HomeMy WebLinkAbout1526 . . . RESOLUTION 1526 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO. 95-006 FOR A RESTAURANT AT 855 S. BALDWIN AVENUE. WHEREAS, on August 7, 1995, a Conditional Use Permit application was filed by Sergio Gonzalez for a restaurant in a 4,700 sq.ft. restaurant building, Development Services Department Case No. CUP 95-006, at property commonly known as 855 S. Baldwin A venue, more particularly described in Exhibit "A". WHEREAS, a public hearing was held on September 12, 1995, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. . . . \ SECTION 3. That for the foregoing reasons this Commission grants a (:onditional Use Permit for a restaurant ina 4,700 square foot restaurant building at 855 S. Baldwin Avenue upon the following conditions: 1. The daily hours of operation shall be limited to 11:00 a.m. to 2:00 a.m. Monday thru Sunday. 2. That building code compliance shall be provided to the stisfaction of the Building Section. Upon submittal of new plans showing any required revisions, the restaurant must be maintained per plans on file in the Development Services Department. 3. That fire safety shall be provided to the satisfaction of the Arcadia Fire Department. 4. That any changes in exisiting domestic or fire protection water sevice (installation of new, abandonment of existing, reloction, removal, etc.) will be made by Arcadia Water Division at develper's expense. 5. That all conditions from the Engineering Division shall be complied with to the satisfaction of the City Engineer. 6. That CUP 95-006 shall not take effect until the owner and applicant have executed an acceptance form, available at the Development Services Department, indicating awareness and acceptance of the conditions of approval. 7. Noncompliance with Conditional Use Permit shall suspension or revocation. SECTION 4. Butler, Community Development Administrator By: John Halminski, Assistant Planner SUBJECT: Conditional Use Permit No. CUP 95-006 855 S. Baldwin Avenue SUMMARY . This Conditional Use Permit application was filed by Sergio Gonzalez for a proposed restaurant with a seating capacity of 160 persons at 855 S. Baldwin Avenue. The Development Services Department is recommending approval of the requested Conditional Use Permit and of the proposed architectural design, subject to the conditions outlined in this staff report. GENERAL INFORMATION APPLICANT: Sergio Gonzalez for DD's Cafe LOCATION: 855 S. Baldwin Avenue (Previously Sizzler Restaurant) REQUEST: A conditional use permit to operate a proposed restaurant. Concurrent with the consideration of the requested conditional use permit, the applicant is also requesting approval of the proposed design concept plans. LOT AREA: Approximately 39,480 square feet (0.90 acre) FRONTAGE: 141.22 feet along Baldwin Avenue EXISTING LAND USE & ZONING: . The site is developed with a vacant 4,700 sq. ft. restaurant building that was previously occupied by a Sizzler restaurant, and a parking lot with 63 spaces; zoned C-2. . . . GENERAL PLAN DESIGNATION: The subject site is designated as Commercial. SURROUNDING LAND USES & ZONING: North: Mixed commercial and a legal non-conforming residential use; zoned C-2. Mixed commercial; zoned C-2. Mixed commercial across Baldwin Avenue; zoned C-2. Multiple family residential; zoned R-3. South: East: West: PROPOSAL The applicant is seeking a conditional use permit to operate a DD's Cafe restaurant with seating for 160 persons, as shown on the submitted floor plan. This business necessitates the remodel of the site's existing restaurant facility of approximately 4,700 square feet, which was previously vacated by "Sizzler", and an addition of approximately 1,500 sq. ft., as shown on the submitted site plan. Business hours would be from 11:00 a.m. to 2:00 a.m., Monday thru Sunday. Exterior alterations would consist of adding brick veneer and stucco to the exterior walls, new awnings, new windows, 1,500 sq. ft. addition of office space and storage to the rear of the building, and three new wall signs, as shown on the submitted elevations. ANALYSIS Uses such as eating establishments and restaurants require conditional use permits, and an evaluation of the proposed and existing parking spaces provided, in order to consider such applications. Based on the number of required parking spaces of 10 spaces per 1,000 sq. ft. of gross floor area, the proposed restaurant requires 62.6 spaces. A total of 63 on-site spaces are provided which satisfies the current parking requirement. Architectural Design Review: Concurrent with the consideration of this conditional use permit, the Planning Commission may approve, conditionally approve or disapprove the applicant's design concept plans for the proposed restaurant. Staff believes that the applicant's proposal meets the intent of the design criteria set forth in the City's Architectural Design Review Regulations. The design elements of the subject building (ie., window awnings, brick veneer, stucco, windows and window CUP 95-006 September 12, 1995 Page 2 . treatments, etc.) will provide the necessary visual break up of flat wall areas. Also, the architectural design of the structure and the exterior materials would be visually harmonious with the surrounding developments (see the attached building elevations). Attached for your consideration are the proposed plans. CEOA Pursuant to the provisions of the California Environmental Quality Act, the Planning Office has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, three is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATIONS The Development Services Department recommends approval of Conditional Use . Permit 95-006 subject to the following conditions: 1. Conditions as outlined in the attached report from the Engineering shall be complied with to the satisfaction of the City Engineer. 2. All changes to the existing water system shall be provided to the satisfaction of the Arcadia Water Division. 3. Install auto fire sprinklers and a fire alarm system per Arcadia Municipal Code Amendment 2015. All fire protection shall be provided to the satisfaction of the Arcadia Fire Department. 4. Conditions as outlined in the attached staff report from the Building Section shall be complied with to the satisfaction of the Inspection Services Manager. 6. That CUP 95-006 shall not take effect until the owner and applicant have executed a form available at the Planning Section office, indicating awareness and acceptance of the conditions of approval. . FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration, find that the project will not have a significant effect on the environment, find that the design concept plans are in compliance with the ADR criteria, and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission. Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. Unless a real hardship is involved, there should be provided a path of travel from the sidewalk for disabled access. By applying for an unreasonable hardship a waiver to use the driveway may be approved providing all the slope requirements per regulations are met (as the site exist.s this is not achievable). 2. All toilets are required to comply with the requirements for disabled access regulations. Technically, there should be one toilet for each sex for the employees, however employees can also use the facilities provided for the customers, in this case the one employee toilet and the office toilet are required to be UNISEX. 3, Water closet compartments are required to have doors which are self closing equipped with a loop or U shaped. handle with a flip-over style or sliding latch. Strike edge clearance on doors are required to be a minimum of 18 inches. Strike edge clearance on the toilet room doors is also required to be 18 inches. 4. The single stall toilet room is not allowed to have the toilet room door swinging into the room and encroach on the 60 inch diameter clearance requirement. 5. A minimum of three handicapped parking stalls are required and should be arranged in such a manner that no person in a wheelchair shall pass behind other stalls. 6. In the. past separate ductwork has been required for smoking and non-smoking areas. California law may now require separate HV AC equipment but in any case it may be good engineering practice to provide separate systems. Mostahkami, Assistant Engineering SUBJECT: ADR 95-008, Proposed Restaurant (DD's Bistro) 855 South Baldwin Avenue In response to your memorandum, the items which this Division has' concern or special knowledge of are listed below: 1. The existing parkway width is thir.teen and one half feet (13Y..') on west side of Baldwin Avenue at: the subject property. 2. Traffic volume may be increased, but there will be no major impact. 3. Th~ subject property is served by a sewer line that has the capacity to transport sewage flows generated in accordance with land use reflected in the City'S current general plan with Los Angeles County's Sanitation District. . The following conditions of approval are recommended: 1. All existing and proposed driveway aprons, parkway trees, pull boxes, meters, street lights, sidewalks, fire hydrant, newsstand, drainage box and gravity drainage system (drainage area, high point, direction of flow, etc.) shall be shown on the site plan. 2. Gravity drainage inlet and parkway drains at the proposed driveway apron shall be constructed to conform to Arcadia City Standard Drawing No. S-ll. 3. Proposed new driveway apron shall be constructed according to Arcadia City Standard Drawing No. S-11. The location of the new driveway apron shall not conflict with existing parkway drainage box and mature parkway trees. No driveway shall be constructed closer than three (3) feet from any curb return, fire hydrant, ornamental light standard, telephone or electrical pole, meter box, underground vault or manhole or tree. 4.. Close the existing driveway not to be used and reconstruct curb, gutter and sidewalk per Arcadia City Standards S-ll,5-17 and to match existing. . -1- . . . 5. NO portions of existing gutter and A.C. pavement shall be removed unless prior approval is obtained from Development Services Director. 6. Remove and replace deficient or damaged curb, gutter, sidewalk and/or pavement to the satisfaction of the Development Services Director. Contact Engineering Division for exact locations of removal and replacement. 7. Existing parkway trees in good condition shall remain. Any tree removal/replacement is subject to the approval of the Maintenance Services Direc'tor. 8. Arrange with Edison Company to install a new 22,000 lumen HPSV Edison owned (LS-2) street light. Light standard and head to match existing. Exact location to be determined by the City. Contractor shall obtain a lighting standard drawing S-25 from the City'S Engineering Division. Contact Engineering Division 24 hours prior to construction of the street light base. 9. Obtain permit for all work performed in the public right-of- way. The Engineering Inspector shall be contacted at (818) 574-5490 at least 24 hours prior to construction of off-site improvements. All improvements shall be completed to the satisfaction of Development Services Department prior to final acceptance by Building Division and prior to occupancy. 10. All survey monuments, centerline ties and survey reference points shall be protected in place or re-established where disturbed. This work will be the responsibility of the . permittee and shall be at the permittee's expense. 11. Contractor shall comply with all requirements of Federal, State, and local laws and regulations pertaining to the CLEAN AIR AND CLEAN WATER ACT and National Pollutant Discharge Elimination System (NPDES) Best Management Practices (BMPs). 12. All construction in the public right-of-way shall be in accordance with all applicable sections and/or provisions of the latest edition of the "Standard specification for Public Works Construction" (Greenbook). 13. All off-site improvement plan checking, inspection charges, and other miscellaneous costs associated with the proposed development shall be reimbursed to the City. The above items are to be complied with to the satisfaction of the Development Services Director in accordance with the applicable provisions of the Arcadia Municipal Code.
