given full opportunity to be heard and to present evidence.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION I. That the factual data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2. This Commission finds:
I. That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare, or injurious to the property or improvements in such zone or
vicinity because the initial study did not disclose any substantial adverse effects to the
area affected by the proposed project.

2. That the use applied for at the location indicated is a proper one for which a
Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and
other features are adequate to adjust said use with the land and uses in the neighborhood.
The proposed project complies with all related zoning requirements as set forth in the
Arcadia Municipal Code.
4. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan because the land use and current zoning are consistent with
the General Plan.
6. That the new exterior design elements for the subject building will be in
compliance with the design criteria set forth in the City's Architectural Design Review
Regulations.
7. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there is no evidence that the
proposed project'will have any potential for an adverse effect on wildlife resources or the
habitat upon which the wildlife depends.
SECTION 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit, to provide additional floor space, a new swimming pool, and add
the sale and consumption of beer and wine for a 30,090 sq.ft. athletic club facility at 56 E.
Duarte Rd. subject to the following conditions:
1. That building code compliance and conditions of approval must be met to the
complete satisfaction of the Inspection Services Officer. All ADA requirements shall be
meet for disabled access; parking, restrooms, door hardware, and entrances.

2. All City code requirements regarding accessibility, fire protection, occupancy,
and safety shall be complied with to the satisfaction of Building Services and the Fire
Department which shall include, but are not limited to the following items:
a. A Knox-box with keys shall be installed in conformance with Uniform Fire
Code, per UFC 904.
b. An NFP A-72 Fire Alarm System shall be installed in accordance with the
Uniform Building Code and all other applicable provisions .of the Arcadia
Municipal Code (3114.1).
c. Provide occupant load signs at all locations within the occupancy. Provide
seating plan and have in posted in the manager's office for inspection.
d. Exit illumination shall comply with Sec. 1211 UFC.
e. That all exit doors shall be equipped with panic hardware as defined in the
building code. All interior doors shall open in the direction of travel.

3. The athletic club shall be maintained and operated in a manner that is consistent
with the application and plans submitted and approved for CUP 01-013.
4. That a modification be granted for 112 on-site parking spaces in lieu of 152
spaces required. This approval shall not constitute an approval for a general reduction in
parking for the total site. That this parking modification shall only be for the use
approved by CUP 01-013.
5. That CUP 01-013 shall not take effect until the owner and applicant have
executed a form available at the Planning Office indicating awareness and acceptance of
the conditions of approval.
6. All conditions of approval shall be complied with prior to the construction of the
new stairwell, entrance, pool and sale of beer and wine. Noncompliance with the plans,
provisions and conditions of CUP 01-013 shall be grounds for immediate suspension or
revocation of any approvals for the atWetic club.

7. Noncompliance with the provisions and conditions of this conditional use permit
shall constitute grounds for its immediate suspension or revocation.
SECTION 4. The Secretary shall certify to the adoption of this
Resolution and shall cause a copy to be forwarded to the City Council of the City of
Arcadia.

SUBJECT: Conditional Use Permit No. CUP 01-013 and ADR 01-016
SUMMARY
This Conditional Use Permit application was submitted by Larry Lachner to provide
additional floor space, a new swimming pool, and add the sale and consumption of
beer and wine for a 30,090 sq. ft athletic club facility at 56 E. Duarte Avenue.
Concurrent with this application the applicant is requesting design review approval for
the exterior remodel of the eXisting building.

and adoption of Resolution 1643 granting the conditional use permit subject to the
conditions in this staff report. .
GENERAL INFORMATION
APPLICANT: Larry Lachner (property owner)
LOCATION: 56 E. Duarte Avenue
REQUEST: A Conditional Use Permit and Architectural Design Review to
provide additional floor space, a new swimming pool, and add the
sale and consumption of beer and wine for a 30,090 sq.ft athletic
club facility. .
SITE AREA: 72,478 sq.ft. (1.66 acres)
FRONTAGES: 333 feet along Duarte Avenue and 136 feet along First Avenue

EXISTING LAND USE & ZONING:
The site is developed with a 30,090 sq.ft. athletic club facility with 101 on-site
parking spaces, which are dispersed around the building. Tenant
improvements consist of remodeling the existing cafe area, adding a new
entry, and adding a new pool area. The site is zoned C-2, General
Commercial.
SURROUNDING LAND USES & ZONING:
North: Multi-family residential and Commercial; zoned R-3and C-2
South: Multi-family residential; zoned PR-1, R-2 and R-3
East: Multi-family residential and Commercial; zoned R-3 and C-2
West: Multi-family residential and Commerciai; zoned R-3 and C~2
GENERAL PLAN DESIGNATION:
The site is designated as Commercial
BACKGROUND
On January 25, 1977, the Planning Commission approved CUP 77-002 to operate a
health fitness center at the sUbject location. At that tim~ a parking modification was
granted for 83 parking spaces in lieu of 100 spaces required by code.
In December 1979, the applicant built the subject facility and upgraded the on-site
parking to provide 101 spaces. The hours of operation at that time were 7 a.m. to 11
p.m. seven days a week.
PROPOSAL AND ANALYSIS
The applicant is requesting a Conditional Use Permit to expand the 'existing facility for
the purpose of building a new 180 sq.ft. staircase tower, changing the entry to the
ground floor level, adding a new swimming pool area, and to, provide the sale and
consumption of beer and wine on the premises.
PARKING
Currently, there are 101 on-site parking spaces; however, with the addition of the
pool area the applicant has redesigned portions of the parking lot to provide 112
spaces, as shown on the submitted site plan.

The applicant's proposal, if approved, will increase the total square footage of the
club to approximately 30,270 sq.ft. which requires five parking spaces per 1000 sq.ft.
of gross floor area per current parking standards. Based on this requirement, 152
spaces are required for the athletic club.
Based on staffs experience with the existing athletic club facility, it is our opinion that
a 40 space parking deficiency would not be detrimental to the site, neighboring
businesses or to the adjacent residential units to the south.
ARCHITECTURAL DESIGN REVIEW:
Concurrent with the consideration of this modification, the Planning Commission may
approve, conditionally approve or disapprove the applicant's design concept plans.
The applicant's design concept plan proposes to remodel the existing exterior of the
athletic club. Proposed changes include removing existing siding and replacing with
stucco, adding the 180 square foot staircase tower with angled windows, a new
canopy over the ground floor entrance, and removal of the existing sign, to be
relocated and replaced with a single channel letter, non-illuminated, sign on the
westerly portion of the north elevation (as shown on the submitted elevation).
Staff recommends approval of the design elements as shown on the submitted
elevations, except for the angled windows located on the staircase tower and the
angled canopy over the entrance, because such angled elements are not visually
harmonious with the surrounding development. Staff also recommends approval of
the'submitted building and sign colors.
ANALYSIS
The proposed changes to the eXisting athletic club, i.e. the interior and exterior
remodel, additional floor space, and to permit the consumption of beer and wine
within the facility, requires a Conditional Use Permit. Generally, staff does not
encourage uses, which are deficient in parking, however, based upon the applicant's
proposal, it is staffs opinion that the proposed use and improvements would be
appropriate for the site.
Staff recommends that the applicant revise the submitted building elevation to delete
the non-harmonious elements, as noted by staff.
The applicant shall be required to comply with all code requirements as determined
necessary by the Building Official, Fire Marshall, Public Works Services Director and
Community Development Administrator.

CEQA
. Pursuant to the provIsions of the California Environmental Quality Act, the
Development Services Department has prepared an initial study for the proposed
project. Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project' including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole, there is
no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.

RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit.No. CUP 01-013 subject to the following conditions:
1. The athletic club shall be maintained and operated in a manner that is consistent
with the application and plans submitted and approved for CUP 01-013.
2. That a modification be granted for 112 on-site parking spaces in lieu of 152
spaces required. This approval shall not constitute an approval for a general

angled windows and entrance canopy subject the Development Services
Manager review and approval.
6. All conditions of approval shall be comPlied with priorto the construction of the

FINDINGS AND MOTIONS
Approval
The Planning Commission should move to approve and file the Negative Declaration
and adopt Resolution No. 1643: A Resolution ofthe Planning Commission of the City
of Arcadia, Califomia, granting Conditional Use Permit No. 01-013 to operate an
athletic club.
Denial
If the Planning Commission intends to deny this Conditional Use Permit application,
the Commission should state the reasons for denial and direct staff to prepare the
appropriate resolution incorporating the Commission's decision and specific findings.

EVALUATION OF ENVIRONMENTAL IMPACTS:
1. A brief explanation is required for all answers except "No Impact" answers that are adequately
supported by the information sources a lead agency cites in the responses following each question. A
"No linpact" answer is adequately supported if the referenced information sources show that the impact
simply does not apply to projects like the one involved (e.g., the project falls outside a fault rupture
zone). A "No Impact" answer should be explained where it is based on project-specific factors as well
as general standards (e.g., the project will not 'expose sensitive receptors to pollutants, based ona
project-specific screening analysis).
2. All answers must take account of the whole action involved, including off-site as well as on-site,
cumulative as well as project-level, indirect as well as direct, and construction as well as operational
impacts.
3, Once the lead agency has determined that a particular physical impact may occur, then the checklist
