HomeMy WebLinkAbout1521 . . . RESOLUTION 1521 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO. 95-002 FOR AN ART SCHOOL AT 23 W. LAS TUNAS DRIVE. WHEREAS, on December 19, 1994, a Conditional Use Permit application was filed by Owen Chen for an art school in a 1200 sq.ft. retail space, Development Services Department Case No. CUP 95-002, at property commonly known as 23 W. Las Tunas Drive which is part of a retail center at 23 W. Las Tunas Drive, more particularly described in Exhibit "A". WHEREAS, a public hearing was held on January 24, 1995, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the attached report is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Amendment will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Amendment is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed .use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. . . . SECTION 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for an art school in a 1200 square foot retail space at 23 W. Las Tunas Drive upon the following conditions: 1. The daily hours of operation shall be limited to 9:00 a.m. to 9:00 p.m. Monday thru Fr.iday, and 9;00 a.m. to 6:00 p.m. Saturday and Sunday. 2. That building code compliance shall be provided to the stisfaction of the Building Division. Upon submittal of new plans showing any required revisions, the art school must be maintained per plans on file in the Development Services Department. 3. That fire safety shall be provided to the satisfaction of the Arcadia Fire Department. 4. That any changes in exisiting domestic or fire protection water sevice (installation of new, abandonment of existing, reloction, removal, etc.) will be made by Arcadia Water Division at develper's expense. 5. That a Modification be granted for 287 on-site parking spaces in lieu of 373, and that this approval shall not constitute an approval for the general reduction in parking for the total site. That this parking modification shall only be for the use approved by CUP 95-002 (an art school). 6. That CUP 95-002 shall not take effect until the owner and applicant have executed an acceptance form, available at the Development Services Department, indicating awareness and acceptance of the conditions of approval. 7. Noncompliance with Conditional Use Permit shall the provisions and constitute grounds conditions of this for its immediate suspension or revocation. SECTION 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of January 24, 1995, and the following vote: AYES: NOES: ABSENT; Commissioners Bell, Clark, Huang, Kalemkiarian, Kovacic, Murphy, Daggett None None -2- 1521 . Las Tunas Dr. The Development Services Department is recommending approval of Conditional Use Permit No. CUP 95-002 subject to the conditions in this report. Approximately 215,000 square feet (4.94 acres) 526.96 feet along W. Las Tunas Drive 241.83 feet along S. Santa Anita Avenue EXISTING LAND USE & ZONING: A 58,200 sq. ft, multi-tenant shopping center with 287 on-site parking spaces and a rear loading area. The proposed operating hours are 9:00 a.m. to 9:00 p.m. Monday through Friday, and . 9:00 a.m. to 6:00 p.m. Saturday and Sunday. CUP 95-002 January 24, 1995 Page 2 . Automobile 'ParKing The applicant has indicated that the majority of the students are under 18 years of age and will more than likely be dropped off adjacent to the building by their guardians. In addition, a number of the students will be commuting on. foot and bicycles. There are a total of four employees, who would be able to park in and ar6-und the center without creating a detrimental affect on the parking situation. There are a total of 287 on-site parking spaces. The shopping center was originally approved with 293 spaces, but it appears that several spaces were lost when handicap spaces were included, and a few spaces were eliminated from the northwest area of the parking lot to provide an additional exit for the Thrifty Drugstore and to improve truck access. . Art schools require one parking space per 35 sq.ft., of the classroom's gross floor area. Based upon this requirement, and that 816 sq.ft., of the proposed school will be used for the purpose of conducting art classes, the proposed art school requires 24 parking spaces. However, the existing on-site parking ratio of 4.93 spaces per 1,000 sq. ft., of gross retail floor area results in a net parking space requirement of 19 spaces for the proposed art schooL With the addition of the art school the total number of on-site spaces required for the shopping center would be 373. The applicant has submitted a parking survey (copy attached) which was conducted over a one week period. The survey indicates that the shopping center has a peak parking demand of 220 parking spaces (count occured at 7:00 p.m., on December 11, 1994). As noted 287 spaces exists on the site, which indicates that there would be ample on-site parking for the proposed art school. Staff has made random vehicle , counts on the site, and concurs with the applicant's survey. Based upon the applicant's proposal and parking survey, it is staffs opinion that the proposed use would be an appropriate addition to the shopping center. CEOA . Pursuant to the provisions of the California Environmental Quality Act, the Development Services Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change ill any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. CUP 95-002 January 24, 1995 Page 3 . RECOMMENDA nON The Development Services Department recommends approval of Conditional Use Permit No. CUP 95-002 subject to the following conditions: 1. Building Code compliance and conditions of approval must be met to the complete satisfaction of the Building Division, as defined and stated in the attached memo. 2. Fire safety shall be provided to the complete satisfaction of the Fire Department, as defined and stated in the attached memo. 3. Any changes in existing domestic or fire protection water service (installation of new, abandonment of existing, relocation, removal, etc,) will be made by Arcadia Water Division at developer's expense. 4. A modification be granted for 287 on-site parking spaces in lieu of 373, and that this approval shall not cons.titute an approval for the general reduction in parking for the total site. That this parking modification shall only be for the use approved by CUP 9S.;()02 (an art school), . 5. All of the conditions of approval shall be complied with prior to or concurrent with the opening of the art school. Noncompliance with the provisions and conditions of CUP 95.;()02 shall constitute grounds for its immediate suspension or revocation which may result in closure of the school. 6. Approval of CUP 9S.;()02 shall not take effect until the property owner and applicant have executed and filed the Acceptance Form available from the Development Services Department to indicate their awareness and acceptance of the conditions of approval. FINDINGS AND MOTIONS Approval If the Planning Commission intends to approve this Conditional Use Permit application, the Commission should move to approve and file the Negative Declaration and direct staff to prepare an appropriate resolution that will incorporate the Commission's decision, specific findings and conditions of approval. .
