A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL
USE PERMIT 92-006 FOR AN ENGliSH LANGUAGE IMPROVEMENT
SCHOOL AT 11 W. DUARTE RD,
WHEREAS, on May 18, 1992, an application was filed by J.e. Cross Cultural
Corporation for a Conditional Use Permit to operate a school conducting classes for
students seeking improvement of English language/speaking skills, Planning
Department Case No. e.u.P. 92-006, on property commonly known as 11 W. Duarte
Rd., more particularly described as follows:
Portion of Lot 3 of Tract 950 in the City of Arcadia, County of Los Angeles,
State of California, as per Map recorded in Book 17, Page 25 of Maps, in the
office of said County Recorder.
WHEREAS, a public hearing was held on June 23,1992, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in the
attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental
to the public health or welfare, or injurious to the property or improvements in
such zone or vicinity.
2. That the use applied for at the location indicated is a proper use for which
a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping
and other features are adequate to adjust said use with the land and uses in the
neighborhood.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.

5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit for a school for the improvement of English language/
speaking skills upon the following conditions:
1. That fire safety shall be provided to the satisfaction of the Arcadia Fire
Department.
2. That parents dropping students off should pull into the driveway and park
in designated parking stalls only. There shall be no parking along side curbs or in
driveways that will potentially block and obstruct the flow of traffic along Duarte Rd.
3. That the classes shall be limited to the said maximum number of students
and operating hours on weekdays (Monday thru Friday) and on weekends
(Saturday only) as listed in the staff report. No more students than the approved
maximum number of students shall be on the premises at anyone time.
4. That c.u.P. 92-006 shall not take effect until the owner and applicant have
executed a form available at thl! Planning Department indicating awareness and
acceptance of the conditions of approval.
5. Noncompliance with the provisions and conditions of this Conditional
Use Permit shall constitute grounds for its immediate suspension or revocation.
Section 4. The decision, findings and conditions contained in this Resolution
reflect the Commission's action of June 23, 1992 and the following vote:

Section 5. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the Oty of Arcadia.

This application was filed by J.C. Cross Corporation to operate a school which would
provide classes dedicated to the improvement of English language skills. The
Planning Department is recommending approval subject to the conditions outlined
in this report.

PROPOSAL
The applicant is requesting a conditional use permit to operate a school for
improving the speech and language skills of students. The school will be utilizing
a 1,800 square feet single-story office building on a 10,880 square foot lot.
The students attending the school will be in junior and senior high school, between
the ages of 14 and 18 years of age. The intent of the proposed school is to aide young
students in improving their usage of the English language and general speaking
skills. The school will also conduct classes for students preparing for college
entrance exams such as the Scholastic Aptitude Test (SAT).
There will be an average of five to six students in attendance at each class, with a
maximum not to exceed eight students in anyone session. There will be one full time
instructor conducting the classes with three to four part time instructors helping.
The hours of operation will be from 9:00 am to 7:30 pm Monday through Friday.
Depending upon student schedules, some students may come to the school
for morning classes between the hours of 9:00 am and 1:00 pm. Most classes,
however, will be conducted from 3:30 pm to 4:30 pm. Occasional classes will be
conducted on Saturdays through the hours of 9:00 am to approximately 4:00 pm,
depending upon the need. There will be no class sessions on Sundays.
. A Conditional Use Permit is required for the proposed project as per Section
9275.1.35. of the Municipal Code for the operation of schools.
PARKING
Based upon the square. footage of the building and the parking code requirements for
schools (1 space per 35 sq. ft. of gross floor area), the proposed language improvement
school is in need of 24 on-site parking spaces. The site plan submitted with
Architectural Design Review 92-015 indicates a total of 18 standard parking spaces
will be provided with the planned remodel of the building. The 18 spaces includes 3
compact spaces and one handicap space.
On-site parking is located on the westerly side and rear of the subject building. Based
upon staffs total count, there are approximately 11 marked parking stalls existing
on the lot.
ARCHITECTURAL DESIGN REVIEW

Concurrent with the consideration of these requests, the Planning Commission may
approve, conditionally approve or disapprove the applicant's architectural design
concept plans.

The existing brick masonry on the front of the building will remain the same (Desert
Brown Flash). The proposed awnings on the front, rear and westerly side will be a
medium blue shade. The existing wood trim along the roof line will be painted light
blue and all exterior walls will be beige. A wrought iron gate will enclose the easterly
side yard where the proposed new patio area is planned.
ANALYSIS
Because the request for the school proposes a minimal number of students, staff
does not feel that the flow of traffic into and out of the site will be significantly
affected. Although traffic flow along Duarte Rd. appears to be peak throughout the
day, the small number of students in attendance at the school should not create any
substantial traffic congestion.
ENVIRONMENTAL DOCUMENT A TION
Pursuant to the provisions of the California Environmental Quality Act, the Planning
Department has prepared an initial study for the proposed project. Said initial study
did not disclose any substantial or potentially substantial adverse change in any of the
physical conditions within the area affected by the project including land, air, water,
minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance.
When considering the record as a whole, there is no evidence that the proposed project
will have any potential for adverse effect on wildlife resources or the habitat upon
which the wildlife depends. Therefore, a Negative Declaration has been prepared for
this project.
RECOMMENDATIill'l:.
The Planning Department recommends approval ofC.U.P. 92-006 subject to the
following conditions:
1. Parents dropping students off should pull into the parking lot and park in
designated parkmg areas only. There shall be no parking or stopping along
side the curb or blocking the driveway in front of the site, potentially affecting
traffic flow along Duarte Rd.
2. Parking lot must be re-paved and appropriately landscaped to the approval and
satisfaction of the Planning Department.
3. Trash enclosure wood door must be replaced with metal door to comply with
current requirements.

4. Fire safety shall be provided to the satisfaction of the Fire Department
regarding occupancies. exits and seating plans for the students, as defined
and stated in the attached memo.
5. That c.u.P. 92-006 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating awareness and
acceptance of the conditions of approval.
6. Noncompliance with the provisions and conditions of this Conditional Use
permit shall constitute grounds for the immediate suspension or revocation of
said Permit.
FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find that
the project will not have a significant effect on the environment and direct staff to
prepare the appropriate resolution incorporating the specific findings and conditions of
approval set forth in the staff report (or as modified by the Commission),
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate resolution
incorporating the Commission's decision and findings in support of that decision.

dental office. The block structure is sound but appearance
is out dated.
There are 14 parking stalls without landscaping to soften the
setting.

The proposed alterations to the project site.

A driveway at East will be closed for converting it into a garden.
