RESOLUTION 1495
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL
USE PERMIT 93-001 TO OPERATE A COFFEE BAR WITH SEATING
FOR 7 PERSONS AT 733 WEST NAOMI AVENUE, UNIT "B"
WHEREAS, on December 21, 1992, an application was filed by John Daigle to
operate a coffee bar with seating for 7 persons, Planning Department Case No.
C.U.P. 93-001 at 733 West Naomi Avenue, Unit "B", more particularly described as
follows:
Lot 2 of Parcel Map 17248, in the City of Arcadia, County of
Los Angeles, State of California, as flied in Book 184, Pages
45 - 47 of Parcel Maps in the Office of the Los Angeles County
Recorder.
WHEREAS, a public hearing was held on January 26, 1993, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in the
attached. report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental
to the public health or welfare, or injurious to the property or improvements in
such zone or vicinity.
2 That the use applied for at the location indicated is a proper use for which
a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping
and other features are adequate to adjust said use with the land and uses in the
neighborhood.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.

5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit for the operation of a coffee bar upon the following
conditions:
1. Fire safety shall be provided to the satisfaction of the Fire Chief
2. That seating shall be limited to a maximum of 7 persons.
3. That there shall be no food preparation on the premises and that all food
served shall be prebaked and prepackaged.
4. That no lunches or dinners shall be served and the use shall remain
strictly a coffee (tea) type bar.
5. A modification be granted for 760 on-site parking spaces in lieu of 1,401,
and that this approval shall not constitute an approval for the general reduction in
parking for the total site. That this parking modification shall only be for the use
approved by c.u.P. 93-001 (a coffee bar).
6. That C.U.P. 93-001 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating awareness and
acceptance of the conditions of approval.
7. Noncompliance with the provisions and conditions of this Conditional
Use Permit shall constitute grounds for its immediate suspension or revocation.
Section 4. The decision, findings and conditions contained in this Resolution
reflect the Commission's action of January 26, 1993 and the following vote:

Section 5. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUMMARY
An application was filed by John Daigle to request a conditional use permit for a
proposed coffee bar with seating for 7 persons at 733 West Naomi Avenue, Unit "B".
There will be no on-site food preparation. The Planning Department is
recommending approval of the applicant's request subject to the conditions as set
forth in this report.
GENERAL INFORMATION
APPLICANT: John Daigle (Agent for Starbucks Coffee)
LOCAnON: 733 West Naomi Avenue, Unit "8"
REQUEST: A Conditional Use Permit to operate a coffee bar.
LOT AREA: 391,720 sq.ft. (8.99 acres)
FRONTAGE: 660.00 feet along Baldwin Avenue
680.00 feet along Duarte Road
535.00 feet on Naomi Avenue
EXISTING LAND USE & ZONING:
The site is developed with a Hinshaw's department store building (vacated)
and various retail shops; zoned C-2 and C-2 & H 4 (along Baldwin Avenue).
SURROUNDING LAND USE & ZONING:
North General commercial uses; zoned C-2 and C-2 & D.
South: Retail shopping center (Sav-on) and mixed residential uses; zoned C-
2 and R-3 respectively.
East: General commercial uses; zoned C-2 & H.
West: Yon's Pavilion and retail shops; zoned C-2.
GENERAL PLAN DESIGNAnON:

The subject site is designated as Commercial.
PROPOSAL
The applicant is seeking a conditional use permit to operate a proposed coffee bar
with seating for 7 persons, as shown on the submitted floor plan. The primary retail
business will involve the sale of specialty coffee and coffee merchandise (i.e., coffee
brewing machines, grinders, mugs, pots, etc.). The requested coffee bar will be an
incidental use for the convenience of the customers to taste selected coffee. No
meals will be prepared on the premises, though prepackaged pastries will be
available. Because of the aforementioned seating, the actual use is considered to be
an eating establishment.
The business would occupy a retail space of approximately 870 sq.ft., which is within
a 276,905 sq.ft. shopping center, as shown on "Parcell" of the submitted site plan.
Business hours would be from 6:00 a.m. to 9:00 p.m.
PARKING
Eating establishments require 20 parking spaces per 1,000 sq.ft. of gross floor area.
Based upon this requirement the proposed coffee bar requires 18 spaces. However,
the existing on-site parking ratio of 2.745 spaces per 1,000 sq.ft. of gross retail floor
. area results in a net parking space requirement of 16 spaces for the coffee bar.
The on-site parking consists of 760 spaces, and does not comply with the current
Code requirement of 1,385 spaces for the existing shopping center (i.e., 5 spaces per
1,000 sq.ft. of gross retail floor area). With the addition of the coffee bar, the total
number of on-site spaces required for the shopping center would be 1,401.
The attached "Parking Survey" was submitted by the applicant, which indicates that
the subject shopping center has a peak parking demand of 378 parking spaces (count
occurred at 2:00 p.m on December 19, 1992). As noted 760 spaces exist on the site,
which indicates that there would be ample on-site parking for the proposed coffee
bar. Staff has made random vehicle counts on the site, and concurs with the
applicant's parking survey.
Furthermore, there is a reciprocal easement agreement with the neighboring Yon's
Pavilion shopping center to utilize the parking areas in common. The Yon's site
provides 428 parking spaces.
ANALYSIS

Normally staff is concerned with the potential increase in traffic which may result

from new retail uses which may locate on this site. Uses such as eating
establishments and restaurants require conditional use permits and traffic concerns
can be addressed as part of the consideration of such applications.
Generally staff does not encourage uses which are deficient in parking; however, the
proposed coffee bar is a unique type of use i.e., it will be incidental to the applicant's
primary retail business which involves the sale of specialty coffee and coffee
merchandise. The proposed seating for the coffee bar is minimal ( only 7 chairs).
Based upon the applicant's proposal and "Parking Survey", it is staff's opinion that
the proposed use would not create a parking problem. Also, it would be an
appropriate addition to the shopping center, provided that the use is limited to a
"coffee" bar and there are adequate conditions of approval to insure that the
operation remains consistent with this application.
CEOA
Pursuant to the provIsions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project. Said
initial study did not disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected by the project
including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole, there is
no evidence that the proposed project will have any potential for an adverse effect
on wildlife resources. Therefore, a Negative Declaration has been prepared for this
project.
RECOMMENDATION
The Planning Department recommends approval of Conditional Use Permit 93-001
subject to the following conditions:
1. Fire safety shall be provided to the satisfaction of the Fire Chief.

6. That Cu.P. 93-001 shall not take effect until the owner and applicant
have executed a form available at the Planning Department indicating
awareness and acceptance of the conditions of approval.
7. Noncompliance with the provisions and conditions of this Conditional
Use Permit shall constitute grounds for its immediate suspension or
revocation.
FINDINGS AND MOnONS
Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find
that the project will not have a significant effect on the environment and direct
staff to prepare the appropriate resolution incorporating the specific findings and
conditions of approval set forth in the staff report, or as modified by the
Commission.
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and fmdings in support of that
decision.
