A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO.
01-006 TO OPERATE A 2,081 SQ.Fr. COMPUTER ARCADE AND
INTERNET LAB AT 651 W. DUARTE ROAD.
WHEREAS, on January 17,2001, a Conditional Use Permit application was filed
by Huang Ke to operate a 2,081 sq.ft. computer arcade and internet lab, Development
Services Department Case No. C.U.P. 01-006, at property commonly known as 651 W.
Duarte Road; and
WHEREAS,a public hearing was held on February 27 and March 27, 2001, at
which time all interested persons were given full opportunity to be heard and to present
evidence.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual 'data submitted by the Development Services
. Department in the attached report is true and correct.
SECTION 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare, or injurious to the property or improvements in such zone or
vicinity.
2. That the use applied for at the location indicated is a proper use for which a
Conditional Use Permit is authorized.
3. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed uSe.
4. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan.
5. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there is no evidence that the
proposed project will have any potential for an adverse effect on wildlife resources or the
habitat upon which the wildlife depends.

SECTION 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to operate a 2,081 sq.ft. computer arcade and internet lab, upon
the following conditions:
I. Building Code compliance and conditions of approval must be met to the
complete satisfaction of the Building Section.
2. Fire safety shall be provided to the complete satisfaction of the Fire
Department.
3. That an on-site parkingrnodification be granted for 214 parking spaces in lieu
of 368 spaces required by Code. The parking modification does not constitute an
approval of a general reduction of the parking requirement for the entire commercial
center, but only for the specific use approved by CUP 01-006.
4. The applicant shall comply with the Business Licensing and Game Machine
Regulations stipulated in Article VI of the Municipal Code which include, but are not
limited to the following:
a. Any locations where a game machine is operated shall provide personnel over
twenty-one (21) years of age to maintain supervision of each game machine
and patrons thereof.
b. Any locations where any game machine is operated shall prohibit persons
under the age of eighteen (18) years from using or-playing any game machine
between the hours of 8:00 a.ni. to 3:00 p.m., Monday through Friday and after
10:00 p.m. daily, unless accompanied by a parent or guardian. The 8:00 a.m.
through 3:00 p.m. restriction shall not apply during school holidays and
school vacation periods recognized by schools within the City of Arcadia.
5. The proposed business shall be limited to 30 computer stations, and the
operation of the computer arcade shall be between the hours of 1 :00 p.m. to I :00 a.m.
6. There shall be four employees on site during the arcade operation.
7. If there are legitimate complaints about excessive noise vibrating from the
computer arcade, the lessee shall be required to provide wall insulation.
8. If there are legitimate complaints about loitering the applicant shall be
required to have a security guard on site after 9:00 p.m.
9. Bicycle racks shall be provided and installed to the satisfaction of the
. Community Development Administrator.
10. Noncompliance with the provisions and conditions of this conditional use
permit shall constitute grounds for its immediate suspension or revocation.
SECTION 4. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy'to be forwarded to the City Council of the City of Arcadia.

SUMMARY
This Conditional Use Permit (C.U.P.) application was submitted by Huang Ke to
operate a 2,081 sq.ft. computer arcade and internet lab from 11 :00 a.m. to 1 :00 a.m.,
at 651 W. Duarte Road. Such a permit is required because the applicant's proposal
constitutes an arcade, as defined by Municipal Code Section 6115.2.

The Development Services Department is recommending approval of C.U.P. 01-006
and adoption of Resolution No. 1634 granting the requested permit subject to the
conditions in this staff report.
GENERAL INFORMATION
APPLICANT: Huang, Ke (Lessee)
LOCATION: 651 W. Duarte Road
REQUEST: A Conditional Use Permit to operate a 2,081 sq.ft. computer arcade
and internet lab at the subject location.
SITE AREA: 110,932 sq.ft. (2.55 acres)
FRONTAGES: Approximately 389 feet on Duarte Road, and 310 feet on Arcadia
Avenue.

EXISTING LAND USE & ZONING:
The site is developed with a 50,399 ! sq.f.t. commercial shopping
center with 214 on-site parking spaces. The property is zoned C-2
& r1-4 (Gei[leral Commercial with a Height Overlay for a maximum of
4 stories, riot to exceed 45 feet).

GENERAL PLAN DESIGNATION:
The site is designated as Commercial
PROPOSAL & ANALYSIS
The applicant's proposal is to operate a computer arcade and an internet iab from
11 :00 a.m. to 1 :00 a.m., 7 days a week. Patrons to the store can either play computer
video games or research the internet for work or for school purposes on a hourly fee.
The proposed business will have 30 computer stations.
. Playing games on a computer is not typically associated with an arcade; However,
the applicant's proposal is considered an arcade because Section 6115.2. of the
Arcadia Municipal Code defines an arcade as any place of business containing four
(4) or more "game machines." Such machines are defined in Section 6115.1.1. of
said code as any device for amusement, including but not limited to a pinball machine
or video game, which may be activated by a coin or any consideration paid for its
usage.
Game machines are subject to business licensing and other related regulations under
Article VI of the Municipal Code. A copy of these regulations is attached.
PARKING
The subject shopping center was built in 1959. and currently provides 214 on-site
parking spaces (175 parking spaces within the central area of the Shopping center
and 39 spaces behind the retail buildings on the northerly and easterly portion of the
site). The on-site parking does not comply with the current Code requirements, as
summarized in the following table:

The proposed computer arcade and lab will occupy a portion of a space that was
previously a martial arts studio, which recently closed. The required on-site parking
for the martial arts studio was seventy (70) spaces. The proposed computer arcade
and lab would require 59 on-site parking spaces per the Municipal code (i.e., 1 space
per 35 sq.ft. of computer gaming area). The addition of the proposal would create a
parking deficiency of 154 spaces.
. ANALYSIS
.
Based upon the applicant's proposal and background information about the site, it is
staff's opinion that the proposed computer arcade and lab will be an appropriate use
for the commercial center.
The Development Services' staff has visited the site on numerous occasions and
noted that no parking problems exist. Also, staff is not aware of any complaints
regarding parking problems for the site.
The Police Department has address concerns with the number of computer stations
and the operating hours. They believe that if the number of computer stations
exceed the number requested the business could draw customers from outside the
community, which could pose a potential problem because similar type businesses
have become a gathering place for gangs (See attached Police Dept. Comments).
The Development Services staff believes that limiting the business to thirty (30)
computer stations would mitigate the impact of the business from attracting clientele
from outside the City, thereby also minimizing the potential of the business from
advertising to customers from outside the City. If any problems arise from the
business operation the Commission could revoke the Conditional Use Permit or

amend the conditions of approval to mitigate any negative impacts to the commercial
center.
Bicycle Parking:
"

Section 9275.6.3. of the SpeCial Resulations for Game Machine Arcades requires
that adequate off-street parking be provided for bicycles as well as automobiles.
Because the proposed game machines primarily appeal to young children (under 16
years old) there will probably be a need for bicycle parking. The applicant will need
to designate an area at the front of the building to accommodate such parking. The
designated bicycle parking area will be subject to staffs review and approval to
ensure that it shall not obstruct the pedestrian path of travel or any existing parking
space.
The applicant shall be required to comply with all code requirements as determined
necessary by the Building Official, Fire Marshall, Maintenance Service Director and
Development Services Director.
CEOA
Pursuant to the provIsIons of the California Environmental Quality Act, the
Development Services Department has prepared an initial study for the proposed
project. Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole, there is
no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit No. CUP 01-006 subject to the following conditions:
1. A modification is granted for 214 on-site parking spaces in lieu of 368 spaces
.required. This approval shall not constitute an approval for a general reduction in
parking for the total site. That this parking modification shall only be for the use
approved by CUP 01-006 (computer arcade and lab).
2. All City code requirements regarding accessibility, fire protection, occupancy, and
safety shall be complied with to the satisfaction of Building Services and the Fire
Department which shall include, but not limited to the following items:
a. If only one of the proposed restrooms is to be disabledlhandicapped
accessible, then both of the restrooms must be unisex.

b. Installation of a Knox-box with keys in conformance with the Uniform Fire
Code.
c. Installation of an NFPA-72 fire alarm system in conformance with the Arcadia
Municipal Code.
3. The applicant shall comply with the Business Licensing and Game Machine
Regulations stipulated in Article VI of the Municipal Code which include, but are
not limited to the following:
a. Any locations where a game machine is operated shall provide personnel over
twenty-one (21) years of age to maintain supervision of each game machine
and patrons thereof.
b. Any locations where any game machine is operated shall prohibit persons
under the age of eighteen (18) years from using or playing any game machine
between the hours of 8:00 a.m. to 3:00 p.m., Monday thrOugh Friday and after
10:00 p.m. daily, unless accompanied by a parent or guardian. The 8:00 a.m.
through 3:00 p.m. restriction shall not apply during school holidays and school
vacation periods recognized by schools within the City of Arcadia.
4. The proposed business shall be limited to 30 computer stations.
5. The computers shall have a software program to block pomographic materials.
6. Bicycle racks shall be provided and installed to the satisfaction of the Community
Development Administrator.
7. Approval of CUP 01-006 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the
Deveiopment Services Department to indicate acceptance of the conditions of
approval.
8. All conditions of approval shall be complied with prior to completion of the tenant
improvements, and opening of the computer arcade. Noncompliance with the
plans, provisions and conditions of CUP 01-006 shall be grounds for immediate
suspension or revocation of any approvals that could result in the closing of the
computer arcade.
FINDINGS AND MOTIONS
Approval
The Planning Commission should move to approve the Negative Declaration
and adopt Resolution No. 1634: A Resolution ofthe Planning Commission of
the City of Arcadia, California, granting Conditional Use Permit No. 01.006 to
operate a computer arcade and lab at 651 W. Duarte Road.

Sir,
It is my understanding that the owners of the V-Games, the on-line computer games
business, is requesting a permit for operation. My concern with the business is the
number of computer stations and the operating hours.

I understand that the location is requesting a permit for thirty stations. I believe that if the
number of stations were to increase above this number, that the owners would be looking
to draw people from outside the City of Arcadia. I am involved with other Police
agencies in the San Gabriel Valley that have similar businesses. These businesses have
become a gathering place for Asian Gangs, and require a great deal of attention to deal
with the associated problems.
The late hours of operation also create a problem with under age teens being out without
adult supervision.

EVALUATION OF ENVIRONMENTAL IMPACTS:
.
1) A brief explanation is required for all answers except "No Impact" answers that are
adequately supported by the infonnation sources a lead agency cites in the parentheses following
each question. A "No Impact" answer is adequately suPP't!.rted if the referenced information
sources show that the impact simply does not apply to projects like the one involved (e.g. the
project falls outside a fault rupture zone). A "No Impact" answer should be explained where it is
based on project-specific factors as well as general standards (e.g. the project wil\ not expose
sensitive receptors'to pollutants, based on a project-specific screening analysis).

6-i11.5. GAME MACHINE
REGUU. TIONS,
Each entertainment permit issued for a game
machine shall be subject to the following condi-
tions:
I. The Io<:ation where each game machine is
operated shall provide sui1ident security mea-
su~ to erTec~ively regulate interior and e:tterior
loitering. parking congestion. disturbing noise
and light, loud conversations and c~minal
activities.
2. Any Io<:ations where a game machine is
operated shall provide penonnel over twenty-
one (21) year.; of age to maintain supe:-.ision of
each game machine and patrons thereof.
3. Any locations where any game machine is
operated shall prohibit persons under the age or
eighteen (18) years from using or playing any
game machine between the houn of 8:00 A.M.
and 3:00 P.M., Monday through Friday and wer
10:00 P.M. daily, unless accompanied by a parent
or guardian. The 8;00 A.M. through 3:00 P.M.
restriC'jon shall not apply during school holidays
and school vacation periods recognized by
schools within the City oi Arcadia.
4. No game machine arcade or game machine
shail be permitted in a building an entrance oi
which is within five hundred (500) feet walking
distance oi any real estate parcel boundary con-
taining any elementary school, junior high
school or senior high school. whether public or
privately operated. This Subsection 6411.5.4
shall not apply to any building in whiCh a game
machine or machines were lawfully in operation
on the effective date of Ordinance No. 1764 pro-
vided no such building shall contain nor shall a
permit be issued for more game machines than
the number lawfully in operation on the etTective
date of Ordinance No. l764 until such time such
building complies with this subsection. (Added

6411. APPLlCA TION.
Each application for a license under subsec.
tion 6220.4 shaH describe the location where
each machine is to be operated. (Amended by
Ord. 1764 adopted 2.15-83)
6411.1. DISPLAY OF LICENSEE'S

Eacr. machine shall also bear the name of the
licensee in plain view in .Ieners of not less than
one-fourth inch in height.
6411.2. (Repealed by Ord. l764 adopted

6411.3. PENALTIES.
Each and every machine described in subsec.
tion 6220.4 and operated in the City and not
licensed or not complying with other regulations
of this Article maybe sealed against further oper-
ation and held.by the City, at the owner's risk.

6411.4. GAMBLING PROHIBITED.
No person, either as principal, agent,
employ~ or otherwise, shall operate, play or
utilize. or permit any person or persons to oper-
ate, play or utilize any amusement machine,
game or device described in subsection 6220.4
fonhe purpose of gambling, betting. wagering or
pledging in any manner whatsoever any money,
thing or consideration of value or the equivalent
or memorandum thereof. upon the outcome,
score or ~ult of the playing or operation of said
amusement machine, game or device.

Dear Commissioner David Olson:
As concerned parents, business owners and long-time citizens of the City of Arcadia, we
would like to bring to your attention a new business coming to our neighborhood. IUs an
"arcade" called "V-Games" backed by Digit Century.
V -Games by Digit Century is a computer arcade with 40+ existing computer stations and
plans for 30 more. Its sole function is video gaming with no other business intentions.
They are owned and operated by non-Arcadian residents and seeks to attract older
teen-agers from other cities.
With this many computer stations, V-Games will require more customers than Arcadia
can provide. Thus, this arcade will be forced to rely on business attracted from outside
Arcadia city limits. Examples of such a large-scale arcade can be seen in cities like
Alhambra, San Gabriel, KoreaTown etc. where gang violence is evident.
Through high education standards and traditional intervention, Arcadia has been
fortunate to avoid the gang problems that plague our neighboring cities thus far. Families
move to Arcadia for its high standard of living, and safe neighborhoods. However the
advertising and business model that V -Games has proposed will change all of that. They
have already commenced mass advertising throughout the San Gabriel Valley through
magazines and flyers. With this kind of promotion, we fear that our Police force will be
burdened with regulating outer-city teens while parents will be obliged .to worry about the
element that their children are being exposed to.
Digit Century has applied for a Conditional Use Permit, and a hearing is set for Tuesday,
February 27111, to operate a large-scale arcade in the City of Arcadia. We urge you to be aware
of the potential impact this Applicant may have on our fair city if this C. U.P. is approved.
