A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT 95-001 TO OPERATE A RESTAURANT WITH SEATING FOR 52 PERSONS AT 1311-B SOUTH BALDWIN AVE. WHEREAS, on November 21, 1994 an application was filed by Mike Pernecky to operate a McDonald's Express Restaurant with seating for 52 persons, Community Development Division Case No. C.U.P. 95-001 at 1311-B S. Baldwin Ave., more particularly described as follows: Lots 13 and 14 of Tract No. 6925, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 74, Page 79 of Maps, in the office of said County Recorder. WHEREAS, a public hearing was held on January 10, 1995, at which time all . interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Community Development Division in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. . 5. That the granting of such Conditional Use Permit will not adversely affect . the comprehensive General. Plan. 6. That the use applied for will not have a substantial adverse impact on the environment, and that based upon the record as a whole there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources on the habitat upon which the wildlife depends. See-lion 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for the operation of a McDonald's Express restaurant, upon the following conditions: 1. Fire safety shalI be provided to the satisfaction of the Arcadia Fire Department. 2. Any change in the existing water meter or service shall conform to the Uniform Plumbing code and will be installed by the Arcadia Water Division upon the request and payment of fees by the developer. 3. That the seating shall be limited to a maximum of 52 persons. 4. A modification be granted for 771 on-site parking spaces in lieu of 1,427, and that this approval shall not constitute an approval for the general reduction in . parking for the total site. That this parking modification shall only be 'for the use approved by CUP. 95-001 (a restaurant). 5. That c.u.P. 95-001 shall not take effect until the owner and applicant have executed a form available at the Community Development Division indicate awareness and acceptance of the conditions of approval. 6. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of January 10, 1995 and the following vote: A YES: Commissioners Bell, Clark, Huang, Kalemkiarian, Kovacic, Murphy, Daggett NOES: None . -2- 1519 Section 5. Pemecky Management Corporation to request a conditional use permit for a proposed McDonald's Express restaurant with seating for 52 persons at 1311 B South Baldwin Avenue. The Planning Division is recommending approval of this request subject to the conditions as set forth in this report. GENERAL INFORMATION APPLICANT: Mike pemecky (tenant) LOCATION: 1311 B South Baldwin Avenue REQUEST: A conditional use permit for a proposed McDonald's Express restaurant. LOT AREA: 391,720 sq.ft. (8.99 acres) FRONTAGE: 660.00 feet along Baldwin Avenue 680.00 feet along Duarte Road 535.00 feet on Naomi Avenue EXISTING LAND USE & ZONING: . The site is developed with the Burlington Coat Factory, a two level parking structure and various retail shops; zoned C-2 and C-2 & H 4 (along Baldwin Avenue), . . . SURROUNDING LAND USE & ZONING: North South: General commetcial uses; zoned C-2 and C-2 & D. Retail shopping center (Sav-on) and mixed residential uses; zoned C- 2 and R-3 respectively. General commercial uses; zoned C-2 & H. Yon's Pavilion and retail shops; zoned C-2. East: West: GENERAL PLAN DESIGNATION: The subject site is designated as Commercial. PROPOSAL The applicant is seeking a conditional use permit to operate a McDonald:s Express restaurant with seating for 52 persons, as shown on the submitted floor plan. This business would occupy a retail space of approximately 2,800 sq. ft., which is within a '276,905 sq.ft. shopping center, as shown on "Parcell" of the submitted site plan. Business hours would be from 8:00 a.m. to 9;00 p.m., Monday thru Sunday. Exterior alterations would only consist of adding new wall signs to the front and rear of the building (see the attached sign elevations). PARKING Restaurants require 10 parking spaces per 1,000 sq.ft. of gross floor area. Based upon this requirement the proposed restaurant requires 28 spaces. However, the existing on-site parking ratio of 2.784 spaces per 1,000 sq. ft. of gross retail .floor area results in a net parking space requirement of 26 spaces for the proposed McDonald's restaurant. The on-site parking consists of 771 spaces (418 spaces are within the two-story parking struchlre) and does not comply with the current Code requirement of 1,401 spaces for the pre-existing shopping center (Le., 5 spaces per 1,000 sq.ft. of gross retail floor area plus 16 spaces for the Starbuck's Coffee shop seating - C.U.P. 93-001). With the addition of the McDonald's restaurant the total number of on-site spaces required for the shopping center would be 1,427. The attached "Parking Survey" was submitted by the applicant, which indicates that the Shopping center has a peak parking demand of 387 parking spaces (count occurred at 6;30 p.m on November 17, 1994). As noted 771 spaces exist on the site, which indicates that there would be ample on-site parking for the proposed restaurant. Staff has made random vehicle counts on the site, and concurs with the applicant's parking survey. C.U.P.95-001 January 10, 1995 Page 2 . Furthermore, there is a reciprocal easement agreement with the neighboring Von's Pavilion shopping center to utilize the parking areas in common. The Von's site provides 428 parking spaces. ANALYSIS Uses such as eating establishments and restaurants require conditional use permits, and traffic concerns can be addressed as part of the consideration of such applications. Generally staff does not encourage uses which are deficient in parking; however, the proposed restaurant is a unique type of McDonald's facility. It will not provide any drive-through service, and its primary purpose is to provide a food service to the shoppers and employees that patronize the shopping center. In 1988 a similar size restaurant was approved by the Planning Commission (C.u.P. 88-030) at the shopping center's 1317 South Baldwin Avenue retail space, and during its two year operation, prior to its closing in 1991, no parking problems were noted by staff. Based upon the applicant's proposal and "Parking Survey", it is staffs opinion that the proposed use would be an appropriate addition to the shopping center. . CEOA Pursuant to the prOViSIOns of the California Environmental Quality Act, the Planning Division has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit 95-001 subject to the following conditions: 1. Fire safety shall be provided to the satisfaction of the Arcadia Fire Department. . 2. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission. Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
