A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE
PERMIT 92-007, INCREASING THE SEATING TO 24 FOR THE
- EXISTING RESTAURANT (KENTUCKY FRIED CHICKEN) AT 119 E.
FOOTHILL BLVD.
WHEREAS, on June 8, 1992, an application was filed by Kasmar
Enterprises, Inc. for a Conditional Use Permit increasing the seating to 24
for the existing restaurant (Kentucky Fried Chicken), Planning Department
Case No. C.U.P. 92-007, on property commonly known as 119 E. Foothill
Blvd., more particularly described as follows:
Portion of Lot 9 of Tract 23972 in the City of Arcadia,
County of Los Angeles, State of California, as per Map
recorded in Book 748, Pages 63, 64 & 65 of Maps, in
the office of said County Recorder.

WHEREAS, a public hearing was held on July 14, 1992, at which time
all interested persons were given full opportunity to be heard and to
present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning
Department in the attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be
detrimental to the public health or welfare. or injurious to the property or
improvements in such zone or vicinity.
2. That the use applied for at the location indicated is a proper use
for which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape
to accommodate said use. All yards, spaces, walls, fences, parking,
loading, landscaping and other features are adequate to adjust said use
with the land and uses in the neighborhood.

4. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not
adversely affect the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse
impact on the environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit, increasing the seating to 24 for the existing
restaurant (Kentucky Fried Chicken) upon the following conditions
1. That seating within the restaurant shall not exceed a maximum of
24 persons.
2. That restroom facilities be brought up to code compliance to
accommodate sit-down customers.
3. That fire safety shall be provided to the satisfaction of the
Arcadia Fire Department.
4. That C.U.P. 92-007 shall not take effect until the owner and
applicant have executed an acceptance form available at the Planning
Department indicating awareness and acceptance of the conditions of
approval.
5. Noncompliance with the provisions and conditions of this
Conditional Use Permit shall constitute grounds for its .immediate
suspension or revocation.
Section 4. The decision, findings and conditions contained in this
Resolution reflect the Commission's action of July 14, 1992 and the
following vote:

BACKGROUND
As per current regulations, restaurants are permitted in the C-l zone with an approved
conditional use permit. The existing Kentucky Fried Chicken has operated at its present
location for over 20 years. The restaurant has always had a minimal number of tables
and seats, although there is no record of an approved Conditional Use Permit.
A Conditional Use Permit is necessary for the additional seating.
PROPOSAL
The restaurant occupies 1,378 square feet of space Within an approximate 215,000 square
foot retail shopping center.
As the result of an interior remodel, the applicant is requesting a conditional use
permit for twelve additional seats within the existing Kentucky Fried Chicken
restaurant. By adding the requested seating, the restaurant will have a total seating for
(24) twenty four (seven tables with twenty four chairs).
. No exterior additions are proposed.
PARKING
On-site parking is located in the front and on the north and south sides of the subject
building. There are (6) parking spaces existing directly in front of the KFC and another
six are located to the north along the northwesterly' property line. Pizza Hut next door
has (6) six spaces directly in front of their establishment as well.
Recentre-striping of the entire parking lot indicates approximately (62) parking spaces
adjacent to those mentioned above. These (62) spaces provide parking for Vons
customers.
Parking Standards for an Restaurant
10 spaces per 1,000 square feet.
This request requires 14 parking spaces on-site.

Parking on the other side of the shopping center (Savon Drugs) was not considered in
the tabulation due to its great distance from KFC.
ANALYSIS
In the past, the City has allowed seating for 12 persons in take-out restaurants (with an
approved conditional use permit) as an incidental use to
the take-out nature of the establishment. In these instances the uses have not been
required to upgrade the toilet facilities. However, when seating exceeds 12, the use
changes from predominantly take-out in nature to a sit-down restaurant.
It is staff's opinion that the restaurant facilities should be brought up to code
compliance if the Planning Commission grants this conditional use permit to increase
seating to more than 12 persons. This should be done at the time the interior
remodeling is in progress.
Staff believes that the Vons shopping Center has adequate on-site parking for the
proposed use. This is based on staff's past experience with food establishments and
current observation of the traffic flow into and out of the subject site.
ENVmONNffiNTALDOCUMENTATION
Pursuant to the provisions of the California Environmental Quality Act, the Planning
Department has prepared an initial study for the proposed project. Said initial study
did not disclose any substantial or potentially substantial adverse change in any of the
physical conditions within the area affected by the project including land, air, water,
minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance.
When considering the record as a whole, there is no evidence that the proposed project
will have any potential for adverse effect on wildlife resources or the habitat upon
which the wildlife depends. Therefore, a Negative Declaration has been prepared for
this project.
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 92-007 subject to the
following conditions:

1. That the seating within the restaurant shall not exceed the requested maximum
of 24 persons.
2. That restroom facilities be brought up to code compliance to accommodate sit-
down customers.
3. Fire safety shall be provided to the satisfaction of the Fire Department.
4. Upon re-submittal of new plans showing the required restroom facilities, the
restaurant shall be maintained per the plans on file in the Planning Department.
5. That C.u.P. 92-007 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating awareness and
acceptance of the conditions of approval.
6. Noncompliance with the provisions and conditions of this Conditional Use
permit shall constitute grounds for the immediate suspension or revocation of
said Permit.
FINDINGS AND MOTIONS
. Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find that
the project will not have a significant effect on the environment and direct staff to
prepare the appropriate resolution incorporating the specific findings and conditions of
approval set forth in the staff report (or as modified by the Commission).
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate resolution
incorporating the Commission's decision and findings in support of that decision.
