RESOLUTION 1468
A RESOLUTION OF 1HE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE
PERMIT NO. CUP 91-011 FOR A MARTIAL ARTS STUDIO AT 113
EAST HUNTINGTON DRIVE.
WHEREAS, on July 8, 1991, an application was filed by Mr. Chong Park to
occupy a 2,000 square foot commercial space with a martial arts instruction studio,
Planning Department Case No. CUP 91-011, on property commonly known as 113
East Huntington Drive, more particularly described as follows:
The westerly 25 feet of Lot 4 of Block 75 of the Santa Anita Tract in the
City of Arcadia, County of Los Angeles, State of California, and
recorded in M. R. 15, pages 89 & 90 in the offices of the County Recorder
of said County.
WHEREAS, a public hearing was held on August 13, 1991, at which time all
interested persons were given full opportunity to be heard and to present evidence;
NOW, lHEREFORE, lHE PLANNING COMMISSION OF 1HE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning Department in
the attached report is true and correct.
SECTION 2. This Commission finds:
1. That the granting of such Conditional Use Permit will not be detrimental
to the public health or welfare, or injurious to the property or improvements in
such zone or vicinity.
2. That the use applied for at the location indicated is properly one for
which a Conditional Use Permit is authorized.
3. That the site for the proposed use is adequate in size and shape to accom-
modate said use, and all yards, spaces, walls, fences, parking, loading, landscaping
and other features are adequate to adjust said use with the land and uses in the
neighborhood.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
5. That the granting of such Conditional Use Permit will not adversely affect

the comprehensive General Plan.
6. That with mitigation measures the use applied for will not have a
substantial adverse impact on the environment, and, that there is no evidence that
the proposed project will have any potential for adverse effect on wildlife resources.
SECTION 3. That for the foregoing reasons this Commission grants a Condi-
tional Use Permit for a 2,000 square foot, martial arts instruction studio upon the
following conditions:
1. Modifications shall be approved for six parking spaces (four substandard
spaces and two spaces in Parking District One) in lieu of 30 spaces, and no
landscaping in the parking area in lieu of 5% (81 sq. ft.) with one tree. The parking
area shall be restriped prior to this proposed occupancy.
2. The design and finish of any improvements or alterations to the exterior
will be subject to Architectural Design Review.
3. Classes shall not begin before 5:30 p.m. and 15 students shall be the
maximum number being trained at any on~ time.
4. The occupancy proposed by this application shall not commence until the
earthquake damage has been evaluated by a registered structural engineer and all
necessary repairs have been completed to the satisfaction of the Building Division.
5. Any changes to the existing water services shall be made by the Arcadia
Water Division at the applicant's expense.
6. Fire protection, emergency access and egress, and occupancy shall be
provided and maintained to the satisfaction of the Arcadia Fire Department. Such
shall include, but not be limited to a central station fire alarm system. Plans for
these and any other installations shall be submitted to the City for approval prior to
installation, and shall be operational prior to the proposed occupancy of the space.
7. All of the conditions of approval shall be complied with prior to
occupancy.
8. If the conditions of CUP 91-011 are not completely complied with and this
CUP is not implemented within six months of its effective date (the day after the
appeal period expires) or is unused, abandoned or discontinued for any period of six
months, this CUP shall become null, void and of no effect.
9. CUP 91-011 shall not take effect unless the property owner and applicant
have executed the Acceptance Form available at the Planning Department to
indicate their awareness and acceptance of the conditions of approval.

10. Noncompliance with the provisions and conditions of CUP 91-011 shall
constitute grounds for immediate suspension or revocation of the permit and
business license and closure of the establishment.
SECTION 4. The decision, findings and conditions contained in this Resolu-
tion reflect the Commission's action of August 13, 1991 and the following vote:
A YES: Amato, Clark, Hedlund and Szany
NOES: None
ABSENT: Daggett
SECTION 5. The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.

SUMMARY
This application was filed by Mr. Chong (Jonathan) Park for a martial arts studio
at 113 E. Huntington Drive. With mitigation measures, the Planning Department
is recommending a conditional approval of this application.
GENERAL INFORMATION

PROPOSAL AND ANALYSIS
This proposal is for a martial arts studio to occupy a retail space totalling 2,000 sq.
ft. It will be located in a one-story building that fronts on E. Huntington Drive.
Classes are proposed to be held from 4:00 p.m. to 8:00 p.m: and 15 students will be
the maximum size of anyone session.
Parkins and Landscaping
There are two parallel on-site parking spaces at the rear of the building and two
spaces from Parking District One allotted to this property. The four angled
parking.spaces shown on the site plan are not existing and do not meet code.
The required parking for an instructional use is one space per 35 gross square feet
of the area available for the conducting of classes. Based on the floor plan, 1,025
sq. ft. is to be used for classes; requiring 30 parking spaces.
The rear parking area has no landscaping and no landscaping has been proposed.
The Code requires that five percent (81 sq, ft.) of the parking area be landscaped
with one tree for every five parking spaces, H the parking area is striped
according to the proposed site plan, the excess areas between the parking spaces
should be made into tree wells and planted with 15 gallon trees.
The modifications required for this proposal are as follows:
A) Six parking spaces (four substandard spaces and two spaces in Parking District
One) in lieu of 30, This is an 80% deficiency. (9269.5)
B) No landscaping in lieu of five percent (81 sq. ft.) with at least one tree
(9269.13.A)
Because the subject site cannot adequately provide parking for the proposed
martial arts studio and because the parking area of this property is used for access
purposes by the adjacent properties. It is staffs opinion that the proposed use
would significantly aggravate an already problematic parking situation.
However, if the proposal were amended so th~t classes did not begin until 5:30
p.m. at the earliest, the parking and access problems could be mitigated: A letter
of concern from the adjacent business at 115 E, Huntington Drive is attached for
your consideration.

Special Information
During the June 28th earthquake, the subject property was structurally damaged.
The property owner has been advised in writing that currently unoccupied
spaces may not be occupied until such time as the damage has been remedied.
This will require a review and analysis by a structural engineer and completion
of the recommended repairs. Until the necessary repairs have been completed,
staff cannot recommend approval of occupancy of this building.
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project.
With recommended mitigation measures. said initial study did not disclose any
substantial or potentially substantial adverse change in any of the physical
conditions within the area affected by the project, including land, air, water,
minerals, flora, fauna, ambient noise and objects of historical or aesthetic
significance. When considering the record as a whole, there is no evidence.that
the proposed project will have any potential for adverse effect on wildlife
resources or the habitat upon which the wildlife depends. Therefore, a Negative
Declaration has been prepared for this project.
RECOMMENDATION
The Planning Department recommends approval of ConditionaI,.-Use Permit No.
91-011 subject to the following conditions:
1. Modifications shall be approved for six parking spaces (four substandard
spaces and two spaces in Parking District One) in lieu of 30 spaces, and no
landscaping in the parking area in lieu of 5% (81 sq. ft.) with one tree. The
parking area shall be restriped prior to this proposed occupancy.

FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file a Negative Declaration and find
that the project will not have a significant effect on the environment subject to
the mitigation measures and direct staff to prepare the appropriate resolution
incorporating the specific findings and conditions of approval set forth in th~
staff report, or as modified by the Commission.
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and supporting findings.

The area is presently occupied by businesses that do not generate substantial
amounts of traffic or parking demands. Nevertheless, the existing parking
situation of this area is inadequate. However, if the proposed martial arts
studio does not begin its classes until after 5:00 p.m.. the impact upon the
parking situation would be negligible.
13a. Transportation/Circulation. Will the proposal result in the generation of
substantial additional vehicular movement?
The Public Works Department has reviewed this proposal and determined
that traffic volume will be negligibly increased, and that there will be no
major impact on the existing traffic circulation.

parking facilities or demand for new parking?
The proposed martial arts stud~o will create a demand for parking.
