RESOLUTION 1497
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE
PERMIT NO. CUP 93-002 TO INSTALL UP TO 20 AMUSEMENT
GAMES AT THE EXISTING 1,075 SQ. Fr. RETAIL SPACE AT 160
EAST DUARTE ROAD.
WHEREAS, on February 4, 1993, a Conditional Use Permit application was
filed by Gail Marshall and Arlene Marshall to install approximately 20 game
machines in a 1,075 square foot retail space, Planning Department Case No. CUP
93-002, at property commonly known as 160 E. Duarte Road, more particularly
described as follows:
Parcels 1 and 2 of Parcel Map No. 15487 in the City of Arcadia,
County of Los Angeles, State of California, as per Map recorded in
Book 167, Pages 88 and 89 of Maps, in the Office of said County
Recorder.
WHEREAS, a public hearing was held on March 9,1993, at which time all
interested persons were given full opportunity to be heard and to present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning Department
in the attached report is true and correct
SECTION 2 This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare, or injwious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is properly one for
which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping and other features required to adjust said use with the land and uses
in the neighborhood.

4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely
affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on
the environment, and, that based upon the record as a whole there is no
evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends.
SEcnON 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit to install up to 20 game machines in the existing 1,075
square foot retail space at 160 E. Duarte Road with the operating hours of 2:00
p.m. to 10:00 p.m. on school days and nights and 10:00 a.m. to 10:00 p.m. on
weekends, holidays and summer vacation upon the following conditions:
1. Building occupancy, accessibility, and safety features shall be provided
and maintained to the satisfaction of the Chief Building Official. Such shall
include, but not be limited to, the following:
a. Adequate access (i.e. handicap access) to the restroom facilities and
throughout all parts of the game machine arcade.
b. Plans for the installation and arrangement of the game machines shall
be submitted for review and approval.
c. A minimum of 36 inches of clear aisle access shall be provided
throughout the facility, from door to door, and to the restroom. The aisle
accesses are to be in addition to any space necessary for the game players and/or
spectators:
2. Fire protection, water supply, and building occupancy shall be provided
and maintained to the satisfaction of the Arcadia Fire Department. Such shall
include, but not be limited to, the following:
a. A full fire alarm system installed in accordance with NFPA-72
standards with transmission to an approved central station.
b. Installation of Knox boxes with keys in accordance with UFC Sec. 10.302.
c. All exit doors must open in the direction of exit travel (i.e. outward)
d. Installation of one 2A-10Be fire extinguisher.
e. Plans for these and any other fire safety installations shall be reviewed
and approved by the Fire Department prior to installation.

3. Any changes in the existing water service(s) (i.e. size or location) will be
made by the Water Division at the developer's expense.
4. The applicant shall comply with the Business Licensing and Game
Machine Regulations stipulated in Article VI of the Municipal Code which
include, but are not limited to, the following:
a. Any locations where a game machine is operated shall provide
personnel over twenty-one (21) years of age to maintain supervision of each
game machine and patrons thereof.
b. Any locations where any game machine is operated shall prohibit
persons under the age of eighteen (18) years from using or playing any game
machine between the hours of 8:00 a.m. and 3:00 p.m., Monday through Friday
and after 10:00 p.m. daily, unless accompanied by a parent or guardian. The 8:00
a.m. through 3:00 p.m. restriction shall not apply during school holidays and
school vacation periods recognized by schools within the City of Arcadia.
5. Bicycle racks shall be provided and installed to the satisfaction of the
Planning Director.
6. Modifications for six parking spaces in lieu of 26 spaces and deletion of
the loading zone are granted for CUP 93-002 and are in addition to the parking
modification granted for CUP 86-10. These parking modifications do not
constitute an approval for a general reduction of the parking requirement for the
enlireretail building, but rather only for the specific uses approved by CUP 86-10
and CUP 93-002.
7. The subject site and interior layout shall be improved and maintained
in a manner that is consistent with the plans approved for the original
construction of this retail building, as well as with the plans filed with the
Planning Department for CUP 93-002. The following deficiencies shall be
corrected by the owner and/or applicants to the satisfaction of the Planning
Director whether or not any amusement games are installed:
a. Installation of a wheel stop in the parking space directly behind the
trash enclosure.
b. Replacement of the four missing trees (minimum 15 gallon size) in the
planters on the east and west sides of the retail building.
c. Restoration of the landscaping in the planters along the west side of the
building and in the vicinity of the trash enclosure.

d. Repainting of the metal flashing along the tops of the parapet walls.
8. All of the conditions of approval shall be complied with concurrently
with the installation of the amusement games. Noncompliance with the
provisions and conditions of CUP 93-002 shall constitute grounds for its
immediate suspension or revocation which may result in closure of the subject
establishment.
9. Approval of CUP 93-002 shall not take effect until the property owner
and applicant have executed and filed the Acceptance Form available from the
Planning Department to indicate their awareness and acceptance of the
conditions of approval.
SECTION 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of March 9, 1993 and the following
vote:
A YES: Amato, Daggett, Hedlund and aark
NOES: Huang
ABSENT: None
SECTION 5. The Secretary shall certify to the adoption of this Resolution
and shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUMMARY
This Conditional Use Permit application was submitted by Gail Marshall and
Arlene Marshall to install approximately 20 amusement game machines at 160 E.
Duarte Road. The Planning Department is recommending approval of
Conditional Use Permit No. CUP 93-002 subject to the conditions in this report.

days and nights and 10:00 a.m. to 10:00 p.m. on weekends,
holidays and summer vacation.

GENERAL PLAN DESIGNATION:
C - Commercial
BACKGROUND
The 4,600 sq. ft. retail building was built in 1986 and complied with all zoning
requirements at that time. There are currently 23 on-site parking spaces and one
loading zone. The subject property shares with the adjacent shopping center, access
rights from both Duarte Road and Second Avenue by way of two 25 foot wide
driveways to the west and south, respectively, of the subject building.
In September of 1986, Ccmditional Use Permit No. CUP 86-10 (Resolution No. 1320)
was granted for the seating of ten customers in the 769 sq. ft. yogurt shop. CUP 86-10
included a parking modification of 23 spaces in lieu of34.
PROPOSAL AND ANALYSIS
The proposal is to install approximately 20 amusement game machines along with
a counter area for distributing change. The proposed operating hours are 2:00 p.m.
to 10:00 p.m. on school days and nights, and 10:00 a.m. to 10:00 p.m. on weekends,
holidays and during summer vacation. In addition, the applicants have indicated
that they will install security cameras and lighting to monitor the parking areas.
The installation of eight or more games constitutes a "Game Machine Arcade"
which requires a Conditional Use Permit (Sees. 9275.1.48. & 9275.6. et seq.) In
addition, amusement game machines are subject to business licensing and other
related regulations under Article VI of the Municipal Code. A copy of these
regulations is attached.
Automobile Parking
There exists a total of 23 on-site parking'spaces and one loading zone which
complies with the requirements for a 4,600 sq. ft. retail building. The loading zone
is not delineated as required and is being used as an additional parking space.
However, it does not appear that any of the uses in this retail building needs a

10'x25' loading zone. In addition, a wheel stop is needed for the parking space
directly behind the trash enclosure.
The parking modification of 23 spaces in lieu of 34 that was granted for the yogurt
shop does not appear to be having a detrimental affect upon the parking situation
of the subject retail building or upon the adjacent shopping center. The parking at
the east end of the shopping center is not being fully utilized and may be mitigating
any parking difficulties at the subject retail building. The parking on the adjacent
shopping center property is not available to the applicants to satisfy the parking
requirements of their proposed game machine arcade.
Approximately 900 sq. ft. of the proposed 1,075 sq. ft. game machine arcade will be
available for the installation of game machines. One parking space is required for
each 35 square feet of area available for the game machines. This results in a
requirement of 26 parking spaces in lieu of six spaces for the 1,075 sq. ft. retail space.
When combined with the parking modification for the yogurt shop, the overall
parking modification for this retail building would be 23 parking spaces in lieu of
55 spaces. The operation of an arcade at this location will probably not increase the
parking demand, and there are no indications that the existing number of parking
spaces is insufficient.
Bic;ycle Parking
Section 9275.6.3. of the Special Regulations for Game Machine Arcades requires that
adequate off-street parking be provided for bicycles as well as automobiles. Because
the proposed game machines primarily appeal to young children (under 16 years old) .
there will probably be a significant need for bicycle parking. The applicants have
designated an area at the front of the building to accommodate bicycle parking.
Landscaping
The existing 820 sq. ft. of landscaping in the parking areas exceeds the five percent
minimum requirement. However, the trees that had been included in the planters
along the east and west sides of the building when this retail project was originally
constructed are missing, and the landscaping in the planters in the vicinity of the
trash enclosure need to be cleaned up.
Environmental Review
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project. Said
initial study did not disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected by the project
including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole, there

is no evidence that the proposed project wiil have any potential for adverse effect
on wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of Conditional Use Permit No.
CUP 93-002 subject to the following conditions:
1. Building occupancy, accessibility, and safety features shall be provided and
maintained to the satisfaction of the Chief Building Official. Such shall
include, but not be limited to, the following:
a. Adequate access (i.e. handicap access) to the restroom facilities and
throughout all parts of the game machine arcade.

FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to approve this Conditional Use Permit
application, the Commission should move to approve and file the Negative
Declaration and adopt Resolution No. 1497 which incorporates the Commission's
decision, specific findings and conditions of approval as set forth in the staff report,
or as modified by the Commission.
Denial
If the Planning Commission intends to deny this Conditional Use Permit
application, the Commission should move to deny and adopt Resolution No. 1497
which incorporates the Commission's decision and specific findings.
Note:
Because there will not be a March 23,1993 meeting, resolutions of approval
and denial have been drafted so that the applicants may avoid any
inordinate delay in the processing of this application.

CHAPTER 4.
SPEOAL REGULATIONS
PART 1.
ENTERTAINMENT ENTERPRISES
64U.5. GAME MACHINE
REGULATIONS.
Each entenainment pennit issued for a game
machine shall be subject to the following condi-
tions:
I. The location .....here each game machine is
operated shall provide sufficient security mea-
sures to effectively regulate interior and exterior
loitering, parking congestion, disturbing noise
and light, loud conversations and criminal
activities.
2. Any locations where a game machine is
operat~ shall provide personnel over twenty-
one (21) years of age to maintain supervision of
each game machine and patrons thereof.
3. Any locations where any game machine is
operat~ shall prohibit persons under the age of
eighteen (18) years from using or playing any
game machine between the hours of 8:00 A.M.
and 3:00 P.M.. Monday through Friday and after
10:00 P.M. daily, unless accompanied by a parent
or guardian. The 8:00 A.M. through 3:00 P.M.
restriction shall not apply during school holidays
and school vacation periods recognized by
schools within the City of Arcadia.
4. No game machine arcade or game machine
shall be pennitted in a building an entrance 01
which is within five hundred (500) feet walking
distance of any real estate parcel boundary con.
taining any elementary school, junior higb
school or senior high school, whether public 01
privately operated. This Subsection 6411.S.4
shall not apply to any building in which a gam~
machine or machines were lawfully in operatio~
on the effective date of Ordinance No. 1164 pro-
vid~ no such building shall contain nor shall a
permit be issued for more game machines thaII
the number lawfully in operation on the effectiv~
date of Ordinance No. 1764 until such time suc~
building complies with this subsection. (Added

DIVISION 1.
AMUSEMENT AND GAME MACHINES
6411. APPLICATION.
Each application for a license under subsec-
tion 6220.4 shall describe the location where
each machine is to be operated. (Amended by
Ord. 1764 adopted 2.15-83)
6411.1. DISPLAY OF LlCENSEE'S
NAME.
Each machine shall also bear the name of the
licensee in plain view in letters of not less than
one-fourth inch in height.

6411.2. (Repealed by Ord. 1764 adopted
2-15.83)
6411.3. PENALTIES.
Each and every machine described in subsec-
tion 6220.4 and operated in the City and not
licensed or not complying with other regulations
of this Article may be sealed against funher oper-
ation and held.by the City, at the owner's risk,
until all license fees, storage charges and other
accumulated costs are paid.
6411.4. GAMBLING PROHIBITED.
No per.son, either as ptincipal, agent,
employee or otherwise, shall operate. play or
utilize, or permit any person or persons to oper-
ate, play or utilize any amusement machine,
game or device described in subsection 6220.4
for the purpose of gambling, betting, wagering or
pledging in any manner whatsoever any money,
thing or consideration of value or the equivalent
or memorandum thereof, upon the outcome,
score or result oFthe playing or operation of said
amusement machine, game or device.
