RESOLUTION 1641
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO.
01-011 TO EXPAND AN EXISTING MARTIAL ARTS INSTRUCTION
STUDIO BY INCREASING THE FLOOR AREA, CHANGING THE HOURS
OF OPERATION, AND INCREASING THE NUMBER OF STUDENTS AT
616-618 E, LIVE OAK AVENUE,
WHEREAS, on April 23, 2001, a conditional use permit application was filed
by Vincent Duchetta to expand an existing martial arts instruction studio by increasing
the floor area, changing the hours of operation, and increasing the number of studentS,
Development Services Department Case No, C,U.P, 01-011, at use at 616-618 E, Live
Oak Avenue, and more particularly described as:
Lots 3, 4, 5, & 6 of Tract 15233 in the City of Arcadia, County of Los Angeles,

State of Califomia,as recorded in the Office of the County Recorder of said
County .
WHEREAS, A public hearing was held on June 12, 2001, at which time all
interested persons were given full opportunity to be heard and to present evidence.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION I, That the factual data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2. This Commission finds:
I, That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare, or injurious to the property or improvements in such zone or
vicinity because the initial study did not disclose any substantial adverse affects to the
area affected by the proposed project.

2, That the use applied for at the location indicated is a proper use for which a
Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and
other featw:es are adequate to adjust said use with the.1and and uses in the neighborhood,
The proposed project complies with all related zoning requirements as set forth in the
Arcadia Municipal Code.
4. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use,
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan because the land use and current zoning are consistent with
the General Plan,
6. That the new exterior design elements for the subject building are in
e compliance with the design criteria set forth in the City's Architectural Design Review
Regulations,
7. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there is no evidence that the
proposed project will have any potential for an adverse effect on wildlife resources or the
habitat upon which the wildlife depends.
SECTIONJ. That for the foregoing reasons this Commission grants a
Conditional Use Permit, to expand an existing martial arts instruction studio by
increasing the floor area, changing the hours of operation, and increasing the number of
students at 616-618 E. Live Oak Avenue subject to thefollowing conditions:
I. That building code compliance and conditions of approval must be met to the
complete satisfaction of the Inspection Services Officer, All ADA requirements shall be
meet for disabled access; parking, restrooms, door hardware, and entrances,

2, All City code requirements regarding accessibility, fire protection, occupancy,
and safety shall be complied with to the satisfaction of Building Services and the Fire
Department which shall include, but are not limited to the following items:
a, A Knox-box with keys shall be installed in conformance with Uniform Fire
Code, per UFC 904.
b, An NFP A-72 Fire A1ann System shall be installed in accordance with the
Uniform Building Code and all other applicable provisions of the Arcadia
Municipal Code (3114,1).
c. Provide occupant load signs at all locations within the occupancy, Provide
seating plan and have in posted in the manager's office for inspection,
d, Exit illumination shall comply with See, 1211 UFC,
e. That all exit doors shall be equipped with panic hardware as defined in the
building code. All interior doors shall open in the direction of travel.

3, That the hours of operation shall be limited to 9 am, to 9 pm, Monday thru
Friday and lOam. to I pm, on Saturdays.
4. That the instructional area shall not exceed 1,200 sq.ft" as shown on the
submitted site plan,
5. That CUP 01-011 shall not take affect until the owner and applicant have
executed a form available at the Planning Office indicating awareness and acceptance of
the conditions of approval.
6. A modification be granted for 58 on-site parking spaces in lieu of 1 08, and that
this approval shall not constitute an approval for the general reduction in parking for the
total site. That this parking modification shall only be for the use approved by C. U ,P, 01-
o II (a martial arts instruction studio),
7. That the maximum number of students to occupy the subject studio at anyone
time shall not exceed 45 students per class.

8. Noncompliance with the provisions and conditions of this conditional use permit
shall constitute grounds for its immediate suspension or revocation.
SECTION 4. The Secretary shall certify to the adoption of this
Resolution and shall cause a copy to be forwarded to the City Council of the City of
Arcadia,

SUMMARY
This Conditional Use Permit application was submitted by Vincent-Marco Duchetta to
expand an existing martial arts instruction studio by increasing the floor area,
changing the hours of operation, and increasing the number of students, at 616-618
E. Live Oak Avenue.

The Development Services Department is recommending approval of CUP 01-011
and adoption of Resolution 1641 granting the conditional use permit subject to the
conditions in this staff report. -
GENERAL INFORMATION
APPLICANT: Vincent-Marco Duchetta (tenant)
LOCATION: 616-618 E. Live Oak Ave.
REQUEST: A Conditional Use Permit to expand an existing martial arts
instruction ,studio by increasing the floor area, changing the hours of
operation, and increasing the number of students. A parking
modification is also being requested for 58 on_site spaces in iieu of
108 spaces required.
SITE AREA: 30,730 sq.ft. (0,71 acres)

The site is developed with a commercial center with 58 on-site parking spaces.
The site is zoned C-2-General Commercial
SURROUNDING LAND USES & ZONING:
North: A church and mixed commercial; zoned C-2
South: Single-family residence; located within the LA County area
East: Vacant city-owned property; unzoned area
West: Restaurants; zoned C-2
GENERAL PLAN DESIGNATION:
The site is designated as Commercial
BACKGROUND
On April 13, 1999, the Planning Commission approved CUP 99-007 to operate a 995
sq.ft. martial arts instruction studio at 616 E. Live Oak Avenue. At that time the
business was approved for a maximum of 15 students for each session, four
sessions a day, The hours of operation were from 9 a.m. to 10 p,m., Tuesday thru
Sunday.
The original martial arts studio was purchased by the applicant who has been
operating the studio under its Conditional Use Penn it. CUP 99-007, Now the
applicant wishes to expand the business by increasing the square footage of the
school, changing the hours of operation, and increasing the number of students.
PROPOSAL AND ANALYSIS
Currently, the studio occupies a 995 sq,ft. unit within a commercial center at 616 E.
Live Oak Avenue. The business hours are from 9,a,m. to 10 p.m., Tuesday thru
Sunday. Currently there is a maximum of 15 students per instructional session.
The proposal consist of expanding into the 1,275 sq,ft. vacant unit to the west of the
existing martial arts studio for a total square footage of 2,270 sq.ft. The applicant is
also requesting to increase the maximum number of students to 45 for each class
period based on the proposed increase in additional floor space.
The proposed business hours are Monday thru Friday, 9:00 a.m. to 9:00 p,m. and
Saturdays, 10:00 a,m. to 1 :00 p.m.

PARKING
. Currently, there are fifty-eight (58) on-site parking spaces for the center. A parking
modification was originally approved for CUP 99-007 to permit 58 on-site parking in
lieu of 91 spaces required for the commercial center to include a 995 sq.ft. martial
arts studio. At that time the number of required parking spaces was based on an
existing parking deficiency of 58 spaces in lieu of 73 spaces required for the existing
businesses plus an additional 17 spaces for the studio's instructional area of 600
sq.ft, that required 1 parking space per 35 square feet of instructional area.
This proposal increases the instructional area to 1,200 sq.ft" which requires 17
additional parking spaces. With the proposed expansion of the studio, 108 on-site
parking spaces are required for the center.
The applicant's proposal, if approved. would result in a total parking space deficiency
of fifty (50) spaces, In staffs opinion the parking deficiency is not significant, because
of the availability of on-site parking, as represented in a parking survey provided by
the applicant. Additionally, the applicant informed staff that the majority of students
who participate in the classes will be minors who are dropped off and picked up by
parents. ' '
ANALYSIS
.
Uses such as a martial arts studio require a conditional, use permit, and traffic'
concerns can be addressed as part of the consideration of such applications.
Generally, staff does not encourage uses which are deficient in parking, however,
based upon the applicant's proposal and the average age of the students, it is staff's
opinion that the proposed use would be appropriate for the site. '
The applicant shall be required to comply with all code requirements as determined
necessary by the Building Official, Fire Marshall, Public Works Services Director and
Community Development Administrator.
CEQA
Pursuant to the prOVISions of the California Environmental Quality Act, the
Development Services Department has prepared an initial study for the proposed
project. Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole, there is
no evidence that the proposed project will have any potential for adverse effect on

Wildlife resources or the habitat upon which the wildlife depends. Therefore, a
e Negative Declaration has been prepared for this project.

RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit No. CUP 01-011 subject to the following conditions:
1. The martial arts studio shall be maintained and operated in a manner that is
consistent with the application and plans submitted and approved for CUP 01-
011. '
2. All City code requirements regarding accessibility, fire protection, occupancy,
and safety shall be complied with to the satisfaction of BUilding Services and the
Fire Department.
3. That the hours of operation shall be limited to 9 am. to 9 pm. Monday thru Friday
and 10 am. to 1 pm. on Saturdays.
4. That the instructional area shall not exceed 1,200 sq.ft" as shown on the
submitted site plan,
5, That the maximum n'umber of students to occupy the subject studio at. ahy one
time shall not exceed 45 students per class.
6. A modification be granted for 58 on-site parking spaces in lieu of 108, and that
this approval shall not constitute an approval for the general reduction in parking
for the total site. That this parking modification shall only be 'for the use approved
by C.U.P, 01-011 (a martial arts instruction studio).
7. Approval of CUP 01-011 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the
Development Services Department to indicate acceptance of the conditions of
approval.
8. All conditions of approval shall be complied with prior to the expansion of floor
space,. expanded hours and increase in total number of students.
Noncompliance with the plans, provisions and conditions of CUP 01-011 shall be
grounds for immediate suspension or revocation of any approvals for the
remedial tutoring center.

Denial
If the Planning Commission intends to deny this COl'lditional Use Permit application,
the Commission should state the reasons for denial and direct staff to prepare the
appropriate resolution incorporating the Commission's decision and specific findings.
