RESOLUTION 1505
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE
PERMIT 93-007, FOR A TUTORIAL SCHOOL AT 556 LAS TUNAS DR.
WHEREAS, on September 14, 1993, an application was filed by Yvonne Lu
for a Conditional Use Permit for a school offering general education tutoring for
junior high through high school age students, Planning Department Case No.
c.u.P. 93-007, on property commonly known as 556 Lazs Tunas Dr. , more
particularly described as follows:
Lot 27 of Tract No. 6641 in the City of Arcadia, County of Los
Angeles, State of California, as per Map recorded in Book 126,
Page 67 of Maps, in the office of said County Recorder.
WHEREAS, a public hearing was held on September 14, 1993, at which time
all interested persons were given full opportunity to be heard and to present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in the
attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental
to the public health or welfare, or injurious to the property or improvements in
such zone or vicinity.
2. That the use applied for at the location indicated is a proper use for which
a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping
ahd other features are adequate to adjust said use with the land and uses in the
neighborhood.
4. That the site abuts streets and highways adequatejn width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not, adversely affect
the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment.

Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit for the operation of a tutorial school upon the following
conditions:
1. That parents dropping students off should park in designated parking
stalls only. There shall be no parking along side curbs or in driveways that will block
the flow of traffic into and out of the retail center.
2. That Building Code compliance and conditions of approval shall be met to
the satisfaction of the Building Department.
3. That fire safety, emergency access and egress, and occupancy shall be
provided to the satisfaction of the Arcadia Fire Department, regarding occupancies,
exits and seating plans for students.
4. That all conditions of approval shall be complied with prior to occupancy.
5. That c.u.P. 93-007 shall not take effect until the owner and applicant have
executed an acceptance form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
6. Noncompliance with the provisions and conditions of this Conditional
Use Permit shall constitute grounds for its immediate suspension or revocation.
Section 4. The decision, findings and conditions contained in this Resolution
reflect the Commission's action of September 14, 1993 and the following vote:
A YES: Commissioners Amato, Daggett, Hedlund, Huang, Clark
NOES: None
ABSENT: None
Section 5. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forWarded to the City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular
meeting of the Planning Commission held on the 12th day of October, 1993 by the

~ PROPOSAL
The applicant is requesting a conditional use permit to operate a general education
tutorial school. The school will be utilizing approximately 2,300 square feet of office
space on the second floor of the two-story retail/office center.
The school will be conducting tutorial sessions for students between the 7th and 12th
grades. The hours of operation will be from 10:00 am to 6:00 pm Monday through
Saturday. The maximum number of students anticipated on-site at anyone time is 25.
PARKING
There are 113 on-site parking spaces existing, located on the sides and the rear of the
subject building. There are currently 5 first floor tenants and 1 second floor tenant in
operation:

ANALYSIS

The daily operation of the existing businesses at the office center do not result in a great
demand for parking. Because the request for the school proposes a minimal number
of students, staff does not feel that the flow of traffic: into and out of the site will be
significantly affected. Upon several site inspections conducted at odd hours throughout
the day, there appears to be adequate parking and no congestion resulting from the
tenants currently operating. The proposed school should not result in any significant
impact in traffic flow.
Pursuant to the provisions of the California Environmental Quality Act, the Planning
Department has prepared an initial study for the proposed project. Said initial study
did not disclose any substantial or potentially substantial adverse change in any of the
physical conditions within the area affected by the project including land, air, water,
minerals, flora, fauna, ambient noise and objects of historical or aesthetic: significance.
When considering the record as a whole, there is no evidence that the proposed project
will have any potential for adverse effect on wildlife resources or the habitat upon
which the wildlife depends. Therefore, a Negative Dec:1aration has been prepared for
this project

.. RECOMMENDATION
The Planning Department recommends approval of C.U.P. 93-007 subject to the
following conditions:
1. Parents dropping students off should park in designated parking areas only.
There shall be no parking curb side along Las Tunas Dr. or in the driveways that
will block traffic flow into and out of the retail/office center.
2. Building Code compliance and conditions of approval must be met to the
satisfaction of the Building Department, as defined and stated in the attached
memo.
3. Fire safety shall be provided to the satisfaction of the Fire Department, as defined
and stated in the attached memo.
