RESOLUTION 1527 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO. 95-007 FOR AN AUTOMOBILE REPAIR SHOP AT 119 W. LIVE OAK AVENUE. WHEREAS, on August 21, 1995, a Conditional Use Permit application was filed by Eddy Widjaja for an automobile repair shop in !l 1,925 sq. ft. commercial building, Development Services Department Case No. CUP 95- 007, at property commonly known as II9 W. Live Oak Avenue, more particularly described as follows: Land described in doc. 0003274, in the City of Arcadia, County of Los Angeles, State of California, Santa Anita Colony, portion of lot 68. WHEREAS, a public hearing was held on September 26,1995, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely . . . , affect the comprehensive General Plan. SECTION 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for an automobile repair shop in a 1,925 square foot commercial building at 119 W. Live Oak Avenue upon the following conditions: 1. All changes to the existing water system shall be provided to the satisfaction of the Arcadia Water Division. 2. Provide a Knox Box per UFC 10.302. All fire protection shallbe provided to the satisfaction of the Arcadia Fire Department. 3. Conditions as outlined by the Building Section shall be complied with to the satisfaction of the Inspection Services Manager. 4. All work and vehicle inspections shall be conducted inside the building. 5. The following. businesses shall be specifically prohibited: auto painting spray booths, auto body work, auto dismantling, towing services, auto sales, auto leasing and vehicle storage. 6. Outdoor storage of automobile parts, wares, merchandise, crates, bottles and similar items be prohibited. 7. That CUP 95-007 shall not take effect until the owner and applicant have executed an acceptance form, available at the Development Services Department, indicating awareness and acceptance of ~he conditions of approval. 8. Noncompliance with Conditional Use Permit shall the provisions and constitute grounds conditions of this for its immediate suspension or revocation. SECTION 4. This Conditional Use Permit application was filed by Eddy Widjaja for a proposed automotive repair shop at II9 W. Live Oak Avenue. The Development Services Department is recommending approval of the requested Conditional Use Permit subject to the conditions outlined in .this staff report. GENERAL INFORMATION APPLICANT: Eddy Widjaja LOCATION: II9 W. Live Oak Avenue REQUEST: A conditional use permit to operate an automotive repair shop. LOT AREA: Approximately 15,839 square feet (0.34 acre) FRONTAGE: 101.24 feet along Live Oak Avenue and 100 feet along Las Tunas EXISTING LAND USE & ZONING: The site is developed with a 7,806 sq. ft. industrial building and a parking lot with 16 spaces; zoned CoM. GENERAL PLAN DESIGNATION:. The subject site is designated as Commercial. . . . . SURROUNDING LAND USES & ZONING: North: South: East: West: Mixed commercial; zoned C-2 & CoO. Mixed commercial; zoned CoM. Mixed commercial; zoned C-2 & CoM. Mixed commercial and light industrial; zoned CoM & M-1. PROPOSAL AND ANALYSIS The applicant is requesting a conditional use permit to operate an automotive repair shop, as shown on the submitted floor plan. This business will occupy approximately 1,925 sq. ft. of the existing 7,806 sq. ft. building. Business hours would be from 8:00 a.m. to 6:00 p.m., Monday thru Friday and 7:30 a.m. to 4:30 p.m. on Saturday. Uses such as automotive repair establishments require conditional use permits, including evaluation of the existing parking spaces situation. The existing 7,805 sq. ft. building is currently divided into two spaces, 5,881 sq. ft. is occupied by a pasta manufacturing plant and the remaining 1,925 sq. ft. is vacant. Based on the number of required parking spaces of 2 spaces per 1,000 sq. ft. of gross floor area, the proposed automotive repair shop requires 4 spaces. The existing pasta manufacturing use requires 6 spaces. A total of 16 on-site spaces are provided which satisfies the current parking requirement. Currently, the pasta manufacturing use employs four people and the proposed auto repair shop will employ two people. Staff has randomly surveyed the site and has determined that an average of 4 spaces are used on a regular basis by the pasta manufacturing plant. With the addition of the proposed auto repair shop, two additional spaces will be used by employees. A total of 10 spaces will be available for normal business operations. According to the applicant, a total of four cars will be on the site during any given day. The interior of the shop is laid out to accommodate the storage and repair of four cars. It is the owners' intent to only repair a total of four cars at one time. A concern of the Community Development staff is parking and storage of customers' vehicles in the designated on-site parking spaces. The applicants are proposing to park customers' cars inside the building at all times. This restriction would limit the size of the business and number of vehicles that could be worked on. All work will be required to be done inside the building. It is the Community Development staff's opinion that the business should not include auto body painting or auto body work. These activities require vehicles to be stored on the premises for longer periods of time, which could increase the necessity to use on- site parking spaces for employees and patrons. A garage that does auto body painting or auto body work should have a separate parking lot used exclusively for the storage CUP 95-007 September 26, 1995 Page 2 '\ \ I ! - . . of vehicles. The subject site is not large enough to accommodate painting or body work. Staff has no objection to general automotive repair on the site. CEOA Pursuant to the provisions of the California Environmental Quality Act, the Planning Office has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, three is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATIONS The Development Services Department recommends approval of Conditional Use Permit 95-007 subject to the following conditions: 1. All changes to the existing water system shall be provided to the satisfaction of the Arcadia Water Division. 2. Provide a Knox Box per UF.C. 10.302. All fire protection shall be provided to the satisfaction of the Arcadia Fire Department. 3. Conditions as outlined in the attached staff report from the Building Section shall be complied with to the satisfaction of the Inspection Services Manager. 4. All work shall be conducted inside the building. 5. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration, find that the project will not have a significant effect on the environment, and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission. Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. Note: Because there will not be an October 10, 1995 Planning Commission meeting, resolutions of approval and denial have been prepared for adoption so that there will not be an inordinate delay in the processing of this application. A brief explanation is required for all answers except "No Impact" answers that are adequately supported by the informationsources a lead agency cites in the parentheses following each question.
