HomeMy WebLinkAbout1516 . . . RESOLUTION 1516 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT NO. CUP 94-009 FOR A MARTIAL ARTS INSTRUCTIONAL STUDIO AT 651 WEST DUARTE ROAD. WHEREAS, on September 19, 1994, a Conditional Use Permit application was filed by Robert Y. Lee for a martial arts instructional studio in a 2,850 square foot retail space, Planning Division Case No. CUP 94-009, at property commonly known as 651 West Duarte Road which is part of a retail center at 627-655 West Duarte Road, more particularly described in Exhibit "An. WHEREAS, a public hearing was held on October 25, 1994, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Division in the attached report is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment, and, that based upon the record as a whole there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources . . . or the habitat upon which the wildlife depends. SECTION 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for a martial arts instructional studio in a 2,850 square foot retail space at 651 West Duarte Road upon the following conditions: 1. The hours of operation shall be limited to 3:30 p.m. to 8:30 p.m. Monday through Friday, and 9:00 a.m. to 12:00 noon on. Saturdays. 2. Not more than two classes shall be conducted at one time with twenty to be the total cumulative number of students in attendance at a time. 3. Building occupancy, accessibility, egress, re.st rooms, parking facilities, and safety features shall be provided and maintained to the satisfaction of the Building Division. These shall include, but not be limited to, the following: a. Provision of two rest rooms, one for each sex, that comply with the State's Title 24 requirements, and the Federal ADA. b. Van accessible parking, with access adjacent to the building entrance, that complies with the State's Title 24 requirements, and the Federal ADA. 4. Fire protection, water supply, and building occupancy shall be provided and maintained to the satisfaction of the Arcadia Fire Department, which shall include, but is not limited to, the installation of a Knox Box entry device with keys per Uniform Fire Code Section 10.503. 5. A Modification for 196 parking spaces in lieu of the 382 spaces required, is granted for CUP 94-009. This parking Modification does not constitute an approval of a general reduction of the parking requirement for the entire retail center, but rather only for the specific use approved by this CUP. 6. All of the conditions of approval shall be complied with prior to or concurrent with the opening of the martial arts instructional studio. The subject site shall be maintained in a manner that is consistent with the plans approved for CUP 94-009. Noncompliance with the plans, provisions and conditions of CUP 94- 009 shall constitute grounds for its immediate suspension or revocation which may result in closure of the studio. 7. CUP 94-009 shall not take effect until the property owner and applicant have executed and filed the Acceptance Form available from the Planning Division to indicate awareness and acceptance of the conditions of approval. SECTION 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of October 25, 1994 and the following -2- 1516 . vote: A YES: Commissioners Bell, Clark, Huang, Kalemkiarian, Kovacic & Daggett NOES: Commissioner Murphy SECTION 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. CUP 94-009 A MARTIAL ARTS INSTRUCTIONAL STUDIO AT 651 W. DUARTE ROAD. SUMMARY This Conditional Use Permit application was submitted by Robert Y. Lee for a 2,850 square foot martial arts instructional studio at 651 W. Duarte Road. The Planning Division is recommending approval of Conditional Use Permit No. CUP 94-00~ subject to the conditions in this report. . GENERAL INFORMATION APPLICANT: Robert Y. Lee LOCATION: 651 W. Duarte Road REQUEST: A Conditional Use Permit with parking modifications for a 2,850 square foot martial arts instructional studio. The proposed operating hours are 3:30 p.m. to 8;30 p.m. Monday through Friday and 9:00 a.m. to 12:00 noon on Saturdays. SITE AREA: 164,731 square feet (3.78 acres) FRONTAGE: 389.275 feet along W. Duarte Road 310.170 feet along Arcadia Avenue . EXISTING LAND USE & ZONING: A multi-tenant retail center of approximately 50,000 square feet, The site is zoned C-2 & H-4: General Commercial with a Special Height Overlay allowing a maximum of 4 stories or 45 feet. . . . GENERAL PLAN DESIGNATION: Commercial SURROUNDING LAND USES & ZONING: North: Multiple family - zoning is R-3 South: Bank and offices - zoning is C-2 & H-4 E a S t: Offices - zoning is CoO West: Offices and retail- zoning is C-2 PROPOSAL AND ANALYSIS The proposal is to occupy a 2,850 square foot commercial space as a martial arts instructional studio. The proposed operating hours are 3:30 p.m. to 8:30 p.m. Monday through Friday, and 9:00 a.m. to 12:00 noon on Saturdays. Classes will be held hourly and will be for students six years old through high school ages. It is anticipated that there will be five to ten students in each class session. Two rooms totaling approximately 2,440 square feet of the subject retail space will be- used for martial arts instruction. One parking space is required for each 35 square feet of the instructional rooms. This results in a requirement of 69.7 parking spaces as opposed to 14.3 spaces for a retail use. Based on the applicant's information, however,a maximum of two classes could be conducted simultaneously with a total of twenty students. This would not necessitate 70 parking spaces for this use. Parking The property is developed with a multi-tenant retail center that was built in 1959. The current uses and parking requirements are as follows: . Approximate . . There are 197 parking spaces on-site which is almost double the 100 parking spaces that were required in 1959. However, the proposed martial arts studio togetller with the other uses (with vacancies considered retail) currently require a total of 382 spaces. This is a 185 spac~ deficiency from the current Code requirements. Parking Modifications were granted for the two uses with Conditional Use Permits (Le. Gymboree and the Eating Establishment) and the restaurant was considered a retail USE! when it was included as part of the original development. A Modification was also granted to eliminate 15 spaces when the cable television facilities were installed. These four uses account for 150 spaces of the deficiency. The remaining deficiendes are attributed to the difference in current parking requirements and those of 1959. Parking spaces for the physically disabled are provided at this site, but they do not appear to comply with current accessibility requirements. Compliance with those regulations for this application will result in tpe loss of one parking space. However, this is a requirement that cannot be disregarded. A review of the parking situation indicates that there is presently not a parkinlt problem at this retail center. Several observations showed that only about 70 parking spaces were occupied at any time. The limitations of the applicant's proposal, and the emphasis on non-driving age students, should prevent it from creating a parking problem. Environmental Review Pursuant to the provisions of the California Environmental Quality Act, the Planning Division has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significar...ce.. When considering -the record as a whole, there is no evidence tli.at the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Division recommends approval of Conditional Use Permit No. CUP 94-009 subject to the following conditions: CUP 94-009 October 25,1994 Page 3 _ ______l_ . 1. The hours of operation shall be limited to 3:30 p.m. to 8:30 p.m. Monday through Friday, and 9:00 a.m. to 12:00 noon on Saturdays. . 2. Classes shall be limited to students ranging in age from six years old through high school ages. 3. Not more than two classes shall be conducted at one time with twenty to be the total cumulative number of students in attendance at a time. 4. Building occupancy, accessibility, egress, rest rooms, parking facilities, and safety features. shall be provided and maintained to the satisfaction of the Building Division. These shall include, but not be limited to, the following: a. Provision of two rest rooms, one for each sex, that comply with the State's Title 24 requirements, and the Federal ADA. . b. Van accessible parking, with access adjacent to the building entrance, that complies with the State's Title 24 requirements, and the Federal ADA. 5. However, implied with this Modification is an approval to reduce the overall number of parking spaces for the entire retail center to accommodate the updating of parking spaces for the physically disabled to comply with current Title 24, and Federal ADA accessibility requirements.. 7. The subject site shall be maintained in a manner that is consistent with the plans approved for CUP 94-009. Noncompliance with the plans, provisions and conditions of CUP 94-009 shall constitute grounds for its immediate suspension or revocation which may result in closure of the studio. . 8. CUP 94-009 shall not take effect until the property owner and applicant have executed and filed the Acceptance Form available from the Planning Division to indicate awareness and acceptance of the conditions of approval. FINDINGS AND MOTIONS Approval If the Planning Commission intends to approve of this Conditional Use Permit application, the Commission should move to approve and file the Negative Declaration and adopt Resolution No. 1516 which incorporates the Commission's decision, specific findings and conditions of approval as set forth in the staff report, or as modified by the Commission. Denial If the Planning Commission intends to deny this Conditional Use Permit application, the Commission should move for denial and adopt Resolution No. 1516 which incorporates the Commission's decision and specific findings. Note: Because there will not be a November 8, 1994 meeting, resolutions of approval and denial have been drafted so that there will not be an inordinate delay in the processing of this application.
