A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO.
01-003 TO CONSTRUCT A 6,042 SQ.FT. CHURCH AND SUNDAY SCHOOL
AT 614-622 S. FIRST AVENUE.

WHEREAS, on December II, 2000, a Conditional Use Permit application was
filed by Jonathan Barner to construct a 6,042 sq.ft. church and Sunday school,
~
Development Services Department Case No. C.U.P. 01-003, at property commonly
known as 614-622 S. First Avenue; and
WHEREAS, a public hearing was held on January 23, 2001, at which time all
interested persons were given fuIl opportunity to be heard and to present evidence.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2. This Commission finds:
1. That the granting of such Conditional Use Permit wiIl not be detrimental to
the public health or welfare, or injurious to the property or improvements in such zone or
vicinity.
2. That the use applied for at the location indicated is a proper use for which a
Conditional Use Permit is authorized.
3. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use.
4. That the granting of such Conditional Use Permit wiJI not adversely affect the
comprehensive General Plan.
5. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there is no evidence that the
proposed project will have any potential for an adverse effect on wildlife resources or the
habitat upon which the wildlife depends.

SECTION 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to construct a 6,042 sq.ft church and Sunday school, upon the
following conditions:
1. Building Code compliance and conditions of approval must be met to the
complete satisfaction of the Building Section.
2. Fire safety shall be provided to the complete satisfaction of the Fire
Department.
3. Church activities shall be limited between the hours of9:00 a.m. to 9:00 p.m.
4. No kitchen facilities shall be permitted.
5. The church shall not have gatherings for events such as banquets, funerals,
and weddings.
6. A landscape and irrigation plan shall be submitted to the Community
Development Administrator for review and approval prior to any installation.
7, Noncompliance with the provisions and conditions of this conditional use
permit shall constitute grounds for its immediate suspension or revocation.
SECTION 4. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUMMARY
This Conditional Use Permit (C.U.P.) application was submitted by Jonathan Barnes
to construct a 6,042 sq.ft. church and Sunday school located at 614-622 S. First
Avenue. The Development Services Department is recommending approval of the
applicant's proposal, and the adoption of Resolution No. 1631 granting the requested
conditional use permit subject to the conditions In this staff report.
\_ GENERAL INFORMATION

EXISTING LAND USE & ZONING:
The site is currently developed with a three unit apartment complex and a two-
story office building; zoned C-2.

GENERAL PLAN DESIGNATION:
The site is designated as Mixed Use.
PROPOSAL
The applicant's proposal involves the removal of a three-unit apartment complex and
a two-story office building to construct a one-story 6,042 sq.ft. church facility. The
architectural design of the church is considered "contemporary" with varying high
pitch vaulted roofs with a combination of concrete blOck, stucco, aluminum, and wood
trims. The overall height of the building will be approximately 38'-0" above the
existing grade. The church will provide a 100-seat auditorium, children's Sunday
school, and offices for church staff. The church does not have an area for a social
hall or a kitchen facility.
The church building fronts both First Avenue and Genoa Street, with the parking lot
located to the north and east ofthe building. Parking adjacent to the multiple-family
is buffered by a 5'-0" wide landscape planter. The northerly parking area is adjacent
to a 20'-0" wide alley. Seven (7) parking spaces will utilize the alley for back out.
Access to the parking area will be from a driveway on Genoa Street and from the
alley on FirstAitenue.

The church will, have a service on Sunday from 10:00 a.m. to 11 :00 a.m. in
conjunction with the children's Sunday school. A second service is proposed on
Wednesday night from 7:30 p.m. to 8:30 p.m. Two to three staff members will be
available during the weekdays from 9:00 a.m. to 5:00 p.m. Monday through Friday,
and from 11 :00 a.m. to 2:00 p.m. on Saturday for church administration and visitation
with church members.
According to the applicant the primary function of their church is to provide service to
their members and not for gathering events, such as banquets, funerals or weddings.
Parking:
The Municipal code requires 1 parking space for each 5 fixed seats for a church use.
The proposal has 100 fixed seats, requiring 20 parking spaces. The proposed church
will provide 33 on-site parking spaces, The proposed use exceeds the required
number of on-site parking spaces required per the Municipal Code.

ANALYSIS
. It is staffs opinion that the proposed church is an appropriate use for this property
, and is compatible with the surrounding developments. Retail shops and offices are
located north and west of the subject property. East of the site are multiple-family
dwellings and south of the site is the Presbyterian Church.
The proposed church is located in an area where similar projects have been
developed. No significant traffic or noise impacts have been associated with similar
uses. The Development Services Staff believes that .the, church would be an
improvement to the existing site and would service their members who live in the
community.
Architectural Design Review:
Concurrent with the consideration of this CUP application, the Planning Commission
may approve, conditionally approve or disapprove the applicant's design concept
plans for the proposed facility.

The Planning Services staff believes that the applicant's proposal meets the intent of
the d~sign criteria set forth in the City's Architectural Design Review Regulations.
The design elements for the building will provide the necessary visual breakup of flat
wall areas. Also, the architectural design of the building and the exterior materials
would be visually harmonious with the surrounding commercial development.
The applicant shall be required to comply with all code requirements as determined
necessary by the Building Official, Fire Marshall, Maintenance Service Director and
Community Development Administrator.
CEQA
Pursuant to the prOVIsions of the California Environmental Quality Act, the
Development Services Department has prepared an initial study for the proposed
project. Said initial study did not disclose any substantial or potentially substantial .
adverse change in any of the physical ,conditions within the area affected by the
project including land, air, weiter, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole, there is
no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.

RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit No. CUP 01-003 subject to the following conditions:
1. All City code requirements regarding accessibility, fire protection, occupancy, and
safety shall be complied with to the satisfaction of Building Services and the Fire
Department which shall include, but not limited to the following items:
a. If only one of the proposed restrooms is to be disabled/handicapped
accessible, then both of the restrooms must be unisex.
b. Installation of a Knox-box with keys in conformance with the Uniform Fire
Code.
c. Installation of an NFPA-72 fire alarm system in conformance with the Arcadia
Municipal Code.
Church activities shall be limited between the hours of 9:00 a.m. to 9:00 p.m.

No kitchen facilities shall be permitted.
The church shall not have gatherings for events such as banquets, funerals, and
weddings.
A landscape and irrigation plan shall be submitted to the Community
Development Administrator for review and approval prior to any installation.
Approval of CUP 01-003 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the
Development Services Department to indicate acceptance of the conditions of
approval. .
All conditions of approval shall be complied with prior to completion of the tenant
improvements, and opening of the mixed-use crematory. Noncompliance with the
plans, provisions and conditions of CUP 01-003 shall be grounds for immediate
suspension or revocation of any approvals that could result in the closing of the
crematory.
FINDINGS AND MOTIONS
Approval
The Planning Commission should move to approve the Negative Declaration
and adopt Resolution No. 1631: A Resolution of the Planning Commission of
the City of Arcadia, California, granting Conditional Use Permit No. 01-003 to
construct and operate a Church at 614-622 S. First Avenue.

Denial
. If the Planning Commission intends to deny this Conditional Use Permit application,
the Commission should move for denial and direct staff to prepare a resolution which
incorporates the Commission's decision and specific findings.

that the proposed project will not have a significant effect on the environment based on the
consistency of the proposed project with the City's General Plan and Zoning Ordinance and

On the basis of this initial evaluation:
I find that the proposed project COULD NOT have a significant effect on the environment. and a
NEGATIVE DECLARATION will be prepared.
I find that although the proposed project could have a significant effect on the environment, there will
not be a significant effect in this case because revisions in the project have been made by or agreed to
by the project proponent. A MITIGATED NEGATIVE DECLARATION will be prepared.
I find that the proposed project MAY have a significant effect on the environment, and an
ENVIRONMENT /'J... IMP ACT REPORT is required.
I find that the proposed project MAY have a "potentially significant or "potentially significant unless
mitigated" impact on the environment, but at least one effect 1) has been adequately analyzed in an
earlier document pursuant to applicable legal standards, and 2) has been addressed by mitigation
measures based on the earlier analysis as described on attached sheets. An ENVIRONMENTAL
IMPACT REPORT is requited, but it must analyze only the effects that remain to be addressed.
I find thatalthouglt the, proposed project could have a significant effect on the environment, because
all potentially significant effects (a) have been analyzed adequately in an earlier EIR or NEGATIVE
DECLARATION pursuant to applicable standards, and (b) have been avoided or mitigated pursuant
to that earlier EIR or NEGATIVE DECLARATION, including revisions or mitigation measures that
are imposed upon the proposed project, nothing further is required.

EVALUATION OF ENVIRONMENTAL IMPACTS:
.
I) A brief explanation is required for all answers except "No Impact" answers that are
adequately supported by the information sources a lead agency cites in the parentheses following
each question. A "No Impact" answer is adequately supported if the referenced information
sources show that the impact simply does not apply to projects like the one involved (e.g. the
