RESOLUTION 1492 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT 92-011 TO ADD OUlDOOR SEATING FOR FOUR PERSONS AT THE EXISTING COFFEE BAR AT 107 SOUTH FIRST AVENUE WHEREAS, on October 19, 1992, an application was filed by Amy and Karen Towner to add outdoor seating at the existing coffee bar, Planning Department Case No. C.U.P. 92-011 at 107 South First Avenue, more particularly described as follows: South 25',0" of Lot 18, Block 71, Santa Anita Tract. WHEREAS, a public hearing was held on November 24, 1992, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section. 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity, 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That because of the unique nature of the use, the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. There is adequate on-site parking to accommodate the proposed use, 4, That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use, 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan, 6. That the use applied for will not have a substantial adverse impact on the environment. -1- 1492 . . . Section 3, That for the foregoing reasons this Commission approves a Conditional Use Permit for the addition of outdoor seating at the existing coffee bar upon the following conditions: 1. That the applicants continue to comply with the conditions set forth in Resolution 1484 for c.u.p, 92-008. 2. That outdoor seating shall be limited to four (4) persons, with a total seating limited to 30 persons. 3. That the tables and chairs shall be located on private property within the front setback along First Avenue. 4, That c.u.P. 92-011 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of November 24,1992 and the following vote: AYES: Commissioners Amato, Daggett, Hedlund, Clark NOES: None ABSENT: Commissioner Huang Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. -2, 1492 . . . BUTLER, ASSISTANT PLANNING DIRECTOR CASE NO.: C.U,P, 92,011 FROM: SUMMARY An application has been filed by Amy and Karen Towner to add outdoor seating to the coffee bar at 107 South First Avenue, The Planning Department is recommending approval subject to the conditions set forth in the staff report, GENERAL INFORMATION APPLICANT: Amy and Karen Towner LOCATION: 107 South First Avenue REQUEST: Conditional use permit to add outdoor seating to the existing coffee bar with total seating of 30 persons LOT AREA: 3,525+ square feet FRONTAGE: 25 feet on First Avenue EXISTING LAND USE & ZONING The site is developed with a 1,545 square foot building; zoned C-2. SURROUNDING LAND USE & ZONING North: Developed with mixed commercial uses including a nail shop and the Cheyenne Supper Club; zoned C-2 Developed with mixed commercial uses including an office and paint store; zoned C-2 Developed with mixed commercial uses, including a bank; zoned C-2 Developed with mixed residential uses; zoned R-3 South: East West: C.U,P. 92-011 November 24, 1992 Page 1 . . . GENERAL PLAN DESIGNATION Commercial BACKGROUND, PROPOSAL AND ANALYSIS On September 8,1992, the Planning Commission adopted Resolution 1488 granting conditional use permit 92-008 to operate a coffee bar at 107 South First Avenue. All tables with seating were designated inside the building, Unfortunately, outside eating establishments are a separate use permit in the code. If the applicant's had specified on their plan or in their application that they wanted outdoor seating, this could have been included in the original application. The coffee bar contains 945 square feet and includes the preparation and sales of specialty coffee. In addition prepackaged snack foods are available along with bottled waters and juices. They have seating for 30 persons, There is no food preparation on the site. The applicant is requesting to place two 24" round tables with two chairs each in the 4',0 paved area in front of the building. This 4',0" area is part of the subject property. The tables and chairs will not be within the public right-of,way, It is staff's opinion that the placement of two tables for outdoor seating within the 4'.0" setback along First Avenue would not create a problem and will not impact the existing parking. CEOA Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any ,substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends, Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of c.u.P. 92-011 subject to the following condition. C.U.P.92-011 November 24, 1992 Page 2 . . . 1. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the spedfic findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
