RESOLUTION NO,1640
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE
PERMIT NO, CUP 01-010 TO OPERATE A NEW AND PRE-OWNED
(USED) AUTOMOBILE SALES DEALERSHIP AND AUTOMOBILE
SERVICE CENTER AT 55 W. HUNTINGTON DRIVE.
WHEREAS, on April 9 2001, an application was filed by Rusnak/Arcadia to
operate a new and pre-owned (used) automobile sales dealership and automobile
servica canter, Development Services Department Case No. CUP 01-010, at
55 W. Huntington Drive, more particularly described in the attached Exhibit 'A'; and
WHEREAS, a pUblic hearing was held on May 22, 2001 at which time all
interested persons were given full opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report dated May 22, 2001 is true and correct.
SECTION 2. This Commission finds:
1. That the granting ofthe Conditional Use Permit will not be detrimental to
the public health or welfare, nor injurious to the property or improvements in the
zone or vicinity.
2. That the uses applied for at the location indicated are properly ones for
which a Conditional Use Permit is authorized.
3, That the site, or sites for the proposed uses are adequate in size and
shape to accommodate said uses, and all yards, spaces, walls, fences, parking,
loading, landscaping and other features required to adjust said uses with the land
and uses in the neighborhood,
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed uses.
5. That the subject property is designated for commercial use in the General
Plan, that the proposed uses are consistent with that designation, and that the
granting of the Conditional Use Permit will not adve~ely affect the comprehensive
general plan.
6. That the evaluation of the environmental impacts as set forth in the Initial
Study are appropriate and that the project will have no significant effect upon the
environment within the meaning of the California Environmental Quality Act of 1970,
and when considering the project as a whole, there was no evidence before the City
that the proposed project would have any potentially adverse effect on wildlife
resources or the habitat upon which wildlife depends, and therefore, a Negative
Declaration was approved.
SECTION 3, That for the foregoing reasons this Commission grants
Conditional Use Permit No, CUP 01-010 to operate a new and pre-owned (used)
automobile seles dealership and automobile service center at 55 W. Huntington
Drive, subject to the following conditions:
1. This approval of CUP 01-010 is for the specific uses (i.e., sales of new &
pre-owned automobiles and the operation of an automobile service center) as
indicated on the survey map and in the application materials submitted for
CUP 01-010, and the automobile sales dealership and service center shall be
operated and maintained in a manner that is consistent with this approval of
CUP 01-010.
2, The sale of any vehicle displayed and/or stored at this site, regardless of
its eventual delivery destination, is to be recorded as a retail sale in the City of
Arcadia.
3, While all exterior improvements, including painting of the buildings, signs,
on-site landscaping, and the refitting of the light standards, are subject to
architectural design review and approval, such shall include as a minimum, and be
conditioned as follows, subject to the approval of the Development Services Director
and/or the Deputy Executive Director of the Arcadia Redevelopment Agency:
a.Freestanding signs (the Code limits the site to 2 freestanding signs with a
minimum distance of 200 feet between them) shall be limited to monument type
. signs with a maximum overall height of 12 feet (i.e"including the sign area and any

decorative base and/or cap) and their colors and materials shall be consistent with
the architecture of the building. The final design and location of any freestanding
sign shall be subject to approval by the Development Services Director and/or the
Deputy Executive Director of the Arcadia Redevelopment Agency.
b. The automobile service center area shall be fully enclosed so that all
service activities are not visible from outside of the site. Any vehicles in need of
significant body repair work that are to be stored or parked on the site for any period
of time shall be stored out-of-sight. The design of the enclosure(s) and the
location(s) for storage/parking of damaged vehicles shall be subject to approval by
the Development Services Director and/or the .Deputy Executive Director of the
Arcadia Redevelopment Agency,
c. Any existing chain-link fencing and gates are to be replaced with wrought-
iron fencing and gates, or thoroughly concealed (e,g., with landscaping material)
from public view. Any existing barbed wire and/or razor wire must be removed, Any
new or replacement fencing to be installed shall be wrought iron. Compliance with
these fence conditions is subject to Architectural Design Review and the final
installations are subject to approval by the Development Services Director and/or the
Deputy Executive Director of the Arcadia Redevelopment Agency.
d. A detailed landscaping and irrigation plan shall be submitted for review
and approval by the Development Services Director and/or the Deputy Executive
Director of the Arcadia Redevelopment Agency, and shall include, at a minimum, the
following:
i. New landscaping planters with a minimum 42-inch wide planting area
shall be installed along the Huntington Drive and Morlan Place property lines in front
of the new car showroom so that all of the street frontages are landscaped. In
addition to groundcover and shrubbery, trees shall be included at a maximum
interval of 20 feet and two-thirds of them shall be 15-gallon and one-third of them
shall be 24-inch box trees.
ii. New landscaping planters with a minimum 3-foot wide planting area shall
be provided immediately in front of and along the sides of both the new and

pre-owned automobile sales buildings, and immediately behind the pre-owned
automobile sales building, In addition to groundcover, shrubbery, and vines for
screening of the wall, the landscaping for these buildings shall include 15-gallon
trees at a maximum interval of 20 feet.
iii. New 2Q-foot long landscaping planter retums with a minimum 42-inch
wide planting area shall be installed at all the driveways along Huntington Drive and
Santa Clara Street. In addition to groundcover and shrubbery, each planter retum
shall include two 24-inch box trees.
iv. All existing and new landscaping planters shall be surrounded with
continuous 6-inch high raised Portland concrete cement curbing.
v. The landscaping in the existing planters along the perimeter of the site
shall include 15-gallon trees at intervals that are consistent with the existing Crape
Myrtle trees along Santa Clara Street.
vi. The tree wells on the west side of the westerly service building are to be
planted with 15-gallon trees and vines to screen the wall.
e. Materials and colors sample boards shall be provided for all of the
buildings and the final building finishes are subject to approval by the Development
Services Director and/or the Deputy Executive Director of the Arcadia
Redevelopment Agency.
f. The light standards shall be painted to match the buildings subject to the
approval of the Development Services Director and/or the Deputy Executive Director
of the Arcadia Redevelopment Agency.
4. The entire site is to be slurry sealed and re-striped. On-site employee
and customer parking shall be provided. The striping plan, lane markings, and the
number and locations of the employee and customer parking spaces are to be
approved by the Fire Marshall and Development Services Director and/or the Deputy
Executive Director of the Arcadia Redevelopment Agency.
5. A plan and schedule for deliveries and pick-ups, either on- or off-site,
shall be provided (deliveries and pick-ups will not be allowed on Huntington Drive)

and shall be subject to approval by the Development Services Director anellor the
Deputy Executive Director of the Arcadia Redevelopment Agency.
6, The use of a public address system anellor any outdoor speakers shall be
limited to normal business hours (i.e., 7:00 a.m. to 7:00 p.m., Monday thru Saturday,
except for holidays) and shall be installed and used in accordance to a plan that
shall be subject to approval by the Development Services Director anellor the Deputy
Executive Director of the Arcadia Redevelopment Agency.
7. All conditions of approval and all life-safety items shall be complied with
prior to occupancy and operation, or any non-life safety items not completed may be
bonded for to guarantee their completion in a timely manner subject to approval by
the Development Services Director anellor the Deputy Executive Director of the
Arcadia Redevelopment Agency.
8. Noncompliance with the plans, provisions and conditions of CUP 01-010
shall be grounds for immediate suspension or revocation of any approvals.
9, Approval of CUP 01-010 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the Planning
Services to indicate awareness and acceptance of these conditions of approval.
10, Except as allowed by Code for promotional and other special events,
pennants, streamers, spinners, festoons, inflatable figures anellor other similar-types
of attention attracting displays are prohibited.
SECTION 4, The decision, findings, and conditions of approval contained in
this Resolution reflect the Planning Commission's action of May 22, 2001, by the
following vote:

SECTION 5. The Secretary shall certify to the adoption of this Resolution

SUMMARY
This Conditional Use Permit application was submitted by Rusnak/Arcadia to
operate a new and pre-owned (used) automobile sales dealership and automobile
service center at the'vacant automobile dealership at 55 W, Huntington Drive. The
Development Services Department is recommending 'approval of the application,
subject to the conditions listed in this report.
GENERAL INFORMATION

GENERAL PLAN DESIGNATION: Commercial
PROPOSAL & ANAL YS~
The applicant is proposing to operate a new and pre-owned (used) automobile sales
dealership and service center in the existing facilities, The survey map generally
indicates how the site will be used. New car sales will be at the existing showroom
building at the comer of Huntington Drive and Morlan Place, New cars will be on
display in the showroom building and in the areas in front of the building and
immediately to the west. The bulk of the new car inventory, however, will be stored
on the northern portion of the site. Pre-owned car sales will be at the sales building
near the intersection of Huntington Drive and Santa Clara Street with an outdoor
display area in front of the building.
Cars will be serviced in the two service buildings and the open area in between. The
two service buildings face each other and provide a semi-enclosed open area that is
. used for service work that does not need to be done on a hoist. This open area

should be fully enclosed so that all service activities will not be visible from outside
of the site.
These uses will require an Industrial Waste Discharge Permit, and will have to
comply with any applicable National Pollution Discharge Elimination System
(NPDES) and Standard Urban Storm Water Mitigation Plan (SUSMP) requirements.
The buildings and the site are presently being rehabilitated, which is to include slurry
sealing and re-striping of the pavement, concealment of the existing chain-link
fencing or replacement with wrought-iron fencing, and removal of any barbed wire.
The buildings will have new tenant improvements installed and the exteriors will be
repainted, The three larger buildings are required to have automatic fire sprinkler
systems.
The light standards.- have already been refitted with new lights, and a Modification
(MC 01-015) was approved by the Modification Committee for a height of 20 feet in
lieu of 15 feet fot approximately 15 of the light standards that are within 100 feet of
the residentially zoned properties that back up to Santa Clara Street. The new light
fixtures that were installed will limit their illumination along the west side of Santa
Clara Street (adjacent to the ,back yards of the residences) to a level of about 0.1
foot-candle, which is substantially less, than the City's ,illumination standard of 1.115
average foot-candles for Santa Clara Street. Therefore, the project's on-site lighting
will not have an impact on the residences that back up to Santa Clara Street. The
light standards must be painted to match the buildings,
The only new buildings that have so far been contemplated are a new or extended
service reception canopy to accommodate four lanes of cars, and an enclosure to
the north of the service area, to house a car waShing machine, This car washing
machine may require an upgrading of the water service and a larger meter. Any new
construction, as well as any significant exterior alferations of the existing buildings,
including the repainting, and any signs (all signs and sign structures have been
removed) are subject to Architectural Design Review approval by the City and
Redevelopment Agency.
Traffic and Parkina
The primary entrance to the dealership will be the driveway on Huntington Drive. A
limited amount of on-site customer parking will be provided along this driveway, but
it is anticipated that most customers will u'se on-street parking, which is available on
all three of the' streets that abut the site, At present, the curbside parking is
unrestricted except in the immediate vicinity of Rod's Grill where there is a 2-hour
limit. The survey map does not include a specific location for employee parking,' but
space should be available in the areas labeled, "Cli,ent & Pre-Service Parking".

There are 3 driveways (1 on Huntington Dr, with only westbound access, 1 on Santa
Clara St. & 1 on Morlan PI.) that could provide access for customers bringing their
cars to the service center. A reception center will be at the canopied area at the
west 'end of the larger service building. This canopy may be extended or replaced to
increase the reception lanes from 2 to 4. If a vehicle is not to be serviced
immediately, the car will be parked in the area along Santa Clara Street. Vehicles in
need of significant body repair work should be stored out-of-sight. After a car has
been serviced, it will be washed and parked in the enclosed area immediately north
of the service center.
Deliveries
The survey map does not indicate an on-site location for the delivery and pick-up of
inventory. There ate traffic concerns if deliveries and pick-ups are to occur at
curbside or in traffic lanes, Deliveries and pick-ups will not be allowed on
Huntington Drive, Also, there are noise concerns on behalf of the residences that
back up to Santa Clara Street if deliveries and pick-ups occur in that area outside of
normal business hours (Le., from 7:00 a,m, to 7:00 p,m., MonClay thru Saturday.
Normal business hours do not include Sundays and holidays), A plan and schedule
for deliveries and pick-ups, whether they are to be conducted on- or off-site, should
be provided for staff's review and approval. '
. Noise
Automobile sales and servicing should not generate excessive noise, and the uses
are subject to the City's Noise Regulations, However, the use of a public address
system by an automobile dealership, while not excessively noisy, is a particular type
of noise that is sometimes considered annoying by neighbors, Staff is especially
concerned about such annoyanCes to the occupants of the residences that back up
to Santa Clara Street, the patrons of the County Park, and the attendees at the
Church,
If a public address system is to be used at this location, it should be used and
installed with consideration for the neighbors. Therefore, the use of a public address
system and any outdoor speakers shall be limited to normal business hours (Le"
from 7:00 a.m, to 7:00 p.m., Monday thru Saturday. Normal business hours do not
include Sundays and holidays) and a plan for the installation of such should be
reviewed and approved by staff.
Another source of noise that can have undesirable effects at automobile dealerships
is the delivery and pick-up of inventory that occurs outside of normal business hours.
This concern can be addressed by having a plan and schedule for deliveries and
pick-ups subject to City approval.

. Landscaoina
The ,current rehabilitation activities include the cleaning and replanting of the
existing landscape areas, and the applicant has indicated that landscaping will be
added to provide greenery along, all of the street frontages, to enhance the
entrances to the site, and to decorate the showroom and pre-owned car sales
b!Jilding. The areas at which new lan~scaping is to be provided are shown in red on
the survey map. A d~tailed landscaping and irrigation plan shall be provided for City
review and approval, and any changes to the landscaping in the parkway areas must
be approved by the Public Works Services Department.
Code Reauirements '
All City requirements regarding disabled access and facilities, occupancies, building
safety, and site design shall be cOmplied with to the satisfaction of the Building
Official and Community Development' Administrator, and are to be determined by
having fully detailed construction and tenant improvement plans for all of the
buil~ings submitted for plan check review and approval.
Fire safety and occupancy limits shall be provided to the satisfaction of the Fire
Marshall based on the above-mentioned actual construction and tenant improvement
plans, and must include, but are not limited to the following:
.
. All buildings over 2,500 square feet in area shall have a NFPA 13 (1996 Edition)
automatic fire sprinkler system installed by'a licensed C-16 contractor with all
,sprinkler heads to be quick-responsety~, and all underground work to be done
in accordance with NFPA 24. ' '
. The automatic'fire sprinkler systems are to be monitored by a central station and
a certified copy of the central: station monitoring contract shall be presented to
the Fire Marshall prior to occupancy. '
. Knox boxes shall be provided for access to all res,tricted areas.
. Fire lanes shall be adequately marked with signs, 'striping, and curb or pavement
painting. '
.
. Permits from the Fire Marshall shall be obtained for operation of the automobile
service center, storage of flammable and combystible materials, and for the
performance of hot work,
Industrial Waste Discharge Permits from the Public Works Services Department
shall be obtained prior to occupancy and operation, of the automobile dealership
and/or service center, and the automobile dealership and service center shall

comply with the criteria and requirements of the Los Angeles Regional Water Quality
Control Board for a Standard Urban Storm Water Mitigation Plan (SUSMP) to the
satisfaction of the Public Works Services Director. '
Water services shall be provided, tested and inspected to the satisfaction of the
Public Works Services Director and include, but are not limited to, the following:
. Backflow preventers on the building fire sprinkler systems shall be as approved
by the Public Works Services Department with screening from public view subject
to approval by the Development Services DepartmenUPlanning Services.
. Water Meter Clearance Application(s) and pressure test results if necessary shall
be filed with the Public Works Services Department prior to the issuance of ahy
building permits to ensure appropriate meter sizing, and adequate water service
for domestic use and fire suppression purposes at the required pressure levels,
. There are currently 3 water meters for the site, Any removals and/or new
Installations shall be provided for by the developer In accordance with the
specifications of the Public Works Services Department, and shall be il1stalled at
locations pre-approved and marked by the Public Works Services Department.
Any deviation from the City's specifications anc\lor pre-approved locations must
. be approved prior to installation.
. No water service facility, including any laterals, meters, f1ush-outs, backflow
preventers, or fire hydrants may be located in any driveway, nor may such
facilities be closer than 3 feet to any other utility installation or from the top of "x"
of any driveway,
. The landscaping irrigation system(s) shall be installed in accordance with the
Uniform Plumbing Code and the Arcadia Municipal Code and shall include
reduced pressure backflow preventers as approved by the Public Works Services
Department.
. All pipe, valves, hydrants, meters, fittings, other water service appurtenances,
and disinfection and flushing of them shall meet the specifications 'of the Public
Works Services Department.
CEQA
.
Pursuant to the prOVISions of the California Environmental Quality Act, the
Development Services Department has prepared an Initial Study for the proposed
project. Said Initial Study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the

project including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole, there
is nO'evidence that the proposed project will have any potential for adverse effect on

Negative Declaration has been prepared for this project.
RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit Application No, CUP 01-010 subject to the following conditions:
1, This approval of CUP 01-010 is for the specific uses (Le., sales of new & pre-
owned automobiles and the operation of an automobile service center) as
indicated on the survey map and in the application materials submitted for
CUP 01-010, and the automobile sales dealership and service center shall be
operated and maintained in a manner that is consistent with this approval of
CUP 01-010.
2. The sale of any vehicle displayed and/or stored at this site, regardl.ess of its
eventual delivery destination, is to be recorded as a retail sale in the City of
Arcadia.
3. While all exterior improvements, including painting of the buildings, signs, on-
site landscaping, and the refitting' of the light standards, are subject to
architectural design review and approval, such shall include as a minimum, and
be conditioned as follows, subject to the approval of the Development Services
Director and/or the Deputy Executive Director of the Arcadia Redevelopment
Agency:
a, Freestanding signs (the Code limits the site to 2 freestanding signs with a
minimum distance of 200 feet between them) shall be limited to monument
type signs with a maximum overall height of 12 feet (Le., including the sign
area and any decorative base and/or cap) and their colors and materials
shall be consistent with the architecture of the building. The final, design
and location of any freestanding sign shall be subject to approval by the
Development Services Director and/or the Deputy Executive Director of the
Arcadia Redevelopment Agency,
b. The automobile service' center' area shall be fully enclosed so that all
service activities are not visible from outside of the site. Any vE;lhicles in
need of significant body repair work that are to be stored or parked on the
site for any period of time shall be stored out-of-sight. The design of the
enclosure(s) and the location(s) for storage/parking of damaged vehicles

shall be subject to approval by the Development Services Director and/or
the Deputy Executive Director of the Arcadia Redevelopment Agency.
c, Any existing chain-link fencing and gates are to be replaced with wrought-
iron fencing and gates, or thoroughly concealed (e.g" with landscaping
material) from public view. Any existing barbed wire and/or razor wire must
be removed. Any new or replacement fencing to be installed shall be
wrought iron. Compliance with these fence conditions is subject to
Architectural Design Review and the final installations are subject to
approval by the Development Services Director and/or the Deputy Executive
Director of the Arcadia Redevelopment Agency.
d. A detailed landscaping and irrigation plan shall be submitted for review and
approval by the Development Services Director and/or the Deputy Executive
Director of, the Arcadia Redevelopment Agency, and shall include, at a
minimum, the following: ' ,

i. New landscaping planters with a minimum 42-inch wide planting area
shall be installed along the Huntington Drive and Morlan Place property
lines in front of the new car showroom so that all of the. street frontages
are landscaped, In addition to groundcover and shrubbery, trees shall
be included at a maximum interval of 20 feet and two-thirds ~f them
shall be 15-gallon and one-third of them shall be 24-inch box trees,
ii. New landscaping planters with a minimum 3-foot wide planting area
shall be provided immediately in front of and along the sides of both the
new and pre-owned automobile sales buildings, and immediately behind
the pre-owned automobile sales building. In addition to groundcover,
shrubbery, and vines for screening of the wall, the landscaping for these
buildings shall include 15-gallon trees at a maximum interval of 20 feet.
Hi. New 20-foot long landscaping planter returns with a minimum 42-inch
wide. planting area shall be installed at all the driveways along
Huntington Drive and Santa Clara Street. In addition to groundcover
and shrubbery, each planter return shall include two 24-inch box trees.
iv. All existing and new landscaping planters shall be surrounded with
continuous 6-inch high raised Portland concrete cement curbing,
v, The landscaping in the existing planters along the perimeter of the site
shall include 15-gallon trees at intervals that are consistent with the
existing Crape Myrtle trees along Santa Clara Street.

vi. The tree wells on the west side of the westerly service building are to be
planted with 15-gallon trees and vines to screen the wall.
e. Materials and colors sample boards shall be provided for all of the buildings
and the final building finishes are subject to approval by the Development
Services Director and/or the Deputy Executive Director of the Arcadia
~edevelopment Agency.
f. The light standards shall be painted 'to match the buildings subject to the
approval of the Development Ser.vices Director and/or the Deputy Executive
Direct?r of the Arcadia Redevelopment Agency. '
4: The entire site is to be slurry sealed and re-striped. On-site employee and
customer parking shall be provided. The striping plan, lane markings, and the
number and locations of the employee and customer parking spaces are to be
approved by the Fire Marshall and Development Services Director and/or the
Deputy Executive Director of the Arcadia Redevelopment Agency.
5. A plan and schedule for deliveries and pick-ups, either on- or off-site, shall be
provided (deliveries and pick-ups will not be allowed on Huntington Drive) and
shall be subject to approval by the Development Services Director and/or the
Deputy Executive Director of,the Arcadia Redevelopment Agency.
6. The use of a public address system and/or any outdoor speakers shall be limited
to normal business hours (i.e., 7:00 a.m. to .7:00 p.m" Monday thru Saturday,
except for hOlidays) and shall be installed and used in accordance to a plan that
shall be subject to approval by the Development Services Director and/or the
Deputy Executive Director of the Areadia Redevelopment Agency.
7. All conditions of approval and all life-safety items shall be compli,ed with prior to
occupancy and operation, or any non-life safety items not completed may be
bonded for to guarantee their completion in a timely manner subject to approval
by the Development Services Director and/or the Deputy Executive Director of
the Arcadia Redevelopment Agency.
8. Noncompliance with the plans, provisions and COnditions of CUP 01-010 shall
be grounds for immediate suspension or revocation of any approvals. '
9. Approval of CUP 01-010 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the
Planning Services to indicate awareness and acceptance of these conditions of
approval.

PLANNING COMMISSION ACTION
ADDroval
The Planning Commission should move to approve the Negative Declaration
and adopt Resolution No. 1640: A Resolution of the Planning Commission of
the City of Arcadia, California, granting Conditional Use Pennit No. CUP 01..Q10
for a new and used automobile sales dealership and automobile service center
at 55 W. Huntington Drive.
The resolution is subject to approval by the City Attorney. Any substantive changes
must be presented to the Planning Commission for approval.
Denial
If the Planning Commission intends to deny this Conditional Use Permit application,
the Commission should move for denial and direct staff to prepare a resolution
incorporating the Commission's decision and specific findings.

Street. A restaurant is across the street from the southerly portion of the site and an
office building is across the street from the northerly portion. In between these
commercial uses are single--family residences that back-up to Santa Clara Street.
The north side of the site is adjacent to a parking lot for a church. The east side of
the site is bounded by Morlan Place. Across Morlan Place are a res~aurant and
self-storage/truck rental business, The south side of the site is on Huntington Drive
and across the street is the Los Angeles County Park.
