HomeMy WebLinkAbout1466 , . ~ RESOLlITION 1466 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING CONDITIONAL USE PERMIT 91-009 TO OPERATE AN EATING ESTABLISHMENT WITH SEATING FOR 12 PERSONS AT 600 EAST liVE OAK AVENUE. WHEREAS, on June 12, 1991 an application was filed by Ming Feng Chian& to operate an eating establishment with seating for 12 persons, Planning Department Case No. C.U.P.91-006, on property commonly know as 600 E. Live Oak Avenue, more particularly described as follows: Lots 3, 4, 5 and 6 of Tract 15233, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 532, Pages 29 and 30 of Maps, in the office of the Los Angeles County Recorder. WHEREAS, a public hearing was held on July 23,1991, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That the granting of such conditional use permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a conditional use permit is authorized. 3. That the site for the proposed use is adequate in size and shape to accommodate said use. AIl yards, spaces, walls, fences, parking, loading, landscaping and other features are adequate to adjust said use with the land and uses in the neighborhood. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. That the granting of such conditional use permit will not adversely affect the comprehensive General Plan. 1466 -1- e . . 6. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission grants a Conditional Use Permit to operate an eating establishment with seating for 12 persons, upon the following conditions: 1. That the seating within the eating establishment shall not exceed 12 persons. 2. A modification shall be granted for 58 parking spaces in lieu of 69 parking spaces. This approval shall not constitute an approval for a reduction in parking for the total site. That this parking modification shall only be for the use approved by CUP 91..009. 3. Fire safety shall be provided to the satisfaction of the Fire Department which may include fire extinguishers and that both exit doors be operable from inside without a key or special knowledge (per section 3115.2.5 - no dead bolts). 4. The eating establishment shall be maintained per the plans on file in the Planning Department. 5. That c.u.P. 91-009 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 6. Noncompliance with the provisions and conditions of this Conditional Use Permit shall constitute grounds for the immediate suspension or revocation of said Permit. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of July 23, 1991 and the following vote: A YES: Commissioners Amato, Daggett, Hedlund, Szany, Clark NOES: None ABSENT: None 1466 -2- . . . (Sec. 9269.5). 30,730 square feet (0.1 acres) Approximately 204 feet on Live Oak Ave, Approximately 132 feet on Hempstead.Ave. EXISTING LAND USE & ZONING The site is currently developed with a retail shopping center and is zoned C.2, SURROUNDING LAND USE & ZONING North: South: East: West: A church and mixed commercial uses; Zoned C.2 Single Family Residences which are located in the Los Angeles County area, Arcadia Mounted Police facility; unzoned area. Mixed Commercial; Zoned C-2. GENERAL PLAN DESIGNATION Commercial . C.U.P.91-009 July 23, 1991 Page 1 . . . PROPOSAL ~ ~ The applicant is requesting a conditional use permit to operate an eating establishment with seating for (12) patrons (four tables with twelve chairs). By adding the requested seating, the business changes from a retail activity to an eating establishment which requires a Conditional Use Permit. The proposed business would occupy 1,175 square feet of retail space within a 9,535 square foot retail shopping center which fronts on Live Oak Avenue, as shown on the attached site plan. PARKING On-site parking is located in the front and to the rear of the subject building. A total of 58 on-site parking spaces exist on the site, which meets the current on-site parking requirements for the shopping center. . This request requires 24 spaces which results in a net increase of an additional 11 spaces for the site, Said increase is due to the difference in the required parking standards (i.e., 5 spaces per 1,000 square feet of retail as compared to 20 spaces per 1,000 square feet for an eating establishment, etc.) With the addition of the proposed eating establishment, 69 on-site parking spaces are required for the site. ANALYSIS Since 1982, there have been approximately fourteen Conditional Use Pennits granted for requested seating in food establishments, and, as of this date, staff is not aware of any problems that have been caused by the operation of these establishments. It is staffs opinion that to allow a limited number of seating in small food establishments only provides a needed convenience for customers and does not create a situation that is detrimental to the site or neighboring properties. Based on staffs past experience with food establishments, staff believes that the subject site would provide adequate on-site parking for the proposed use, provided that the seating within the eating establishment is limited to a mAnmum of 12"persons. .' Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. C.U.P.91-009 July 23, 1991 Page 2 . . . RECOMMENDATION .:- The plAnning Department recommends approval ofC.U.P, 91-009 subject to the following conditions: 1. That the seating within the eating establishment shall not exceed 12 persons. 2. A Modification be granted for 58 parking spaces in lieu of 69 spaces. This approval shall not constitute an approval for a general reduction in parking for the total site. That this parking Modification shall only be for the use approved by C.U.P. 91-009 (eating establishment). 3. FINDINGS AND MOTIONS Approval If the Planning Commission intends to take action to approve this project, the Commission should move to approve and file the Negative Declaration and,.find that the project will not have a significant effect on the environment and direct staff to prepare the appropriate resolution incorporating the specific findings and conditions of approval set forth in the staff report (or as modified by the Commission). Denial If the Planning Commission intends to take action to deny this project, the Commission should move to deny and direct staff to prepare an appropriate resolution incorporating the Commission's decision and findings in support of that decision.
