RESOLUTION 1499
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE
PERMIT NO. CUP 93-004 FOR A TUTORIAL CENTER IN 2,280 SQ.
Fr. OF RETAIL SPACE AT 1 W. DUARTE ROAD.
WHEREAS, on February 4, 1993, a Conditional Use Permit application was
filed by Mr. Jeng-Chang Li for a tutorial center in a 2,280 square foot retail space,
Planning Department Case No. CUP 93-004, at property commonly known as 1
W. Duarte Road, more particularly described in the attached Exhibit "A".
WHEREAS, a public hearing was held on May 11, 1993, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning Department
in the attached report is true and correct.
SECTION 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or weUare, or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one for
which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping and other features required to adjust said use with the land and uses
in the neighborhood.
4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on
the environment, and that based upon the record as a whole there is no evidence
that the proposed project will have any potential for adverse effect on wildlife
resources or the habitat upon which the wildlife depends.
SECTION 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit for a tutorial center for up to 30 students of elementary

through high school age in the existing 2,280 square foot retail space at 1 W.
Duarte Road with the operating hours of 9:00 a.m. to 9:00 p.m., Monday through
Friday, and 9:00 a.m. to 5:00 p.m. on Saturdays upon the following conditions:
1. Building occupancy, accessibility, and safety features shall be provided
and maintained to the satisfaction of the Building Division. Such shall include,
but not be limited to, the following:
a. Adequate access (i.e. handicap access) to the restroom facilities and
throughout all parts of the tutorial center.
b. All corridors and common areas shall have 20 minute labeled door
and frame assemblies.
c. All corridors shall be a minimum of 44 inches clear in width. No
fixtures or appurtenances shall encroach into the 44 inch clear width.
d. Panic exiting hardware shall be provided on exterior exit doors.
e. Corridor ventilation ducts that penetrate the required one-hour wall or
ceiling assemblies shall have fire dampers.
2. Fire protection, water supply, and building occupancy shall be provided
and maintained to the satisfaction of the Arcadia Fire Department. Such shall
include, but not be limited to, the following:
a. A minimum of two exits as specified by the Uniform Building Code.
b. The occupancy of this facility shall be classified as an E-l Occupancy and
the maximum occupant load shall not exceed 62 persons.
c. An automatic fire alarm system must be installed per Uniform
Building Code Section 809, and Uniform Fire Code Section 14.104(d).
d. Fire sprinklers shall be installed as necessary due to the addition of any
wall or partitions.
e. A Knox Box with keys shall be installed per Uniform Fire Code Sec. 10.302.
f. Plans for these and any other fire safety installations shall be reviewed
and approved by the Fire Department prior to installation.
3. Any changes in the existing water service(s) (Le. size or location) will
be made by the Arcadia Water Division at the developer's expense.
4. Bicycle rack(s) shall be provided and installed to the satisfaction of the
Planning Director.
S. A Modification for 55 parking spaces in lieu of 67 spaces is granted for
CUP 93-004 and is in addition to the parking modification granted for CUP 88-
004. These parking modifications do not constitute an approval for a general
reduction of the parking requirements for the entire retail center, but only for

the specific uses approved by CUP 88-004 and CUP 93-004.
6. The subject site and interior layout of units D, E & F shall be improved
and maintained in a manner that is consistent with the plans approved for the
original construction of this retail building, and with the plans filed with the
Planning Department for CUP 93-004.
7. All of the conditions of approval shall be complied with concurrently
with the installation of the tenant improvements for the tutorial center.
Noncompliance with the provisions and conditions of CUP 93-004 shall consti-
tute grounds for its immediate suspension or revocation which may result in
closure of the subject establishment.
8. Approval of CUP 93-004 shall not take effect until the property owner
and applicant have executed and filed the Acceptance Form available from the
Planning Department to indicate their awareness and acceptance of the
conditions of approval.
SECTION 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of May 11, 1993 and the following vote:
A YES: Hedlund, Huang and Clark
NOES: None
ABSENT: Amato and Daggett
SECTION 5. The Secretary shall certify to the adoption of this Resolution
and shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUMMARY
This Conditional Use Permit application was submitted by Mr. Jeng-Chang U to
operate a tutorial center for elementary through high .school age students at the
retail complex known as 1 W. Duarte Road. The Planning Department is
recommending approval of Conditional Use Permit No. CUP 93-004 subject to
the conditions in this report.
GENERAL INFORMATION
APPLICANT: Mr. Jeng-Chang Li
LOCATION: 1 W. Duarte Road, Units D, E & F
REQUEST:
A Conditional Use Permit and parking modification to allow a
tutorial center for approximately 30 elementary through high
school age students in a 2,280 sq. ft. retail space.
The operating hours will be 9:00 a.m. to 9:00 p.m., Monday
through Friday, and 9:00 a.m. to 5:00 p.m. on Saturdays.
SITE AREA: 33,227.9 square feet (0.76 acre)
FRONTAGE: 101.25 feet along W. Duarte Road
239.97 feet along S. Santa Anita Avenue

Two retail buildings totalling 9,200 sq. ft. with 55 on-site parking
spaces and one loading zone. The zoning is C-2 (General
Commercial)

GENERAL PLAN DESIGNATION:
C - Commercial
BACKGROUND
The 9,200 sq. ft. retail center was built in 1987. There are currently 55 on-site
parking spaces and one loading zone. The subject property has access from
Duarte Road and southbound Santa Anita Avenue. Exiting from the property is
limited to right turns only.
In February of 1988, Conditional Use Permit No. CUP 88-004 (Resolution No.
1362) was granted for the seating of 12 persons in the 1,150 sq. ft. yogurt shop and
included a parking modification of 55 spaces in lieu of 64.
In January of 1992, Conditional Use Permit No. CUP 92-002 (Resolution No. 1483)
was granted for a tutorial center for 20 persons in 2,020 sq. ft. of retail space at this
property. That CUP was not implemented and has expired.
PROPOSAL AND ANALYSIS
The proposal is to use the 2,280 sq. ft. in the three westerly units of the north
building as a tutorial center for up to 30 elementary through high school age
students. The proposed operating hours are 9:00 a.m. to 9:00 p.m. on weekdays,
and 9:00 a.m. to 5:00 p.m. on Saturdays. Oasses are to run from 60 to 90 minutes
each and there would not be more than four classes at a time.
With limited exceptions for trade schools, and voice and music lessons, all
instructionally related uses require a Conditional Use Permit (Sec. 9275.1.35.1.) in
any zone.
Automobile Parking
There are a total of 55 on-site parking spaces which exceeds the requirement of 46
spaces for the 9,200 sq. ft. of retail space on the site. The landscaping of the
parking area complies with Code and is adequately maintained.

Approximately 1,125 sq. ft. of the proposed 2,280 sq. ft. tutorial center will be used
for classroom space. One parking space is required for each 35 square feet of
classroom area. Based upon that requirement, this tutorial center will need 32.1
parking spaces which results in a modification of 55 spaces in lieu of 67 spaces.
When combined with the parking modification of 55 spaces in lieu of 64 ,spaces
that was granted by CUP 88-004 for the yogurt shop, the overall parking
modification for this retail center would be 55 parking spaces in lieu of 84 spaces.
Because most of the students at the proposed tutorial center will not be driving
themselves, it is not anticipated that the tutorial center will increase the parking
demand. The modification for the yogurt shop has not had a detrimental affect
upon the parking situation of this retail center.
Bicycle Parking
Because the proposed tutorial center will include children, there may be a need for
bicycle parking. There is an open area to the west of units D, E & F that will
accommodate bicycle parking, and such facilities should be located in this area.
Environmental Review
Pursuant to the provisions of the Califurnia Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project.
Said initial study did not disclose any substantial or potentially substantial
adverse change in any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna, ambient noise and
objects of historical or aesthetic significance. When considering the record as a
whole, there is no evidence that the proposed project will have any potential for

adverse effect on wildlife resources or the habitat upon which the wildlife
. depends. Therefore, a Negative Declaration has been prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of Conditional Use Permit No.
CUP 93-004 subject to the following conditions:
1. Building occupancy, accessibility, and safety features shall be provided and

in the staff report, or as modified by the Commission.

Denial
If the Planning Commission intends to deny this Conditional Use Permit
application, the Commission should move to deny and adopt Resolution No.
1499 which incorporates the Commission's decision and specific findings.
Note: Because there will not be a May 25,1993 meeting, resolutions of approval
and denial have been drafted so that the applicant might avoid an
inordinate delay in the processing of this application.
