RESOLUTION 1484 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 92-004 TO ADD A STORAGE ROOM TO AN EXISTING RESTAURANT AT 116 EAST LIVE OAK AVENUE WHEREAS, on February 5, 1992, an application was filed by Ben Cazares on behalf of Olan Ray Harrell to add a storage room to the existing Steerburger Restaurant Planning Department Case No. c.u.P. 92-001 at 116 East Live Oak Avenue, more particularly described as follows: Lot 4 of Tract No. 13623, Map Book 278, Page 29 as recorded in the Office of the Los Angeles County Recorder. WHEREAS, a public hearing was held on March 24, 1992, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. There is adequate on-site parking to accommodate the proposed use. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. -1- 1484 . . . Section 3. That for the foregoing reasons this Commission approves a Conditional Use Permit for the addition of the storage room upon the following conditions: 1. Wheel stops shall be provided to meet the satisfaction of the Planning Department. 2. That five gallon shrubs are to be provided within the planter to the satisfaction of the Planning Department 3. That in lieu of screening all mechanical equipment as required by Code, the mechanical equipment shall be painted to match the building. 4. That permits shall be obtained for the existing satellite dishes. 5. That a metal gate shall be installed on the trash enclosure. 6. That the trash enclosure shall accommodate both the grease receptacle and the trash bin and be enclosed by a metal gate. 7. That the Steerburger sign at the rear of the building shall be repaired to its original condition. If a new sign is designed it must be approved through the design review process. 8. That the electrical meters shall be moved to the satisfaction of the Building Department. A set of plans must be submitted for review of said relocation. 9. That fire safety shall be provided to the satisfaction of the Fire Department. This shall include, but not be limited to a central station fire alarm system. Plans for these and any other installations shall be submitted to the City for approval prior to installation and shall be operational prior to the proposed occupancy of the space. 10. That fire protection, emergency access and egress and occupancy shall be provided and maintained to the satisfaction of the Arcadia Fire Department and the Building Department. 11. That all conditions of approval shall be complied with prior to a final inspection by the Building Division. 12. That c.u.P. 92-004 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 13. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. -2- 1484 . . . Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of March 24, 1992 and the following vote: A YES: Commissioners Amato, Daggett, Hedlund, Szany, Clark NOES: None Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the aty of Arcadia. LIVE OAK AVENUE FROM: SUBJECT: SUMMARY This conditional use permit application was filed by Ben Cazares on behalf of Olan Harrell for a 341 square foot storage room (1I'x31') addition to the existing Steerburger Restaurant at 116 E. live Oak Avenue. With mitigation measures, the Planning Department is recommending a conditional approval of this application. GENERAL INFORMATION APPUCANT: Ben Cazares of Caz C. Construction Co. for Olan Harrell of Steerburger 116 E. Uve Oak Avenue LOCATION: REQUEST: A conditional use permit to add a 341 square foot storage addition to an existing restaurant LOT AREA: 8,250 sq. ft. (.189 acre) EXISTING LAND USE AND ZONING: A 3,000 sq. ft. restaurant; zoned C-2 (General Commercial) SURROUNDING LAND USES: North: Medical building and Pharmacy South: Single family residential E a s t: Pharmacy West: Printing and Graphics shop GENERAL PLAN DESIGNATION: Commercial PROPOSAL AND ANALYSIS . This proposal is for a storage room addition of 341 square feet. The storage room will be located at the rear of the building facing the parking lot. The new addition will be used for storage only and will not change the pre-existing floor plan. The total seating capacity for the existing restaurant is approximately 83. In 1979 a C.U.P. was approved by the City Council for the expansion of the Steerburger restaurant. The approval of the expansion was subject to the following conditions: . 1. That a trash enclosure be provided to the satisfaction of the Planning Department. 2. That the parking lot be restriped and wheel stops be provided to the satisfaction of the Planning Department. 3. That a modification be granted for 10 standard parking spaces in lieu of 30 required. 4. That a 5 foot landscaped buffer be provided along the east or west side of the parking lot to the satisfaction of the Planning Department. . These conditions have just recently been fulfilled. Parking and Landscaping On-site parking is located in the rear of the building. There are currently ten (10) parking spaces located on the project site. The modification of ten spaces in lieu of the required thirty was approved by the City Council on July 3,1979 (C.u.P. 79-9). The applicant is proposing to provide wheel stops to comply with the conditions of approval for c.u.P. 79-9. Because the new addition is for storage space only, no additional parking are proposed. There are two fifteen gallon trees existing in the planter area as required by Code. However, the landscape within the planter is sparse. Special Infonnation The mechanical equipment on the roof is not screened per Code requirement and can be seen from the rear of the adjoining properties. Driving east or west on live Oak Avenue, the mechanical equipment is also visible. . CUP 92-004 March 24, 1992 Page 2 The two satellite dishes on the rear of the building do not meet City regulations and there are no permits for these on file. . The trash enclosure on the site is not enclosed with gates. Code requires all trash and storage to be fully contained within the enclosure. A receptacle for cooking grease and oil is also stored within the enclosure. This has made it difficult to enclose the trash receptacle. The Steerburger sign at the rear of the building is broken. There are two electricallJleters located in the middle of the rear wall. The proposed addition would enclose these meters. Building Department and Southern California Edison require that meters be easily accessible for periodic readings. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. The initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project, including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. . RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit No. 92- 004 subject to the following conditions: 1. Wheel stops shall be provided to meet the satisfaction of the Planning Department. 2. Five gallon shrubs are to be provided within the planter to the satisfaction of the Planning Department. 3. In lieu of screening all mechanical equipment as required by Code; the mechanical equipment shall be painted to match the building. 4. Permits shall be obtained for the existing satellite dishes. 5. That a metal gate shall be installed on the trash enclosure. 6. That a new enclosure shall be provided for the grease receptacle adjacent to the existing trash enclosure. If a new sign is designed it must go through the design review process. 8. That electrical meters must be moved to the satisfaction of Building Department. Such shall include, but not be limited to a central station fire alarm system. CUP 92-004 shall not take effect unless the property owner and applicant have executed the Acceptance Form available at the Planning Department to indicate their awareness and acceptance of the conditions of approval. 12. Noncompliance with the provisions and conditions of CUP 92-004 shall consti- tute grounds for immediate suspension or revocation of the permit and business license and closure of the establishment. . FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and me a Negative Declaration and find that the project will not have a significant effect on the environment subject to the mitigation measures and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report, or as modified by the Commission. Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolu- tion incorporating the Commission's decision and supporting findings. .
