RESOLUTION 1477 A RESOLUTION OF THE PLANNING COMMISSION OF THE OTY OF ARCADIA, CALIFORNIA, GRANTING CONDmONAL USE PERMIT 91-017 TO OPERATE AN EATING ESTABLISHMENT aCELAND YOGURn AT 411 EAST HUNTINGTON DRIVE WHEREAS, on October 15, 1991, an application was filed by Nutricorp, Inc. to allow tables with seating for 12 persons in the existing yogurt shop (Iceland Yogurt), Planning Department Case No. c.u.P. 91-017 at 411 East Huntington Drive, more particularly described in attached Exhibit A. WHEREAS, a public hearing was held on November 26, 1991, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or weUare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. There is adequate on-site parking to accommodate the proposed use. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission approves a Conditional Use Permit to allow tables with seating for 12 persons upon the following conditions: -1- 1477 . . . 1. That seating shall be limited to 12 persons. 2. That fire safety shall be provided to the satisfaction of the Fire Department, including the posting of the seating plan in plain view for the Fire Inspector at all times. 4. No alcoholic beverages shall be served in the restaurant. 5. That C.U.P. 91-017 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 6. Noncompliance with the provisions and conditions of this Conditional Use permit shall constimte grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of November 26, 1991 and the following vote: A YES: Commissioners Amato, Daggett, Hedlund, Szany, Clark NOES: None Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. BUTLER, ASSISTANT PLANNING DIRECTOR CASE NO.: C.U.P.91-017 SUMMARY An application was filed by Nutricorp, Inc., dba Iceland Yogurt to allow tables and seating for 16 persons in the existing yogurt shop at 411 East Huntington Drive. The Planning Department is recommending approval subject to limiting the seating to 12 persons and based upon the conditions outlined in this report. GENERAL INFORMATION APPLICANT: Nutricorp, Inc., dba Iceland Yogurt LOCATION: 411 East Huntington Drive #118 - Landmark Development REQUEST: Conditional use permit to install tables with seating in the existing yogurt shop and related parking modifications. EXISTING LAND USE & ZONING The site is developed with a mixed commercial development (office and retail) and two restaurants; zoned CPO-I. SURROUNDING LAND USE & ZONING North: South: East: West: Developed with the Residence Inn; zoned CPD-l Developed with the Arcadia Gateway Center; zoned CPD-l Developed with the Santa Anita Wash; zoned CPD-l Developed with the Souplantation and Hampton Inn; zoned CPD-l GENERAL PLAN DESIGNATION Planned Development - 1 C.U.P.91-017 November 26, 1991 Page 1 . BACKGROUND On June 27, 1989 the Planning Commission adopted Resolutions 1411 and 1412 granting Conditional Use Permits 89-007 and 89-008 to operate two restaurants on the site (Tony Roma's and Tokyo Wako). Since that time, conditional use permits have been granted for the following fast food restaurants/eating establishments within the retail center: Use C.U.P. No. Unit Size Seating Thai restaurant Subway Chinese Res. 90-013 90-015 91-012 1,00Di: 1,00Di: 1,62Di: 16 12 18 PROPOSAL AND ANALYSIS The applicant is requesting to add tables and chairs for 16 persons in the Iceland Yogurt shop which is located in the northerly portion of the retail center. The total square footage of the shop is 1,121 square feet. . The site contains the following uses: Retail Space Office Space Tokyo Wako Restaurant Tony Roma's Thai Buffet restaurant Subway Sandwich Shop Chinese Restaurant Iceland Yogurt Sq. Ft. 28,318 sq. ft 37,650 sq. ft. 6,600 sq. ft. 5,000 sq. ft. 973 sq. ft. 993 sq. ft. 1,620 sq. ft. 1,121 sq. it. Required Parking Total 142 150 66 50 10 20 17 ...zs 480 There are 428 parking spaces on the site (244 spaces within the parking structure and 184 on-grade spaces). Based upon code requirements for eating establishments and retail uses nineteen additional parking spaces are required for Iceland Yogurt based upon the parking ratio for eating establishments which is 20 spaces per 1,000 sq. ft. of gross floor area. This results in a net deficiency of 52 parking spaces (10.9%) for the site (428 in lieu of 480 spaces required). . C.u.P.91-017 November 26, 1991 Page 2 . . . The yogurt shop is an existing use in the retail center and it is staff's opinion adding seating will not result in a traffic impact in the retail center. In the past the Planning Commission has allowed tables and seating for 12 or less persons in yogurt shops with the determination that the seating is incidental to the yogurt shop and primarily a convenience to the customers. The Planning Department would recommend that the seating be limited to 12 persons. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed project will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a ' Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of C.U.P. 91-017 subject to the following conditions. 1. That seating shall be limited to 12 persons. 2. Fire safety shall be provided to the satisfaction of the Fire Department including the posting of the seating plan in plain view for the Fire Inspector at all times. 3. That C.U.P. 91-017 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 4. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff C.U.P.91-017 November 26,1991 Page 3 . . . to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial IT the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
