RESOLUTION 1471 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT 91-014 TO OPERATE A LANGUAGE CENTER AT 411 EAST HUNTINGTON DRIVE WHEREAS, on August 23,1991, an application was filed by FLS Language Centres to operate a language center providing tutoring instructions for up to 60 persons in four to five classrooms and tutoring small groups for Scholastic Aptitude Tests (SAn, Planning Department Case No. C.U.P. 91-014 at 411 East Huntington Drive, more particularly described in attached Exhibit A. WHEREAS, a public hearing was held on September 24,1991, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. All yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. There is adequate on-site parking to accommodate the proposed use. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission approves a Conditional Use Permit to allow a language center upon the following conditions: -1- 1471 e . . 1. That there shall be no more than 60 students at anyone time on the premises. 2. That the hours of operation shall be from 9:00 a.m. to 10:00 p.m. 3. That fire safety shall be provided to the satisfaction of the Fire Department, including occupancy and seating arrangements. 4. That employees shall park in the parking structure. 5. That students shall be advised in writing that persons waiting to pick them up must park in a designated parking stall and not stop or obstruct traffic in a driveway aisle. 6. That C.U.P. 91-014 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 7. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commis.sion's action of September 24, 1991 and the following vote: AYES: Commissioners Amato, Daggett, Hedlund, Szany, Clark NOES: None Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. The Planning Department is recommending approval subject to conditions outlined in this report. GENERAL INFORMATION APPLICANT: FLS Language Centres LOCATION: 411 East Huntington Drive - Landmark Development REQUEST: Conditional use permit to operate a language center which: (1) Provides tutoring instruction for up to 60 persons (in 4 to 5 classrooms - average of 10 students per class), and (2) Tutors small groups for Scholastic Aptitude Tests (SAT) EXISTING LAND USE & ZONING The site is developed with a mixed commercial development (office and retail) and two freestanding restaurants; zoned CPD-L SURROUNDING LAND USE & ZONING North: South: East: West: Developed with the Residence Inn; zoned CPD-l Developed with the Arcadia Gateway Center; zoned CPD-l Developed with the Santa Anita Wash; zoned CPD-l Developed with the Souplantation and Hampton Inn; zoned CPD-l C.U.P.91-014 September 24, 1991 Page 1 ~ GENERAL PLAN DESIGNATION Planned Development - 1 BACKGROUND On December 18, 1990, a business license was issued to the Arcadia Language Institute (same as FLS Language Institute) at 6 North First Avenue for the purpose of "language consulting - administrative work such as scheduling interpreters, translations". One of the questions on the application was: "Will training or classes be conducted on the premises?" The applicant indicated "no". In July, it came to our attention that the Arcadia Language Institute was conducting language classes on the premises; on July 19, the Planning Department sent a letter to the American Language Institute advising them that classes could not be conducted at this location or any other location in the City without an approved Conditional Use Permit. On August 20, the applicants ceased conducting classes at 6 North First Avenue. The applicants would like to relocate the school to the proposed location. . PROPOSAL AND ANALYSIS The applicants are proposing to utilize two units containing 2,591 square feet on the third floor in the Landmark Development center. The FLS Language Center provides: · Translation and interpretation services of all languages · Tutoring instruction of all languages · Tutoring services for small groups for SAT tests (Scholastic Aptitude Tests) preparation · Education consulting, curriculum development and test development for government and business According to the applicant there will be a maximum of 60 students at anyone time on the premises. There are usually 4 to 5 classes being conducted with an average of 10 students per class. Classess are conducted from 9 a.m. to 10 p.m. Monday through Friday. Classes are primarily for English as a second language and preparation of high school students for SAT Tests. Classes range from 2 to 3 1/2 hours. Attached is a copy of a typical class schedule for the Arcadia Language Institute. . C.U.P.91-014 September 24, 1991 Page 2 As noted on the schedule, there are ten classes operating Monday through Friday . during the daytime hours: Four classes operate from 9:00 a.m. to 12:30 p.m. Two classes operate from 10:00 a.m. to 12:00 p.m. One class operates from 1:00 p.m. to 3:00 p.m. Two classes operate from 1:30 p.m. to 4:30 p.m. One class operates from 3:00 p.m. to 6:00 p.m. There are two evening classes Monday through Thursday which operate from 6:00 p.m. to 9:45 p.m. During their peak hour between 10:00 a.m. to 12:30 p.m. there are 53 students. The students range from youths to adults There are 428 parking spaces on the site (244 spaces within the parking structure and 184 on-grade.spaces). Based upon code requirements for an office use, 11 parking spaces are required for 2,591 sq. ft. of floor area. The parking requirements for schools and other places of assembly are 1 parking space for each 5 fixed seats. If the maximum number of students at anyone time is limited to 60, twelve (12) parking spaces would be required for the school. . The location of the school is on the third floor of the office/retail structure. Access to the parking structure is from the second floor. Staff has conducted several site inspections, and has not observed any parking problems in the parking structure or in the northwest area of the parking lot. However, only a portion of the Landmark center is occupied. When the Arcadia Language Institute was in operation on First Avenue, staff observed many younger students outside the building, either waiting for rides or walking from the premises. According to the applicant, a good majority of their students do not drive. The peak hours of the center are during the lunch hour and early evening hours (around dinner time). Most classes are held during the morning up to the lunch hour (9:00 a.m. to 12:30 p.m.) and then after the lunch hour (1:30 and on). It is staff's opinion that the proposed use will not significantly impact the on-site parking, however, there could be some conflict with traffic when students are dropped off and waiting to be picked up after classes. This could cause a disruption in the on-site circulation if persons stop their vehicles in the driveway aisles waiting for students. Unfortunately, there is no easy way to monitor this type of activity. . C.U.P.91-014 September 24, 1991 Page 3 . . . In order to minimize the use of on-grade parking, the Planning Department recommends that all employees park in the parking structure and that the school also encourages the students to parking with the structure. Staff also recommends that the school provide handouts to each student advising them that persons waiting to pick them up must park in a designated parking stall and not stop or obstruct traffic in a driveway aisle. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of c.u.P. 91-014 subject to the following conditions. 1. That there shall be no more than 60 students at anyone time on the premises. 2. That the hours of operation shall be from 9:00 a.m. to 10:00 p.m. 3. That fire safety shall be provided to the satisfaction of the Fire Department, including occupancy and seating arrangements. 4. That employees shall park in the parking structure. 5. That students shall be advised in writing that persons waiting to pick them up must park in a designated parking stall and not stop or obstruct traffic in a driveway aisle. 6. That Cu.P. 91-014 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 7. Noncompliance with the provisions and conditions of this Conditional Use permit shall constitute grounds for the immediate suspension or revocation of said Permit. Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission).
