RESOLUTION 1483 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CAUFORNIA, GRANTING CONDmONAL USE PERMIT 92-002 TO OPERATE A LANGUAGE CENTER AT 5 WEST DUARTE ROAD WHEREAS, on December 9, 1991, an application was filed by Gina Pilic to operate a language center which provides one on one tutoring and instruction in Spanish, French, German, Italian, Mandarin, Japanese and English language; provides group lessons of 3-5 people in the English language and provides complete translation and interpretation services, Planning Department Case No. C.U.P. 92-002 at 5 West Duarte Road, more particularly described in attached Exhibit A. WHEREAS, a public hearing was held on January 14, 1992, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOL YES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or weUare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. There is adequate on-site parking to accommodate the proposed use. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the en vironmen t. Section 3. That for the foregoing reasons this Commission approves a Conditional Use Permit for a language center upon the following conditions: -1- 1483 . . . 1. That there shall be no more than 20 persons (including students and instructors) on the premises at anyone time 2. That fire safety shall be provided to the satisfaction of the Fire Department, including: a. Submittal of complete sprinkler plans per NFPA 1-9 for tenant improvement. b. All exits must be equipped with panic hardware. c. Occupant load signs and seating plan will be posted at all times. d. Exit on east side must be unobstructed and egress must be to the street. e. A Knox Box must be provided. f. Emergency lighting must be provided. g. illuminated exit signs on a separate circuit must be provided. h. Installation of an approved fire alarm system that will activate either on water flow or smoke detector signal is required. Alarm system will be audible in all parts of the building and will report to an approved central station. Manual pull stations will also be required. 3. That the following condition set forth by the Building Division shall be complied with to the satisfaction of the Building Inspector: a. Occupancy shall not exceed 56 persons. b. One-hour corridor will be required. c. Two complete sets of architectural, mechanical and electrical drawings must be submitted for plan checking. 3. That c.u.P. 92-002 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 4 Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of January 14, 1992 and the following vote: AYES: Commissioners Amato, Daggett, Hedlund, Szany, Clark NOES: None Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. -2- 1483 . . . Pilic to operate a language center providing one on one tutoring instructions, group lessons and translation and interpretation services for up to 10 people at 5 West Duarte Road. The Planning Department is recommending approval subject to conditions outlined in this report. GENERAL INFORMATION APPUCANT: Gina S. Pilic, Director ofthe Language Academy LOCATION: 5 West Duarte Road (northwest comer of Duarte Road and Santa Anita Avenue) REQUEST: Conditional use permit to operate a language center which: (1) Provides one on one tutoring and 'instruction in Spanish, French, German, Italian, Mandarin, Japanese and English language (2) Provides group lessons (3-5 people) in the English language. and (3) Provides complete translation and interpretation services EXISTING LAND USE & ZONING The site is developed with a small neighborhood center; zoned C-2. West: Developed with a service station and mixed commercial uses; zoned C"2 GENERAL PLAN DESIGNATION Commercial PROPOSAL AND ANALYSIS The center will utilize the 2,016 sq. ft. unit recently occupied by the cleaners. The language center provides both one on one tutoring and group lessons as well as translation and interpretation services. Based on information submitted by the applicant, instruction is for persons 15 years old and up. The hours of operation are Monday through Friday 9:00 a.m. to 9:00 p.m. and Saturdays 9:00 a.m. to 12 noon. The applicant has noted that the maximum number of people on the premises at anyone time, including employees will be ten. Their busiest hours of operation are Monday through Friday between 9 a.m. and 11 a.m, and 6 p.m. to 9 p.m. and Saturdays from 10 a.m. to 12 noon. Ms. Pilic currently operates language centers in Alhambra and Claremont. There are 55 on-site parking spaces. Based upon code requirements for a retail use, 10 parking spaces are required for a 2,000+ sq. ft. unit. If the use operates based upon Ms. Pilic's statements, the maximum number of people in the language center at anyone time would be ten persons. Although staff feels that limiting the number of persons to ten is too restrictive, because there is limited on-site parking, staff would recommend that the maximum number of students and employees be restricted to twenty at anyone time. Staff has conducted several site inspections, and has not observed any parking problems in this center. Based upon the parking needs and the property location, staff feels that the requested use is appropriate for this location. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is CUP. 92-002 January 14, 1992 Page 2 . . . no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of CU.P. 92-002 subject to the following conditions. 1. That there shall be no more than 20 persons at anyone time on the premises. 2. That fire safety shall be provided to the satisfaction of the Fire Department as per the attached memo. 3. That the applicant shall comply with the Building Division's regulations as per the attached memo. 3. That Cu.P. 92-002 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 4. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
