RESOLUTION 1514
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE
PERMIT NO. CUP 94-007 AND APPROVING ARCHITECTURAL
DESIGN REVIEW NO. ADR 94-005 FOR A ONE-STORY 2,282 SQUARE
FOOT THERAPY FACILmES ADDITION TO THE 99 BED SKILLED
NURSING CENTER AT 400 WEST HUNTINGTON DRIVE.
WHEREAS, on July 5,1994, a Conditional Use Permit application was filed by
Terri S. Sweeney, Administrator of the Huntington Drive Skilled Nursing Center,
operated by Beverly Enterprises, Inc., for a one-story 2,282 square foot therapy
facilities addition to the existing 99 bed skilled nursing center, Planning Division
Case No. CUP 94-007, at property commonly known as 400 West Huntington Drive,
more particularly described as follows:
Lot 1 of Parcel Map 10928, in the City of Arcadia, County of Los Angeles,
State of California, as recorded in Parcel Map Book 132, Pages 92 and 93,
in the Office of the Recorder of said County.
. WHEREAS, a public heaFing was held on August 9, 1994, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning Division in the
attached report is true and correct.
SECTION 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental
to the public health or welfare, or injurious to the property or improvements in
such zone or vicinity.
2. That the Use applied for at the location indicated is properly one for which
a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping and other features required to adjust said use with the land and uses in
the neighborhood. The existing 99 bed skilled nursing center operates under
Conditional Use Permit No. CUP 77-32 (Resolution No. 1028) which granted

. Modifications for the existing number of beds, setbacks, and parking spaces.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment, and, that based upon the record as a whole there is no evidence that
the proposed project will have any potential for adverse effect on wildlife resources
or the habitat upon which the wildlife depends.
7. That the proposed design is consistent with, and satisfies the purposes and
criteria of the City's Architectural Design Review Regulations.
SECTION 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit and approves an Architectural Design Review for the one-
story 2,282 square foot therapy facilities addition to the 99 bed skilled nursing center
at 400 West Huntington Drive upon the following conditions:
1. The Modification for the number of beds is revised to allow a maximum
of 99 beds in lieu of the 86 bed limit.
. 2. That the necessary amounts of land be dedicated, and that the sidewalks
and comer wheelchair ramp be altered and/or improved to comply with the current
Federal and State accessibility requirements.
3. Modifications for a 30 foot setback from Huntington Drive in lieu of the 50
foot special setback with five foot encroachments in lieu of the standard three feet
for architectural features. These Modifications are granted only for the therapy
facilities addition approved by CUP 94-007 and ADR 94-005, and are not a reduction
of the setback requirements for any other buildings, improvements or portions of
the site.
4. Detailed plans for the parking areas, and the landscaping and irrigation of
the areas adjacent to and in front of the therapy facilities addition, shall be submitt~
for the review and approval of the Planning Division prior to the beginning of
construction. The landscaping and irrigation plans shall be prepared by a licensed
landscape architect. These required plans shall include, but not be limited to, the
following:
a. A minimum of three 36 inch box trees, and four, 48 inch box trees to
replace the two large trees that are to be removed to accommodate the addition, and

tall, dense shrubbery along the west property line.
b. A plan of both the front and rear parking areas. Both new and existing
parking spaces shall be striped, labeled and signed to comply with the Arcadia
Municipal Code, and the Federal and State accessibility requirements.
c. That the Modification for the landscaping of the rear parking area be
revised to allow a width of three feet in lieu of five feet for the planters between the
rear parking area and the adjacent property lines.
d That storage areas for equipment, trash and recyc1ables be located or
enclosed so as not be visible from adjacent streets and properties.
e. That the subject property shall be separated from adjacent properties on
the south and west by minimum six foot high walls or fences, except that such walls
or fences shall be only four feet high between street side property lines and the
building setback lines, and not more than three feet high if within the City's
vehicular visibility areas.
f. That all outside lighting shall be arranged and shielded to prevent any
glare or reflection, any nuisance, inconvenience or hazardous interference of any
kind on adjoining streets or properties. No light standard shall exceed a height of
ten feet, and all outside illumination shall meet with the approval of the
Department of Public Works.
5. The following conditions of approval which are recommended by the
Public Works Department, and which shall be complied with to the satisfaction of
the Director of Public Works in accordance with all applicable provisions of the
Arcadia Municipal Code:
a. The submittal of a grading and drainage plan prepared by a registered civil
engineer, and which shall be subject to the review and approval of the Director of
Public Works. Such plan shall show all existing and proposed parkway trees, pull
boxes, meters, power poles, street lights, driveways, sidewalks and handicap access
ramps.
b. Closure of any existing driveways, or any portions thereof, that are not to
be used and reconstruction of curb, gutter and sidewalk to match existing.
c. Removal and replacement of any deficient or damaged curb, gutter,
sidewalk and/or pavement. The Public Works Department shall be contacted to
identify the exact locations and limits of any such necessary removals and
replacements.

d. Any driveways shall include commercial type P. C. C. aprons constructed
in accordance with Arcadia Standard Drawing No. 5-11. No driveway shall be closer
than three feet from any curb return, fire hydrant, ornamental light standard,
telephone or utility pole, meter box, underground vault, manhole or tree. No
portions of existing gutters and/ or A. C. pavement shall be removed without
obtaining approval from the Director of Public Works.
e. Permits shall be obtained for all work to be performed in the public rights-
of-way. The Public Works Inspector shall be contacted at least 24 hours prior to
beginning any construction of any off-site improvements. Any such improvements
shall be completed to the satisfaction of the Director of Public Works prior to
occupancy of, and the final inspection and acceptance of the therapy facilities
addition by the City of Arcadia and/or the State of California.
f. All contractors shall comply with all requirements of Federal, State and
local laws and regulations pertaining to the Clean Air and Clean Water Acts.
6. Fire protection shall be provided and maintained to the satisfaction of the
Arcadia Fire Department, and shall include, but is not limited to, the following:
a. An automatic fire sprinkler system must be added to the new addition. If
the existing fire sprinkler riser is altered, plans must be submitted to the Arcadia
Fire Department for review and approval. The Arcadia Fire Department connection
must be located adjacent to the front sidewalk in accordance with the applicable
regulations of the Arcadia Municipal Code and Arcadia Fire Department Sprinkler
Ordinances.
b. The fire alarm system and all safety devices required by the Fire and
Building Codes are to be functional at all times, are subject to testing by the Arcadia
Fire Department, and must be installed in accordance with plans that have been
submitted, reviewed and approved by the Arcadia Fire Department and Building
Division.
c. All other fire and safety devices must be installed in accordance with the
1991 Uniform Fire and Building Codes as adopted by the City of Arcadia.
7. Water supply and facilities shall be provided and maintained to the
satisfaction of the Arcadia Water Division and shall include, but are not limited to,
the following:
a. Water flow for fire protection shall be maintained to the satisfaction of the
Arcadia Fire Department.

b. Any changes in size or location of existing and/or additional fire or
domestic water services are to be provided by the Arcadia Water Division at the
expense of the property owner or applicant. These shall include, but are not limited
to, the installation of new services and/or the abandonment of existing services.
c. A Water Meter Clearance Application shall be submitted if required in
order to verify the size of service necessary and/or the adequacy of the existing
service.
d Water service laterals, meters, flush-outs, or fire hydrants may not be
located in any driveway. nor closer than three feet from the top of an "XU driveway
apron transition, and not within three feet of any other utility installation.
e. All fire protection and landscape irrigation systems shall have backflow
protection and are subject to review and approval by the Arcadia Water Division,
and shall be screened from view in accordance with the standards on file with the
Arcadia Planning Division.
8. The subject site, buildings, parking areas and landscaping shall be
maintained in a manner that is consistent with the plans approved for CUP 94-007
and ADR 94-005.
9. All of the conditions of approval shall be complied with, and completed
prior to completion of the addition approved by CUP 94-007 and ADR 94-005.
Noncompliance with the provisions and conditions of CUP 94-007 and ADR 94-005
shall constitute grounds for immediate suspension or revocation of the Conditional
Use Permit which may result in closure of the entire skilled nursing center.
10. Approvals of CUP 94-007 and ADR 94-005 shall not take effect until the
property owner and applicant have executed and filed the Acceptance Form
available from the Planning Division to indicate their awareness and acceptance of
the conditions of approval.
SECTION 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of August 9, 1994 and the following
vote:
A YES: Commissioners Clark, Huang, Murphy and Daggett
NOES: None
ABSENT: Commissioner Kovacic
SECTION 5. The Secretary shall certify to the adoption of this Resolution
and shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUMMARY
The Conditional Use Permit and Architectural Design Review applications were
submitted by Beverly Enterprises for a one-story, 2,282 square foot therapy facilities
addition to the 99 bed skilled nursing center at 400 W. Huntington Drive. The
Planning Division is recommending approval of CUP 94-007 and ADR 94-005
subject to the conditions in this report.

BACKGROUND
In 1962 a Zone Variance was conditionally granted for a 60 bed, 15,000 square foot
convalescent home at the subject property. In 1977 CUP 77-32 was approved for a
48 bed, 12,500 square footaddition. Included among the conditions of approval were
the following:
A. A Modification for 108 beds in lieu of the 88 beds allowed.
B. A Modification for a 35 foot setback from the Huntington Drive property line in
lieu of the 50 feet required with a garden screen wall allowed to encroach six feet
into the 35 foot setback.
C A Modification for a 27 foot setback from the Holly Avenue property line in lieu
of the 40 feet required with patio screen walls allowed to encroach three feet into
the 27 foot setback.
D. A Modification for 51 parking spaces in lieu of the 54 required.
Special Regulations
Section 9275.1.44.1 of the Arcadia Municipal Code allows for convalescent and board
and care facilities with a Conditional Use Permit in the R-2, R-3 and C-O zones.
Prerequisite Conditions for a Conditional Use Permit
Section 9275.1.2. of the Arcadia Municipal Code requires that before a Conditional
Use Permit may be granted, the following conditions must be satisfied:
1. That the granting of such Conditional Use Permit will not be detrimental to the
public health or welfare or injurious to the property or improvements in such
zone or vicinity.

2. That the use applied for at the location indicated is properly one for which a
Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to accommodate
said use, and all yards, spaces, walls, fences, parking, loading, landscaping and
other features required to adjust said use with the land and uses in the
neighborhood.
4. That the site abuts streets and highways adequate in width and pavement type to
carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan.
PROPOSAL AND ANALYSIS
The applicant is proposing a one-story, 2,282 sq. ft. addition to provide space for up-
to-date therapy facilities and services. A letter from the applicant is attached. The
addition will abut the front of the existing west wing, and align with the side walls.
The existing 15 foot west side setback will be maintained. The proposed design
requires the following Modifications:
A. A 30 foot front setback in lieu of the 50 foot special setback along Huntington
Drive (9320.40.4)
B. An encroachment of five feet into the requested 30 foot front setback in lieu of
the three foot encroachment allowed for architectural features (9255.2.6)
The west wing, which is the older part of the nursing center, currently is set back 50
feet in compliance with the special setback along Huntington Drive. The east wing
which was added in 1977 is set back 35 feet with a six foot high garden wall
encroaching six feet into the 35 foot setback for an effective setback of 29 feet. The
neighboring condominiums to the west have a 35 foot front setback.
The addition has been proposed in the only feasible location, and its size has been
kept to a minimum. With the encroachment of the architectural features, the front
setback will be 25 feet. The addition has been designed with a low profile and the
elevation will be broken-up by several wing walls which will reduce the mass of the
structure and soften its appearance. Furthermore, the landscaping of the front
setback area will be increased to screen the addition.

Section 9275.5.4 of the Special Regulations for convalescent and board and care
facilities requires one parking space for every two beds. Based on the current
occupancy of 99 beds and the existing 51 on-site parking spaces, this nursing center
complies with the required number of parking spaces. However, both the front and
rear parking areas appear always to be full.
The applicant is proposing to add two standard parking spaces to the front parking
lot off of Huntington Drive which may help the parking situation, however, it is
not feasible to add any parking to the rear area. Nevertheless, because the nursing
center site is self-contained, and curbside parking is not allowed along Holly
Avenue, the lack of on-site parking does not appear to be impacting any of the
neighboring uses. Because of the parking situation, staff recommends that the
occupancy of this nursing center be limited to the current 99 beds.
Landscaping
The site as it exists is well landscaped and maintained. The most noticeable change
to be caused by the therapy facilities addition will be the loss of two large, multi-
trunk trees in the setback area along Huntington Drive. These trees are very mature
and are at least 35 feet tall. Unfortunately, there is no practical way to preserve these
trees and still provide the necessary therapy facilities.

The applicant has indicated a willingness to provide whatever landscaping is
deemed reasonably necessary to mitigate the loss of these large trees. The
preliminary landscaping layout indicates seven new trees in front of the addition.
The Planning Division recommends that at a minimum these replacement trees be
comprised of three 36 inch box trees, and four 48 inch box trees.
The preliminary landscaping plans also indicate that the three large trees along the
westerly property line will be preserved. Staff recommends that the dense shrubbery
along the west property line be preserved and enhanced to maintain and improve
the screening of the nursing center from the residential developments to the west.
The landscaping plans also include a new decorative driveway.
Accessibility
Because the nursing center provides services to the disabled, and is under the
jurisdiction of the State of California, it is assumed that it will fully comply with the
Americans with Disabilities Act and the accessibility requirements of California's
Title 24. However, the off-site improvements around the nursing center are not in
compliance. The wheelchair ramp that was required and installed as a condition of

approval of CUP 77-32 does not meet the current accessibility requirements, and the
sidewalks along Huntington Drive and Holly Avenue are too narrow and have too
many obstructions. Staff recommends that the necessary amounts of land be
dedicated, and that the sidewalk and wheelchair ramp be altered and/or improved
to comply with the current accessibility requirements.
Architectural Design Review (ADR 94-005)
Concurrent with the consideration of the Conditional Use Permit application, the
Planning Commission is to review the architectural design concept for the proposed
project and may approve, conditionally approve or deny the proposed design.
The existing buildings are finished with dark, neutral colors. The west wing is
stucco finished with masonry accents on the front. This area will be hidden from
view by the addition. The east wing is stucco and wood with masonry screen walls
along Holly Avenue. The roofs are low angled with composition tiles and the fascia
flashing is painted an accent color.
The proposed addition will be stucco finished with colors that match the existing
buildings. The primary architectural feature will be the vertical wing walls which
will break-up what would otherwise be a flat horizontal elevation. Small recesses
and scoring will be provided to accent the stucco surfaces. The windows will be
inset approximately 18 inches, and the mullions will be anodized a dark bronze.
The roof will be flat with fascia flashing colored to match the other buildings.
Staff finds that the proposal is consistent with the existing on-site improvements,
and that .overhangs and architectural features will provide shadows and visual
relief. Staff finds that the proposed design satisfies the criteria of the City's Architec-
tural Design Review Regulations.
Environmental Review
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Division has prepared an initial study for the proposed project. Said
initial study did not disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected by the project
including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole, there is
no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Dedaration has been prepared for this project.

. RECOMMENDATION

The Planning Division recommends approval of CUP 94-007 and ADR 94-005
subject to the following conditions:
1. The Modification for the number of beds is revised to allow a maximum of
99 beds in lieu of the 86 bed limit.
2. That the necessary amounts of land be dedicated, and that the sidewalks and
comer wheelchair ramp be altered and/or improved to comply with the current
Federal and State accessibility requirements.

5. The following conditions of approval which are recommended by the Public
Works Department, and which shall be complied with to the satisfaction of the
Director of Public Works in accordance with all applicable provisions of the
Arcadia Municipal Code:

closer than three feet from any curb return, fire hydrant, ornamental light
standard, telephone or utility pole, meter box, underground vault, manhole
or tree. No portions of existing gutters and/or AC. pavement shall be
removed without obtaining approval from the Director of Public Works.
e. Obtain permits for all work to be performed in the public rights-of-way. The
Public Works Inspector shall be contacted at least 24 hours prior to beginning
any construction of any off-site improvements. Any such improvements
shall be completed to the satisfaction of the Director of Public Works prior to
occupancy of, and the final inspection and acceptance of the therapy facilities
addition by the City of Arcadia and/or the State of California.

f. All contractors shall comply with all requirements of Federal, State and local

e. All fire protection and landscape irrigation systems shall have backflow
protection and are subject to review and approval by the Arcadia Water
Division, and shall be screened from view in accordance with the standards
on file with the Arcadia Planning Division.
8. The subject site, buildings, parking areas and landscaping shall be maintained in
a manner that is consistent with the plans approved for CUP 94-007 and
ADR 94-005.
9. All of the conditions of approval shall be complied with, and completed prior to
completion of the addition approved by CUP 94-007 and ADR 94-005.
Noncompliance with the provisions and conditions of CUP 94-007 and
ADR 94-005 shall constitute grounds for immediate suspension or revocation of
the Conditional Use Permit which may result in closure of the entire skilled
nursing center.
10. Approvals of CUP 94-007 and ADR 94-005 shall not take effect until the property
owner and applicant have executed and filed the Acceptance Form available
from the Planning Division to indicate their awareness and acceptance of the
conditions of approval.

If the Planning Commission intends to approve this Conditional Use Permit
application, and the architectural design concept, the Commission should move to
approve and file the Negative Declaration and direct staff to prepare a resolution
incorporating the decision, specific findings and the conditions of approval.

application, the Commission should move for denial and direct staff to prepare a

Dear Community Development Department:
Huntin9ton Drive Convalescent Hospital I Beverly Enterprises have made the
commitment to provide the highest level of quality for its rehabilitation therapy services
for our residents. We have made progress in providing our residents with therapy
services that has allowed for our residents to recover faster and better from sickness,
injury and accidents. Our Huntington Drive facility has focused on achieving an even
higher level of service, Unfortunately, our facility in the City of Arcadia was built during
a time when rehabilitation therapy was not emphasized as much as today within a
skilled nursing facility. Thus, we have very little space to provide the desired level of
quality therapy for our residents,
. Therefore, we would like to expand our facility by building approximately 2000 square
feet of space to be used solely for therapy services. The additional space would
alleviate our current situation in which therapy services competes with other resident
services for space. We feel the addition would be an enhancement to both our facility
as well as.to the City of Arcadia, and allow us to better provide an important service to
our residents and community,
In addition to the proposed therapy space, we would like to add two new parking
spaces for additional ease of parking. However, we will not be adding additional
certified beds to the facility. Our resident count will continue to be at 99 beds,
