RESOLUTION 1488 A RESOLUTION OF TIlE PLANNING COMMISSION OF TIlE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 92-008 TO OPERATE A COFFEE BAR WITH SEATING FOR 30 PERSONS AT 107 SOUTH FIRST AVENUE WHEREAS, on July 22, 1992, an application was filed by Any and Karen Towner and Catharyn Lawrence to operate a coffee bar with seating for 30 persons, Planning Department Case No. CU.P. 92-008 at 107 South First Avenue, more particularly described as follows: South 25'-0" of Lot 18, Block 71, Santa Anita Tract. WHEREAS, a public hearing was held on August 25, 1992, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, TIlEREFORE, TIlE PLANNING COMMISSION OF TIlE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That because of the unique nature of the use, the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. There is adequate on-site parking to accommodate the proposed use. 4, That the site. abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan, 6. That the use applied for will not have a substantial adverse impact on the environment. -1- 1488 . . . Section 3. That for the foregoing reasons this Commission approves a Conditional Use Permit for the operation of a coffee bar upon the following conditions: 1. That Fire safety shall be provided to the satisfaction of the Fire Chief. 2. That seating shall be limited to a maximum of 30 persons. If the Fire Department determines that seating shall be less, the applicants shall comply with the Fire Department's regulations. 3. That a minimum of 6 parking spaces shall be provided including one handicap space and the area striped in accordance with Section 9269.8.1 (hairpin striping). 4. That there shall be no food preparation on the premises and that all food served shall be prebaked and prepackaged. 5. That no lunches or dinners shall be served and the use shall remain strictly a coffee (tea) type bar. 6. That the coffee bar shall not remain open later than 10:00 p.m. or earlier than 6:00 a.m. 7. That the back door shall be painted. 8, The trash enclosure shall be constructed of a decorative block with metal gates. 9. That c.u.P. 92-008 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 10. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4, The decision, findings and conditions contained in this Resolution reflect the COmmission's action of August 25, 1992 and the following vote: A YES: Commissioners Amato, Daggett, Hedlund, Huang, Clark NOES: None Section 5. BUTLER, ASSISTANT PLANNING DIRECTOR CASE NO.: c.u.P. 92-008 SUMMARY An application was filed by Amy and Karen Towner and Catharyn Lawrence to operate a coffee bar with seating for 30 persons at 107 South First Avenue. There will be no on-site food preparation. The Planning Department is recommending approval subject to the conditions set forth in the staff report. GENERAL INFORMATION APPLICANT: Amy and Karen Towner and Catharyn Lawrence LOCATION: 107 South First Avenue REQUEST: LOT AREA: Conditional use permit to operate a coffee bar 3,525+ square feet FRONTAGE: 25 feet on First Avenue EXISTING LAND USE & ZONING The site is developed with a 1,545 square foot building; zoned C-2. SURROUNDING LAND USE & ZONING North: Developed with mixed commercial uses including a nail shop and the Cheyenne Supper Club; zoned C-2 Developed with mixed commercial uses including an office and paint store; zoned C-2 Developed with mixed commercial uses, including a bank; zoned C-2 Developed with mixed residential uses; zoned R-3 South: East: West: c.u.P. 92,008 August 25, 1992 Page 1 . . GENERAL PLAN DESIGNATION Commercial PROPOSAL The applicants are proposing to operate a coffee bar which will include the retail sales of roasted coffee beans in the northerly portion of the bUPding located at 107 South First A venue. This portion of the building contains 945 square feet. The adjacent office use contains 600 square feet. The coffee bar will include the preparation and sales of specialty coffee. In addition, the prepackaged snack foods will be available along with bottled waters and juices. There will be no food preparation on the site. They are proposing seating for approximately 30 persons. A new handicap bathroom is proposed to be constructed and will be accessible to the public. Business hours will be from 6:00 a;m. to 6:00 p.m. Because of the seating, this use is considered at eating establishment. Coffee houses (bars) have recently become very popular as a place to enjoy a cup of coffee and relax and as a meeting place for social interaction. . Parking Eating establishments require 20 parking spaces per 1,000 square feet of gross floor area and offices require 4 parking spaces per 1,000 square feet of gross floor area. Based upon these requirements, the coffee bar would require 20 parking spaces and the office area requires 3 spaces; for a total of 23 parking spaces. There will be six parking spaces on the site, including one handicap space. The parking behind this building and the other buildings fronting on First between Alta and the alley are accessed from the rear, Although there is no written agreement, the parking areas tend to be utilized in common. A trash enclosure is proposed at the rear of the building. This enclosure will not interfere with any of the parking spaces. ANALYSIS An eating establishment is a permitted use in the C-2 zone. Normally staff does not encourage uses which are deficient in parking, however, this is a unique type of use. Because the applicants are proposing to provide tables with seating for persons coming to the coffee bar and will have prepackaged food available (scones, biscuits, . C.U.P. 92-008 August 25, 1992 Page 2 . . . . etc.), the code defines the use as an eating establishment and has the same parking requirements as McDonald's, Carl Jr's, etc. There will be no food preparation on the site. In addition the types of food proposed to be served are scones, rolls, muffins; foods that are often consumed with coffee. There will not be any lunch or dinner type food items. Based upon this type of service, there should not be any conflict with parking during the lunch and dinner hour when the Cheyenne Supper Club is in operation. It is staffs opinion the proposed use would not create a parking problem and would be an appropriate addition to this area if the use is strictly limited to a "coffee" bar and there are adequate conditions of approval to insure that the operation remains consistent with this application. Although the applicants have indicated they will be operating from 6:00 a.m. to 6:00 p.m., staff would like to provide them the flexibility of remaining open until after normal dinner hours, i.e., unti110:00 p,m. CEOA Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of c.u.P. 92-008 subject to the following conditions. 1. If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision' and findings in support of that decision. .
