RESOLUTION l53l A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMlTNO. 95-011 FORA HEALTH CLUB AT 1201 SOUTH BALDWIN A VENUE. WHEREAS, on October II, 1995, a Conditional Use Permit application was filed by Todd Von Sprecken to operate a proposed 25,000 sq. ft., L.A. Fitness health club, Development Services Department Case No. C.U.P. 95-011, at property commonly known as ) 20) South Baldwin A venue, more particularly described as follows: Lots 13 and 14 of Tract No. 6925, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 74, Page 79 of Maps, in the office of said County Recorder. WHEREAS, A public hearing was held on November l4, 1995, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF . ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION I. That the factual data submitted by the Development Services Department in the attached report is true and correct. SECTION 2. This Commission.finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. . . . . 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the new exterior design elements for the subject building are in compliance with the design criteria set forth in the City's Architectural Design Review Regulations. 7. That the use applied for will not have a substantial adverse impact on the environment, and that based upon the record as a whole there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. SECTION 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for the operation of a 25,000 sq.ft., L.A. Fitness health club at 1201 South Baldwin A venue upon the following conditions: I. That the health club and the site shall be maintained and operated in a manner that is consistent with the plans and application materials submitted for C.U.P. 95-011. 2. That the following modifications be granted for the proposed uSe: A. 77l on-site parking spaces in lieu of 1,766 required by Code. This parking modification does not constitute an approval of a general reduction of the parking requirement for the entire shopping center, but only for the specific use approved by C.U.P. 95-0ll (Le., a health club). B. 444 sq.ft. of multiple tenant signs on the southerly exterior wall in lieu of 404 sq.ft. permitted by Code. 3. All applicable code requirements regarding building occupancy, exiting, fire protection, disabled access, safety features, etc., shall be complied with to the satisfaction of Building Services and the Fire Department. 4. That the minimwn planting size for each potted tree be 36" box, and that the tree type, and the design of the planting containers be subject to the review and approval of the Development Services Department. 5. C.U.P. 95-011 shall not take effect until the property owner and applicant have executed and filed the Acceptance Form that is available from the Development Services Department to indicate awareness and acceptance of the conditions of approval. 2 1531 . . . 6. Noncompliance with the provisions and conditions of this conditional use permit shall constitute grounds for its immediate suspension or revocation. SECTION 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of November 14, 1995, and the following vote: A YES: Commissioners Bell, Huang, Kalemkiarian, Murphy, Sleeter, Daggett NOES: None ABSTAIN: Commissioner Kovacic SECTION 5. The subject of this staff report is a request for a conditional use pennit to operate a proposed 25,000 sq.ft., L.A. Fitness health club at 1201 South Baldwin Avenue. The hours of operation would be from 5:00 a.m. to II :00 p.m., Monday thru Friday, and 8:00 a.m. to 8:00 p.m., Saturday and Sunday. The Development Services Department is recommending approval of the requested conditional use pennit subject to the conditions that are outlined in this staff report. GENERAl. INFORMATION APPLICANT: L.A. Fitness, Inc. (contact person: Todd Von Sprecken) LOCATION: 1201 South Baldwin Avenue REQUEST: A conditional use pennit to operate a proposed 25,000 sq.ft., L.A. Fitness health club with related parking and signage modifications, and architectural design review. LOT AREA: 391,720 sq.ft. (8.99 acres) FRONTAGE: 660.00 feet along Baldwin Avenue 680.00 feet along Duarte Road . 535.00 feet along Naomi Avenue . EXISTING LAND USE & ZONING, . . The site is developed with the Burlington Coat Factory, Ross Dress For Less, a two-level parking structure and various retail shops; zoned C-2 and C-2 & H4 (along Baldwin Avenue). GENERAL PLAN DESIGNATION: The site is designated as Commercial. PROPOSAL The applicant is seeking a required conditional use permit to operate a proposed L.A. Fitness health club, as shown on the submitted floor plan (copy attached). The new business would occupy a second floor retail space of approximately 25,000 sq.ft., which is directly above the Burlington Coat Factory store and within a 276,905 sq.ft. shopping center, as shown on "Parcell" of the submitted site plan (copy attached). Business hours would be from 5:00 a,m. to 11 :00 p.m., Mondaythru Friday, and 8:00 a.m. to 8:00 p.m., Saturday and Sunday. PARKTNG Health clubs require 1 parking space for each 35 sq. ft. of gross floor area that is within a workout and/or a non-permanent seating area Within the proposed health club facility there are various workout and non-permanent seating areas that total approximately 14, 300 sq.ft., which amounts to a parking requirement of 409 on-site spaces for such a facility. However, the existing on-site parking ratio of 2.784 spaces per 1,000 sq.ft. of gross retail floor area results in a net parking space requirement of 339 spaces for the proposed health club. On-site parking consists of 771 spaces (420 spaces are within the two-story parking structure with 195 spaces on the lower level and 225 spaces on the upper level). This existing amount of on-site parking does not comply 'with the current Code requirement of 1,427 spaces for the pre-existing shopping center (Le., 5 spaces per 1,000 sq.ft. of gross retail floor area for a total of 1,385 spaces, plus 16 spaces for the Starbuck's Coffee shop seating -- C.U.P. 93-001 and 26 spaces for the McDonald's restaurant -- C.U.P. 95-001). With the addition of the L.A. Fitness health club the total number of on-site spaces required for the shopping center would be 1,766. The attached "Parking Survey" was submitted by the property owner, which indicates that the shopping center has a peak parking demand of 483 spaces (count occurred at 2:30 p.m., on October 7, 1995). In addition, staff has noted that during several recent on-site vehicle counts the maximum number of occupied parking spaces within the parking structure has been 141 spaces with a maximum count of 25 vehicles on the second level. C.U.1'.95-011 November 14, 1995 Page 2 . The applicant has stated in his application (copy attached) that their peak business hours would be from 6:00 a.m. to 8:00 a.m. and 4:00 p.m. to 8:00 p.m., Monday thru Thursday, and that there would be approximately 250 to 300 people within the proposed facility at anyone time. The parking survey indicates that during the applicant's noted peak business hours there would be ample on-site parking for the proposed health club i.e., the parking counts show 2 to 42 occupied spaces from 6:00a.m. to 8:00 a.m., and from 4:00 p.m. to 8:00 p.m., 169 to 448 occupied spaces. Also, there is a recorded reciprocal easement agreement with the neighboring Yon's Pavilion shopping center to utilize the parking areas in common. The Yon's site provides 425 parking spaces (see the attached site plan). EXTERIOR AL TERA TIONS Minor alterations to the exterior of the subject building will consist of the following improvements: . I. A new parapet extension will be added directly above a proposed 5' -0" deep metal entry canopy to enhance the main entrance to the health club, as shown on the submitted west elevation. Also, illwninated metal trellises (architecturlil embellishments) will be mounted to the westerly exterior wall surface to further enhance the entrance. 2. New window areas will be provided, as shown on the submitted north elevations; and, 3. New "LA Fitness" wall signs will be installed on all of the exterior walls, as shown on the.submitted exterior elevations. The proposed 75 sq. ft. southerly wall sign requires a modification to permit 444 sq.ft. of multiple tenant signs in lieu of 408 sq.ft. permitted by Code. Currently, the existing wall signs exceed the Code requirement by approximately l7 sq.ft., which was granted by Modification Application No. 94-033. Concurrent with the consideration of the requested conditional use permit the applicant is also requesting architectural design review approval, which incorporates the above mentioned improvements. LANDSCAPING . The applicant is also proposing four (4) potted trees to further enhance the main entrance, as shown on the submitted west elevation. Staff is recommending that the minimum planting size for each tree be 36" box, and that the tree type, and the design of the planting containers be subject to the review and approval of the Development Services Department C.U.P. 95-0t I November 14, 1995 Page 3 . . . ANAL YSIS Uses such as health clubs require conditional use pennits, and traffic concerns can be addressed as part of the consideration of such applications. Generally staff does not encourage uses which are deficient in parking; however, based upon the applicant's proposal and the various parking surveys, it is staff opinion that the proposed use would be an appropriate addition to the shopping center. Also, staff believes that the applicant's proposal meets the intent of the design criteria set forth in the City's Architectural Design Review Regulations. The new design elements of the subject building (i.e., the parapet extension directly above the proposed 5'-0" deep metal entry canopy, the illuminated metal trellises (architectural embellishments), and the added windows and signage) would be visually harmonious with the surrounding commercial developments (see the attached building elevations). CEQA Pursuant to the provisions of the California Environmental Quality Act, the Development Services Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RE~OMMENDATlON I. That the health club and the site shall be maintained and operated in a manner that is consistent with the plans and application materials submitted for C.U.P. 95-011. 2. That the following modifications be granted for the proposed use: A. 771 on-site parking spaces in lieu of 1,766 required by Code. Noncompliance with the provisions and conditions of this conditional use pel'l11it shall constitute grounds for its immediate suspension or revocation. FINDINGS AND MOTIONS Approval . If the Planning Commission intends to approve this conditional use permit application, the Commission should move to approve and file the Negative Declaration, and find that the new design elements of the subject building are in compliance with the ADR criteria, and direct staff to prepare a resolution which incorporates the Commission's decision, specific findings and conditions of approval as set forth in the staff report, or as modified by the Commission. Denial If the Planning Commission intends to deny this conditional use permit application, the Commission should move for denial and direct staff to prepare a resolution which incorporates the Commission's decision and specific findings.
