HomeMy WebLinkAbout1510 . . . RESOLUTION 1510 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 94-002, FOR A TEA ROOM RESTAURANT AT 21 E. HUNTINGTON DRNE. WHEREAS, on January 17, 1994 an application was filed by Gayle Theilacker for a Conditional Use Permit for a tea room restaurant, Planning Division Case No. C.U.P. 94-002, on property commonly known as 21 E. Huntington Dr., more particularly described as follows: The west 25 feet of Lot 6, Block 4 of the Santa Anita Tract, as recorded in Book 15, Pages 89 and 90 of Maps in the office of said County Recorder in the City of Arcadia, County of Los Angeles, State of California. WHEREAS, a public,hearing was held on February 22, 1994, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Division in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 1510 1 . . . 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit, with seating for 49 persons, upon the following conditions 1. That seating within the restaurant shall not exceed the requested maximum of 49 persons. 2. A trash enclosure must be provided on-site in accordance with code requirements. This requirement may be waived if an agreement is reached with the westerly property owner (19 Huntington Dr.) for shared trash enclosure usage. Said agreement shall be subject to approval by the Planning Director and maintained in writing on file in the Planning Division. 3. That restroom facilities be brought up to code compliance to accommodate patrons/sit down customers. This should be done at the time the interior remodeling is in progress. 4. Building code compliance shall be provided to the satisfaction of the Building Division. Upon re-submittal of new plans showing any required revisions, the eating establishment must be maintained per the plans on file in the Planning Division. S. That fire safety shall be provided to the satisfaction of the Arcadia Fire Department. 4. That c.u.P. 94-002 shall not take effect until the owner and applicant have executed an acceptance form available at the Planning Division indicating awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for its immediate suspension or revocation. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of February 22, 1994 and the following vote: AYES: Commissioners Daggett, Hedlund, Huang, Kovacic, Clark NOES: None ABSENT: None 2 1510 . . . Huntington Drive, The Planning Division is recommending approval subject to the conditions outlined in the staff report. GENERAL INFORMATION . Approximately 3,500 square feet 25 feet on Huntington Dr. EXISTING LAND USE & ZONING The site is currently developed with a two story retail building and is zoned C-2. GENERAL PLAN DESIGNATION . Commercial C.U.P.94-002 February 22, 1994 Page 1 . . . 'I.. BACKGROUND In July of 1993, a parking modification was granted for a proposed beauty salon for 1.7 .spaces in lieu of 10 required (MC 93-037). However, the proposed use never occupied the building and the site has remained vacant. At this time, 21 E. Huntington Dr. is the only unoccupied building on the north side of the block between Santa Anita and First Avenue adjacent to the City Parking district. PROPOSAL The proposed tea room restaurant will occupy the entire 2,600 square feet of ground floor area of the building. A portion of the second floor (approx. 1,500 square feet) will be used for storage. Some exterior face changes are proposed as well as interior remodeling. The applicant is requesting seating for 49 persons. The proposed hours of operation will be from 10:00 a.m. to 5:30 p.m., Tuesday through Saturday. The business will serve tea with some baked goods and sandwiches. Coffee will be available, however; tea will be the main emphasis. Retail items consisting of tea paraphernalia (tea bags, cups, etc.) will be sold as well. PARKING The site has 2 existing on-site parking spaces (1.7 spaces are allocated from the parking district). This total falls 22.3 spaces short of the 26 stalls required to comply with Code, The parking requirements for a restaurant-type use is 10 parking spaces per 1,000 square feet of gross floor area. The proposed use requires 26 parking spaces on-site. ANALYSIS Based upon staffs observation, the Parking district lot to the rear of the subject building will provide adequate parking for the proposed use. This is based on staffs current observation of the traffic flow into and out of the subject site. The parking district lot appears adequate enough to handle any proposed parking needs by retail, office uses or small scale restaurant establishment. The parking spaces required, in terms of Code requirements, does not reflect the existing conditions at the subject site. C.U.P.94-002 February 22, 1994 Page 2 ..... . REDEVELOPMENT GOALS The proposed use is also consistent with the types of uses which the City would like to see in the Redevelopment area. The Downtown Revitalization Strategy Plan promotes the concentration of retail, restaurant, service and entertainment uses in a compact cluster in the center of downtown. In addition, shared parking within the downtown core is encouraged in the new plan which will ultimately result in a revision of the existing parking policies. The proposed tea room is compatible with the redevelopment goal and should not pose a negative impact upon the surrounding businesses. In this case, strict interpretation of the parking requirements Chapter of the Code would result in an unreasonable hardship for the proposed project. ENVffiONMENTALDOCUMENTATION . Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance, When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Division recommends approval orc.u.p. 94-002 subject to the following conditions: 1. That the seating within the restaurant shall not exceed the requested maximum or 49 persons. 2. A trash enclosure must be provided on site in accordance with code requirements. This requirement may be waived if an agreement is reached between the westerly property owner (19 E. Huntington Dr.) for shared trash enclosure usage, said agreement shall be subject to approval by the Planning Director and maintained in writing on file in the Planning Division. . 3. That restroom facilities be brought up to code compliance to accommodate patrons/sit-down customers. This should be done at the time the interior remodeling is in progress. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find tha.t the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission).
