RESOLUTION NO. 1629
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCi\DIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO.
01-001 TO OPERATE A 2,300 SQ.FT. COMPUTER CONSULTING
BUSINESS WITH COMPUTER VIDEO GAMES AT 1023 S. BALDWIN
AVENUE.
WHEREAS, on November 20, 2000, a Conditional Use Permit application was
filed by Margaret Wong to operate a 2,300 sq.ft. computer consulting and retail business
with computer video games, Development Services Department Case No. C.U.P. 01-001,
at property commonly known as 1023 S. Baldwin Avenue; and
WHEREAS, a public hearing was held on January 9, 2001, at which time all
interested persons were given full opportunity to be heard and to present evidence.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOL YES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Development Services
Department in the attached report is true and correct.
SECTION 2. This Commission finds:
I. That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare, or injurious to the property or improvements in such zone or
vicinity.
2. That the use applied fc;>r at the location indicated is a proper use for which a
Conditional Use Permit is authorized.
3. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use.
4. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan.
5. That the use applied for will not have a substantial adverse impact on the
environment, and that based upon the record as a whole there is no evidence that the
proposed project will have any potential for an adverse effect on wildlife resources or the
habitat upon which the wildlife depends.

SECTION 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to operate a 2,300 sq.ft. computer consulting and retail business
with computer video games, upon the following conditions:
1. Building Code compliance and conditions of approval must be met to the
complete satisfaction of the Building Section.
2. Fire safety shall be provided to the complete satisfaction of the Fire
Department.
3. That an on-site parking modification be granted for 58 parking spaces in lieu
of 151 spaces required by Code. The parking modification does not constitute an
approval of a general reduction of the parking requirement for the entire commercial
center, but only for the specific use approved by CUP 01-001.
4. The applicant shall comply with the Business Licensing and Game Machine
Regulations stipulated in Article VI of the Municipal Code which include, but are not
limited to the following:
a. Any locations where a game machine is operated shall provide personnel over
twenty-one (21) years of age to maintain supervision of each game machine
and patrons thereof.
b. Any locations where any game machine is operated shall prohibit persons
under the age of eighteen (18) years from using or playing any game machine
between the hours of8:00 a.m. to 3:00 p.m., Monday through Friday and after
10:00 p.m. daily, unless accompanied by a parent or guardian. The 8:00 a.m.
through 3 :00 p.m. restriction shall not apply during school holidays and
school vacation periods recognized by schools within the City of Arcadia.
5. The proposed business shall be limited to 20 computer stations, and the
operation of the computer arcade shall be limited to the hours of5:00 p.m. to 1 :00 a.m.
6. Bicycle racks shall be provided and installed to the satisfaction of the
Community Development Administrator.
7. Noncompliance with the provisions and conditions of this conditional use
permit shall constitute grounds for its immediate suspension or revocation.
SECTION 4. The Secretary shall certifY to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUMMARY
This Conditional Use Permit (C.U.P.) application was submitted by Margaret Wong to
operate a 2,3QO sq.tt. cornputer consulting and retail business with cornputer video
games being available for use from 5:00 p.m. to 1 :00 a.m., at 1023 S. Baldwin
Avenue. Such a permit is required because the applicant's proposal constitutes an
arcade, as defined by Municipal Code Section 6115.2.

The Development Services Department is recommending approval of C.U.P. 01-001
and adoption of Resolution .#1629 granting the requested permit subject to the
conditions in this staff report.
GENERAL INFORMATION

GENERAL PLAN DESIGNATION:
The site is designated as Commercial.
PROPOSAL & ANALYSIS
The applicant's proposal is to operate a computer consulting business with computer
video games available from 5:00 p.m. to 1 :00 a.m., 7 days a week. The proposed
business will have 20 computer stations and a waiting area to accommodate patrons
If the computer stations are occupied. During the day the business will be a
computer store, where patrons can purchase computer components and research
information through high-speed cornputer networks that are typically not available on
a home computer. The business operation at night will include an arcade. Playing
games on a computer is not typically associated with an arcade; Howev.er, the
applicant's proposal is considered an arcade because Section 6115.2. of the Arcadia
Municipal Code defines an arcade as any place of business containing four (4) or
more "game machines." Such machines are defined in Section 6115.1.1. of said
code as any device for amusement, including but not limited to a pinball machine or
video game, which may be activated by a coin or any consideration paid for its
usage.
Game machines are subject to business licensing and other related regulations under
Article VI of the Municipal Code. A copy of these regulations is attached.
Parking:
The site currently has 58 on-site parking spaces, which is a substandard amount in
comparison to our current standards, as summarized in the following chart:

Currently the site has a parking space deficiency of 83 spaces. If this application is
approved the deficiency would be 93 spaces. It is staff's opinion, based upon the
applicant's proposal and several random site inspections by staff that the proposed
use should not create any potential parking or traffic Impacts upon the site. The
computer arcade will be open when the majority of the other businesses are closed,
and when there is ample on-site parking. The applicant has also obtained signatures
from all the tenants in the commercial center consenting to the proposed use.
Bicycle Parking:
Section 9275.6.3. of the Special Regulations for Game Machine Arcades requires
that adequate off-street parking be provided for bicycles as well as automobiles.
Because the proposed game machines primarily appeal to young children (under 16
years old) there will probably be a need for bicycle parking. The applicant will need
to designate an area at the front of the building to accommodate bicycle parking.
The designated bicycle parking area shall not obstruct the pedestrian path of travel or
any existing parking space.
The applicant shall be required to comply with all code requirements as determined
necessary by the Building Official, Fire Marshall, Maintenance Service Director and
Development Services Director.
CEQA
Pursuant to the prOVISions of the California Environmental Quality Act, the
Development Services Department has prepared an initial study for the proposed
project. Said Initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water. minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When conSidering the record as a whole, there Is
no evidence that the proposed project will have any potential for adverse effect on

wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
RECOMMENDATION
The Development Services Department recommends approval of Conditional Use
Permit No. CUP 01-001 subject to the following conditions:
1. That an on"site parking modification be granted for 58 parking spaces in lieu of
151 spaces required by Code. This parking modification does not constitute an
approval ofa general reduction of the parking requirement for the entire shopping
center, but only for the specific use approved by CUP 01-001.
2. All City cod~ requirements regarding accessibility, fire protection, occupancy, and
safety shall be complied with to the satisfaction of Building Services and the Fire
Department which shall include, but not limited to the following items:
a. If only one of the proposed restrooms is to be disabled/handicapped
accessible, then both of the restrooms must be unisex.
b. Installation of a Knox-box with keys in conformance with the Uniform Fire
Code.
c. Installation of an NFPA-72 fire alarm system in conformance with the Arcadia
Municipal Code.
3. The applicant shall comply with the Business Licensing and Game Machine
Regulations stipulated In Article VI of the Municipal Code which include, but are
not limited to the following:
a. Any locations where a game machine is operated shall provide personnel over
twenty-one (21) years of age to maintain supervision of each game machine
and patrons thereof.
b. Any locations where any game machine is operated shall prohibit persons

between the hours of 8:00 a.m. to 3:00 p.m., Monday through Friday and after

vacation periods recognized by schools within the City of Arcadia.
4. The proposed business shall be limited to 20 computer stations, and the operation
of the computer arcade shall be limited to the hours of 5:00 p.m. to 1 :00 a.m.
5. Bicycle racks shall be provided and installed to the satisfaction of the Community
Development Administrator.
6. Approval of CUP 01-001 shall not take effect until the property owner and
applicant have executed and filed the Acceptance Form available from the
Development Services Department to indicate acceptance of the conditions of
approval.

7. All conditions of approval shall be complied with prior to completion of the tenant
improvements, and opening of the computer arcade. Noncompliance with the
plans, provisions and conditions of CUP 01-001 shall be grounds for immediate
suspension or revocation of any approvals that ,could result in the closing of the
computer arcade.
FINDINGS AND MOTIONS
Approval
The Planning Commission should move to approve the Negative Declaration
and adopt Resolution No. 1629: A Resolution of the Planning Commission of
the City of Arcadia, California, granting Conditional Use Permit No. 01-001 to
operate a comp~ter' consulting business with computer video games at 1023 S.
Baldwin Avenue. '
Denial
If the Planning Commission intends to deny this Conditional Use Permit application,
the Commission should move for denial and direct staff to prepare a resolution which
incorporates th~ Commission's decision and specific findings.

EVALUATION OF ENVIRONMENTAL IMPACTS:
.
I) A brief explanation is required for all answers except "No Impact" answers that ar,e
adequately supported \)y the information sources a lead agency cites in the parentheses following
each question. A "No Impact" answer is adequately supported if the referenced information
sources show that the impact simply does not apply to projects like the one involved (e.g. the
project falls outside a fault rupture zone ). A "No Impact" answer should be explained where it is
based on project-specific factorS as well as general standards (e.g. the project will not expose
sensitive receptors to pollutants, based on a project-specific screening analysis).
2) All answers must take account of the whole action involved, including off-site as well as on-

The proposal is consistent with the commercial
designation in the General Plan and with the C-2
zoning ofthe site, and is required to comply with the

The proposed computer consulting hnsiness and
arcade and its operation will'be snbject to local air
quality regulations as administered by the South Coast
Air Quality Management District which should
prevent any impacts relative to items (a) andlor (b)
above. There are no exterior Improvements proposed
that would result in alterations to air movement,

REGULATIONS.
Each entertainment permit issued for a game
machine shall be subject to the following condi.

1. The location where each game machine is
operated shall provide sufficient security mea-

loitering, parking congestion. disturbing noise
'and light, loud conversations and criminal
activities.
2. Any locations 'where a game machine is
operated shall provide personnel over twenty.
one (2!) years of age to maintain supe:-vision of
each game machine and patrons thereof.
3. Any locations where any game machine is
operated shall prohibit persons under the age of
eighteen (18) years from using or playing any
game machine between the hours of 8:00 A.M.
and 3:00 P.M., Mondav through Fridayandii'rer
10:00 P.M. daily, unless accompanied by a parent
or guardian. The 8:00 A.M. through 3:00 P.M.
restriction shall not apply during school holidays
and school vacation periods recognized by
SChools within the City of Arcadia.

which is within five hundred (500) feet walking
