HomeMy WebLinkAbout1490 . . . RESOLUTION 1490 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT NO. CUP 92-010 TO INSTALL APPROXIMATELY 25 AMUSEMENT GAMES AND MACHINES AT THE EXISTING RESTAURANT AT 245 EAST FOOTHILL BOULEVARD. WHEREAS, on August 17, 1992, a Conditional Use Permit application was filed by Sterling Foods, Inc. (dba Shakey's Pizza Parlor) to install approximately 25 amusement games and machines in place of 70 seats at the existing restaurant, Planning Department Case No. CUP 92-010, on property commonly known as 245 East Foothill Blvd., more particularly described as follows: Lot 5 of Tract 12834, located in the City of Arcadia, County of Los Angeles, State of California as per Map Book 262, Page 24, as recorded in the County Recorder's Office of said County. WHEREAS, a public hearing was held on September 23, 1992, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized, 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. . . . 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment, and, that based upon the record as a whole there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. SECTION 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to install approximately 25 amusement games and machines in place of 70 seats at the existing restaurant upon the following conditions: 1. The parking lot shall be restriped to Code. One of the end parking spaces in the northerly row of front parking spaces shall be equipped for bicycle parking. A Modification shall be granted for 43 parking spaces in lieu of 58 spaces. 2. The landscaping and irrigation shall be rehabilitated and maintained. A detailed landscaping and irrigation plan shall be submitted for review and approval to the Planning Department. 3. The trash enclosure(s) shall be refitted with solid metal gates. 4. The existing street tree well cover shall be replaced with a new cover consistent with City Standard Drawing No. 5-13-1. The type and size of the cover shall be determined by the Public Works Department. Permits shall be obtained, and the Public Works Inspector shall be contacted at least 24 hours prior to any construction in the public right-of-way. This condition shall be complied with to the satisfaction of the Director of Public Works. 5. Fire protection, water supply, and building occupancy shall be provided and maintained to the satisfaction of the Arcadia Fire Department. Such shall include, but not be limited to, the following: a. One (1) Knox Box with keys to enable access to all parts of the building; b. A comprehensive fire sprinkler system per NFPA standard no. 13 (1991 Ed.); c. A comprehensive fire alarm system per NFPA standard nos. 71-72E; d. All exit signs are to be in conformance with the most restrictive -2- 1490 . . . requirements of the UFC (1991 Ed.); and, e. Plans for these and any other installations shall be reviewed and approved by the Fire Department prior to installation. 6. Building occupancy, accessibility, and safety features shall be provided and maintained to the satisfaction of the Chief Building Official. Such shall include, but not be limited to, the following: a. Adequate access (i.e. handicap access) to the restroom facilities and throughout all parts of the restaurant; b. A minimum of two (2) handicap parking spaces with crosswalks painted across any traffic lanes between the handicap parking spaces and the entrance to the restaurant. 7, The applicant shall comply with the Business Licensing and Game Machine Regulations stipulated in Article VI of the Municipal Code which include, but are not limited to, the following: a. Any locations where a game machine is operated shall provide personnel over twenty-one (21) years of age to maintain supervision of each game machine and patrons thereof. b. Any locations where any game machine is operated shall prohibit persons under the age of eighteen (18) years from using or playing any game machine between the hours of 8:00 a.m. and 3:00 p.m., Monday through Friday and after 10:00 p.m. daily, unless accompanied by a parent or guardian. The 8:00 a.m. through 3:00 p,m, restriction shall not apply during school holidays and school vacation periods recognized by schools within the City of Arcadia. 8. The subject site and interior layout shall be maintained in a manner that is consistent with the plans filed with the Planning Department for CUP 92- 010, and all of the conditions of approval shall be complied with concurrently with the installation of the amusement games and machines. 9. Approval of CUP 92-010 shall not take effect until the property owner and applicant have executed and filed the Acceptance Form available from the Planning Department to indicate their awareness and acceptance of the conditions of approval. 10. Noncompliance with the provisions and conditions of CUP 92-010 shall constitute grounds for its immediate suspension or revocation which may result in closure of the subject establishment. -3- 1490 . . . 11. The applicant shall provide documentation to the Planning Department to substantiate that the amusement games and machines are intended for the amusement of children ranging in age from two to ten years and CUP 92-010 is subject to the approval of the amusement games and machines as signified in writing by the Director of Planning. SECTION 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of September 23, 1992 and the following vote: A YES: Daggett, Hedlund and Oark NOES: None ABSENT: Amato and Huang SECTION 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. Foothill Boulevard SUMMARY This Conditional Use Permit application was submitted by Sterling Foods, Inc. (dba Shakey's Pizza Parlor) to install redemption games and amusement machines in the existing restaurant at 245 E. Foothill Boulevard. The games and machines will take the place of seating for 70 people. Seating will remain for 102 people. The Planning Department is recommending approval of Conditional Use Permit No. CUP 92-010 subject to the conditions in this report. GENERAL INFORMATION . APPUCANT: Sterling Foods, Inc. (dba Shakey's Pizza. Parlor) LOCATION: 245 E. Foothill Boulevard REQUEST: A Conditional Use Permit to install approximately 25 redemption games and amusement machines in an existing family restaurant. The games and machines will take the place of 70 seats. The building size is to remain the same and there will be no alterations to the exterior of the building or other site improvements. SITE AREA: -27,950 square feet (0.642 acre) FRONTAGE: 100 feet along E. Foothill Boulevard EXISTING LAND USE & ZONING: A 5,795 sq. ft., 172 seat restaurant with 45 on-site parking spaces. The southerly 135 ft. of the lot is zoned C-2 (General Commercial) and the northerly 144.5 ft. is zoned PR-l (parking or Single Family) . . . . SURROUNDING LAND USES &; ZONING: North: Single family residential, the zoning is R-l South: Offices, retail and two single family residences, the zoning is C-2 E a s t: Restaurant, retail and one single family residence, the zoning is C-2 &; PR-l West: Supennarket, the zoning is C-2 GENERAL PLAN DESIGNATION: C - Commercial BACKGROUND The original 4,800 sq. ft. restaurant was built in 1965, prior to the City's requirement of a Conditional Use Pennitfor a restaurant. A Modification (M 64-114) was granted to allow the rear portion of the restaurant to be built in the PR-l zone so that the front would align with the supennarket to the west. A Variance (V 83-004 - Reso. 1230) was granted in 1983 to allow a 995 sq. ft. storage space addition to the rear of the restaurant in the PR-l zone. The Variance conditionally approved the existing restaurant to operate seven days a week from 11:00 a.m. to 12:00 midnight, granted a parking Modification of 46 spaces in lieu of 116 spaces, and approved the existing 765 sq. ft. of landscaping. During construction, one parking space was eliminated to provide a handicap space. It should be noted that at the time of the Variance, the parking requirement was based upon this facility being an eating establishment (20 spaces per 1,000 sq. ft.) By current definition it is a restaurant (10 spaces per 1,000 sq. ft.) Therefore, the current parking requirement is 58 spaces. PROPOSAL AND ANALYSIS The proposal is to rearrange the main dining area to accommodate the installation of approximately 25 games and amusement machines. No changes to the exterior of the building or to the site are proposed. The installation of eight or more games constitutes a "Game Machine Arcade" which requires a Conditional Use Pennit (Sees. 9275.1.48. &; 9275.6. et seq.) In addition, amusement and game machines are subject to business licensing and other related regulations under Article VI of the Municipal Code. CUP 92-010 September 23,1992 Page 2 4t The games will include video games, prize issuing games, and redemption games. The redemption games will issue coupons based upon one's score and the coupons are redeemable for prizes. The amusement machines are small merry-go-rounds and other similar rides. There will also be a playground area for small children. The games and machines are intended to appeal to pre-teenage children, but there will be games that will appeal to children of all ages. Parking . There are a total of 45 on-site parking spaces. Twenty spaces are at the rear of the restaurant and 25 are in front. The parking lot striping is not to Code and current handicap regulations require a second handicap parking space. The parking spaces are delineated with single line stripes instead of two-line, hairpin stripes and are somewhat faded. Also, the parking space in the extreme northeast comer at the rear of the site is too narrow. The Code requires a width of 11'-6" for standard commercial parking spaces that are adjacent to a wall, fence or property line. Section 9275.6.3. of the Special Regulations for Game Machine Arcades requires that adequate off-street parking be provided for bicycles as well as automobiles. Because the proposed games and machines are intended to appeal to pre-teenage children, there will probably be a need for bicycle parking. However, there is not an area in the existing parking lot that will readily accommodate bicycle parking. Therefore, one of the parking spaces that is close to the front entrance should be utilized for bicycle parking. Correcting the parking lot deficiencies and providing bicycle parking will result in a loss of two parking spaces for a total of 43 spaces. The installation of the games and machines should not increase the parking demand, and there have been no indications that the existing number of parking spaces is insufficient. A parking Modification of 43 spaces in lieu of 58 is necessary, and should not have an adverse affect upon the parking situation at this restaurant. Landscaping The existing 765 sq. ft. of landscaping was approved under Variance No. V-83-004, and was upgraded at that time. However, the landscaping and irrigation should be rehabilitated because some of the plants are dead, damaged, or missing. The existing trash enclosures are attached to the rear of the building and have chain- link with metal slats for gates. Current policy requires solid metal gates, Environmental Review . Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said CUP 92-010 September 23, 1992 Page 3 ~ initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit No. CUP 92-010 subject to the following conditions: 1. The parking lot shall be restriped to Code. One of the end parking spaces in the northerly row of front parking spaces shall be equipped for bicycle parking. A Modification shall be granted for 43 parking spaces in lieu of 58 spaces. 2.
