RESOLUTION NO. 1464
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA, CALIFORNIA, DENYING CONDITIONAL USE
PERMIT APPLICATION NO. CUP 91-008 FOR A BILLIARD CLUB AT
320-326 EAST HUNTINGTON DRIVE.
WHEREAS, on June 6, 1991, a conditional use permit application was filed by
Pool Pockets, Inc. (Arcadia Billiard Club) for. a billiard club at property commonly
known as 320 - 326 East Huntington Drive, more particularly described as follows:
Lot 1 of Parcel Map 19433 in the City of Arcadia, County of Los Angeles,
State of California as recorded in Parcel Map Book 209, Pages 1 and 2 in
the records of said County.
WHEREAS, a public hearing was held on July 9, 1991 by the Planning
Commission at which time all interested persons were given full opportunity to be
heard and to present evidence; and
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the information submitted by the Planning Department in
the attached report is true and correct.
SECTION 2. That this Commission made the following findings:
A. That applications for modifications to the parking requirements have
already been approved for the Arcadia Gate:way Centre which cumulatively result in
a 109 parking space (11.68%) deficiency.
B. That the subject retail spaces in which the billiard club was proposed to be
located are inappropriate because the disproportionate distribution of the parking
within the Arcadia Gateway Centre commercial/retail complex results in a shortage
of parking in that particular area.
C. That the activities and traffic that the proposed billiard club could generate
would be detrimental to the other uses in this complex as well as to the uses in the
surrounding developments.
SECTION 3. That for the foregoing reasons this Commission denies
conditional use permit application no. CUP 91-008.

SECTION 4. The decision and findings contained in this Resolution reflect
the Commission's action of July 9, 1991 and the following vote:
A YES: Amato, Clark, Daggett, and Szany
NOES: None
ABST AIN: Hedlund
ABSENT: None
SECTION 5, The Secretary shall certify to the adoption of this Resolution and
shall cause a copy to be forwarded to the City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular

SUMMARY
This application was filed by Pool Pockets, Inc. for a 6,640 sq. ft, billiard club with
25 tables, full bar service, seating for 89 people, and four arcade game machines
that will be open for business from 10:00 a,m. to 2:00 a,m, at 320-326 E. Huntington
Drive. The Planning Department is recommending approval subject to the
conditions and restrictions listed in this report,
GENERAL ~FORMATION
APPLICANT: Pool Pockets, Inc. - Mr. Jerry Jamgotchian
LOCATION: 320-326 E. Huntington Drive
REQUEST: A conditional use permit and parking modifications for a
6,640 sq. ft. billiard club with 25 billiard tables, full bar service,
seating for 89 people, and four arcade game machines that
will be open for business from 11:00 a.m. to 2:00 a.m,
SITE & ZON~G: A 6,640 sq. ft. retail space in a one-story multi-tenant building
in a 9 acre commercial center that also includes a two-story
medical building (CIGNA) two restaurants (Bennigan's and
Olive Garden) a three-story office building (AAA) and a four-
story multi-tenant office building.
The zoning is CPD-1 (Commercial Planned Development)

SURROUNDING LAND USES:
North: Hotels (Embassy Suites, Hampton Inn, and Marriott
Residence Inn) restaurants (Derby, Souplantation,
Tony Roma's and Tokyo Wako), and a three-story
office and retail building.
South: AT & SF railroad right-of-way
E a s t: 3 story office building (Calif. State Bank) a self-
storage facility and a mobile home park.
West: Strip commercial along E, Huntington Drive
GENERAL PLAN DESIGNATION:
Planned Development Area
INTRODUCTION
At the June 4, 1991 meeting, the City Council determined that billiard clubs
(includes full bar service) subject to an approved conditional use permit, are
compatible uses in the CPD-1 zone. The CPD-1 zone applies to the area bounded
by the 210 Freeway on the north, Fifth Avenue to the east, the railroad tracks to
the south, and Second Avenue to the west.
This proposal is the first for this type of use. However, staff has been contacted in
this regard for a similar use in the new Landmark Development project on the
north side of Huntington Drive.
PROPOSAL AND ANALYSIS
This proposal is for a billiard club to occupy a retail space totalling 6,640 sq. ft. It
will be located in the middle of the one-story retail building at the west end of
the Arcadia Gateway Centre mixed-use project. The proposed hours of operation
are from 11:00 a.m. to 2:00 a.m. and there will be seating for 89 people.
Sections 9260,1,12(14) and 9275,1.53,7 of the Municipal Code require a conditional
use permit for the billiard club and for a business that will be open at some time
between the hours of 12:00 midnight and 6:00 a.m.
Included in the original floor plan of this proposed billiard club are ten game
machines (1 coin operated pool table, 3 foosball soccer tables, 2 pinball machines,
and 4 video games). Any place of business with eight or more game machines is

defined as a game machine arcade. Arcades are only allowed in the C-l, C-2 and
C-M zones with a conditional use permit. Eight or more game machines are not
important to this proposal and a game machine arcade is not included in this
application. The number of game machines have been reduced to four.
The applicant calls his establishment a "billiard club" in order to be distinguished
from the traditional "pool hall" and the problems associated with such uses. The
applicant has suggested the following conditions of approval to minimize the
potential for any problems:
A) The Club will be available to patrons 21 years of age and older only (J.D.
Required) and will cater to both Women and Men.
B) A Drivers License or other acceptable Identification will always be retained at
the Billiard Ball Check-Out Counter for Player Control.
C) The MOTHERS AGAINST DRUNK DRIVING (MADD) Designated Drivers
Program will be in full operation during all operating hours.
D) No Pitchers of Beer or any other drinkwill ever be sold at anytime within
the Club.
E) No Loitering, Gambling or any type of nuisance will be tolerated during
operating hours.
F) A reasonable Dress Code will be ih force during all operating hours.
G) All conditions of the ABC, City of Arcadia, Arcadia Police Department and all
other applicable codes and ordinances will be strictly adhered to.
H) In case of Violation, REVOCATION of our License and CLOSURE of the Club
is an acceptable Condition of Approval.
In addition to security measures that will be employed by the billiard club, there
is private security provided for this commercial center. Correspondence from
the property's management regarding the center's security is included in the
attachments. .
Parking
There are 824 on-site parking spaces. Included in this is parking for the proposed
site as a retail use (5 spaces per 1,000 gross sq. ft. = 34 spaces) However, Section
9269.5 of the Code requires 10 parking spaces per 1,000 gross sq, ft. for restaurants

and bars. Ther~ore, the proposed 6,640 sq. ft. billiard club (which includes full
bar service) requires 67 parking spaces. This is an additional requirement of 33
parking spaces.
A past parking modification approved the existing 824 parking spaces in lieu of a
combined use requirement of 933 spaces. This was a decrease of 109 spaces
(11.68%) The proposed billiard center would result in a requirement of 966
parking spaces for a deficiency of 142 spaces (15.22%).
The past modification was granted on the basis of a traffic engineer's report
(September 11, 1989 by Barton-Aschman Associates, Inc.) for this mixed use
center which showed that the combined uses on the site would have a 2:00 p.m.
peak demand of 812 spaces. This report is included as an attachment.
The proposed billiard club would add slightly to this 2:00 p.m. peak but probably
not significantly, The peak for this use would be between the hours of 5:00 p.m.
and 11:00 p.m. According to the September 1989 traffic engineer's report this
center would have a parking demand of 476 spaces at 5:00 p.m. that would
decrease to a demand of 104 spaces at 11:00 p.m. Also, it is anticipated that many
of the billiard dub patrons would be employees in the nearby office buildings and
would also be patrons of the surrounding restaurants and hotels. These patrons
would hopefully walk between the different uses. Staff is of the opinion that the
addition of the proposed billiard dub would not result in an unacceptable overall
parking situation.
Pursuant to the provisions of the California Environmental Quality Act, the
Planning Department has prepared an initial study for the proposed project. Said
initial study did not disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected by the project,
including land, air, water, minerals, flora, fauna, ambient noise and objects of
historical or aesthetic significance. When considering the record as a whole,
there is no evidence that the proposed project will have any potential for adverse
effect on wildlife resources or the habitat upon which the wildlife depends.
Therefore, a Negative Declaration has been prepared Jor this project.

e RECOMMEND A nON
The Planning Department recommends ~pproval of Conditional Use Permit
No. 91-008 subject to the following conditions:
1. CUP 91-008 be limited to the specified 6,640 sq. ft. commercial space and the
establishment shall be operated and maintained according to the
application and plans filed with the Planning Department for CUP 91-008,
2. A modification shall be approved for 824 parking spaces in lieu of 966.
3. The design and finish of any improvements or alterations to the exterior
will be subject to Architectural Design Review,
4. Window coverings sha.ll be subject to review and a.Rproval by the City.
5, No persons under the age of 21 years shall be permitted in the
establishment at any time regardless of adult accompaniment. Security
services shall be provided within the establishment to ensure all
conditions and regulations are complied with at all times.

6. A Drivers License or other acceptable photographic identification will
always be retained at the Billiard Ball Check-0ut Counter for player control.
7. A Designated Driver Incentive Program will be in full operation during all
operating hours.
8. Drinks shall be sold in single servings. No pitchers of beer or any other
alcoholic beverage will be sold at anytime within the establishment.
9. No loitering, gambling, excessive noise or any type of nuisance will be
tolerated during operating hours.
10. A reasonable dress code will be enforced during all operating hours.
11, A dance floor and dancing are not permitted at this establishment.
12. Game machines shall be limited to a maximum number of seven,
13. Fire protection, emergency egress, and occupancy (maximum 160 persons,
both patrons and employees, at any time) shall be provided and maintained
to the satisfaction of the Arcadia Ffre Department. Such shall include, but

not be limited to an automatic fire sprinkler system and a central station
fire alarm system. Plans for these and any other installations shall be
submitted to the City for approval prior to installation, and shall be
operational prior to occupancy of the space.
14.
All of the conditions of approval shall be complied with prior to the
installation of any equipment or other improvements.
15.
CUP 91-008 shall not take effect until the property owner and applicant
have executed the Acceptance Form available at the Planning Department
to indicate their awareness and acceptance of the conditions of approval,

If the conditions of CUP 91-008 are not complied with, or this CUP is not
implemented within six months of its effective date, or is unused,
abandoned or discontinued for any period of six months, this CUP shall
become null and void and of no effect.
17.
Noncompliance with the provisions and conditions of CUP 91-008 shall
constitute grounds for immediate suspension or revocation of the permit
and business license and closure of the establishment,
FINDINGS AND MOTIONS
Approval
If the Planning Commission intends to take action to approve this project, the
Commission should move to approve and file the Negative Declaration and find
that the project will not have a significant effect on the environment and direct
staff to prepare the appropriate resolution incorporating the specific findings and
conditions of approval set forth in the staff report, or as modified by the
Commission.
Denial
If the Planning Commission intends to take action to deny this project, the
Commission should move to deny and direct staff to prepare an appropriate
resolution incorporating the Commission's decision and supporting findings.

Equity West Development would like to open the ARCADIA
BILLIARD CLUB, an upscale billiard facility at the Arcadia
Gateway Center. This use, which requires a Conditional Use'
Permit ("CUP"), is an approved one under the CPD-1 Zone
Designation so we herein request your favorable consideration
of this CUP and provide the following information for your
advance review.
As everyone knows, visions of the old neighborhood Pool Hall
certainly do not create a desirable picture for anyone,
including our company. consequently, to show you how we are
different and how much the billiard industry really has
improved, we offer some of the following very stringent and
proven ARCADIA BILLIARD CENTER operating conditions for your
consideration:
1)
The Club will be available to patrons 21 years of af~
and older only (I.D. Required) and wilY-cater t~
Women and Men.
2)
A Drivers License or other acceptable Identification
will always be retained at the Billiard Ball Check-
Out Counter for Player Control.
3)
The MOTHERS AGAINST DRUNK DRIVING (HADD) Desi~ated
Drivers Program will be in full operation dur ng all
operating hours.
4)
No Pitchers of Beer or any other drink will ever be
sold at anytime within the Club.

5) No Loitering, Gambling or any type of nuisance will
be tolerated during operating hours.

In case of Violation, REVOCATION of our License and
CLOSURE of the Club is an acceptable Condition of
Approval.
The ARCADIA BILLIARD CLUB will very positively compliment and
enhance the nearby Restaurants, Hotels and other
Entertainment oriented facilities currently located around
this Center by giving Businesspeople, Hotel Guests and
Restaurant Customers another quality recreational opportunity

Responding to your inquiry and concern regarding security
here in the Arcadia Gateway Centre, we contract with A n S
Security of Glendora, California.
The objective of Security is to discourage vandalism, auto
theft, and to establish and maintain a ,safe, comfortable
work place for our tenants.
The daily work-schedule of the security guard here at
Arcadia Gateway Centre would be to foot-patrol the parking
garage, walk the center and be seen by all, monitor park-
ing and traffic-flow, assist in any emergencies that may
arise, and be a good-will ambassador to anyone that may ask
for assistance.
If a problem arises in a store or office and 911 is not
necessary, the tenants are encouraged to call security for
assistance. They would dial security beeper number and
dial in their address. Response time is generally within
three to four minutes. After dark security is available
to walk employees to their automobiles.
Because of the tenant/employee turn-over, tenants are re-
addressed to calling security ever~ 90 days.

side of HuI'1tirqton Drive between Seoorx:l Avenue and Fifth Avenue in Art:adi.a.
Portions of the project have already been c:atpletec1, including a Bennigan's
restaurant, a CIGNA Healthplan medical office buildinJ, and a small retail
1:W.ldinJ. Two office 1:W.lcli.rgs are cw......ltly un:1er const:ructi.on, including
one int:erx1ed to house the regional headquarters of the Autanobile Club of
SOUthern califomia, !easing activity is currently un:1eJ::way for the retail
suites and negotiations are pl~..=sing for a seoon::i restaurant tenant.
'!he mixed-use nature of the Arcadia Gateway Centre makes it a pr.ime
candidate for inplementation of a shared parkinq program. un:ler such a
i'..~..a4I, the parkinq supply is adjustec1 to reflect the fact that different
land uses have peak parkinq denands that oc:cur at various tine; of the day.
For example, ...nile office builcli.rgs have their highest parking demand during
the midday period (typically at approx:iJ1ately 11:00 AM), restaurants peak in
the evening, Shared parkinq also reflects the interaction that occurs
between the various uses.
Previous parkinq analyses have delronstratec1 that the parking demand at the
center will be significantly lower than the the city of Arcadia Parkinq
Regulations WQ]J.d typically require. In particular, in June of 1988 an
analysis was prepared that resultec1 in approval of an overall parkinq ratio
of 4.60 parking spaces per 1,000 square feet for the project. In
CXI1iJarison, the city requirerrent called for provision of a ratio of 5,09

My company serves as the property management company for the Arcadia
Gateway Centre, As the property manager for the past few years, I have
observed and worked closely with the tenants in the retail building as
well as the office buildings, At this time, the "Arcadia Billiard
Club", has appl ied for a conditional use permit to operate an upscale
billiard facil itv at the property.

As requested by Mr, Jerry Jamgotchian, the two different types of
security services which are provided by the Landlord and billed back
to the tenants as a cam expense, are the followingl
I> ON-SITE SECURITY I There is one (i) guard on the property seven days
a week to patrol the property, He is responsible to oversee the well
being of the emDloyees as well as the patrons of the shopping center
and office buildings, The guard also provides an escort opportunity to
any employee of the property, The manner in which this takes place is
by the tenant dialing their code number into the telephone, which is
programmed into the guard's beeper, The guard would then gO to the
tenant's premises to provide an escort, This process has been
available to all tenants for more than a year and specific information
regarding it can be acouired from the on-site property manager or any
securitv Cluard,
2) ROVING PATROL, This service is also performed seven nights per
week, A guard drives through the prpperty on a frequent basis during
the evening and early morning hours to make certain everything is fine.
Both the on-site and the roving patrol guards are employed by AnS
Security, This is a professional company locally owned and managed by
two retired pol ice officers, AnS Security has serviced the property
for the past few years and the security problems have been minimal,

It is my hooe that the City of Arcadia's Planning Commission approves
the "Arcadia Billiard Club's" Conditional Use Permit Application. We
feel it will bring additional cl ientele to the shopping center and it
is a non competetive use to the other businesses in the area.

We the tenants of Arcadia Gateway Centre have rec~ntly been oontacted by
Mr. Jerry Jamgot~hian of Equity West Development regarding ~is proposed
lease of office t.etail space in the Arcadia Gateway Centre complex. Mr.
Jamgotchian proposes to conduct a billiard club business in this center and
has 90 advised all of the present tenants. He has also provided all the
~enants li,terature describing his proposed establishment.
We the und~rsigned tenants are very concerned about this type of business
being established in the Arcadia Gateway Center complex. We believe that a
bill iard club is not in keeping with the "business character" of this
centel'. ''Je also feel that: it may have an ,adverse effect on our indiv,idual
busiqesses, The following are some MAJOR CONCERNS that we would like to
add ress : .
1. NOISE LEVEL- It is our understanding that Hr. Jamgotohian has submitted
a proposal to the City of Arcadia to conduct business during the hours of
lOJnO a.m. to 2100 a.m. As you are aware, Mr. Gribble. the demiSing walls
between all leased tenant space is not completely sound proof and our
concern is for the leased tenant space located at Penny Saver and at La
Caballet IIdr Salon, To begin with billiards is not a quiet game, When .
you combine that with a full bar and a center for video games. the
increased noise level will be diaturbing to the adjacent tenants, Complete
insulation in the walls and ceiling and "Sound SOak' paneling that absorbs
noise would be essential to reduce the noise level.
2, PARKING SPACE AVAILABILITY-Hr, Jamgotchian is telling all the current
tenants that we should not be concerned with parking because his clientele
will be uFJin~ the parking space primal'ily after 5:00 p.m. Whether this
holds true or not is not the main point here; the parking lot is already
reaching maximum usage during the day.' Where are ,all these additional
parking cars 90ing ~o park? How is this 90in9 to effect the parking for
the existing tenants clients? Manv of us are already finding that our
clients cannot park close to our location, and some of these clients are
elderly. and have difficulty walking, A business with a difficult.parking
situation can be detrimental to business_
~. LOITERING-It is our understanding that there will be a full bar in the
billiard club and it is our concern that this will lead to people hanging
around the center that have had too much to drink. Many of the tenants
have customers who come in the evening and some of us work late hours--we
do not want our customers or our employees having tp deal with this late at
night in the parking lot, In addition, we have been advised that the
video game area will have a separate door and that young people will be
allowed to enter and play the games. This will also add to loitering and
problems with skateboarding on the sidew~lk and bicycles, What restric-
tions will you be placing on lOitering? And what recourse will the tenants
have to find out what kind of compliance the new restrictions will require?
We do not believe that once the problem develops that if can be controlledl
4, SECURITY-At this time all of the present tenants pay a 'C8m' cost which
covers security for the center for specific hours. Who is 90ing to incur .

SUBJECT: CUP 91-008-Conditions
Pursuant to our discussion concerning the above agenda item,
for the Planning Commission meeting of July 9,1991 I recommend the
following with regard to the conditions:
1. Deletion of proposed condition No. 10 regarding a dress code.
This has never been used by the City, is far removed from land use
considerations, and due to its possible effect on the rights of
third parties (i,e.those visiting the business) , City involvment
is not recommended. Such involvement may get us named in a lawsuit
if a patron is excluded from the business due to a dress code. The
code should be a policy of the business alone and not a part of the
CUP proposal. .
2. Addition of a condition that is consistent with our municipal
code provisions concerning the possible negative conduct of patrons
to a business, as supported by the California Supreme Court in the
1972 case of Sunset Amusement Co. v. Board of Police Commissioners,
7 C3d 64.
The gist of this condition is to make the business seeking the
CUP responsible for the activities of it's patrons that become a
public nuisance on or immediately off the premises(i.e. the
shopping center). This would cover disruptive conduct that disturbs
the peace, obstructs traffic, damages property, etc..As set forth
in the cited court decision, inclusion of such a condition on the
CUP helps sustain its application when revocation or suspension of
the permit is sought.
Attached is a copy of AMC Section 6314 which is based on the
Sunset Amusement case and should be considered as a possible
condition, Such a condition could be worded as follows: .
10. Consistent with condition No.9, Applicant agrees that
this CUP is subject to the requirements of AMC
6314 (attached) and that any conduct or actions inconsistent
with these conditions are grounds for revocation or
suspension of this Conditional Use Permit and the applicable
business license to subject premises and activities.

In any application for the renewal of any per-
mit issued in accordance with the procedure
outlined in this Pan.. it shall be sufficient for
applicant to insert the words "same as in prior
application" wherever such words are truly
applicable.

ORGAi'lIZA nONS.
Upon written request the Council may. by
motion of four-fifths ("/,) of its members. waive
any or all of the requirements of this Part with
respect to any institution or organization which
is conducted, managed or carried on wholly for
the benefit of charitable. religious. educational.
recreational or scientific purposes and from
which profit is not derived either directly or indi.
rectJy by any individual firm or corporation.

6313.2. EXISTING PERMITS.
All permits heretofore issued by the City under
this Chapter or any other regulatory City ordi-
nance shall remain in full force and effect until
the expiration date therein specified. If no expira.
tion date is therein specified. such permit shall
expire on December 31 of the year during which
it was issued. All businesses for which a permit is
required by the termS of this Chapter. which are
in actual operation upon the date this Chapter
becomes applicable thereto, shall have to and
including the 2nd day of January of the following
year within which time to make application for
the permit required for such business. and may
continue to operate therafter until final action is
taken by the Council on such application. Any
business for which a permit is required uncler this
Chapter commencing after the provisions ofchis
Chapter or any similar regulatory City ordinance
becomes applicable thereto shaJJ not commence
operation until a valid and proper permit shaJJ

DIVISION 4.
SUSPENSION AND REVOCA nON
6314. GROUNDS.
The Council may revoke any permit issued by
it under the provisions of this Chapter upon any
ground upon which such permit could or should
have been denied in the first instance. or when-
ever the Council is satisfied that the conduct of
any such business does or will in any manner
endanger, threaten or jeopardize the public
health. safety. morals. peace orwelfare or that the
same has been conducted in an illegal. improper
or disorderly manner or that such permit was
obtained upon false or misleading statements or
representations of or on behalf of the applicant.
The Council may revoke ifit is determined that
the applicant or applicants agents have. in the
conduct of the sa. me or any similar b~ess. been
guilty of fraud. misrepresentatio~ conduct
detrimental to the public welfare which includes
operations or activities that do not comport with
the peace. health. safety and convenience of the
public such as (a) operation ofa business prohib-
ited bv local or state law (b) allowance of
activities that are or become a public nuisance
which includes the disruptive conduct of busi-
ness patrons whether on or immediately off the
premises where such patrOns disturb the peace.

criminal conduct. violate the law and othe~
impair the free enjoyment of life and'pro~

appreciate learning about the four (4) property management
oriented concerns whicb you expressed therein. _ I certainly
sbare these same concerns also because, as a future tenant in
this center, I too need the !!!!!.. protections.
I would like to address these concerns directly from my
viewpoint because there are some very important factors wbich

noise will not be a factor because Billiards is

As I have st:ated, I do not need many ~inq
spaces until 7:00 pm niqIffily, at the earliest,
because Billiards is basically a ni~ime
