PLANNING COMMISSION RESOLUTION 1462 A RESOLUTION AMENDING CONDmON 3 OF RESOLUTION 1237 TO ALLOW AN INCREASE IN THE PRESCHOOL ENROLLMENT OF THE MONTESSORI SCHOOL AT 141 LAS TUNAS DRIVE FROM 48 STUDENTS TO 60 STUDENTS. WHEREAS, on May 21, 1991, the Planning Department received a request from Sandhya Ray, Director of the Wonder Years Montessori School to amend condition 3 of Resolution 1237 to allow the increase in enrollment from 48 children to 64 children, Planning Department Case NO. c.u.P. 83-9, on property commonly known as 141 Las Tunas Drive, more particularly described as follows: Lot 30 of Tract 13540 in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 277, Pages 11 and 12 of maps in the offices of the County Recorder of said county. WHEREAS, a public hearing was held on June 25, 1991, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW. THEREFOR, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: 1. That amending said Conditional Use Permit will not be detrimental to the public health or welfare, or injurious to the property or improvements in such zone or vicinity. 2. That the use applied for at the location indicated is a proper use for which a Conditional Use Permit is authorized. 3. The Commission recognizes there is a need for child care services within the community and the increased enrollment will create additional traffic, but will not result in a major impact on traffic and circulation on the site or on Las Tunas Drive. 4. That the site is adequate in size to accommodate 60 children, based on Fire Department requirements. 5. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. -1- 1462 I . . . 6. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. 7. That the use applied for will not have a substantial adverse impact on the environment. Section 3. That for the foregoing reasons this Commission amends Condition 3 of Resolution 1237 to read: 3. That the preschool enrollment be limited to 60 children per session. Section 4. The decision, findings and conditions contained in this Resolution reflect the Commission's action of June 25, 1991 and the following vote: AYES: Commissioners Amato, Clark, Hedlund, Papay NOES: None ABSENT: Commissioner Szany Section 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. BUTLER, ASSISTANT PLANNING DIRECTOR SUBJECT: REVISION TO C.U.P. 83-9 REOUEST On May 21, 1991, the Planning Department received a request from Sandhya Ray, Director of the Wonder Years Montessori School at 141 West Las Tunas Drive to amend condition 3 of Resolution 1237 to allow an increase in the number of preschoolers from 48 to 64 children, mSTORY AND PROPOSAL .. On May 10,1983, the Planning Commission adopted Resolution 1237 granting a conditional use permit for the expansion of the day care school at 141 West Las Tunas Drive. Condition 3 of Resolution 1237 set forth the condition that the "preschool enrollment be limited to 48 children per session." Prior to the current owners purchasing the property, the garage ("annex" shown on map) was converted to classrooms, There have been no approvals since 1983 to increase the school enrollment. The current owners bought the property in July of 1990. The preschool has reached its maximum capacity of 48 children and because of its success there is a need for increased enrollment. PROpOSAL AND ANALYSIS As pet the attached letter, the applicants are requesting to increase enrollment to 64 children. They are proposing to use the "annex" building for the increased enrollment. The Fire Department has reviewed the request, and based upon Fire Department occupancy regulations and inspection of the site, a maximum of 60 children would be allowed. Revision to C.U.P. 83-9 June 25, 1991 Page 1 . . . The Planning Department recognizes there is a need for child care services within the community. Although the increase in enrollment will create additional traffic to and from the site, the Planning Department does not feel this will result in a major impact on traffic and circulation along Las Tunas Drive. Attached for the Planning Commission's consideration are the Fire Department's report, the letter from Mr. Ray and a site and floor plan of the school. RECOMMENDATION The Planning Department recommends approval to increase enrollment from 48 children to .6Q children subject to Fire Department requirements. Approval If the Commission determines that the increase in enrollment is appropriate, the Planning Commission should direct staff to prepare a resolution setting forth the Commission's findings and conditions of approval for adoption at its next meeting. Denial If the Planning Commission determines that the increase in enrollment is not appropriate, no further action is necessary. Revision to C. Las Tunas drive, Arcadia/ Request for extension of capacity from 48 to 64 students Dear Ms. Butler, As you know we bought the above property in July '90, and got permission from you and the dept of social service to run a preschool (upto age 6) with a capacity of 48 students. It was based on a covered area that excluded the annex (354 sft). That 48 student capacity was also per CUP 75-16 and CUP 83-9. Last July,' we did n..:>t ask for permission to use the annex as we were not reddy, and also to expedi te the approval process. But since then the school has been very successful and has reached its capacity thanks to good and appreciative responses from the parents. We are dt a point now when we must expand the capacity to its fullest potential. The annex that was built by previous owners were also used as classroom by the previous owner, and per my understanJing i~ d legitimate expansion that had been approved by the building department. So this letter is to request you to grant an extension from the present 48 student limit to a 64 student limit ,permitting us to use the referenced annex as another classroom. Per conversation with you, I understand to initiate the approval process, you will need preliminary plans and elevations, 300' radius map and the resident mailing list in that radius limit. along with necessary fees. This has to be approved by the ci ty council in a public hearing that takes place two times each month. A lead time of 30 days is required prior to public hearing. To expedite the process, please find the following : i). Plans and elevations (4 shts,as drawn by Ray Associates) 2 copies ii). 300' radius map with listed residents.. 1 copy iii).
