RESOLUTION 1523
A RESOLUTION OF THE PLANNING COMMISSION OF THE OTY
OF ARCADIA, CALIFORNIA, GRANTING ZONE VARIANCE NO,
V 95-001, FOR CELLULAR PHONE ANTENNAS TO EXCEED THE
MAXIMUM HEIGHT OF 10'-0" ABOVE THE ROOF OF AN EIGHT-
STORY OFFICE BUILDING AT 150 N, SANTA ANITA AVENUE,
WHEREAS, on February 9, 1995 an application was filed by AirTouch Cellular
for a Zone Variance for cellular antennas to exceed the maximum height of 10'-0"
above the roof of an eight-story office building, Planning Division Case No, V 95-
001, on property commonly known as 150 N, Santa Anita Ave" more particularly
described as follows:
Parcel Map No, 2415, as per Book 34, Page 64 of maps, in the City of Arcadia,
County of Los Angeles
WHEREAS, a public hearing was held on March 28, 1995, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Division in the
attached report is true and correct.
Section 2, This Commission finds:
1, That the granting of such Zone Variance will not be detrimental to the
public health or welfare, or injurious to the property or improvements in such zone
or vicinity,
2, That the use applied for at the location indicated is a proper use for which
a Zone Variance is authorized,
3, That the site for the proposed use is adequate in size and shape to
accommodate said use,
4, That the granting of such Zone Variance will not adversely affect the
comprehensive General Plan,
5, That the use applied for will not have a substantial adverse impact on the
environment.

Section 3, That for the foregoing reasons this Commission grants a Zone
Variance for the height of the proposed cellular antennas, upon the following
conditions:
1. That fire safety shall be provided to the satisfaction of the Arcadia Fire
Department.
2, That building code compliance shall be provided to the satisfaction of the
Building Division,
3, That V 95-001 shall not take effect until the owner and applicant have
executed an acceptance form, available at the Planning Division, indicating awareness
and acceptance of the conditions of approval
8, Noncompliance with the provisions and conditions of this Zone Variance
shall constitute grounds for its immediate suspension or revocation,
Section 4, The decision, findings and conditions contained in this Resolution
reflect the Commission's action of March 28, 1995 and the following vote:
AYES: Bell, Clark, Huang, Kalemkiarian, Kovacic, Murphy, Daggett
NOES: None
ABSENT: None

Section 5, The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia,
I HEREBY CERTIFY that the foregoing Resolution was adopted ata regular
meeting of the Planning Commission held on the 28th day of March, 1995 by
the following vote:
A YES: Bell, Clark, Huang, Kalemkiarian, Kovacic, Murphy, Daggett

SUMMARY
This Zone Variance application was filed by AirTouch Cellular for the installation
of new cellular antennas which will exceed the maximum height requirements for
roof mounted accessory structural items in the C-2 zone, The Community
Development Division is recommending approval subject to the conditions
outlined in this staff report,

GENERAL PLAN DESIGNATION
General Commercial Zone
PROPOSAL
The applicant is requesting a zone variance to install (9) new directional cellular
antennas, (3) omni whip antennas, (2) microwave antennas, (1) loran antenna and
(1) GPS antenna, The proposed antennas are for a new "digital" cellular
transmission service,
The proposed antennas will be mounted to the four exterior walls of the
mechanical equipment screen on the Arcadia Towne Center roof, At present, there
are already (12) directional antennas and (1) microwave antenna mounted in the
same location as the proposed (as shown on the north and east elevation plan and
roof plan),
As per the Municipal Code requirements for C-2 zone properties; towers, chimneys,
mechanical equipment and other roof structures shall not exceed .a height of ten (10)
feet above the roof of any building, The existing and proposed antennas will be
approximately 17'-0" to 20'-0" in height above the roof of the subject building,
TECHNICAL INFORMATION
The existing cellular antennas, signal transmission and reception devices provide
"analog" transmission service and have been in place since August 1991. The new
antennas will increase performance, reception and sound clarity by incorporating a
digital transmission scheme called CDMA (Code Division Multiple Access),
The proposed digital antennas will perform different functions within the
transmission network, as listed below:
1. Directional antennas or "direct panel" antennas direct signals to move to
specific locations,
2. Omni Whip antennas or "width" antennas direct signals to all locations,
3, Microwave antennas are used to connect the site back to the central switching
office,
4, GPS and Loran antennas are used for timing purposes, They synchronize all
the different digital equipment together,

The Mobile Test Unit (as described on the attached plan) is nothing more than a
cellular phone set up within AirTouch's equipment room on the fifth floor,
This unit will allow the company to test hardware at the site without sending out a
technician when things go wrong.
ZONE VARIANCE FINDINGS
Before a zone variance may be granted, the following findings must be shown (the
applicant's responses are in italics),
a, That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved, or to the intended use of the property
that do not apply generally to the property or class of use in the same zone or
vicinity,
.
"The special circumstances applicable to the subject site include its
geographical location, elevation and the established land use pattern, The
location has been a cellular facility since 8-30-91, The proposed antennas will
exceed the current height limitations due to the fact that they cannot transmit
or receive if they are below the parapet wall. The granting of the request is
necessary for the preservation and enjoyment of a substantial property right
possessed by the other properties in the same zone, as well as less permissive
zones. II
b, The granting of such a variance will not be materially detrimental to the
public health or welfare or injurious to the property or improvements in
such zone or vicinity in which the property is located,
"The granting of this variance will not be materially detrimental to the public
welfare or injurious to the property or improvements in the same zone and
vicinity, The facility has been in place for four years without apparent
detriment, The present request anticipates no negative aspects associated
with the operation and maintenance of the facility."
c, That such variance is necessary for the preservation and enjoyment of a
substantial property right of the applicant possessed by other property in the
same zone and vicinity.

enjoyment of a substantial property right and use generally possessed by
other property owners in the same zone or vicinity, The special height
requested is not a unique one. Other communication devices also require
and have beel! granted similar height variances to permit their specialized
use and presence,"

d. That the granting of such variance will not adversely affect the comprehensive
General Plan,
"The master plan does not specifically address future communication
devices, The Arcadia District Plan designates the site for Commercial use,"
ANALYSIS
One might assume that an "antenna" refers to a long mast climbing into the air
with horizontal beams extending outward, In this case, however, the existing and
proposed antennas are one to three feet in diameter and project slightly away from
the surface of the wall,
Visually, the existing directional and microwave antennas cannot be seen from
street level. The proposed antennas will be similar in size and shape and will net
the same effect,
Staff does not foresee any significant negative or detrimental impact as a result of
the proposed cellular antenna installation,
CEOA
PUl'suant to the prOViSions of the California Environmental Quality Act, the
Community Development Division has prepared an initial study for the proposed
project, Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and objects
of historical or aesthetic significance, When considering the record as a whole, there
is no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends, Therefore, a
Negative Declaration has been prepared for this project,
RECOMMENDATION
The Planning Division recommends approval of V 95-001 subject to the following
conditions:
1. No antennas OJ: wires shall interfere with or obstruct any fire protection
equipment, any exits or exit pathways or Fire Department access, as defined
and stated in the attached memo,
2, Building Code compliance and safety must be met to the complete satisfaction
of the Building Division.

3, That V 95-001 shall not take effect until the owner and applicant have
executed a Community Development Division Acceptance Form, available at
the Planning Division, indicating awareness and acceptance of the
condition(s) of approval.
4, Noncompliance with the provisions and conditions of this Zone Variance
shall constitute grounds for the immediate suspension or revocation
of said permit.
REOUIRED FINDINGS AND MOTIONS
The Planning Commission should examine the information and make findings
relevant to the prerequisite conditions as stated in Section 9291.1.2, of the Arcadia
Municipal Code which reads as follows:
A. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved, or to the intended use of the property, that
do not apply generally to the property or class of use in the same zone or vicinity,
B, The granting of such a variance will not be materially detrimental to the
public health or welfare or injurious to the property or improvements in
such zone or vicinity in which the property is located,
C. That such variance is necessary for the preservation and enjoyment of a
substantial property right of the applicant possessed by other property in the
same zone or vicinity,
D, That the granting of such variance will not adversely affect the comprehensive
General Plan,
Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find
that the project will not have a significant effect on the environment and direct staff
to prepare the appropriate resolution incorporating the specific findings and
conditions of approval set forth in the staff report (or as modified by the
Commission),
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate

resolution incorporating the Commission's decision and findings in support of that
decision,
Note: Resolutions of approval and denial have been drafted for adoption so that the
applicant may avoid any inordinate delay in the processing of this application,
