RESOLUTION 1489 A RESOLUTION OF TIlE PLANNING COMMISSION OF TIlE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 92-009 TO INCLUDE SEATING AND TABLES FOR , 12 PERSONS IN TIlE FISH MARKET LOCATED AT 50 WEST LAS TUNAS DRIVE. WHEREAS, on July 31, 1992, an application was filed by Jin Man Kim to include seating and tables for 12 persons in a fish market, Planning Department Case No. C.U.P. 92-009 at 50 West Las Tunas Drive, more particularly described in attached Exhibit A. WHEREAS, a public hearing was held on September 8, 1992, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, 1HEREFORE, TIlE PLANNING COMMISSION OF TIlE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or weUare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That because of the unique nature of the use, the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. There is adequate on-site parking to accommodate the proposed use. 4. That.the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the en vironmen t. -1- ' 1489 , . . . Section 3. That for the foregoing reasons this Commission approves a Conditional Use Permit to add seating and tables to the fish market upon the following conditions: 1. That seating shall be limited to 12 persons. 2 ' Fire safety shall be provided to the satisfaction of the Fire Department, including: a. Install one knox box U.F.C. 10.302 b. Install a full fire alarm system per N.F.P.A. 71 and nE, A.M.C. Amendment to U.F.C. 3115.1. c. The rear exit door must open in the direction of exit travel. 3. That the restroom fadlities located in the back of the market shall be made available to all customers upon request. 4. That C.U.P. 92-009 shall not take effect until the owner and applicant have executed a fonn available at the Planning Department indicating awareness and acceptance of the conditions of approval. 5. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of September 8, 1992 and the following vote: A YES: Commissioners Amato, Daggett, Hedlund, Huang, Clark NOES: None Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the Cty of Arcadia. -2- 1489 . . . BUTLER, ASSISTANT PLANNING DIRECTOR CASE NO.: c.u.P. 92-009 SUMMARY An application was filed by Jin Man Kim to include seating and tables for 12 persons in a fish market at 50 West Las Tunas Drive. The Planning Department is recommen~g approval subject to conditions outlined in this report. GENERAL INFORMATION APPUCANT: Jin Man Kim, operator of the fish market 50 West Las Tunas Drive LOCATION: REQUEST: Conditional use permit to provide seating and tables for 12 persons in a fish market LOT SIZE: 39,204 square feet LOT FRONTAGE: 377 feet along Las Tunas Drive 369 feet along live Oak Avenue EXISTING LAND USE &: ZONING The site is developed with a mixed commercial development (primarily retail stores, including a fast food eating establishment); zoned CoM (Commercial Manufacturing). West: Developed with a Burger King fast food eating establishment; zoned CoM GENERAL PLAN DESIGNATION Commercial BACKGROUND The subject property is developed with a commercial center with various uses including a donut shop with seating for 12 persons (C.U.P. 86-013), a take-out pizza establishment with seating for 8 persons (C.U.P. 88-013) and a fast food eating establishment (Burger Palace) with seating for 32 persons (C.U.P. 88-016). The unit where the fish market is going is currently being remodeled to accommodate this use. PROpOSAL AND ANALYSIS The primary use of the building is a fish market. However, the applicant has indicated he would like to have food for on-and off-premise consumption. The total square footage of the use is 1,682 square feet. The applicant is proposing seating and tables for 12 persons. According to Mr. Kim, if someone wishes to have the fish cooked, they can select the fish from the market and Mr. Kim will prepare the fish for consumption. The addition of seating for 12 persons provides a convenience for the customers who may want to eat the food on the premises. The site contains the following uses: Vacant units Game trek Video store Cleaners Pizza (8 seats) Burger Palace (32 seats) Donuts (12 seats) Florist Fish Market (12 seats) Total Area Sq.Ft. 2,576 1,300 1,300 1,100 1,100 1,682 906 906 ~ 12,552 C.u.P.92-009 September 2, 1992 Page 2 Parking . There are 58 parking spaces on the site. When this project was constructed code required 63 parking spaces (based upon general retail uses), a modification was granted to allow 58 spaces in lieu of the 63 required. Eating establishments require 20 parking spaces per 1,000 square feet of gross floor area. The Burger Palace with seating for 32 persons is an eating establishment and requires 34 parking spaces. In addition, by the strict interpretation of the code, the donut shop, pizza shop and the proposed fish market with seating are considered eating establishments which also require 20 parking spaces per 1,000 square feet of floor area. The Planning Commission at its July 26, 1988 meeting approved a conditional use permit to allow the Burger Palace with 32 seats in addition to the donut shop and pizza shop and further granted a modification for 58 parking spaces in lieu of 124 spaces required. It was the consensus of the Commission that based upon site inspections there did not appear to be any parking problem during the peak lunch hour. H the parking is calculated based upon the four eating establishments (Burger Palace, the Donut Shop, the Pizza Shop and the fish market) and the remaining commercial uses, 143 parking spaces are required. . Although this is a significant reduction in parking, Planning staff has conducted several site inspections and has not noted any parking problems within the center. This center is an island between Las Tunas Drive and live Oak Avenue, and there is substantial on-street parking available along both streets. It is staffs opinion that the addition of seating for 12 persons in the fish market will not cause an increase in the parking needs for this center. The seating is incidental to the operation of the fish market and provides a convenience for customers. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. . C.u.P. 92-009 September 2, 1992 Page 3 RECOMMENDATION . The Planning Department recommends approval of c.u.P. 92-009 subject to the following conditions. 1. That seating shall be limited to 12 persons. 2 Fire safety shall be provided to the satisfaction of the Fire Department, including: a. Install one knox box U.F.C. 10.302 b. Install a full fire alarm system per N.F.P.A. 71 and 72E, A.M.C. Amendment to U.F.C. 3115.1. c. The rear exit door must open in the direction of exit travel. 3. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision. .
