RESOLUTION NO. 1636 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CAI.lFORNIA MAKING ITS REPORT AND RECOMMENDATION ON THE ADOPTION OF THE AMENDED REDEVELOPMENT PLAN FOR THE CENTRAL REDEVELOPMENT PROJECT AND ON THE CONFORMITY OF THE AMENDED REDEVELOPMENT PLAN TO THE CITY'S GENERAL PLAN AND RECOMMEND AF'PROVAL OF THE AMENDED REDEVELOPMENT PLAN TO THE CITY COUNCIL WHEREAS, proceedings have been initiated by the City of Arcadia ("City") and the City of Arcadia Redevelopment Agency ("Agency") for adoption of Amendment No.5 to the Central Redevelopment Plan ("Plan"); and WHEREAS, in accordance with Sections 33346 of the Community Redevelopment Law, Health & Safety Code Section 33000 et seq. ("CRL"), the Plan must be submitted to the Planning Commission for its report and recommendation concerning the Plan and i::s conformity to the City of Arcadia General Plan; and WHEREAS, thl3 proposed Plan (attached hereto as Exhibit "1 ") does not change any existing planning or zoning designations, but rather provides a mechanism for encouraging development and redevelopment of properties consistent with the General Plan; and WHEREAS, Section 412 of the proposed Plan states: "All real property in the Project Area is hereby subject to the controls and requirements of this Plan, which controls and requirementB shall conform to and not be less than those provided in the City's Municipal Code and General Plan". . . . NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. The proposed Plan is in full conformity with the General Plan of the City of Arcadia. SECTION 2. The Planning Commission of the City of Arcadia hereby recommends approval of the proposed Plan by the City Council. SECTION 3. The City Council and Agency are hereby authorized to make additional minor or technical changes to the proposed Plan prior to its adoption without further Planning Commission review and/or recommendation, and such changes do not affect the findings and recommendations of the Planning Commission herein provided the changes do not significantly change the scope or purposes of the Plan or raise the potential for inconsistenciEls with the General Plan. SECTION 4. The Secretary of the Planning Commission of the City of Arcadia is hereby authori;~ed and directed to transmit a copy of this Resolution to the City Council of the City of Arcadia and to the Agency as prescribed in Section 33347 of the Health and Safety Code. DEFINITIONS Amendment Area - means the 75,", acres of territory added to the existing Central Redevelopment Proiect. Oricinal Proiect Area - means the 250 acre territory adopted as the Central Redevelopment Proiect on December 26, 1973 bv Ordinance No. 1490. Proiect Area - means the Ainendment Area and the Oricinal Proiect Area combined. ii . . . PREFACE The Redevelopment Plan ("Original Plan") for the Central Redevelopment Proiect ("Proiect") was adopted bv the City Council of the City of Arcadia on December 26. 1973 by Ordinance No. 1.490. The area included as part of the Original Plan ("Original Proiect Area") consists of approximatelv 250 acres in the downtown area of the Citv. Subsequent amendments (Amendment Nos. 1 throueh 4) may be summarized as follows: Amendment Date Adopted Brief Description Amendment No. I Mav 19. 1981 Added Planned Development (POI Land Use in the area east of Second Street. Amendment No.4 March 17. 1999 Reinstated the use of eminent domain for twelve vears with certain residential areas exemPted. The Arcadia RedeveloDment Agencv has proposed a fifth amendment to add territory located in the South Arcadia Business District (the "Amendment Area"). to make minor technical changes. and to eliminate language or requirements that are addressed in the City's General Plan or zoning regulations and to confonn to the Agency's current practic.es in the Proiect Area. As the Redeyelopment Plan is at, implementing tool of, and is in conformance with the Citv's General Plan and Zoning Ordinan.:es. the specific language in the Plan regarding permitted uses. density. and other land use controls were redundant. The deletion of this language (as outlined below) does not affect existing city land use controls in the Proiect or the Agencv's ability to redevelop the Proiect Area. Section 400 (Use!, Permitted in the Proiect Areal - Sections 402 through 406 have been edited to state tha!: permitted land uses in each land use category will be as oermitted bv the City's Genera: Plan and Zoning Ordin311ces. · Section 411 (New Construction) - SDecific requirements for setbacks. parkimr structures, parking facilities.,and off street loading have been deleted. All new construction is required to comply with the City's General Plan and Zoning Ordinances. · Section 415 (Approximate Number of Dwelliug Units) The estimated number of existing dwelling LLOits in the Proiect Area and the maximum number of dwelling units allowed for the di:'ferent residential densities has been deleted. The number of dwelling units permitted in the Proiect Area will be that allowed bv the City's General Plan and Zoning Ordinances. · Section 417 (Ooen Space. Landscaping, Light. Air and Privacv) - The language governing the amount of open space to be Drovided has been deleted. This reQuirement will be governed bv the City's General Plan and Zoning Ordinances. The requirement for landscaning ptins to automaticalIv be submitted to the Agency for review has been deleted. The Agencv may require the submittal of landscaping plans at its discretion. · Section 418 (Sign!;) The requirement for sign designs to autDmaticallv be submitted to the Agency for re~iew has been deleted. The Agencv may require the submittal of sign designs at its discretion. . . Section 424 (Desilm for Development) - The requirement for the Agency to adopt Design Review Standards has been deleted (Design Review Standards have been adoDted). · Section 426 (Review of Applications for Issuance of Permits) The specific process outlined and the requirement for a written report bv the Agency's Executive Director in this section has bel~n deleted. The new text bermits the Agency to adOPt separate procedures for Dro'~essing permits. Subsequent to the adoption ofthe 1973 Plan. the Agency adopted Use and Design Requirements and Guidelinesand a time limit on Agencv reviews. These documents establish a procedure for evaluating proposed proiects and permit applications. Said documents remain in effect and will be applicable to the Amendment Area until they are amended. deleted or replaced. . Section 900 (Neighborhood Impact Element) - This section has been deleted. The neighborhood impacts of the Fifth Amendment to the Plan have been analyzed in the Environmental Review documents and the Agency's Reoort to the City Council. . iv . . . [9 101] Introduction The Redevelopmmt Plan ("Plan") for the Central Redevelopment Project ("Project") consists ofPart I ("Iemt": aHd Part II ("~4B.fl").the text and maps ("Exhibits") included herein. This Redevelopn:,ent Plan has been prepared by the Arcadia Redevelopment. Agency ("Agency") pursuant to the Community Redevelopment Law of the State of California ("Redevelopment Law"), the California Constitution, and all applicable local laws and ordinances. The California Co=unity Redevelopment Law is located in the California Health and Safety Code Section 33000, et. seq. The Original.Proiect Area and Amendment Area are collectively referred 10 as the Proiect Area. B. [9 102] Term of Redevelopment Plan +ffisFor the Original Proiect Area. this Redevelopment Plan shall remain in effect until January 25,2014, unless this Redevelopment Plan is amended to provide a different time limit permitted under the. [9 301] ,General The Agency propoBes to eliminate and prevent the spread of blight in the Project Area by: (1) Acquisition of certain real property. 2 . . . (2) Demolition or removal ofcertain buildings and improvements. (3) Relocation assistance to displaced residential and nonresidential oc(mpants. (4) Installation, construction, orreconstruction of streets, utilities, and oth.er public improvements. (5) Di~;position of any property acquired for uses in accordance with this Plan. (6) Redevelopment ofland by private entetprise or public agencies for uses in accordance with this Plan. (7) Housing assistance to low and moderate income families as required bylaw. B. [~ 302) Property Acquisition 1. [~ 303) Acquisition of Real Propertv Except as specific,ally exempted herein, the Agency may acquire, but is not required to acquire, any real property located in the Project Area, by any means authorized by law. The Agency shall not within the Project Area acquire (1) interests in oil, gas or other mineral substances, or (2) the right to extract such substances through any opening or penetration for any purpo~;e connected therewith more than 500 feet from the surface. The Agency shall ;10t acquire real property to be retained by an owner pursuant to a participation agreement if the owner fully performs under the agreement. The Agency is authorized to acquire struc:tures without acquiring the land upon.which those structures are located. The Agency is authorized to acquire either the entire fee or any other interest in real property less than a fe.e. The Agency shall not acquire real property on which an existing building is to be continued on its present site and in its present form and use without the consent of the owner, unless (1) such building re:quiresstructural alteration, improvement, modernization or rehabilitation, or (2) the site or lot on which the building is situated requires modification in size, shape or use, or (3) it is necessary to impose upon such property any of the standards, restrictions and controls of the Plan and the owner fails or refuses to participate in the Plan by executing a participation agreement. The Agency may commence eminent domain proceedings within the Original Proiect Area for the acquisition ofproperty\vithiR tlie prejeet area from January 1, 1999 through and including December 3 I, 2010. 3 . . . The Agency mav I)ommence eminent domain proceedings within the Amendment Area for a period oftwe1ve years from the effective date of the City ordinance adopting Amendment No.5. For purposes oftbis Redevelopment Plan, the Agency will be deemed to have "commenced" eminent domain proceedings when it has adopted a resolution of necessity pursuant to Codes of Civil ProcedUre Sections 1245.210 et. seq. (or successor statutes). The properties in Ihe Original Proiect Area shown on Exhibit BE. to this Redevelopment Plan shall be exempt from the power of eminent domain fer !/lis perise!. 4 . . . 2. [~ 304] Acquisition of Personal Property Generally personal property shall not be acquired except in connection with acquisition of related rea:. orooertv. [~ 306] Tenant Participation The Agency shall extend preferences to persons who are engaged in business in the Project Area to re-enter in business within the rel!e";eleped areaProiect Area if they otherwise meet the requirements pmscribed by thethis Plan. The Agency shall also extend preferences to other tenants in the Prcject Area if they otherwise meet the requirements prescribed by wlms Plan. The Agency is authorized to permit business, residential, institutional and semi- public tenants, if they so desire, to purchase and develop real property in the Project Area. 2. [~ 307] Owner Participation The Agency is alst) authorized to permit persons who are owners of residential, business and other types c,freal property in the Project Area to be given the opportunity to participate in redevelopment by rehabilitation, by retention of improvements, or by new development by retaining all or a portion of their properties, by acquiring adjacent or other properties in the Project Area, or by selling their properties to the Agency and purchasing other properties in the Project Area. In the event an owner-participant fails or refuses to rehabilitate or newly develop his real property pursuant to this Plan and the agreement, the real property or any interest therein may be acquired by the Agency and sold or leased for rehabilitation or development in accordance with this Plan. If conflicts develop between the desires of participants for particular sites or land uses, the Agency is authorized to establish reasonable priorities and preferences among the owners and tenants. In addition to opportunities for participation by individual persons and firms, participation to the extent it is feasible shall be available for two or more persons, firms or institutions to join togethe:: in partnerships, corporations or other joint entities. Participation opportunities shall necessarily be subject to and limited by such factors as the expansion of public ,facilities; elimination and changing ofland uses; realignment of streets; the ability of owners to finance acquisition and development in accordance with the Plan; the ability of the Agency to pay for any and all costs pertinent to participation opportunities; any reduction in the total number of individual parcels in the Project Area; and development of sites for ccmmercial centers, office and/or industrial parks. 5 . . . 3. [~ 308] Rules for Participation OPportunities The Agency shall provide an opportunity to owners and tenants in the Project Area to participate in the growth and development of the Project Area, and shall promulgate rules for owner and tenant participation. 4. [~ 309] Participation Agreements Each person desiring to become a participant shall enter into a binding agreement with the Agency by which the participant agrees, to rehabilitate, develop or use the property in confonnance with tfieg1is Plan and to be subject to the provisions hereof. In such agreements, participants who retain real property shall be required to join in the recordation of such documents as are necessary to make the provisions of this Plan applicable to their properties. Whether or not a participant enters into a participation agreement with the Agency, the provisions of this Plan are applicable to all public and private property in the Project Area. D. [~310] Cooperation with Public Bodies Certain public bodies are authorized by State law to aid and cooperate, with or without consideration, in l:he planning, undertaking, construction or operation of this Project. The Agency shall seek the aid and cooperation of such public bodies and shall attempt to coordinate this Plan with the activities of such public bodies.in order to accomplish the purposes ofredevelopmer.t and the highest public good. The Agency, by law, is not authorized to acquire real property owned by public bodies without the consent of such public bodies. The Agency, however, will seek the cooperation of all public bodies which own or intend to acquire property in the Project Area The Agency shall impose IJn all public bodies the planning and design controls contained in the Plan to insure that any future development by public bodies will confonn to the requirements of this Plan. Any public body which owns or leases property in the Project Area will be afforded all the privileges of owner and tenant participation if such public body is willing to enter into a pElticipation agreement with the Agency. In order to carry out the Project with a minimum of hardship to persons displaced from their homes, the Agency shall assist individuals and families in finding housing that is decent, safe, sanitary, within their fmancial means, in reasonably convenient locations, and otherwise suitable to their needs.
