CUP 94-005 FOR A GAME MACHINE ARCADE WITH 20 GAME MACHINES IN A 900 SQUARE FOOT RETAIL SPACE AT 16 EAST DUARTE ROAD. WHEREAS, on April 5, 1994, a Conditional Use Permit application was filed by Michael Girgis for a game machine arcade with 20 game machines in a 900 square foot retail space, Planning Division Case No. CUP 94-005, at property commonly known as 16 E. Duarte Road, more particularly described as follows: Lots 2 through 7 of Tract No. 13252 in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 345, Pages 6, 7 and 8 of Maps, in the Office of said County Recorder. WHEREAS, public hearings were held on May 10, 1994, and May 24,1994 at which times all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Division in the attached reports are true and correct. SECTION 2. That in accordance with the prerequisite conditions set forth in Arcadia Municipal Code Section 9275.1.2. this Commission finds that: A. The granting of this Conditional Use Permit would be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity because there is not an adequate buffer between the proposed use and the adjoining residential properties to the south, and in addition, visibility from the proposed arcade and the street into the parking lot is poor, making it difficult for the police and the arcade operator to adequately monitor activity within the parking lot where the bicycle racks are proposed to be located. . . . B. The site for the proposed use is inadequate in size and shape to accommodate said use because there is inadequate screening and walls to adjust said use with the land and uses in the neighborhood. The properties to the south that share the alley for access are developed with residential uses; the parking lot for the proposed use is adjacent to the alley and there is no fence or wall to buffer the proposed use and the parking area from the adjacent residential properties. SECTION 3. That for the foregoing reasons this Commission denies the Conditional Use Permit application for a game machine arcade with 20 game machines in a 900 square foot retail space at 16 E. Duarte Road. SECTION 4. That the decision and findings stated in this Resolution reflect the Commission's action of May 24, 1994 and the following vote: A YES: Commissioners Daggett, Hedlund, Huang, Kovacic and Clark NOES: None ABSENT: None SECTION 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. The public hearing for this Conditional Use Permit application was continued from the May 10, 1994 Planning Commission meeting. The applicant was unable to attend the meeting that evening. The additional information that the Commission requested will be distributed at the May 24th meeting. . DUARTE RD. SUMMARY This Conditional Use Permit application 'was submitted by Michael Girgis to install 20 amusement game machines at 16 E. Duarte Road. The Planning Division is recommending approval of Conditional Use Permit No. CUP 94-005 subject to the conditions in this report. . NOTE: This application was originally filed, and publicly noticed for 18 E. Duarte Road. The applicant later learned that the discussions with the property owner actually involved 16 E. Duarte Road, the adjacent space. The size of the units is the same and their layouts are very similar, and 16 E. Duarte Road still exceeds the minimum 500 foot distance from a school property boundary. It has been determined that this minor change in location has had no material affect upon this application and its analysis. GENERAL IN'FORMATION APPUCANT: Michael Girgis LOCATION: 16 E. Duarte Road REQUEST: A Conditional Use Permit with parking and landscaping modifications to allew a family amusement game machine arcaae with 2. game machines in a 900 sq. ft. retail space. The proposed eperating hours are 3:00 p.m. to 10:00 p.m. Monday thr.ugh Friday and 12:00 noon to 10:00 p.m. on Saturdays, Sunliays, Heliliays and during academic breaks. . . . . SITE AREA: Approximately 54,400 square feet (1.25 acres) 328.95 feet along E. Duarte Road FRONT AGE: EXISTING LAND USE &: ZONING; Two retail buildings totaling approximately 15,300 sq. ft. The front portion of the site is zoned C-2 (General Commercial) and the rear portion is zoned PR-1 (Single Family with a Commercial Parking overlay) GENERAL PLAN DESIGNATION: Commercial SURROUNDING LAND USES &: ZONING; North: Commercial and nonconforming residential zoned C-2 South; Multiple family residential zoned R-3 E as t : Auto repair zoned C-2 and PR.1 West: Gas station zoned C-2 PROPOSAL AND ANALYSIS The proposal is to install 20 amusement game machines, a change machine, a small office, and a unisex handicap bathroom. The proposed operating hours are 3;00 p.m. to 10:00 p.m. Monday through Friday and 12:00 noon to 10;00 p.m. on Saturdays, Sundays, Holidays and during academic breaks. In addition, the applicant will install security ca::-.eras and lighting to monitor the interior and exterior areas. The installation of 8 or more game machines constitutes a "Game Machine Arcade" which requires a Conditional Use Permit (Sees. 9275.1.48. &: 9275.6. et seq.) In addition, amusement game machines are subject to business licensing and operation regulations under Article VI of the Municipal Code. A copy of these regulations is attached. Backifound and Land Uses The property is developed. with a 14,400 sq.' ft. strip commercial building and a freestanding 900 sq. ft. donut shop with 400 sq. it of outdoor seating for total area of 1,300 sq. ft. This eating establishment was approved by CUP 76-3. CUP 94-005 May 10, 1994 Page 2 . There are 93 parking spaces on-site. The uses and parking requirements are as follows: . CUP 7&;3 114 There are a total of 93 on-site parking spaces. The donut shop has 26 parking spaces with one designated for handicap use allocated to it by CUP 7&;3. This use complies with the required number of parking spaces. Th~ remaining 67 spaces are for the strip commercial building. Based on retail uses, there is a 5 space deficiency. With the exception of the parking spaces for the donut shop, the parking spaces on this site are substandard in length (18 feet in lieu of 20 feet) and do not have wheel stops. All of the spaces are improperly striped, and several are labeled "NO PARKING" for what appears to be loading purposes. No parking modifications have been granted for any of the existing uses. Four handicap parking spaces are required at this site. ' The one existing handicap space is not properly striped or labeled. Compliance with the handicap parking regulations will probably result in a net loss of parking spaces, but is a requirement that should not be modified or disregarded. Approximately 700 sq. ft. of the proposed game machine arcade will be used for the game machines. One parking space is required for each 35 square feet of that area. This results in a requirement of 20 parking spaces in lieu of 5 spaces for a retail use, . CUP 94-005 May 10, 1994 Page 3 . . . or a deficiency of 15 spaces. When combined with the existing shortage, there would be an overall parking deficiency of 20 spaces for this retail property. A review of the parking situation indicates that no parking problem exists at this site. Bicycle Racks Section 9275.6.3. of the Special Regulations for Game Machine Arcades requires that adequate off-street space be provided for bicycles. Because the proposal is for a use that will primarily appeal to younger persons there will be a need for bicycle racks. The applicant has indicated that an area at the rear of the proposed arcade will be made available to accommodate bicycle parking. However, a detailed plan for the installation of bicycle racks will be necessary to assure that the bicycle parking will be provided in an appropriate manner. Security In addition to complying with the requirement that there be supervisory personnel over the age of 21 present at all times, the applicant is proposing to install lighting and security cameras to monitor the interior and exterior of the arcade, especially the rear parkiilg area. The Police Department has in the past reviewed other game machine installations in this area of the San Gabriel Valley, and has found that the presence of uniformed professional security personnel, in addition to adult supervision, significantly improves the security aspects of businesses with game machines. Furthermore, the incidence of truancy can be reduced if the hours of operation are limited to after school hours (as proposed by the applicant>. Of particular concern is the parking lot at the rear of the commercial buildings which is adjacent to residences. The parking lot is not secured, and the Police Department has responded to several complaints of loitering, vandalism, and other illegal activities. The occupants of the adjacent residences have been routinely impacted by these disturbances. Landsc"Pinlf The only landscaping on the site is a 450% sq. ft. planter behind the donut shop which was approved by CUP 76-3. It is poorly maintained with minimal planting. There is no other landscaping on the site. Based on Code requirements, approximately 1,800 sq. ft. (5%) of the parking area shall be landscaped and one tree is required for each 5 parking spaces (19 trees). CUP 94-005 May 10, 1994 Page 4 . . Ie The addition of approximately 1,350 sq. ft. of landscaping and 18 trees in the rear parking lot to meet the requirements would be burdensome since this application does not include any additional building space or significant alterations to the site. However, the landscaping behind the donut shop should be improved regardless of the fact that it is not in the vicinity of the proposed game machine arcade. Trash Enclosures There are 3 commercial trash bins on the site and they appear to be fully utilized. None are in enclosures as required by Code. The adding of masonry enclosures as required by Code would be burdensome since this application does not include any additional building space or significant alterations to the site. Environmental Review Pursuant to the provisions of the California Environmental Quality Act, the Planning Division has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDA nON The Planning Division recommends approval of Conditional Use Permit No. CUP 94-005 subject to the following conditions: 1. The hours of operation shall be from 3:00 p.m. to 10:00 p.m. Monday through Friday and 12:00 noon to 10:00 p.m. on Saturdays, Sundays, Holidays and during academic breaks. 2. Building occupancy (maximum 42 persons) accessibility, egress, safety features, and soundproofmg shall be provided and maintained to the satisfaction of the Acting Assistant Community Development Director/Building. including but not limited to, the following: a. Adequate access (including handicap access) to the building. the rest room, entries and exits, and throughout all parts of the game machine arcade. CUP 94-005 May 10, 1994 Page 5 . . . .. b. Plans for the installation and arrangement of the game machines, rest room, office, soundproofing, security equipment, and any tenant improvements shall be submitted for review and approval. A preliminary review by the Acting Assistant Community Development Director/ Building indicates that the proposed locations of the office and restroom will have to be revised to accommodate a handicap rest room, and to provide an adequate corridor to the rear exit. c. At least a minimum of 48 inches of clear aisle access shall be provided throughout the arcade from door to door, to the restroom, and between game machines. The aisle access space is to be in addition to the space necessary for the ~ame players and/or spectators. 3. Fire protection, water supply, and building occupancy shall be provided and maintained to the satisfaction of the Arcadia Fire Department, which may include, but are not limited to, the following: a. A manual and automatic fire alarm system installed in accordance with NFPA standards with transmission to an approved central station. b. Knox boxes with keys installed in accordance with Uniform Fire Code Section 10.302. c. All exit doors must open in the direction of exit travel (i.e. outward) and be signed and/or labeled as exits. d. At least one 2A-10BC fire extinguisher shall be installed. e. Plans for these and any other fire safety installations shall be reviewed and approved by the Fire Department prior to installation. 4. A Water Meter Clearance Application shall be submitted in order to ensure proper meter/service sizing. Any changes in the existing water service<s) (e.g. size, location or replacement) will be made by the Water Division at the expense of the applicant or property owner. 5. Backflow prevention devices shall be provided on any new landscape irrigation and fire sprinkler systems, and their installations are subject to inspections and approvals by the Arcadia Water Division. 6. Any new water service lateral, meter, flush-out or Eire hydrant may not be located closer than 3 feet from the top of 'x' of any driveway or other utility installation. CUP 94-005 May 10, 1994 Page 6 ... . 7., The applicant shall obtain the required Business License and Entertainment Permit(s) and comply with the Business Licensing and Game Machine Regulations stipulated in Article VI of the Municipal Code. 8. Professional and uniformed security personnel shall be present at the game machine arcade during all hours of operation. 9. Bicycle racks shall be provided and installed. A plan showing the proposed location of the bicycle rack(s) shall be submitted for review and approval to the Planning Division. 10. A Modification for the number of parking spaces is granted for CUP 94-005. This parking Modification does not constitute an approval of a general reduction of the parking requirement for the entire retail property, but rather only for the specific use approved by this CUP. Implied with this Modification is an approval to reduce the overall number of parking spaces as necessary to accommodate bicycle parking, and handicap accessibility requirements. . 11. The parking lot shall be redesigned to include the required handicap spaces and access, and shall be restriped according to Code. A Modification is granted for the lack of wheel stops, and substandard parking stall length if necessary to maintain an optimum number of spaces. 12. A parking plan shall be submitted for review and approval to the Planning and Building Divisions. 13. A Modification for the existing landscaping in lieu of 5% for the parking area is granted. This Modification is for the use approved by CUP 94-005 and not for any other new uses or changes to this retail property. 14. A Modification for one tree in lieu of 19 is granted. This Modification is for the use approved by CUP 94-005 and not for any other new uses or changes to this retail property. 15. The subject site shall be maintained in a manner that is consistent with the approval of CUP 94-005. The dead, dying and missing landscaping in the existing planter shall be replaced and maintained by the owner to the satisfaction of the Assistant Community Development Director/PlaMing whether or not any amusement games are installed. 16. All of the conditions of approval shall be complied with prior to or concurrent . with the installation of the game machines. Approval of CUP 94-005 shall not take effect until the property owner and applicant have executed and filed the Acceptance Form available from the Planning Division to indicate their awareness and acceptance of the conditions of approval. FINDINGS AND MOTIONS Approval If the Planning Commission intends to approve of this Conditional Use Permit application, the Commission should move to approve and file the Negative Declaration and direct staff to prepare an appropriate resolution that incorporates the Commission's decision, specific findings and conditions of approval. Denial If the Planning Commission intends to deny this Conditional Use Permit application, the Commission should move for denial and direct staff to prepare an appropriate resolution that incorporates the Commission!s decision and specific findings. Attached for the Planning Commission's consideration are the applicant's proposal and flyer, a land use and zoning map, the Business Ucense game machine regulations, the environmental documentation, and several letters from nearby residents. No game machine arcade or game ma\:hine shall be permined in a building an entran\:e of whi\:h is within five hundred (500) feet walking dislan\:e of any real estale parcel boundary con- laining any elementary school. junior high school orsenior high school. whether public or privlllely operated. We are protest a plan yOU are currently reviewing near the corner of Santa Anita Blvd. and Star liquor store. I have been Arcadia relatively quiet and writing this letter to to open a video arcade Duarte Rd., near the A business of this nature allows for an increase in vandalism and graffiti around the area. and additional congestion at the corner of the Arco station. which can barely manage its current traffic flow. Creating this kind of situation does not seem to be efficient planning. Especially troubling is that the proximity of the proposed video arcade to the liquor store is iikely to increase the chances of people under 18 years old buying and consuming alcoholic beverages. and possibly driving after doing so. We live facing the alley on that block, and have seen an increasing incidence of speeding teenager drivers. especially at night. During the day time, an arcade would become an additional temptation for the students of Arcadia High School, less than one block away, to leave campus during school hours. You have already allowed a video arcade to operate one-and-a-half blocks from where yOU are considering opening a new one. AS voters, we believe that businesses are an important part of the community; however, your foremost commitment should be to protect the safety and well-being of the city residents. It is a very hazardous situation with many near accidents. The left-turn-lane traffic trom Santa Anita onto Duarte has to slow down. at times to a complete stop, to avoid a line of cars going into the station.
