RESOLUTION 1472
A RESOLUTION OF TIIE PLANNING COMMISSION OF TIIE
CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL
USE PERMIT 91-013 TO OPERATE A TRUCK DRIVING SCHOOL
ON PARCELS 2046 THROUGH 2055 ON RANDOLPH STREET IN
TIIE CHICAGO PARK AREA
WHEREAS, on August 19, 1991, an application was filed by Magno A. Freire to
operate a truck driving school, Planning Department Case No. C.U.P. 91-013 on
Parcels 2046 through 2055 on Randolph Street in the Chicago Park area, more
particularly described as follows:
Lots 2046 through 2055 in the Chicago Park Tract, as per map recorded
in Map Book 8532, page 18 in the City of Arcadia, County of Los Angeles,
WHEREAS, a public hearing was held on September 24, 1991, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, TIIEREFORE, TIIE PLANNING COMMISSION OF TIIE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning Department in the
attached report is true and correct.
Section 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare, or injurious to the property or improvements in such
zone or vicinity.
2. That the use applied for at the location indicated is a proper use for which a
Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in.size and shape to
accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping
and other features are adequate to adjust said use with the land and uses in the
neighborhood. There is adequate on-site parking to accommodate the proposed use.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect
the comprehensive General Plan.
6. That the use applied for will not have a substantial adverse impact on the
environment.

Section 3. That for the foregoing reasons this Commission approves a
Conditional Use Permit to operate a truck driving school upon the following
conditions:
1. Conditions as outlined in the attached report from the Department of
Public Works shall be complied with to the satisfaction of the Public Works Director.
a. Submit grading and drainage plan prepared by a registered civil
engineer subject to the approval of the Director of Public Works. Provide
calculations for gravity drainage system. Computations should show
hydrology and elevations.
b. No truck repair and maintenance shall be conducted on the proposed
property for the duration of this C.U.P.
c. Construct pavement per City Std. 5-23 subject to approval of the
Director of Public Works and Building Official.
d. Inspection fees will be based on actual inspection costs to be paid by
owner.
e. Public Works Inspector shall be contacted at (818) 574-5400, extension
289, at least 24 hours prior to construction. All public works improvements
shall be c:ompleted to the satisfaction of the Director of Public Works prior to
fmal acceptance by Building and Safety and prior to occupancy.
2. The site shall be paved and fenced as per the plans, prior to any activity on
the site. All fencing shall be wrought iron (on the north, east and south property
lines)
3. A Business License shall be secured for the truck driving school.
4. The driving school hours of operation shall be limited from 7:00 a.m. to
10:00 p.m., Monday through Saturday.
5. The school's students shall park their vehicles on the subject property. It
shall be the responsibility of the school to inform and enforce this requirement with
its students.
6. School trucks and vehicles not actively being used for instruction shall not
be parked in the street, but shall be parked on the subject property.
7. The school shall be responsible for the daily cleaning up of debris and
trash caused by their students on the subject site, public right-of-ways and on
adjacent properties. Trash receptacles shall be conveniently placed on the site for
use by the students.
8. There shall be no repair or maintenance of any vehicles on the subject
property.

9. Wrecked, damaged or inoperative vehicles shall not be stored on the
property.
10. Outdoor storage of any kind shall be prohibited with the exception of the
trucks/trailers belonging to the applicant.
11. The operation of the driving school shall comply with all statutory
requirements.
12. At anyone time, the number of students shall not exceed ten (10).
13. The subject property shall be used exclusively by the applicant, its students
and the employees.
14. There shall be no access to the site from Goldring Road.
15. There shall be no truck driving instructions conducted on Randolph
Street with the exception of ingress and egress to and from the property.
16. The site shall be maintained as per the plans on file in the Planning
Department.
17. That Cu.P. 91-013 shall not take effect until the owner and applicant have
executed a form available at the Planning Department indicating awareness and
acceptance of the conditions of approval.
18. Noncompliance with the provisions and conditions of this Conditional
Use permit shall constitute grounds for the immediate suspension or revocation of
said Permit.
Section 4. The decision, findings and conditions contained in this Resolution
reflect the Commission's action of September 24, 1991 and the following vote:
AYES: Commissioners Amato, Daggett, Szany, Clark
NOES: Commissioner Hedlund
Section 5. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

GENERAL PLAN DESIGNATION
Industrial
BACKGROUND
In April, 1991 we received a complaint that a truck driving school was operating on
the subject property.
Based upon an investigation, the Planning Department sent a letter to the property
owner Xavier Contreras advising him that illegal activities were being conducted on
his property.
The City received no response from Mr. Contreras. In May, the City's Code
Enforcement Officer went out to the site and contacted two persons regarding this
matter. The same day, Angel Chavez and Eddie Freire came to the City to determine
what was necessary to operate a driving school. At that time staff advised that they
could not continue to conduct driving classes and they would have to apply for a
conditional use permit.
This application is a result of several meetings with the applicants and their desire
to operate a driving school.
Currently they are operating International Transport at 11725 Goldring Road, which
does long-distance hauling.
PROPOSAL AND ANALYSIS
The applicant is proposing to utilize the 100' by 300' vacant property on Randolph
Street to operate a truck driving school. This area will be primarily used for the skill
maneuvering course. Driving will be done on the surrounding streets.
Classes will be held every two hours with a maximum of ten students per training
session. The applicant has indicated that the hours of training will be 7:00 a.m. to
12:00 midnight, Monday through Saturday. The extended hours allow persons who
work during the day to take lessons during the evening hours. It is possible based
on the proposed hours that they could have up to nine driving classes per day.
Residential property in the City of El Monte is located east of the subject property.
Staff has observed trucks from both the Dootson and Dial Driving Schools driving
on the industrial streets in close vicinity to these neighborhoods. Staff does not feel
that it is appropriate to allow the school to operate until 12:00 midnight and
recommends that hours be limited from 7:00 a.m. to 10:00 p.m.

There will be a maximum of 12 trucks/trailers used to conduct training. The
trucks/trailers will be stored on the subject property when training classes are not in
session.
The applicant has indicated that the "training area will not be used for any mechanic
services at any time".
The lot will be paved and a wrought iron fence with a 40'-0" wide gate will be
installed along Randolph Street. A 150' long wrought iron fence will also be
installed along the east property line extending from Randolph Street to Goldring
Road. In addition a fence will be installed adjacent to the building on Goldring
Road, extending to the east property line. Steel poles will be located along the north
and west perimeter of the property to protect the adjacent buildings walls.
Access to and from the property will be from Randolph Street only. There will be
no access off of Goldring Road.
Randolph Street is 20'-0" in width; there is no designated parkway. Traffic volume
will be increased, with the ingress and egress of trucks onto the site; however, no
driver's training should be done on the street. Driving lessons should not be
conducted on Randolph Street because of the narrow street width.
The applicant has not indicated where the students will park their vehicles; there is
no on-street parking available on Randolph Street. There is adequate room on the
subject property to park trainees' vehicles and the Planning Department
recommends that all students park their vehicles on the subject property and that
this condition be strictly enforced by the driving school operators.
Staff has received two letters in opposition to the proposed driving school (see
attached).
MISCELLANEOUS INFORMATION
The Dootson Truck Driving school has a conditional use permit to operate a driving
school at 11629 Clark Street. They are limited to 76 students at anyone time.
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project. Said
initial study did not disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected by the project
including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. Therefore, a Negative Declaration has been
prepared for this project.

RECOMMENDATION
The Planning Department recommends approval of C.U.P. 91-013 subject to the
following conditions.
1. Conditions as outlined in the attached report from the Department of Public

Commission).

If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and findings in support of that
decision.

We are writing in regard. to t~ truck driving school which
is going to be using the property behind our building and r~
also use the parcel of land next to us on the east eleva-
tion of our property. Driving or parking of trucks on it ..
raises a great amount of dust. '
In the past when it was used for this purpose, there were
a lot of people coming into our building by mistake. Also,
some of them parked in our lot or cut across our lot to
access. the school. This is very disruptive to any business
and is a liability risk.
We feel that a wall is needed to control all of the above
for any business to operate on the property next to us.

Dear Ms. Butler,
My business is located at 11626 GOldring Road, Arcadia. The
property backs up to that proposed for the diving school to be
located on lots 2046 and 2055 on Randolph Street in Arcadia.
At this time, Dootson Driving School operates in our Vicinity and
uses property on Randolpb Street for training. That property is
not paved and causes extreme dust to be generated by the trucks.
I have had to call the City of Arcadia numerous times to bave
them cease using that property as it makes it impossibLe for the
four businesses located on our property to operate. After the
City of Arcadia issues warnings to Dootson, they stop for awhile,
but in a few weeks begin again. As you can see it bas been an
on-going problem. '
My concern is with the Environmental Document. Negative
Declaration. We, nor any of our tenants, were contacted to see
if there would be a negative impact on our businesses. I
definitely do not want a new driving school to create, on a
regular' basis, what bas been an intermittent problem to us for
some years. As I cannot be present on September 24, 1991 at 7.30
p.m. I would like this letter to be submitted VOicing my
objection to the driving school. .

If the request is granted I would request that it be based on a
conditional approval.
1. All property be completely paved prior to the granting
of the request.
2. The training sChedule be coordinated with the existing
school (Dootson), so that extreme traffic problems are
not generated on Goldring Road. Our businesses require
regular deliveries of trucked materials, and at times
our deliveries are delayed while the street is being
cleared of the training trucks.
Thank you for considering our comments on the proposed
application.

INTERNATIONAL TRUCK DRIVING SCHOOL

International Truck Driving School has a ma~ling address
of l17~5 Goldring Road, Arcadia, California 91007.
This map primarily shows the training area (which will
be used for the skill maneuvering course) and the surrounding
boundaries. The training area is rectangular, approximately
300 x 100 ~eet, with an easement of about 25 feet wide to
Goldring Avenue. The south boundary is a paved street. The
north boundary has a 25 feet easement to a paved road. The
east boundary is an unpaved vacant lot with concrete industrial
building across. The west bounda.ry are industrial concrete
buildings.
The training area w~ll be fully paved. A 300 feet iron
fence'will be placed along the s~uth~~n part of the lot with
a 40 fe;t entry door. to allow entrance of the trucks/trailers.~
A 150 feet:fen~i'will be placed ~long the east side Df the lot..
Park~ng polls will be placed to protect the building walls
surrounding the west and north boundaries of the training area.

Generation of substantial additional vehicular movement? The truck
driving school will increase truck traffic in the area. However, classes will be
limited, according to the applicant to ten students per class. If classes are
restricted to ten students, staff does not believe that this will result in a
substantial increase in traffic within the area.
13c.
Substantial impact upon existing transportation systems? Randolph Street is
only 20'-0" in width and access to the site is from this street. In order to
minimize the amount of truck tra~fic, the Planning staff will be
recommending that no driving instructions take place on this street.
13f.
Increase in traffic hazards to motor vehicles, bicyclists or pedestrians? The
school will increase truck traffic in the area. This traffic will be incidental to
the other truck driving schools in the area (Dial and Dootson). This area is
zoned and developed with industrial uses. There is very little pedestrian and
bicycle traffic on the streets. Because of the isolated nature of this area, there
is minimal vehicular traffic that is unrelated to the industrial uses and the
Planning Department does not anticipate that there will be a substantial
increase in traffic hazards.
14e. Maintenance of public facilities, including roads? The addition of another
truck driving school in this area could add to future street maintenance
problems. Although the streets are designed to commercial standards, truck
driving schools have more of an impact on the roadways than the normal
industrial type use. However, even if the school operated outside the City,
there is nothing to prohibit the training-from taking place in the City.

BEING THE LOCATION WHERE DRIVING STUDENTS WILL BE FIRST
INSTRUCTED IN BASIC TRUCK MANUEVERING, SUCH AS BACKING-UP AND
