BALDWIN AVE. WHEREAS, on December 30, 1993, an application was filed by Victor Garcia for a Conditional Use Permit for a Mexican food take-out restaurant with seating for (8) persons, Planning Division Case No. C.U.P. 94-001, on property commonly known as 921 S. Baldwin Ave., more particularly described as follows: Portions of Lot 24 of Tract No. 2731 in the Oty of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 5783, Page 13 of Maps, in the office of said County Recorder. WHEREAS, a public hearing was held on February 8, 1994, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Division in the attached report is true and correct, Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2, That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse irnpacton the environment. 1 .. .. . Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit for the operation of a Mexican food take-out restaurant upon the following conditions: 1. That the seating within the restaurant shall not exceed the requested maximum of (8) persons. 2 That Building Code compliance and conditions of approval shall be met to the satisfaction of the Building Division. 3. That fire safety, emergency access and egress, and occupancy shall be provided to the satisfaction of the Arcadia Fire Department, regarding occupancies, exits and seating plans for students. 4. That all conditions of approval shall be complied with prior to occupancy. 5. That C.U.P. 94-001 shall not take effect until the owner and applicant have executed an acceptance form available at the Planning Division indicating awareness and acceptance of the conditions of approval. 6. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for its immediate suspension or revocation. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of February 8, 1994 and the following vote: AYES: Commissioners Huang, Kovacic, Daggett NOES: None ABSENT: Clark ABSTAIN: Hedlund Section 5. STOKES, ASSISTANT PLANNER C.U.P.94-001 A conditional use permit and related parking modifications have been requested by Victor Garcia for a Mexican food take-out restaurant with seating for (8) persons at 921 S. Baldwin Avenue. The Planning Division is recommending approval subject to the conditions outlined in the staff report. GENERAL INFORMATION . APPLICANT: LOCATION: REQUEST: LOT AREA: FRONTAGE: Victor Garcia 921 S. Baldwin Ave. A Conditional use permit for a take-out food restaurant with seating for (8) persons Approximately 31,~00 square feet (Approximately 1,373 square feet for tenant space A) 171 feet on Baldwin Ave.and 122 feet along Fairview Ave. EXISTING LAND USE & ZONING The site is currently developed with a retail shopping center and is zoned C-2. There are two restaurant establishments and one diet center with approved Conditional Use Permits, currently in operation. Both restaurants contain a minimal number of seats and chairs. SURROUNDING LAND USE & ZONING . North: South: West: East: Color Tile, Sizzler restaurant and mixed commercial; Zoned C-2 7 Eleven, Mexican restaurant and mixed commercial; Zoned C-2 Multiple Family Residential; Zoned R-3 Mixed commercial and restaurants; Zoned C-2 C.U.P.94-001 February 8, 1994 Page 1 . GENERAL PLAN DESIGNATION Commercial PROPOSAL The existing retail space was mostrecentIy occupied by a flower shop. The proposed Mexican food restaurant will occupy approximately 1,373 square feet within the 10,000 square foot retail shopping center. The applicant is requesting seating for a maximum (8) persons. Operating hours will be from 9am to 9pm, Monday through Saturday and closed on Sunday. SPECIAL INFORMATION A parking modification was approved by the Modification Committee on February 12, 1991 (Case No. MC 91-008) to allow 50 parking spaces in lieu of 52 required for the inclusion of a dental office at the retail site. Staffs findings at that time indicated that no parking problem was evident and no complaints had been received. . PARKING On-site parking is located in the rear of the subject building. There are (50) parking spaces existing (38 regular, 10 compact and 2 handicap). Adjacent retail businesses and restaurants have their own parking lots which are inaccessible to the proposed project. Site inspections were conducted at peak hours of the day (12 noon to 1:30 pm) and evening (5 pm to 6:30 pm). At these times, the subject site showed insignificant changes in activity. Based upon the parking requirements for restaurants (10 per 1,000 sq. ft. of gross floor area) the proposed restaurant requires 13 spaces (or a net increase of 6 spaces on site). The proposed restaurant increases the required parking for the center by 6 spaces (50 spaces"in lieu of 58 spaces required; taking into consideration the modification granted for the dental office), Staff concurs with the Modification Committee's findings of two years ago in that the retail shopping center has adequate on-site parking for the existing uses. Staff does not feel that the proposed use will create a significant increase in pedestrian or vehicular traffic either. This conclusion is based on staffs past eXperience with food establishments and current observation of the traffic flow into and out of the subject site. . CU.P.94-001 February 8,1994 Page 2 . ENVIRONMENTAL DOCUMENTATION Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Division recommends approval ofC.U.P. 94-001 subject to the following conditions: 1. That the seating within the restaurant shall not exceed the requested maximum of 8 persons. . 2. Fire safety shall be provided to the satisfaction of the Fire Department. 3. The eating establishment shall be maintained per the plans on file in the Planning Division. 4. That. CU,P, 94-001 shall not take effect until the owner and applicant have executed a form available at the Planning Division indicating awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. FINDINGS AND MOTIONS Approval . If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). c.U.P.94-001 February 8,1994 Page 3 .
