RESOLUTION NO. 1509
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE
PERMIT 94-003 FOR THE EXPANSION OF AN EXISTING HEALTH
CLUB AT 9956 LAS TUNAS DRIVE.
WHEREAS, on January 19, 1994, a Conditional Use Permit application was
filed by David Cirotto for the proposed expansion of the existing "Shape Up
America" health club, Planning Division Case No. C.U.P. 94-003 at 9956 Las Tunas
Drive, more particularly described as follows:
Lot 1 of Parcel Map 11933, in the Qty of Arcadia, County of Los Angeles,
State of California, as filed in Parcel Map Book 119, Pages 49 - 50 in the
Office of the Los Angeles County Recorder.
. WHEREAS, a public hearing was held on February 22, 1994, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Division in the
attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such CQJ\ditional Use Permit will not be detrimental
to the public health or welfare, or injurious to the property or improvements in
such zone or vicinity.
2. That the use applied for at the location indicated is a proper use for which
a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping
and other features are adequate to adjust said use with the land and uses in the
neighborhood.
4. That the site abuts streets and highways adequate in width and pavement
. type to carry the kind of traffic generated by the proposed use.

5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit for the expansion of the health club upon the following
conditions:
1. That fire protection shall be provided to the satisfaction of the Arcadia Fire
Department.
2. That "NO OVERNIGHT PARKING" signs shall be posted within the site's
parking lot.
3. That a modification be granted for 159 on-site parking spaces in lieu of 209,
and that this approval shall not constitute an approval for the general reduction in
parking for the total site. That this parking modification shall only be for the use'
approved by Cu.P. 94-003 (a health club).
4. That the building shall be repainted, and that the new colors be subject to
the review and approval of the Planning Division.
5. That the debris around the trash enclosure, which is directly behind the
health club, be removed and that the trash enclosure be painted subject to the
review and approval of the Planning Division.
6. That the proposed child care area shall only be used as a convenience to
the patrons of the health club.
7. That C.U.P. 94-003 shall not take effect until the owner and applicant have
executed a form available at the Planning Division indicating awareness and
acceptance of the conditions of approval.
. 8. Noncompliance with the prpvisions and conditions of this Conditional
Use Permit shall constitute grounds for its immediate suspension or revocation.
Section 4. The decision, fmdings and conditions contained in this Resolution
reflect the Commission's action of February 22,1994 and the following vote:

Section 5. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUMMARY
The applicant, David Cirotto, is requesting a conditional use permit to expand the
existing "Shape Up America" health club at 9956 Las Tunas Drive. The Planning
Division is recommending approval of the applicant's request subject to the
conditions as set forth in this staff report.
GENERAL INFORMATION
APPLICANT: David Cirotto (owner/manager of the health club)
LOCATION: 9956 Las Tunas Drive

REQUEST: A Conditional Use Permit to expand the existing "Shape Up
America" health club, which will also require a parking modification
for 159 existing on-site parking spaces in lieu of 209 spaces required
per Municipal Code Section 92695.
LOT AREA: 98,528 sq.ft. (2.26 acres)
FRONTAGE: 369.13 feet along Las Tunas Drive
280.00 feet along Rowland Avenue
224.79 feet along Baldwin Avenue
EXISTING LAND USE & ZONING:
Two commercial buildings and a parking lot currently exist on the site. The
larger building contains the health club, an Aaron Brothers retail store, and a
vacant unit. A Wendy's drive-through eating establishment occupies the other
building, as shown on the submitted site plan. The site is zoned C-2 and PR-3.

GENERAL PLAN DESIGNATION:
The subject site is designated as Commercial.
BACKGROUND INFORMATION
The subject building was constructed in 1950 and was occupied by a market until
1977. In 1981 the building was renovated to provide several leasable units.
Currently Aaron Brothers occupies approximately 9,600 sq.ft., and the Shape Up
America health club occupies 6,660 sq;ft. A third unit, which was recently vacated by
a savings and loan business, provides ' 3,075 sq.ft. The applicant proposes to expand
the health club into the vacant unit.
In 1978, Conditional Use Permit Application No. 78-16 was granted for the existing
Wendy's drive-through eating establishment. No parking modification was
necessary for this use which provides seating for 78 persons within the 2,400 sq.ft.,
establishment.
Arcadia Nautilus was the first health club to occupy the site in 1981. The use was
granted by Conditional Use Permit 81-8. In 1984 the health club expanded its facility
by adding a second floor area under Conditional Use Permit 84-17. The approved
expansion required a parking modification to permit 157 on-site parking spaces in
lieu of 162 parking spaces required for the entire site.
In 1985 the "Second Wind" health club replaced Arcadia Nautilus, and continued
the health club business to 1993.
The Shape Up America health club has occupied the subject location since last
December.
PROPOSAL
The applicant is seeking a conditional use permit to expand the existing health club
facility into the adjacent vacant space, as shown on the submitted site plan. The
proposed expansion would provide approximately 3,075 sq.ft., of additional ground
floor space which would be conver,ted into a new men's locker room, aerobic
workout area and office space. If this application is approved the total floor area for
the health club will be 9,735 sq.ft., which includes the existing second-floor area
(1,788 sq.ft.). Also, concurrent with the expansion the applicant is proposing to

convert a portion of the existing second floor space into a child care area, as a .
. convenience to the patrons of the health club.
PARKING
Currently there are 159 on-site parking spaces on the site, and with the proposed
expansion of the health club 209 parking spaces would be required. The following is
a breakdown of the current parking requirements for the site with the proposed
expansion:
Wendy's @ 2,400 sq.ft.
Aaron Brothers @ 9,600 sq.ft.
Shape Up America health club @ 9,735 sq.ft.

In this particular case the square footage of the proposed "workout area" determines
the required number of on-site parking spaces for the health club. Within the
proposed 9,735 sq.ft., health club facility there are several workout areas that total
3,956 sq.ft., which amounts to a requirement of 113 parking spaces (i.e., 1 space for
each 35 sq. ft., of workout area).
The attached "Parking Survey" was submitted by the applicant, which indicates that
the site has a peak parking demand of 51 parking spaces (count occurred at 5:00 p.m
on January 31,1994). A total of 159 spaces exist on the site, which indicates that there
would be ample on-site parking for the proposed expansion of the health club. Staff
has made random vehicle counts on the site, and concurs with the applicant's
parking survey.
Staff is recommending, as a condition of approval, that "NO OVERNIGHT
PARKING" signs be posted within the site's parking lot. This recommendation is in
response to a complaint that was recently made regarding the occasional overnight
parking of refrigerated commercial vehicles on the site.
MISCELLANEOUS INFORMATION
The applicant has advised staff that the hours of operation are Monday through
Thursday 6:00 a,m. to 10:00 p.m., Friday 6:00 a.m. to 9:00 p.m., Saturday 8:00 a.m. to
6:00 p.m., and Sunday 9:00 a.m. to 5:00 p.m. During the peak hours of operation
there are approximately 65 clients and 5 employees.

Prior to submitting this proposal the applicant recently repainted the northwesterly
exterior comer of the subject building in a color scheme that consists of red, white
and blue walls with an overlay of white stars. It is staffs opinion that such a color
scheme does not comply with the City's architectural design review requirements

because it is not visually harmonious with the surrounding development. Staff is '
recommending, as a condition of approval, that the building be repainted and that
the new colors be subject to the review and approval of the Planning Division.
Staff is also recommending that the debris around the trash enclosure, which is
directly behind the health club, be removed and that the trash enclosure be painted.
ANALYSIS
A health club is a permitted use in the C-2 zone with an approved conditional use
permit. Based upon the applicant's proposal it is staffs opinion that this expansion
will increase the types of activities available to the health club members but that it
will not cause a significant increase in the demand for parking.

Pursuant to the prOVIsIons of the California Environmental Quality Act, the
Planning Division has prepared an initial study for the proposed project. Said'
initial study did not disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected by the project
including land, air, water, .minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole, there is
no evidence that the proposed project will have any potential for an adverse effect
on wildlife resources. Therefore, a Negative Declaration has been prepared for this
project.
RECOMMENDATION
The Planning Division recommends approval of Conditional Use Permit 94-003
subject to the following conditions:
1. That fire protection shall be provided to the satisfaction of the Arcadia Fire

parking lot.

FINDINGS AND MOTIONS

If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find
that the project will not have a significant effect on the environment and direct
staff to prepare the appropriate resolution incorporating the specific findings and
conditions of approval set forth in the staff report, or as modified by the
Commission.
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and fmdings in support of that
decision.
