RESOLUTION 1473
A RESOLUTION OF THE PLANNING COMMISSION OF THE
mE CITY OF ARCADIA, CALIFORNIA, GRANTING
CONDmONAL USE PERMIT 91-015 TO SELL ALCOHOLIC
BEVERAGES FOR ON-SITE CONSUMPTION AT A KARAOKE (SING-
ALONG) MUSIC STUDIO AT 612-614 EAST LIVE OAK AVENUE.
WHEREAS, on August 26, 1991 an application was filed by George Hsu and
Anthony Pei, to sell alcoholic beverages (conSiSting only of beer at this time) for on-
site consumption, Planning Department Case No. C.U.P. 91-015, on property
commonly known as 612-614 E. Live Oak Avenue, more particularly described as
follows:
Lots 3, 4, 5 and 6 of Tract 15233 in the City of Arcadia, County of Los
Angeles, State of California, as per Map recorded in Book 332, Pages
29 and 30 of Maps, in the office of said County Recorder.
WHEREAS, a public hearing was held on October 15, 1991, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in the
attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental
to the public health or welfare, or injurious to the property or improvements in
such zone or vicinity.
2. That the use applied for at the location indicated is a proper use for which
a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping
and other features are adequate to adjust said use with the land and uses in the
neighborhood.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.

5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment.
Section 3. That for the foregoing reasons this Commission grants a
Conditional Use Permit for the sale of alcoholic beverages for on-site consumption
from the following conditions:
1. That fire safety (including but not limited to illuminated exit lights and
occupancy load signs) shall be provided to the satisfaction of the Arcadia Fire
Department.
2. That c.u.P. 91-015 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating awareness and
acceptance of the conditions of approval.
3. Noncompliance with the provisions and conditions of this Conditional
Use Permit shall constitute grounds for its immediate suspension or revocation.
Section 4. The decision, findings and conditions contained in this Resolution
reflect the Commission's action of October 15, 1991 and the following vote:
A YES: Commissioners Amato, Daggett, Hedlund, Szany, Clark
NOES: None
ABSENT: None
Section 5. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

PROPOSAL
The applicant is requesting a conditional use permit for the sale of alcohol for on-site
consumption at an existing "karaoke" music studio or sing-along establishment. The
music studio is one of nine businesses operating in the 9,539 square foot retail
shopping center.
The karaoke studio will only be selling beer to customers for on-site consumption.
A Conditional Use Permit is required because the proposed on-site sale of alcohol
will place the business in the classification of a bar.
PARKING
On-site park~g is located in the front and to the rear of the subject building. A total of
58 on-site parking spaces exist on the site. Conditional Use Permit 91-009, granted in
July of this year for a fast food restaurant within the same shopping center, resulted
in a net increase of 11 additional parking spaces needed. This increased the parking
requirements to 69 spaces. The C.U.P. was approved, granting a Modification for 58
spaces in lieu of 69 required.
This Conditional Use Permit for the sale of alcohol at the karaoke studio, will change
the use from the classification of Other Permitted Uses, requiring 5 parking
spaces/l,OOO sq. ft. of gross floor area, to Restaurants and Bars requiring 10
spaces/l,OOO sq. ft. The karaoke studio contains approximately 2,000 sq. ft. of gross
floor area and currenUy meets code requirements with ten parking spaces allocated,
An additional ten spaces will be required with the change in use for the consumption
of alcohol on the premisses. The shopping center will be 21 spaces deficient with a
grand total of 79 parking spaces needed, in lieu of 58 provided.
ANALYSIS
Because the karaoke studio is already in operation, staff does not feel that the
proposed sale of alcohol will negatively impact the existing conditions. The change in
classification to a restaurantlbar use, simply means that the establishment will now
serve alcohol. The establishment itself does not change. The business will still
operate as a karaoke studio and will not change into a bar.
Pursuant to the provisions of the California Environmental Quality Act, the Planning
Department has prepared an initial study for the proposed project. Said initial study
did not disclose any substantial or potentially substantial adverse change in any of the
physical conditions within the area affected by the project including land, air, water,
minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance.
Therefore, a Negative Declaration has been prepared for this project.

RECOMMENDATION
The Planning Department recommends approval ofC.V.P. 91-015 subject to the
following conditions:
1. Fire safety shall be provided to the satisfaction of the Fire Department
regarding illuminated exit lights and occupancy limit signs, as defined and
stated in the attached memo.
2. Alcoholic beverages shall be limited to the sale of beer and wine.
3. That c.u.P. 91-015 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating awareness and
acceptance of the conditions of approval.
4. Noncompliance with the provisions and conditions of this Conditional Use
permit shall constitute grounds for the immediate suspension or revocation of
said Permit.
FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find that
the project will not have a significant effect on the environment and direct staff to
prepare the appropriate resolution incorporating the specific findings and conditions of
approval set forth in the staff report (or as modified by the Commission).
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate resolution
incorporating the Commission's decision and findings in support of that decision.

Dear Sir:
The purpose of this letter is to briefly illustrate the nature of
O'.lr bus iness, and to seek c1 tv' s approv.9.l of some proposed changes in
our service tormat.
Kumquat Tree Vocal Studio is currently licensed to operate as a
vocal studio and audio/video supply rental business (classified as a
retail and service business by the City of Arcadia); we have eight
studio rooms and also have LaserDisc and equipment rentals. Of the
eight studio rootos, there are seven smaller studio rooms and a larger
all purpose studio room (see figure 1 for floor plan layout).
Each studio room will be equipped with a complete set of Laser
Disc Karaoke (Sing-Along Music Machine) music system that plays the
hits of yesterday and today on laser video/audio disc format; a
typical system diagram is shown in figure 2. and a sample list of
laser discs is shown in figure 3. The musical system is capable of
~eading/teaching the user to sing a song of his/h.er choice. and it is
~lso capable of adjusting the key level in accordance with the user's
own vocal range (from bass to soprano). In addition, one can also
produce his/her own vocal recordings with professional results with
the system's tape deck. It is a very fun way to learn to sing the
songs of one's' choice. and it really serves as a great family
entertainment. '
Each of the seven smaller studios can provide all the services
mentioned above. at the same time, it can provide the less skilled
singers an environment to hone in their performances without
interfering the singers in the other studio rooms. On the other hand.
the bigger all purpose studio room not only can provide all of the
services of the smaller studio rooms, it also can provide the more
experienced singers a stage to polish both their vocal skills and
stage manner. In addition, a professional video recording system is
planned to be installed to prOVide a live display of the singer"s
performance via a large TV monitor. Furthermore, it can also be used
to produce his/her own music video collection. (B YL~

However. after conducting some indept usiness researc. we
discovered that in order to better serve t needs of our clientele,
we need to be able to sell soft drink to quench their thirst after
singing) and snacks as a part of our regular business. The menu will
not be very extensive. The soft drink section will be a selection of
4IJoda pops, tea and coffee, and the snacks may include some nuts and
fruit platters. This service is essential since we expect our
clientele to stay for hours at each visit. At the same time. because
of the nature of the Karaoke/LaserDisc rental business, our business
hours will be from twelve o'clock noon to two o'clock in the morning.
. But please rest assured that we will register with the Arcadia Police
Department about our business hours. and we will fully cooperate with
them. If necessary, we are even Willing to hire an off-duty Arcadia
policeman or a security company to monitor our business operation.
It is our sincere hope that this letter has presented a simple but
comprehensive picture of our business. We hope that the city agrees
with us that Kumquat Tree Vocal Studio can provide valuable services
to both the residents of Arcadia and that of the neighboring cities,
and we sincerely hope that the city and us can all prosper from our
business.
