RESOLUTION 1515 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT 94-008, FOR A CREDIT, COLLECTIONS AND FINANCE VOCATIONAL SCHOOL AT 41 E. FOOTHILL BLVD, WHEREAS, on August 23, 1994 an application was filed by Gregory Forrest for a Conditional Use Permit for a vocational school, Planning Division Case No. c.u.P. 94-008, on property commonly known as 41 E. Foothill Blvd" more particularly described as follows: Lot 6, Block 2 of Tract No. 4129, as recorded in Book 75, Pages 48 and 49 of Maps in the office of said County Recorder in the City of Arcadia, County of Los Angeles, State of California. WHEREAS, a public hearing was held on August 23, 1994, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Division in the attached report is true and correct. Section 2. This Commission finds: 1, That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2, That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use, 1515 1 . . . 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for a vocational school, upon the following conditions: 1. That the maximum number of students shall not exceed 15 persons at anyone time. 2. That for a period six months after the adoption of this resolution, the Planning Division shall administer a review period of the traffic flow and subsequent congestion of said site. A report will be rendered to the Planning Commission as an agenda item; and if the Commission determines that further action is necessary, the matter shall be set for a Public Hearing. 3. Signs be posted in a visible area encouraging carpools and drop off locations. Staff shall present a report to the Commission regarding any and all parking and traffic problems as a result of the proposed use and that the Commission reserves jurisdiction to take additional action as necessary in six months. 4. Building code compliance shall be provided to the satisfaction of the Building Division, Upon re-submittal of new plans showing any required revisions, the vocational school must be maintained per the plans on file in the Planning Division. 5. That fire safety shall be provided to the satisfaction of the Arcadia Fire Department. 4. That Cu.P. 94-008 shall not take effect until the owner and applicant have executed an acceptance form available at the Planning Division indicating awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for its immediate suspension or revocation. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of August 23, 1994 and the following vote: A YES: Commissioners Bell, Clark, Huang, Kalemkiarian, Kovacic, Murphy, Daggett None None NOES: ABSENT: 2 1515 . . . Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. The Planning Division is recommending approval subject to the conditions outlined in the staff report. . GENERAL INFORMATION APPUCANT: George Forrest LOCATION: 41 E. Foothill Blvd. REQUEST: A Conditional Use Permit to operate a school offering training in the area of credit, collections and finance per Section 9275.1.35. of the Municipal Code for the operation of schools. EXISTING LAND USE & ZONWG The site is currently developed with a commercial office center and and is zoned C-2 SURROUNDWG LAND USE & ZONING North: South: East West: Single-family residences; Zoned R-1 Retail Commercial uses; Zoned C-2 Retail Commercial uses; Zoned C-2 Retail Commercial uses; Zoned C-2 . C.U.P, 94-008 August 23, 1994 Page 1 . . . , GENERAL PLAN DESIGNATION Commercial PROPOSAL The applicant is requesting a conditional use permit to operate a finance and credit reporting vocational school. The school will be utilizing approximately 1,600 square feefof office space on the ground floor of the two-story office center. The school will be conducting training sessions for students of all ages. The hours of operation will be from 7:30 am to 5:30 pm Monday through Friday. The maximum number of students anticipated on-site at anyone time is 10 to IS. PARKING There are 56 on-site parking spaces existing (1 handicap), located in the rear of the subject building. There are currently 3 first floor tenants and S second floor tenants in operation: 1st Floor (approx 7,000 sq. ft.) Suite 100 Suite 102 Suite 104 Suite 106 2nd Floor (approx 7,300 sq. ft.) Suite 200 Suite 200A Suite 201 Suite 202 Suite 204 Suite 205 ANAL YSIS L & C Realtors American Prof. Business Bureau "Proposed School Law Offices Tekmarine Engineers ACE Development vacant Lazarus & Saunders Accountant Chiropractor Under the current parking regulations, the site is required to proviqe 91 on-site parking spaces for the addition of the proposed school (i.e., 58 spaces for the existing businesses and 33 spaces for the proposed school). However, staff has noted thiH the daily operation of the existing businesses at the office center do not result in an overwhelming,demand for parking. Staff conducted several site inspections which revealed a peak parking demand of 27 on-site spaces. Because the request for the school proposes aminirnal number of students,staff does not feel that on-site parking will be significantly affected. C.U.P.94-008 August 23, 1994 Page 2 . . . Pursuant to the provisions of the California Environmental Quality Act, the Planning Division has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Division recommends approval of c.u.P. 94-008 subject to the following conditions: 1. When dropping students off, there shall be no parking in theaIley in the rear of the subject building or in the driveways to avoid blocking traffic flow into and out of the office center site. 2. Building Code compliance and conditions of approval must be met to the complete satisfaction of the Building Division, as defined and stated in the attached memo. 3. Fire safety shall be provided to the complete satisfaction of the Fire Department, as defined and stated in the attached memo. 4. That c.u.P. 94-008 shall not take effect until the owner and applicant have executed a form available at the Planning Division indicating awareness and acceptance of all conditions of approval. 5. The maximum number of students shall not exceed 15 at anyone time. 6. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. 7. That a modification be granted for 56 on-site parking spaces in lieu of 91 and that this approval shaIl not constitute an approval for the general r~uction in parking for the total site. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an apRropriate resolution incorporating the Commission's decision and findings in support of: that decision.
