RESOLUTION 1517
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE
PERMIT 94-010, FOR A COMPUTER TECHNOLOGY AND SOFTWARE
TRAINING SCHOOL AT 411 E. HUNTINGTON DRIVE.
WHEREAS, on September 19,1994 an application was filed by Katharyn Brett
for a Conditional Use Permit fora computer training school, Planning Division
Case No. C.U.P. 94-010, on property commonly known as 411 E. Huntington Dr.,
more particularly described in attached Exhibit A.
WHEREAS, a public hearing was held on October 25, 1994, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Division in the
attached report is true and correct.
Section 2. This Commission finds:
. 1. That the granting of such Conditional Use Permit will not be detrimental
to the public health or welfare, or injurious to the property or improvements in
such zone or vicinity.
2. That the use applied for at the location indicated is a proper use for which
a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping
and other features are adequate to adjust said use with the land and uses in the
neighborhood.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit for a computer training school, upon the following
. conditions:

1. That the maximum number of students shall not exceed 60 persons at
anyone time.
2. That school administrators are required to take steps to direct school
attendee's to carpool and to park within the three story parking structure to lessen the
demand for parking immediately adjacent to the first floor retail businesses.
3. That directional signs indicating "Elevator" and "Stairwell To First Floor"
or "Exit" must be appropriately placed in the underground parking level or as needed
on the upper levels to make access to and from the parking structure less confusing.
Directional signs must also be placed within the school or at the school's entrance
regarding designated parking areas within the parking structure.
4. That drivers dropping off students must park in available parking spaces to
avoid blocking traffic flow into and out of the retail / office center.
5. That building code compliance shall be provided to the satisfaction of the
Building Division. Upon re-submittal of new plans showing any required revisions,
the vocational school must be maintained per the plans on file in the Planning
Division.
6. That fire safety shall be provided to the satisfaction of the Arcadia Fire
Department.
7. That C.U.P. 94-010 shall not take effect until the owner and applicant have
executed an acceptance form, available at the Planning Division, indicating awareness
and acceptance of the conditions of approval.
8. Noncompliance with the provisions and conditions of this Conditional
Use Permit shall constitute grounds for its immediate suspension or revocation.
Section 4. The decision, findings and conditions contained in this Resolution
reflect the Commission's action of October 25, 1994 and the following vote:

Section 5. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

GENERAL PLAN DESIGNATION
Planned Development. 1
PROPOSAL
The applicant is requesting a conditional use permit to operate a computer technology
and software training school utilizing approximately 3,271 square feet of office space
(1,908 for classrooms) on the ground floor (Suites 115 & 116) of the three-story retail/
office center.
The school will be conducting, training sessions for students from Monday through
Saturday and will be closed on Sunday. The hours of operation will be from 8:30 am
to 10:00 pm Monday through Thursday and close at 5:00 pm on Friday and 12:30 pm on
Saturday. The maximum number of students proposed to be on-site at anyone time is
60.
SITE BACKGROUND
On June 27, 1989 the Planning Commission adopted Resolutions 1411 and 1412 granting
Conditional Use Permits 89-007 and 89-008 to operate two restaurants on the site (Tokyo
Wako and Tony Romas). Since then, an additional five Conditional Use Permits have
been granted for the subject site to accommodate a restaurant, three "fast food" eating
establishments and one school (see exhibit A). Only one of the seven approved CUP's
is no ~onger in business (Iceland Yogurt - Approximate closure date: 9-15-93).
CURRENT TENANTS
There are currently 11 first floor tenants in operation out of approximately 24 retail
spaces available. The second floor has 4 office tenants in operation and the third floor
has 2 (as listed below):

PARKING AND IMPACT ANALYSIS
TherE! are 428 on-site parking spaces existing (244 located in the three level parking
structure and 184 on-grade spaces). Based on the site's current uses there is an existing
parking space deficiency of 33 spaces.
The proposed classroom seating area for the 3,271 square foot Computer school is 1,980
square feet. Under the cunent parking regulations (1 space per 35 sq. ft. of gross floor
area within the classroom/seating area), the site is required to provide 57 on-site
parking spaces for the addition of the cschool - resulting in a net total of 518 on-site
parking spaces being required for the site. The proposed school would result in aft
overall deficiency of 90 spaces (existing deficiency of 33 spaces plus the 57 spaces
required for the proposed school).
FINAL ANALYSIS
Staff has noted that the daily operation of the existing businesses at the retail/office
center do not result in an overwhelming demand for parking. Site inspections have
revealed that a maximum of 75 parking. spaces were taken during the peak morning
hours (9:00 am to 12:30 pm, Mon - Fri) within the on-grade 184 space parking lot
(mostly located immediately adjacent to the first floor retail businesses). A maximum
count of ten cars were parked on the on-grade level of the 244 space, three level parking
structure and no more than ten were ever counted on the top level. Only one car
parked on the underground level of the parking structure throughout the two week
site inspection period.
Because the existing parking structure contains a great number of unused spaces, staff
does not foresee a significant on-site traffic impact.
ENVIRONMENTAL DOCUMENTATION
Pursuant to the provisions of the California Environmental Quality Act, the Planning
Division has prepared an initial study for the proposed project. Said initial study did
not disclose any substantial or potentially substantial adverse change in any of the

physical conditions within the area affected by the project including land,"air, water,
minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance,
When considering the record as a whole, thereis no evidence that the proposed project
will have any potential for adverse effect on wildlife resources or the habitat upon
which the wildlife depends. Therefore, a Negative Declaration has been prepared for
this project.
RECOMMENDATION AND CONDITIONS
The Planning Division recommends approval of C.U.P. 94-010 subject to the following
conditions:
1. When dropping students off, there shall be no parking in driveways. Drivers
must park in available parking spaces to avoid blocking traffic flow into and out
of the retail/office center site.

2. School attendees are encouraged to park within the existing parking structure to
lessen the demand for spaces immediately adjacent to the first floor retail uses.

attached memo.
6. Fire safety shall be provided to the complete satisfaction of the Fire Department,
as defined and stafed in the attached memo.
7. That C.U.P. 94-010 shall not take effect until the owner and applicant have
executed a Planning Division Acceptance Form, available at the Planning
Division, indicating awareness and acceptance of sill. conditions of approval.
8. Noncompliance with the provisions and conditions of this Conditional Use
permit shall constitute grounds for the immediate suspension or revocation
of said Permit.

9. That a modification for 428 on,site parking spaces in lieu of the 518 ~paces
required, is granted for C.U.P. 94-010 (computer school). This parking
modification does not constitiute the approval of a general reduction of the
parking require.JIlent for the entire retail / office center, but only for the use
approved by this CUP.
FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find
that the project will not have a significant effect on the environment and direct staff
to prepare the appropriate resolution incorporating the specific findings and conditions
of approval set forth in the staff report (or as modified by the Commission).
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate resolution
incorporating the Commission's decision and findings in support of that decision.
