RESOLUTION 1493
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL
USE PERMIT 92-012 TO ADD A GARDEN ROOM TO THE
EXISTING MARIE CALLENDER'S RESTAURANT AT 820
SOUTII BALDWIN AVENUE
WHEREAS, on October 30, 1992, an application was filed by Marie Callender's
Restaurant to add a garden room with seating to the existing Marie Callender's
Restaurant, Planning Department Case No. CU.P. 92-012 at 820 South Baldwin
Avenue, more particularly described as follows:
Lots 7 and 8 of Tract No. 6985, in the City of Arcadia, County of Los Angeles,
State of California, as per map recorded in Book 106, Page 53 of Maps in the
Office of the Recorder of said County; and
WHEREAS, a public hearing was held on December 8, 1992, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in the
attached report is true and correct
Section 2. This Commission finds:
. 1. That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare, or injurious to the property or improvements in such
zone or vicinity.
2. That the use applied for at the location indicated is a proper use for which a
Conditional Use Permit is authorized.
3. That because of the unique nature of the use, the site for the proposed use is
adequate in size and shape to accommodate said use. All yards"spaces, walls, fences,
parking, loading, landscaping and other features are adequate to adjust said use with
the land and uses in the neighborhood. There is adequate on-site parking to
accommodate the proposed use.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan.

6. That the use applied for will not have a substantial adverse impact on the
environment.
Section 3. That for the foregoing reasons this Commission approves a
Conditional Use Permit for the addition of a garden room to the existing restaurant
upon the following conditions:
1. That Fire safety shall be provided to the satisfaction of the Fire Chief,
including:
a. Provide fire alarm system per NFPA 71-nE Standard, AMC 8130.7.
b. Provide one Knox Box with entrance keys per UFC 10.302.
c. Submit floor plan showing table arrangement and exit width (new and
existing).
d Provide seating plan and keep occupant load sign visible at all times.
2. That the following conditions set forth by the Public Work's Department
shall be complied with to the satisfaction of the Public Works Director:
a. Remove and replace existing tree well covers with new agriperm tree
well covers per Standard 5-13-1.
b. Remove and replace deficient sidewalk to match existing. Contact the
Public Works Department for the limit of removal and replacement.
3. That the corridor wall extension shall be cut back flush with the toilet
room wall to the satisfaction of the Building Division.
4. That a minimum 36" wide clearance shall be provided in the corridor to
the restroom area to accommodate handicap persons.
5. That a drainage plan be submitted in conjunction with the plans for the
proposed addition to the Planning Department for review and approval addressing
the flooding problem identified above.
6. That the parking area shall be striped per the City's Code Section 9269.8.1.
7. That the compact spaces shall to marked in accordance with Code Section
9269.8.3.
8. That the four parking spaces adjacent to the north property line shall be
marked for "Employee Parking Only" or this area shall be redesigned to meet code
requirements, subject to Planning Department approval.
9. That all work shall be completed prior to occupancy of the garden room.
10. That c.u.P. 92-012 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating awareness and
acceptance of the conditions of approval.

11. Noncompliance with the provisions and conditions of this Conditional
Use permit shall constitute grounds for the immediate suspension or revocation of
said Permit.
Section 4. The decision, findings and conditions contained in this Resolution
reflect the Commission's action of December 8,1992 and the following vote:

Section 5. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUMMARY
An application was filed by Marie Callendar's restaurant to add a garden room with
seating for 18 persons to the existing restaurant at 820 South Baldwin Avenue. The
Planning Department is recommending approval subject to the conditions set forth
in the staff report.

BACKGROUND
In 1971, the Planning Commission approved c.u.P. 71-11 adding 275 square feet to
the existing bakery/restaurant to provide an interior hall to the restrooms.
PROPOSAL AND ANALYSIS
The existing restaurant contains approximately 4,601 square feet. The applicant is
proposing to add a 314 square foot garden room where the existing patio area is
located. The total square footage of the restaurant will be 4,915 sq. ft. In addition to
the garden rooms, the applicant is proposing to bring the bathrooms into
compliance with the handicap regulations. The garden "atrium" room will be
enclosed by a 3 1/2 foot high brick wall with a glass enclosure on top.
Currently there is seating for 70 persons, the addition of the garden room will add
seating for 18 more persons; for a total seating capacity of 88 persons.
Based upon code requirements of 10 parking spaces per 1,000 sq. ft. of gross floor
area, 49 parking spaces are required. The applicant has indicated there are 39 existing
parking spaces; four of the spaces do not have adequate access and do not comply
with code requirements.
The two spaces designated on the plan as "compact" immediately west of the
landscape area are flooded when it rains. This is a low spot in the parking area, and
a significant amount of water drains to this location causing water to pool in this
location. A drain is located on the east side of the planter but it does not appear that
there is any way for the water to flow to this drain.
In addition the "compact spaces" are not marked and the parking area striping does
not comply with code.
It is staffs opinion that the garden room addition will not create a significant
increase of pedestrian and vehicular traffic to the site. Currently, the patio is used
for a waiting area. The addition of the garden room will provide additional eating
area and may result in less waiting time for customers.
ARCHITECTURAL DESIGN REVIEW
Concurrent with the consideration of this conditional use permit, the Planning
Commission may recommend approval, conditional approval or denial of the
applicant's design concept for the garden room.
It is staff's opinion that the proposed design is compatible with the existing building
and complies with the intent of the design criteria set forth in the City's
Architectural Design Review Regulations.

MISCELLANEOUS INFORMATION
The Building Department has reviewed the proposed plans and notes:
1. That the corridor wall extension shall be cut back flush with the toilet
room wall.
2. That a minimum 36" wide clearance shall be provided in the corridor to
the restroom area to accommodate handicap persons.
CEOA
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project. Said
initial study did not disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected by the project
including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole, there is
no evidence that the proposed project will have any potential for adverse effect on
wildlife resources or the habitat upon which the wildlife depends. Therefore, a
Negative Declaration has been prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 92-012 subject to the
following conditions.
1. That Fire safety shall be provided to the satisfaction of the Fire Chief,
including:
a. Provide fire alarm system per NFPA 71-72E Standard, AMC 8130.7.
b. Provide one Knox Box with entrance keys per UFC 10.302.
c Submit floor plan shwoing table arrangement and exit width (new and

FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find
that the project will not have a significant effect on the environment and direct staff
to prepare the appropriate resolution incorporating the specific findings and
conditions .of approval set forth in the staff report (or as modified by the
Commission).

Maybe. The area where the proposed garden room is to be added is
currently utilized as an outside waiting area. Although the addition of
the garden room will increase available seating which could result in
an increased need for parking, it is staffs opinion that this need will
not be significant. Based upon personal experience, the additional
seating at this location will reduce the waiting time and allow for a
quicker turn-over in parking.
