V 91-001 TO ESTABLISH AND OPERATE AN UNMANNED CELLULAR TELEPHONE EQUIPMENT FACILITY WITH A SIXTY-TWO (62) FOOT HIGH MONOPOLE ANTENNAE STRUCTURE AT 10 W. LIVE OAK AVENUE. WHEREAS, on October 1, 1991, applications were filed by Larry Levine of PacTel Cellular to establish and operate an unmanned cellular telephone equipment facility with a sixty-two (62) foot high monopole antennae structure, Planning Department Case Nos. CUP 91-016 and V 91-001, on property commonly known as 10 W. Live Oak Avenue, more particularly described as follows: Lots 5 & 6, in Block "A" of Tract No. 10898, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 189, Pages 42 & 43 of Maps in the office of said County Recorder. WHEREAS, a public hearing was held on November 12, 1991, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the. attached report is true and correct. SECTION 2. This Commission finds: A. That the evaluation of the environmental impacts as set forth in the Initial Study are appropriate and that the projects will hav.e no significant effect upon the environment within the meaning of the California Environmental Quality Act of 1970, and, when considering the projects as a whole, there was no evidence before the City that the proposed projects would have any potentially adverse effect on wildlife resources or the habitat upon which wildlife depends, ~ . . and therefore, a Negative Declaration was approved. B. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. C. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood D. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. E. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved, or, to the intended use of the property, that do not apply generally to the property or class of use in the same zone or vicinity. F. That this Variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity. G. That the granting of this Conditional Use Permit and Variance will not be detrimental to the public health or welfare, nor injurious to the property or improvements in such zone or vicinity in which the property is located. H, That the granting of this Conditional Use Permit and Variance will not adversely affect the comprehensive general plan. SECTION 3. That for the foregoing reasons this Commission grants a Conditional Use Permit and Variance to establish and operate an unmanned cellular telephone equipment facility with a sixty-two (62) foot high monopole antenna~ structure upon the following conditions: A. CUP 91-016 and V 91-001 shall be limited to the one 60 foot high monopole with one 3.5 foot thick, ten foot wide triangular grid of cellular antennae on top for a total overall height of 62 feet, and, one four foot diameter microwave dish antenna at an approximate height of 55 feet. B. The design and finish of any exterior improvements or alterations shall be subject to review and approval by the Planning Department. C. A landscaping plan for the area along the east property line and around the base of the monopole at the south side of the building shall be submitted for review and approval by the Planning Department, and, such -2- 1475 . -- . landscaping shall be installed concurrently with the monopole. D. Structural and wind load calculations for the monopole and antennae (cellular grid and microwave dish) shall be prepared by a registered civil engineer and provided to the Building Division for review and approval prior to the issuance of any building permits for the installation of the monopole and antennae. E. Fire protection and building occupancy limits shall be provided and maintained to the satisfaction of the Fire Department. Plans for any alarms or automatic fire suppression systems shall be submitted to the City for review and approval prior to installation. Any required safety equipment shall be operational prior to operation of the facility and occupancy of the space. F. The subject site shall be maintained according to the plans filed with the Planning Department for CUP 91-016 and V 91-001, and, all of the conditions of approval shall be complied with prior to the operation of the facility. G. CUP 91-016 and V 91-001 shall not take effect until the property owner(s) and applicant(s) have executed the Acceptance Form available from the Planning Department to indicate their awareness and acceptance of the conditions of approval. H. Noncompliance with the provisions and conditions of CUP 91-016 and V 91-001 shall constitute grounds for its immediate suspension or revocation which may result in the shut down of the facility and/ or removal of the equipment and antennae structure. SECTION 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of November 12, 1991 and the following vote: AYES: Commissioners Amato, Hedlund and Szany NOES: None ABSENT: Commissioner Daggett ABSTAIN: Commissioner Clark SECTION 5. Live Oak Ave. SUMMARY These applications were filed by PacTel Cellular for an unmanned cellular telephone facility and a height of 62 feet for a monopole antennae structure at 10 W. Live Oak Avenue. The Planning Department is recommending approval of both applications subject to the conditions listed in this report. GENERAL INFORMA nON APPLICANT: PacTel Cellular LOCATION: 10 W. Live Oak Avenue REQUESTS: A) A Conditional Use Permit for an unmanned cellular telephone equipment facility and a Modification for a fifty (50) foot high monopole antennae support. B) A Variance for a height of sixty-two (62) feet in lieu of fifty (50) feet for a monopole antennae support at the unmanned cellular telephone equipment facility. SITE AREA: Approximately 43,875 square feet (1.01 acre) FRONTAGE: 167.27 feet along W. Live Oak Avenue EXISTING LAND USE & ZONlNG: Two one-story automotive service buildings totalling approximately 15,000 sq. ft. with 65 on-site parking spaces. The zoning is CoM (Commercial-Manufacturing). . . . SURROUNDING LAND USES & ZONING: North: An automotive service station and a retail center zoned C-2 South: Multiple family residences in Temple City E a s t: A patio furniture shop and multiple family residences in Temple City West: A one-story office building zoned CoM GENERAL PLAN DESIGNATION: Commercial BACKGROUND A cellular telephone equipment facility is neither a commercial nor manufacturing use, but, such facilities are permitted in any zone with a Conditional Use Permit (Sec. 9275.1.11) Such facilities might best be accommodated in a fully industrial area. The proposed location is zoned CoM (Commercial-Manufacturing) and is improved with two, one-story, 7,500 sq. ft. automotive service buildings with retail and automobile service uses. the facility proposed under CUP 91-016 should not conflict with the other uses in this center. The CoM zone does not have any provisions for a height of 62 feet as requested by V 91-001. Rather, the CoM zone permits a.maximum building height of 40 feet and provides for an additional ten feet to accommodate accessory structural items. A Modification may be granted under CUP 91-016 to permit the mono- pole to have a maximum height of 50 feet. The public service (mobile telephone capabilities) provided by the applicant is essentially a public utility and the applicant's engineers have indicated that the additional height requested by V 91-001 (ten feet for one additional section of metal pole and two feet for the antennae grid) is crucial to the effectiveness of this facility and their cellular telephone network in this area. The Planning Commission may recall that about a year ago a CUP and a Variance were granted to Los Angeles Cellular Company for a similar facility in a retail space at 206 E. Live Oak Avenue. In that case, the equipment was installed in a retail space at a comer mini-mall and a 60 foot tall monopole antennae support was erected immediately adjacent to the south end of the building with one triangular grid of cellular antennae on top. A microwave dish antenna was not part of that project. CUP 91-016 & V 91-001 November 12, 1991 Page 2 .. . PROPOSAL AND ANALYSIS The proposal is to house cellular telephone equipment in the rear space of the existing multiple tenancy automotive service buildin~ and to erect a 62 foot high antennae structure next to the south side of the building. Site Selection In establishing a cellular telephone network, the location for a new facility is determined by the amount of cellular telephone activity in the area. As the network grows and the prevalence of cellular telephones increases, existing installations become overloaded and their signal range and quality deteriorate. Eventually it becomes necessary to add new facilities to the network in order to maintain an acceptable signal quality. The applicant has provided an exhibit (Exhibit A) illustrating the effective range of the proposed cellular facility. The shaded area indicates the maximum area that, under ideal conditions, could be served by this facility. The dark circle, however, is the area that can be expected to consistently receive reliable service from the proposed facility. The proposed facility is a link in the network that is necessary to maintain the signal quality in the subject area. In selecting a location for this new facility, a study was conducted to establish a "search ring" (Exhibit B) within which the facility must be situated. Ideally, the facility should be at the center of this ring. For practical purposes, investigations were limited to commercially zoned properties. While the selected location is not at the center of the ring, it is available and any impacts upon surrounding properties and uses are minimal. Site Improvements The existing automotive service center was developed under CUP 90-008 which was approved by Resolution No. 1439 in July of 1990. Retail uses in this center are limited to a maximum of 5,000 sq. ft. with the remaining 10,000 sq. ft. available for automotive service facilities. There are presently 65 off street parking spaces which provides a ratio of 4.33 spaces per 1,000 sq. ft. This appears to be adequate for the combination of uses at this center. The space within which the cellular telephone equipment will be housed is approximately 840 sq. ft. in area and has a metal roll-up door as its primary access in the west facing wall. The total height of the antennae structure will be 62 feet, and a security fence will be placed around the base of the monopole. The monopole will be 60 feet tall and measures 1.5 feet in diameter at the base and tapers to a nine inch diameter at the top. CUP 91-016 & V 91-001 November 12, 1991 Page 3 . . . The monopole will support one, four foot diameter microwave dish antenna at a height of approximately 55 feet, and, a 3.5 foot thick, ten foot wide triangular grid of cellular antennae on top. PacTel Cellular requires the microwave dish antenna in order to receive and transmit between their cellular system and their regular telephone system. While the subject property was not developed with this kind of use in mind, it is staff's opinion that this use will not conflict with any present or future uses that may'occupy this automotive service center. Also, with the exception of the visual impact of the antennae structure, the proposed use at this particular site would have no affects upon the other properties in the area. Because the existing building is only about 20 feet tall, a pole of any significant height would have some impact upon the appearance of the subject property and will be visible from other properties. However, existing utility poles in this area are approximately 60 to 80 feet high, and therefore, the requested height of 62 feet is not inconsistent with other similar structures in the area. The applicant has stated that the monopole will be painted a color that will minimize its visual impact. The design and finish of any exterior improvements or alterations should be subject to review and approval by the Planning Department. Parking and Landscaping The proposed monopole with its security fencing will result in the loss of one parking space. The 840 sq. ft. space to be occupied by the equipment would be allotted 3.64 parking spaces. With the exception of an occasional visit by a maintenance crewman, the proposed facility will be unmanned, and therefore, only one parking space is necessary for this facility. The loss of one parking space will not adversely affect the existing automotive service center. The subject property is landscaped in accordance with the City Code. However, staff is concerned that the landscaping at th~ south side of the building, where the monopole will be erected, should be increased. Additional landscaping in the planter along the east property line and around the base of the monopole will improve the overall appearance of the installation. A plan which includes additional landscaping for the area at the south side of the building should be submitted for review and approval by the Planning Department. Environmental Concerns The location of this proposed facility is at an existing automotive service center in a CoM zone. The area is fully developed. The initial study conducted for these projects indicated that there will be no significant environmental effects. Also, CUP 91-016 & V 91-001 November 12, 1991 Page 4 . . . staff has no information in regards to wildlife resources or wildlife habitats that would be affected by these projects. Electronic facilities have at times been a source of concern because of potential health hazards and interference with household electronic appliances. The proposed monopole is intended to support one, 3.5 foot thick, ten foot wide triangular grid of cellular antennae on top, and, one four foot diameter microwave dish antenna at a height of approximately 55 feet. While exposure to large quantities of electromagnetic radiation, can have adverse health affects, the amount discharged by cellular telephone equipment does not even warrant governmental monitoring. The transmission frequency for cellular telephones is very narrow and distinct. The applicant is not aware of any cases where cellular telephones have interfered with other modes of communication. A further discussion of this issue is provided by the applicant's response to the Environmental Checklist Form. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department prepared an initial study for the proposed projects (CUP 91-016 & V 91-001). Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the projects, including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed projects will have any potential for adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for these projects. RECOMMENDATION The Planning Department recommends approval of Conditional Use Permit No. 91-016 and Variance No. 91-001 subject to the following conditions: 1. CUP 91-016 and V 91-001 shall be limited to the one 60 foot high monopole with one 3.5 foot thick, ten foot wide triangular grid of cellular antennae on top for a total overalL height of 62 feet, and, one four foot diameter microwave dish antenna at an approximate height of 55 feet. 2. Motion for Approval If the Planning Commission intends to take action to approve these projects, the Commission should, based upon the evidence presented, make the above listed findings, file the Negative Declaration, and, direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval as set forth in the staff report, or as modified by the Commission. Motion for Denial If the Planning Commission intends to take action to deny these projects, the Commission should specifically state, based upon the evidence presented, which of the above findings are not met by the proposed projects and move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and supportive findings.
